01:03to determine whether someone has been a Muslim for five years or not.
01:07Apart from that, the provision 2.3c, the court has said that until there is a mechanism devised,
01:12no third-party interest can be created, the people cannot be dispossessed of their work properties.
01:19As far as non-Muslim members are concerned, the court has said that in the waqf vote it cannot be more than three
01:24and not more than four in the Section 9.
01:27And on the registration, the court has apparently extended the time limit but has not stayed the provision.
01:33Sir, there was a contestous issue or inquiry by the DM.

01:37So, on that, it has been said that the executive cannot take the role of the judiciary
01:42and have, in a way, stayed the provision until a proper mechanism is devised
01:47and that is why he said that no one can be dispossessed of their waqf property in this matter.
01:51And what about the partners, sorry, members of the waqf board?
01:55The three in, not more than three in the waqf board can be non-Muslim members.

03:11number one there is no history on the amendments brought in by the central government headed by
03:18money narendra modiji so there is no history on the amendments only there is a interim order in
03:25favor of the petitioners regarding that they cannot be deprived of the work property without
03:31following the procedure laid down in the law including the amended law third that if any work
03:38has to be taken by the government or they the the possession has to be taken back that the procedure
03:44laid down in the work act including the amendment of the work that procedure has to be followed
03:51by the tribunal as well as by the honorable high court so after judgment of the tribunal only that
03:59order can be given effect too so that is the very clear order today by the honorable supreme court
04:04and very important order that those works are now has to be registered meaning thereby those works
04:12which are not registered they will not be treated as work property you see if you remember that
04:24when this argument was going on at that point of time learned solicitor general of india had given
04:30concession about this provision that the five years practice of islam the honorable court can decide this
04:37issue as per their own discretion so accordingly those who are practicing who have not practiced islam for
04:43for five years they cannot create work that provision has been established
