00:00The Justice Department Secretary Jesus Crispin Boying Remulia has stepped up to the plate

00:05to defend the country in place of the Attorney General who has opted to recuse himself in

00:11a case of habeas corpus filed by the Duterte children against the Philippine government

00:16and even if the person in question or former President Rodrigo Duterte has been in the

00:22Hague for nearly two weeks, Remulia is confident in his arguments that the government did to

00:27hand over the President to the ICC was in accordance with the rule of law as our Luisa

00:33Erispe narrates in this report.

00:38Justice Secretary Jesus Crispin Remulia is ready to face the Supreme Court to represent

00:43the government's actions in arresting former President Rodrigo Duterte and brought him

00:47to the Hague Netherlands.

00:49As a matter of fact, Remulia has a legal basis as a defense.

00:53For a possible round of legal arguments, if need be, because the way that I've said

01:01it already, it's a done deal.

01:04The man is already under the jurisdiction of the ICC, it is extra-territorial, it's

01:10in another country, so it's beyond the scope of our legal system already.

01:16We have already turned over the person arrested.

01:21Remulia has cited Republic Act No. 9851 or the Philippine Act on Crimes Against International

01:27Humanitarian Law in which the government has every right to extradite a suspect or accused

01:33before an international tribunal.

01:35Another is the Cayetano v. Pangilinan case which was litigated before the Supreme Court

01:41where it was argued how the ICC still has jurisdiction on crimes committed before 2019.

01:48I believe that in the discussions in the court, when the decision was made on that case,

01:55that their view is that we still have a responsibility to the ICC until 2019 arrives.

02:01Remulia also questioned the cap of Duterte for using a provision under the Rome Statute.

02:07They said that they have already built it in the ICC, in their site.

02:12Well, we still go by the principle of comity, that we still respect the ICC.

02:19That's 125 countries grouped together forming the International Tribunal Court.

02:26We respect that, but we don't need to obey every law and order there.

02:33What's important is that they respect us and we respect them.

02:37Meanwhile, aside from Duterte's camp, Remulia has questioned the presence of former presidential

02:43spokesperson attorney Harry Roque.

02:45According to Remulia, instead of staying in The Hague, Netherlands, he should be facing

02:50a human trafficking charge filed against him before the DOJ.

02:53If nothing else happens, he will escape, right?

02:58He still has a case to face.

03:00He's still a lawyer.

03:02He doesn't follow the law.

03:03If he follows the law, he will face it.

03:05Remulia also questioned the request of Roque for asylum in Netherlands.

03:10He said there is no need for asylum because it is a legal due process and because he was

03:15never politically persecuted at any point in time.
