00:00Parents of children who suffer food poisoning after consuming food from school canteens

00:07can sue operators for negligence, lawyers Kitson Fung and Bastian Pius Vandargen said.

00:13They explained that parents could seek monetary compensation by proving that vendors breached

00:19their duty of care and caused harm to their children.

00:23However, Fung warned that the legal process can be costly and time-consuming, with damages

00:29attainable unlikely to be high as canteen operators are not likely to have deep pockets.

00:36He said parents can also file reports with the Police and Health Ministry to prompt criminal

00:41investigation under the Food Act 1983, Food Regulations 1985 and the Food Hygiene Regulations

00:492009.

00:51Last week, the canteen at SK Chepur was closed by the Perak Health Department after 101 students

00:58experienced food poisoning.

01:00Two days later, it was reported that another 55 students and three teachers at SMK Membakud

01:06Dua in Sabah experienced similar symptoms.

01:10In June, a 17-year-old boy and a 2-year-old girl died after consuming fried noodles and

01:16eggs provided by an external caterer at a religious program held at a school in Gumba.

01:22Vandargen said school administrators may take legal action against external caterers for

01:27breach of contract and failure to supply food of merchantable quality.

01:33He also urged state health departments and local councils to be more proactive in maintaining

01:38food quality and hygiene standards in school canteens.
