" Election Commission Aisa Kirdaar Ada Kar Raha Hai Jaisay Aik Fareeq Ban Gaya Hai," Salman Raja
Transcript
00:00Salman, before we go to the break, I would like to ask you a question.
00:03All the cases that go to the courts,
00:06and the whole of Pakistan is looking at the courts,
00:09and if the court's decision comes to this side, then that side will abuse us,
00:12and if it goes to that side, then this side will abuse us.
00:14Whose failure is this?
00:16Can't the court convince the people that we have given the right decision?
00:19Or can't the politician make a decision because of which the case goes to the courts,
00:22and the courts are also politicized somewhere?
00:26Look, obviously the cases go to the courts because there is a dispute,
00:31and a very big reason for this is that our institutions, all kinds of institutions,
00:36from the FBI to the Election Commission and the Police Force and the FIA,
00:42all of them are used at some point in time to achieve their objectives,
00:48and the decisions that should be made with good intentions in a normal situation,
00:54they don't happen, that's why the cases go to the courts,
00:57but even apart from this, in every country where a legal system is not in place,
01:04disputes keep arising there, the courts have to make decisions there,
01:08the history of America is full of such decisions,
01:11which had very big political effects,
01:14so we shouldn't be afraid of them,
01:16this has become a thing that the cases go to the courts,
01:19the politicians should do it themselves,
01:21one thing is that the politicians are not just a team,
01:23the third force is also a team,
01:25and there are many such cases which cannot be decided,
01:27which are not allowed to be decided,
01:29and the courts are the only way.
01:31Can I ask a question?
01:32Mr. Asad Mahan, if you could answer,
01:34today the Chief Justice of Pakistan was repeatedly raising the banner saying,
01:38stay on the banner, stay on the banner,
01:41and Justice Athar Manohar Rao said,
01:43let me tell you the context of my question,
01:46he said, look at the history of Pakistan,
01:48when did it ever act on the banner?
01:50But does he not realize what happens in Pakistan?
01:53How did the elections happen in Pakistan,
01:55and what happened in the parties before the elections,
01:57and how were they broken up,
01:59and who did the press conference and got cleared,
02:01and who didn't do the press conference and remained in jail,
02:03when we talk about the banner,
02:05a judge has written a letter,
02:07a judge from Sargodha has written a letter to the Lahore High Court,
02:10he has come to the Supreme Court,
02:12so now the Chief Justice's wish will be fulfilled,
02:14that if something happened in my presence,
02:16now it has happened in his presence as well.
02:18So now he doesn't realize how this country works.
02:20I will not comment on this,
02:22but it is true that the way this election happened,
02:25and as our friend Mr. Kiani said,
02:27to go to the courts,
02:29we want to go to the courts,
02:31in my case last week there was a notice,
02:33the law says that in 4-5 months,
02:35the decision should be made in 6 months,
02:37we filed an appeal,
02:39the tribunal was not being formed in Lahore,
02:41there are 180 petitions,
02:43it is the biggest province,
02:45only 2 tribunals were formed in that province,
02:47when the new Chief Justice came,
02:49Mr. Shehzad Ahmed Khan,
02:51he sent 6 more names,
02:53the election commission refused,
02:55then 2 names were accepted,
02:57there were 4 names for such a big province,
02:59my case was not going anywhere,
03:01the tribunals were not being formed,
03:03even after the court's decision,
03:05the election commission refused,
03:07the Supreme Court left,
03:09the court had to form an election tribunal itself,
03:11and it is not that these are additions,
03:13which will be included on the retired judges,
03:15in Islamabad,
03:17the cases were handed over to the retired judge,
03:19and were snatched from the service judge,
03:21and how will you decide,
03:23which unfortunate case,
03:25will go to the retired judge,
03:27which is approved,
03:29and which unfortunate case,
03:31will go to the retired high court judge,
03:33so completely,
03:35our system,
03:37our justice system,
03:39regarding the election cases,
03:41and other cases,
03:43it has been distorted,
03:45so we are facing a distorted reality,
03:47if someone doesn't want to believe it,
03:49if someone says everything is fine,
03:51the book is beautiful,
03:53everything is written in the book,
03:55it is his wish,
03:57it is not that beautiful,
03:59day to day realities,
04:01I will add two sentences,
04:03we all know the day to day realities,
04:05of Pakistani politics,
04:07like you said,
04:09many people,
04:11show that everything is written in the law,
04:13but it is not followed,
04:15everyone knows what happens in it,
04:17some believe,
04:19some don't,
04:21some say if I close my eyes like a pigeon,
04:23everything will be fine,
04:25there is a fight to fix this,
04:27which has been going on for the past 70 years,
04:29and it is still going on,
04:31because every time,
04:33someone or the other,
04:35becomes weak.
