00:12Jika kita melihat seksian 4A AUKU berkaitan dengan pelantikan naib cinselor,
00:17kami ambil maklum bahawa sememangnya ada badan penasihat untuk menasihat KPT
00:22berkaitan dengan pelantikan naib cinselor, siapa yang layak, siapa yang ada merit.
00:27tetapi pada pengakhirannya, individu yang meluluskan
00:30atau person who ratified the appointment of the vice chancellor
00:34is still subjected towards the executive discretion of KPT
00:37which is Datuk Syed Zambikadir lah, the current KPT.
00:42Dan kalau kita lihat dalam setiap sistem perolehan universiti,
00:45individu yang akan mempenguruskan jawatan kuasa perolehan tender
00:49adalah naib cinselor itu sendiri.

00:53it's quite impossible for us to say that there is no some sort of
00:56political affiliation or interest
00:58because in the current context, the status quo di Malaysia,

01:02yang mewajibkan menteri ke sesiapa ke to declare their assets,
01:07their financial trail or income.
01:09So when that is the issue that we have today,
01:11banyak persoalan yang boleh berbangkit.
01:13Pertama, ada tak some sort of culture of interest-based interest

01:48Siapa yang meluluskan tender?
01:50Patut dipersoalkan.
01:51Dan pada hari ini, kalau kita lihat dalam laporan ketahui negara,
01:54hanya mendedahkan UKM saja.
01:56Tetapi fakta pada hari ini,
01:58bukan saja UKM yang menerima punca kuasa yang sama daripada AUKU.

02:03So, if a breakdown of procurement system

02:09boleh berlaku di UKM,
02:11apa jaminan perkara yang sama tidak akan berlaku di public universiti yang lain?
02:14Bila kita nak create this new akta ni,

02:24Bukan sahaja Kementerian Perniagaan Tinggi,
02:26bukan sahaja the administration of the university,
02:30bukan sahaja staff universiti,
02:34bukan sahaja mahasiswa,
02:35but actually semua.
02:36and we have to acknowledge
02:39each of the keperluan
02:42for each of these pemegang taruh.
02:44So, when it comes to university governance,

02:49there won't be a sort of

02:54bila the vice chancellor
02:57is able to

03:03kalau it is considered
03:03in good faith,
03:05boleh sahaja teruskan.
03:07because the words that are used
03:09in AUKU currently are far too vague.

03:13Kalau kita gunakan in good faith,
03:15what does that mean?
03:16What does that entail?
03:18And then bila hal pasal
03:20kebebasan akademik
03:23ataupun autonomi mahasiswa,
03:26the reason why kita memang
03:27push untuk memansuhkan AUKU ni
03:29dan kita tak nak pindah.
03:31because if we look back
03:32at the history of
03:33the creation
03:35dan pelaksanaan
03:36AUKU pun
03:37back in 1971,
03:38to tengok history
03:39and the context
03:40and the importance of
03:431971 too
03:44was because there was
03:45an uprising
03:46of student activism
03:47throughout the entire world
03:49including Malaysia.
03:49so AUKU ni
03:51was established
03:54in an era
03:55where student activism
03:58was viewed as a threat
04:00to political stability
04:02and we cannot use
04:04that lens anymore.
