00:01Kelantan's Legislative Assembly has unanimously approved amendments to its Sharia criminal
00:06enactment, replacing 16 provisions struck down by the Federal Court in 2024.
00:11The Sharia Criminal Offences Bill 2026 was tabled by Deputy Mantri Bursa Fazli Hassan
00:17and debated by six Assemblymen before being passed, Bonama reported.
00:22The bill contains nine parts, 62 clauses and one schedule, with improvements to provisions
00:28involving the five daily prayers, restorative punishment, whipping and compound mechanisms.
00:34Mantri Bursa Nasseruddin Daud noted that the bill essentially captured the spirit of the 2019 enactments.
00:40In February 2024, the Federal Court struck down 16 provisions under the Kelantan enactment
00:46in an 8 to 1 majority decision. The Court ruled that the provisions were unconstitutional
00:52because the Kelantan Assembly had no power to enact them.
00:55It found that the offences fell under Parliament's authority to enact federal criminal laws.
