00:36For failure to secure a Certificate of Inception, Section 1c in relation to Section 2, Rule 7 of D.O.
00:46248-2035 provides that any deliberate or willful district card for non-compliance with the provision of said rules shall

01:26First, applying the maximum administrative fine of 10,000 for each prohibited act or separate violation spanning 4 to 490
01:37days, the total administrative fine is computed as values.
01:41490 days times 10,000 pesos per day would equal to 4,900,000 pesos.
01:49Accordingly, Mr. Pauli is liable for an administrative fine in the total amount of 4,900,000 pesos for his
01:58failure to secure the required Certificate of Inception for the period from 10 February 2025 until his resignation on 15
02:07June 2026.
02:08As to Ateneo de Manila, its administrative liabilities as follows, failure to secure an AEP, section 15 of D.O
02:18.146-15 provides that employers found employing foreign nationals with a valid AEP shall pay a fine of 10,000
02:27pesos for every year or if rationed or off.
02:31Hence, for employing Mr. Pauli from 01 December 2015 to 28 September 2016 without a valid AEP for a period
02:44of at least a full nine months, Ateneo de Manila is liable to pay 10,000 pesos.
02:50For failure to secure a certificate of exemptions with respect to the violation of 248-25, this office holds Ateneo
03:00de Manila jointly and solidly liable with Mr. Baldwin for the administrative fine in total amount of 4,900,000
03:09pesos arising for the failure of the latter to secure the required Certificate of Inception.
03:16Wherefore, Ramses consider this office hereby finds Mr. Thomas Anthony Pauli Baldwin and Ateneo de Manila University to be administratively
03:28liable for separate violations of Article 40 of the Labor Code as amended and renumbered and its implementing rules and
03:37regulations.
03:38Accordingly, for failure to secure an area employment permit under Department Order 146-15, Mr. Anthony Pauli Baldwin is ordered
03:49to pay an administrative fine of 10,000 pesos and Ateneo de Manila is ordered to pay an administrative fine
03:57of 10,000 pesos.
03:58For failure to secure a certificate of 146-15, for failure to secure a certificate of exemption under Department Order
04:03No. 248-25, Mr. Thomas Anthony Pauli Baldwin and Ateneo de Manila are jointly and solidly liable to pay an
04:14administrative fine in a total amount of 4,900,000 pesos.
04:21Finally, without prejudice to civil, administrative or criminal complaints pending before other investigative agencies or reports of law against Mr.
04:33Baldwin,
04:34this matter is hereby referred to the Bureau of Immigration and Deportation for summary-reed deportation proceedings.
