00:01The Court of Appeal has dismissed Pastor Raymond Koh's family's bid to lift the suspension of a RM37 million plus
00:08judgment awarded over his disappearance.
00:11Justice Alwi Abdul Wahab ruled that the High Court was legally right to suspend enforcement of the judgment sum pending
00:18the government's appeal.
00:19He said the trial judge had ordered the government to pay Koh 10,000 ringgit a day from the date
00:25he disappeared until the authorities determine his whereabouts.
00:28However, Alwi said refusing a stay would force public funds to be dispersed before the appeal is heard, which the
00:34Court described as structurally impractical.
00:37The three-member panel also included Justices Shahnaz Sulaiman and Amajit Singh, with no order made as to costs.
00:45The Court also maintained the stay on orders relating to the investigation into Koh's disappearance.
00:51Alwi said the issue of whether the Court could order investigating Officer Supari Muhammad and other officers to be removed
00:57from the probe,
00:58should be decided in the appeal.
01:00The government's appeal involving Koh and missing activist Amri Che Mat will be heard on November 30th.
01:07Koh was abducted on February 13th, 2017, while driving in Petaling Jaya,
01:12with the Court previously hearing that five masked men in black military outfits pulled him out of his car.
01:18His wife, Susanna Liu, had sued the police and the government over the state's alleged involvement in his disappearance,
01:24and the manner in which the authorities investigated the case.
