00:01The High Court after hearing the evidence and all that in our submissions found that the
00:09liability against the police officers first unlawful arrest so the plaintiffs were unlawfully
00:15arrested by the police at the Dataran Merdeka and they were also unlawfully detained by the
00:22police when they were brought to IPD Dang Wang Yi and also they were denied legal representations
00:28when their lawyers were not allowed to enter to IPD when their statement was taken so the court found
00:35that there was infringement of article 5.1 and 5.3 of the federal constitution and the court awarded
00:44general damages of 15,000 per plaintiff and also the government of Malaysia has been found vicariously
00:53liable for the actions of the police and I think this is a victory not just for the plaintiffs but
01:01also to the democracy and human rights and it shows that constitutional rights are very important
01:07and the London judge has also said although the court did not find any malice in the police
01:16but the court also emphasized that the administrative convenience or operative convenience cannot be more
01:28important than the constitutional rights. I think there were many things during the trial videos were shown
01:35how the plaintiffs were treated and there were a lot of pulling and dragging to the Black Maria and even
01:45though they the plaintiffs repeatedly asked whether they were under arrest and the police didn't want to
01:50inform them whether they were under arrest and IC was taken away and in view of all this the court
01:57found
01:58that there was indeed arrest and I think another very important thing was that when they were taken to IPD
02:05Langwangi
02:06their forearms, their lengan was marked with numbers corresponding to the plastic bag where they kept their phone
02:15and and I think it was a recognition as well there was a breach of constitutional rights there was no
02:21admitted by the police themselves there was no such SOP for the police to to do that and I think
02:27moving forward
02:28we just hope that the government on the police will improve the framework and how they deal with the participants
02:41or just citizens when they peacefully assemble it's guaranteed under the constitution so the police should
02:49facilitate those assemblies instead of you know carrying out all those other actions
02:55the most important thing is that is the issue of the people to be able to be able to be
03:00able to be able to be able to be able to be able to be able to be able to
03:06be able to meet the people
03:12and that we are also able to take away the task of the SOP actually we have to do the
03:18same thing we are doing to make the rights of the people
03:25democracy and the room
