00:17they try to say trying to gaslight us antifa doesn't exist well we got some antifa folks

00:24that were slapped i mean i mean clobbered with some massive sentences including one sentence

00:50the leftist folks they're whining and crying and complaining about these sentences

00:56uh so yeah let's get into it uh this first video clip that i'm about to show you is some

01:02footage from the incident now this the incident happened excuse me last year okay just an fyi

01:10and you'll see the date and everything uh in the body cam footage that i'm about to show you here

01:14it's not it's not crazy long only about a minute but i just want to uh give you guys a

01:19refresher on what happened that day check it out from the moment the first police officer arrives

01:24hey stop it only takes seconds he's running

01:27he's running he's on the ground before he's shot in the neck

01:33he survived and recovered from what federal authorities call a terror attack

01:37outside a north texas ice detention center on the 4th of july

01:41do not move you will be shot you're seeing the shooting and its aftermath

01:45for the first time on video obtained by wfaa

01:49don't move put your hands

01:51the feds charged more than a dozen people calling them antifa terrorists

01:55in a first of its kind case that led to a manhunt

01:58then guilty pleas and convictions this spring

02:01but that night at least how many is with you

02:04now answers don't know

02:06video shows officers struggled to find everyone involved

02:10i do not consent to search

02:12you ain't got a consent so

02:15dash cam audio shows others were more cooperative

02:20i'm just a peaceful protester

02:21state charges are still pending and nine of the suspects are appealing their federal convictions

02:30so there you saw some of the body cam footage

02:32and thankfully the officer that was hit

02:35uh as you heard there survived

02:38shot in the throat which is

02:40gotta be scary

02:41has to be absolutely terrifying

02:45knowing that you're hitting the throat

02:47and uh you know

02:49you get hit in just the wrong place in your throat

02:51and it's lights out

02:53and there's just about nothing anybody can do about it

02:56um i mean maybe there is some medical intervention or of some sort

03:01um getting hit in that vein but

03:04not that i know of

03:06but anyway uh here's some more information about

03:11these sentencing because this is hilarious

03:14a hundred years i'm loving it

03:17new at four eight people convicted in last year's shooting at an ice detention center in alvarado

03:23learned their fates today

03:25a federal judge in fort worth handed down lengthy sentences

03:28the decision fueled protests among those claiming a violation of free speech

03:33andrea lucia was inside the courtroom for the hearings andrea

03:38yeah the shortest sentence that we saw today was 30 years and that went to a man who was convicted

03:44of

03:45concealing evidence in this case most defendants got 50 years and of course you had

03:50benjamin song the apparent ringleader of the group who was sentenced to a hundred years in federal prison

04:03the sentencing hearings were at times emotional family members friends even a high school history teacher

04:10testified to the character of those convicted and at least two of the defendants were visibly crying

04:16several addressed the court directly including benjamin song he was convicted for the attempted murder of an alvarado police lieutenant

04:24who he shot in the neck during last year's fourth of july protest over conditions at the prairie land immigration

04:30detention center

04:30today he said he acted in fear only after that officer raised his gun at a fleeing unarmed protester

04:37song's mother repeated his statement at a press conference outside

04:41i know i am the person being judged but i also know that a case like this can become a

04:46warning to everyone else

04:48if you speak if you protest if you try to protect someone if you are associated with the wrong idea

04:55you can be turned into a symbol instead of treated like a human being

04:59a federal jury though found song and seven others present at the protest provided material support to terrorists

05:06in this case antifa the defendants have maintained they are not members of any group by that name

05:16the two federal judges who split up today's hearings and handed down these sentences defended their

05:21decisions with one of them saying that terrorism and violence are an assault to democracy we also got

05:28statements from several top trump administration officials praising the sentences that those include

05:33statements from the acting director of ice the acting uh u.s attorney general and fbi director cash

05:40patel who in his statement said uh today's sentences show the fbi remains committed to identifying

05:48locating and dismantling antifa and its funding networks across the country attorneys for the defendants

05:54though say this case has gotten way too politicized and they have vowed to appeal it

06:01appeal it all you want all you want uh to sit here and say that those folks were victims is

06:08crazy

06:09and you can't protest it's just crazy that woman's son uh i believe his name was benjamin

06:16shot an officer in the throat because the officer was prepared to defend himself against individuals

06:29against individuals so-called protesting with rifles so you shot the officer me personally i think that

06:38should be an automatic death penalty uh shooting an officer that's just my humble opinion on it

06:45but y'all can let me know yours in the comments um because if you're willing to shoot an officer

06:51then you're willing to shoot just about anybody for any given reason um so yeah defending somebody from an

07:00officer is just crazy absolutely crazy but anyway let's hop into this clip

07:10of uh you know of course the leftists have to cry and complain because their comrades antifa

07:17uh are going down with some hefty sentences and you know it's interesting because had the shoe been on

07:23the other foot i guarantee you they would be clapping up clapping like a bunch of seals in the circus

07:30if some you know uh individual on the right you know did something similar

07:37and got a lengthy sentence they'd be clapping like a bunch of seals in the circus they were clapping

07:43when nurses were fired when they didn't want to get the covid jab

07:46y'all remember that at first they were the doctors and nurses were were lifesavers they were amazing

07:52folks and then when some of them said no i don't want to get the sploots put in my arm

07:57and they were fired people clapped people cheered people these leftist individuals told them that

08:04they were horrible people and they should have to pay extra on insurance and all of this other stuff

08:09they were putting people's lives at risk and all of this other nonsense so yeah i don't feel bad for

08:16them at all it's shocking to all of us devastating to the families 50 to 100 year sentences those are

08:23essentially life sentences for all of the young people in this case um largely of whom were engaged

08:31in non-violent uh protest at a at an ice detention facility how did we get here so the government

08:41in

08:41this case sought a novel first time that this has happened use of a rarely used statute the provision

08:49of material support to terrorists and that has has not been used in the purely domestic context

08:56you mean rarely used like when you guys all convicted trump of 34 felony counts you mean like that rarely

09:06used okay don't feel bad at all don't i i don't feel bad at all you guys did the same

09:13thing to uncle trump

09:14and now the shoes on the other foot and you want to cry about it for this kind of conduct

09:20that statute

09:21also does not require any connection to a domestic terrorist organization or uh or any kind of a

09:29domestic terror terrorist organization when the government sought prosecution under this statute

09:35they sought to seek a very dangerous precedent that now they allows them to target any american

09:42engaged in protest that results in even the most minor damage to uh property property destruction

09:50any american can be targeted that way now it does not require ties to antifa or to any domestic

09:57terrorist organization it just requires one of these underlying statutes that's a dangerous precedent

10:03and what allowed them to stack these charges uh so high on tuesday on tuesday what happened is

10:12the federal sentencing people were anticipating maximum sentences of 20 years maybe 30 years

10:20uh the way they reach this sentence is the judge

10:23used this very very rarely used in the most extreme federal sentencing guideline called the terrorism enhancement

10:31to inflict maximum sentences on every count of conviction for these defendants and then abused his discretion

10:39to do something that is very rarely done in in in cases like this he ordered each sentence to be

10:48served

10:49consecutively not concurrently so each sentence is served consecutively resulting in sentences for 50 to 100

10:56years in these cases that terrorism enhancement that i mentioned only requires that the offense is

11:03calculated to influence or affect the conduct of government through intimidation or retaliation

11:10that's a very very broad has a very broad application and the government in in past recent years has

11:17sought that in a lot of these prosecutions that people don't pay a lot of attention to and so now

11:23it's

11:23very broadly applied seeking it in this case meant that the guidelines you know the this sort of

11:30federal sentencing structure that's supposed to tailor a sentence to each defendant my client for example

11:37a young mother to a 12 year old daughter uh and why wasn't she at home with her 12 year

11:43old daughter

11:44rather than being out with some terrorists uh shooting police officers in the throat

11:50i don't care oh she had a 12 year old daughter then why wasn't she at home with her clearly

11:56that

11:56daughter didn't mean a whole lot at the moment at the time at least so no i don't care you

12:04telling

12:04me that she's a 12 year old daughter goes in one ear and out the other congratulations you both played

12:10yourselves because once again had the shoe been on the other foot and this was you know uh some republican

12:19they'd be clapping like a bunch of seals in the circus clapping all over the place key key key and

12:25high high high five and each other look at those right wingers so i don't want to hear it artist

12:33poet never been in trouble with the law never even missed a parking ticket um the sentences are supposed

12:39to account for all of these unique situations the fact you know that she has no criminal history but

12:45the terrorism enhancement undoes all of that it recommends a maximum sentence on every charge

12:49for every defendant that's how it operates because it automatically designates them as a career offender

12:56it's particularly abusive in this case though because it results in a significantly unwarranted

13:02sentencing disparity in the united states amongst defendants that have been convicted of similar

13:08conduct now in these kinds of cases where the government is bringing this a novel charge under

13:13a rarely used statute and terrorism you may only have a couple or a handful of cases that are relevant

13:19to kind of distinguish your client or show where the you know expected range should be but in this case

13:25we actually had 1500 plus very recent federal prosecutions related to similar conduct that should have

13:34informed what these sentences should have looked that like and that was of the january 6 defendants

13:39the january 6 defendants were involved in uh rioting completely different situation and

13:47circumstance carrying massive arsenals of weapons uh lots of discussions ahead of time that didn't exist

13:54in this case about targeting law enforcement wanting to kill members of congress uh them actually storming

14:00uh the capitol you mean when the doors were open and they were guided in and it resulted in injury

14:06of 140

14:07officers in that case the government in that case could have sought prosecution under this same material

14:14support of terrorism statute they didn't for those defendants and they could have sought the terrorism

14:19enhancement in the they didn't because the shoe didn't fit those cases because it applied i told you

14:24that vague calculated to influence or affect the conduct of government uh could have applied it in

14:29all of those prosecutions it's only sought them in a small handful and where they sought the terrorism

14:35enhancement the courts then rightly decided not to apply it in the vast majority of the the small

14:42selection of cases where they saw it because they said it was overkill not representative and would

14:47result in unwarranted sentencing disparity the average the average sentence in the capitol riots which had

14:54far more serious conduct than the prairie line nine defendants was 26 months so we have a massive

15:01unwarranted should have been zero months should have been zero months because we've gone on to find out

15:07a whole lot about that situation like there was fbi agents injected into that crowd did we ever even

15:14figure out who that one guy was um i can't remember his name now geez why am i drawing a

15:19blank i can see

15:20too the guy that was like trying to rile up the crowd we gotta go to the capitol that guy

15:24did we

15:24ever even figure out exactly who he was whether he was an agent i can't remember y'all let me

15:29know

15:29in the comments so yeah totally totally different situation of circumstance the only person that died

15:33that day was uh one of us and not an officer even though you know leftists want to say oh

15:39there were

15:40officers that died no no uh that is a total lie but you know of course that's all leftists do

15:50are we surprised no not at all not at all but uh yeah massive massive sentences the shortest sentence

16:00was 30 years so great great news man amazing news uh and hopefully this uh quells any more violence

16:10from these antifa folks and uh we can get back to regular america if you want to protest that's

16:14completely fine um i 100 agree that people should be allowed to protest whenever and however they

16:22choose but when you get violent when you start assaulting people or shooting officers you've now

16:30crossed the line and that is that is exactly what happened in that case and that is exactly what

16:34happens at a lot of these uh antifa riots or wherever these leftists are you're constantly seeing uh

16:40people on the right getting assaulted not long ago uh savannah hernandez was assaulted by that family

16:45right on video right on video that is the recurring theme with these leftists they throw rocks and try
