00:03As far as you understand, this is a draft legislation
00:06and as per our usual practice, we don't comment on draft legislations of member states.
00:11Issues related to the substantive family law, including surrogacy issues,
00:17fall in the exclusive competence of member states.
00:20So only member states can regulate on these matters.
00:23The European Union doesn't have any competence.
00:25However, we are using our competence to protect children,
00:30and especially whenever it is about cross-border protection of children
00:35and the recognition of parenthood.
00:37And for this purpose, we have proposed a piece of legislation last year,
00:43a regulation on the protection of parenthood.
00:46And this should serve, of course, to protect the rights
00:49and the best interests of children in cross-border situations,
00:52specifically the regulation stipulates that parenthood,
00:57wherever it was established in one member state,
01:00it will have to be recognized in all other member states.
01:03The recognition will be ensured irrespective of the type of family of the child,
01:08independently of the sex of the parents,
01:10and irrespective of how the child was conceived or born.
