00:01The Malaysian Bar, on Thursday, won its appeal in its legal challenge against the prosecution's decision to grant a discharge
00:09not amounting to an acquittal, or DNAA, to Datuk Seri Dr. Ahmad Zahid Hamidi in the Yayasan Akalbudi graft case.
00:18A three-judge panel chaired by Justice Faiza Jamaluddin at the Court of Appeal ruled that the bar's application was
00:25not frivolous and raised arguable issues that deserved to be fully heard in court.
00:30Justice Faiza described the case as rare and exceptional, saying it warrants a full judicial review.
00:37The appellate court has now granted leave for the judicial review to proceed and ordered the case to be sent
00:44back to the High Court for a full hearing.
00:46No order was made as to costs.
00:49The Malaysian Bar filed the application in December 2023, claiming the Attorney General acted beyond his powers when applying for
00:58Zahid's DNAA.
01:00Among other things, the bar is seeking a declaration that the decision was null and void, and is also asking
01:07the court to compel the Attorney General to resume prosecution in the case.
01:11Previously, the High Court dismissed the bar's application in June 2024.
