00:14Being a homicide detective in the city of New Orleans, a stressful day at work, could
00:20mean having seen things that 99% of the population has never seen and will never see.
00:329-1-1, what's going on from the M-A-X-N-6?
00:35There's a man shot by Chapitula.
00:38And like, I think that's Andrew.
00:41Chapitula St. Andrew?
00:43Yeah.
00:44He landed on the ground.
00:46Oh, my God.
00:48They're going to steal trombones.
00:50We have units on our way.
00:53Is this your car?
00:54Yeah.
00:54All right, we're going to cut this traffic off and send it down that way.
00:57Temple.
00:58So, I get EMS to the intersection of Chapitula's in the area.
01:01We have one victim down.
01:04Person, gunshot.
01:06Couple to the body, one to the head.
01:09Hey, guys.
01:10There's lots of y'all stepping, all right?
01:11They got cases everywhere.
01:13They got a left man right here.
01:15They got a right homicide.
01:28The only information I have is a black man who was shot, about six caissons on the scene.
01:36And SUV apparently fled from the scene.
01:39A dark gray GFC Yukon just got information that the same SUV may have crashed somewhere in New Orleans East.
01:48This is the warehouse district.
01:51It's kind of mixed residential apartments and businesses.
01:55It's right outside of the Prince Quarter of New Orleans.
02:04As I'm walking into the crime scene, I notice immediately that there's just a large number of people in the
02:10area.
02:11It was the last night of Essence Festival, a three-day festival every year that we have around 4th of
02:16July.
02:17It brings in a lot of visitors to the city.
02:21In this case, the first responding officers were working in detail literally within probably 100 yards of where the homicide
02:27occurred.
02:29What's up?
02:32What do we have?
02:33We got one body?
02:34Yeah, one body.
02:35Okay.
02:38We had a deceased male on the scene.
02:42There's a lot of people there, but nobody wanted to come forward with what they possibly saw related to the
02:49actual homicide.
02:51So I knew that I was going to be relying on video surveillance evidence in the area.
02:56Ugly Dog has cameras.
02:58See, they have a camera right there on the side.
03:01All of the cases are over there by that Nissan, by the Ugly Dog.
03:06So I think he probably got shot over there and ran over this way.
03:09Yeah.
03:10Okay.
03:14It looks like the cameras were pointed in the direction where the murder took place.
03:18Unfortunately, the Ugly Dog is closed at this time, so I'll have to come back tomorrow.
03:23Any idea who the victim is yet?
03:25This is a guy named DeMond Foley.
03:28DeMond Foley?
03:29Okay.
03:33DeMond Foley is 36 years old.
03:35He's self-employed.
03:37He was out enjoying Essence Fest, but instead he was shot and killed.
03:45Let's start here.
03:46OK.
03:48Straight drops.
03:50Down with trajectory.
03:52Now you have to the right.
03:55Contact.
03:58More case into here.
04:01There were a number of shell casings.
04:03They all appear to be the same caliber.
04:07those are definitely not a millimeter blood goes all the way over that in that direction yeah
04:15there's blood on the gun too there was a handgun that was in very close proximity to the victim
04:23at this point i'm not sure if that belonged to the victim or the perpetrator
04:33fnc fnx 40
04:36was that magazine to capacity do we know
04:38the magazine in that gun was at full capacity and there is a live round in the chamber the gun
04:57is a
04:5840 caliber but the spin cases that are on the crime scene they're non-millimeter it's likely at this
05:05point that i'm looking for another gun the deputy that was black in the street right there he said
05:11he heard six shots he waited a few minutes there was nobody around but he saw the door color and
05:18suv to you come from this way when it took the shot street right that's what was it okay did
05:24he see the
05:24shots coming from the yukon no no he just heard the shot he said there was nobody out here okay
05:31the gmc yukon denali was seen fleeing the crime scene by sheriff's deputies the tires were screeching
05:38that's a little suspicious so we want to know more about that vehicle
05:44yeah i contacted the rtcc and they gave me um video for the um the denali and the vehicle was
05:52in
05:52this area at the time of the homicide okay
05:58so um they have people over there they want to know if the victim is somebody named penny penny yeah
06:04penny and i was asking them to describe penny and they showed me a picture of him i say what
06:10kind of car
06:10he's driving so he's driving on a denali um detective smith was approached by someone at the
06:19crime scene who is concerned with whether or not penny is the deceased victim i go over to
06:27speak to the gentleman how you doing man i'm detective ball who's me you okay what brought you out
06:36here like i will sleep i just got a phone call and they said that they saw him on instagram
06:40he was
06:41up here and they said that they thought that this was him okay what does he look like is that
06:48a recent
06:48picture yeah how recent uh about three weeks the gentleman shows me a photograph of penny
06:57it's not the deceased individual that's on the ground but i can't tell him that because i still
07:03want to get as much information as i can i then asked what penny's real name is um and he
07:10tells me
07:11it's alfred pennington alfred pennington yeah what kind of car does it drive oh you called an island
07:19what color is it oh you know i got like really dark blue hang tight i'm gonna come talk to
07:25you in a
07:25well he tells me someone named alfred pennington drives a dark color gmc yukon that matched the
07:34description of the vehicle scene fleeing the homicide scene so um the rtcc gave me a plate on the vehicle
07:42it is a texas plate oh that's who it's registered to yeah they call it's ready to call him penny
07:49so they
07:50the car registered detective smith confirmed with us that the registered owner of the gmc yukon
07:57was in fact alfred pennington so he became a person of interest
08:03i wanted to use
08:10we got information that dark colored suv a yukon fled the scene at a high rate of speed heading
08:18towards the interstate and in new orleans east right after this shooting there is a dark colored suv with
08:27the same plate on it uh that crashed so we're going to be heading out there right now
08:42what did they get i mean it looks like the tire just blew out but i mean they probably hit
08:46something at some point outside of it's all chewed up yeah was anybody here any witness or anything when
08:52y'all got here everybody called i pulled up on it this is exactly what i saw
09:00that license plate matched the license plate on the vehicle that was fleeing the scene
09:05and belongs to alfred pennington so at this point i do have enough probable cause for a search warrant
09:11for that vehicle let's have it toad okay you get it put in the cage for me yeah okay thank
09:18you
09:18well i appreciate it no problem hi man hello good morning come on yeah
09:38in processing the vehicle my goal is to find any evidence that's related to the crime scene like a gun
09:46and any identifying evidence on who was inside the vehicle
10:00if you could take the phone for sure and let's do dna exterior and interior door handles dna
10:12what i need at this point is a gun that i can link to the shell casings found at the
10:17crime scene
10:25no gun
10:30so far i've got really no evidence that alfred was actually in here
10:36i don't know at this point i still need to determine who was in that vehicle at the time
10:43the homicide occurred whether they were the driver or passenger okay thank you much i appreciate it
10:50i need to find the murder weapon and i need to find video that captures the murder without any of
10:57that
10:57so far i'm at a dead end
10:59so
11:03so
11:27at this point i still need to determine who was in that vehicle at the time the offense occurred
11:33so we're heading to the ugly dog saloon which is a business that's located just outside of where
11:40the homicide occurred they supposedly have video of the entire offense so i'm anxious to see that video
11:52i am born and raised in the city of new orleans back in 1985. my grandfather was unfortunately murdered
12:02it was an armed robbery and since i was a child i've grown up wanting to be a policeman specifically
12:09homicide i was motivated by his case and i have had as long as i can remember a sense of
12:17wanting to just
12:18do my part in solving crime
12:27what's going on man doing well how are you good good nice meeting you yeah the video from the camera
12:33that's right there have you seen it yet uh-huh okay so i'm looking for a gray yukon denali that
12:39fled
12:40supposedly oh god this is a good video that's the denali huh yeah that's that's the yukon yeah
12:55they're in between the two cars
13:09wow the video recording from ugly dog it is from a little bit of a distance
13:13in terms of being able to identify the shooter
13:18but i can hear the gunshot and the victim is seen running away and the shooter is seen chasing
13:25after the victim continuing to shoot as the victim eventually collapsed across the street
13:30i don't know at this point that the shooter is alfred pennington for sure but i do see the shooter
13:38get into the driver's side of the dark gray gmc yukon and flee having this video is great for the
13:46first time i'm able to see exactly what occurred what i need at this point is to be able to
13:50identify
13:51who that shooter is and who it was that was operating that gmc yukon that's the one angle okay and
13:58then
13:58i have the other one from behind looking down annunciation sweet
14:06so there's the suv right there that's the shooter come across the street then get in his suv
14:17okay here's the victim coming now yeah right walking right there
14:23it goes around the front that is great video
14:34nice to know yep and then they're in between the two cars
14:50it looks like he had a distinct logo or emblem or something on his shirt front and back
14:57you see his shirt you're right he did hear something yeah
15:02so what i'm thinking i'm gonna go back here and some type of video of him walking
15:05and see if i can get him his face but yeah that's that's great
15:15the video is pretty cut and dry it definitely put everything into perspective
15:21there's still many unanswered questions at this point what occurred in front of the yukon was there
15:27a physical altercation was there a threat we collected a gun at the crime scene did the deceased victim
15:34pull the handgun out and pointed at him all i know about the gun is that it was stolen about
15:39a year
15:39ago that doesn't really tell us much the shooter he's got a pretty distinct shirt it's got some kind
15:46of logo on the front and back of it so i have a reference point on what to look for
15:51hopefully we get
16:09good image of his face
16:10hey what is 911 with the pushback there is a man that just got shot and he is on the
16:17ground he's on the street on the side of his car
16:20he's on the side of his car he's on the side of his car he's on the side of his
16:25car he's on the side of his car
16:25oh my god
16:29yes i need an animal out there
16:31louisa street two minutes got shot they need somebody here right now somebody en route
16:37yes sir okay okay thank you
16:52please shut up all up and down okay you were driving yes
17:20we're working at 30 for us possible 30
17:29no me
17:32no me
17:32no me
17:44no me
17:53I get a call from 5th District.
17:57They're saying that they're working a shooting.
18:00The two victims have been transported to the hospital.
18:02One of them was shot in the hip, but he's expected to survive his injuries.
18:07The other was shot in the chest area, and he passed away due to his injuries.
18:13His name is Stanley Williams.
18:15But to friends and family, he's known as Doody.
18:19He was in his 40s. He's from New Orleans. He grew up in this area.
18:31Once I walk through the tape, I'm able to see that there's our crime scene units.
18:36They're starting to cone certain things in the street, some casings that are on the sidewalk.
18:43I noticed that most of the scene seems to be around a Jeep that's parked in the middle of the
18:47block.
18:47It clearly has some kind of bullet damage to it on the driver's side, and its windows are shattered out
18:54on the passenger side.
18:56There was a witness who was on scene.
18:59Detective Walt Vedman is going to talk to the witness and see what we can find out about who did
19:04this.
19:06So, what do we have on scene?
19:09We got the, this is like the surviving victim's clothes.
19:12We got six .40 caliber shell casings all over here.
19:16Oh, Walt said, the witness says the shooter is a guy named Dino.
19:21And he came over here and started arguing about some video the victim took of him on the victim's phone
19:28or something like that.
19:29And then Dino started shooting him.
19:33Our witness was able to tell us that my decedent, Stanley, was sitting on the passenger side in the Jeep.
19:40There was some kind of argument happening between Stanley and the shooter standing on the passenger side of the car
19:47about some kind of video.
19:49The witness started hearing gunshots.
19:52He saw Stanley was shot, and the driver was also shot, and he said, Dino did it.
20:01He didn't know Dino's real name, but he knew Dino lives in the area.
20:07So, this is Dino's address is supposedly this.
20:12And that came from Walt?
20:14This came from Walt, who got it from the witness.
20:17So, I'm raising S.O.D. to get the house surrounded.
20:20And if we can get a warrant for the house, boom.
20:25Dino supposedly lives right around the corner, a couple houses down from where we're all standing.
20:31Now that we know where Dino lives, we need to get a search warrant, and now we're calling the SWAT
20:36team.
20:38S.O.D.
20:39S.O.D.,
20:50Hey, Lou.
20:51It's Donnie Williard over at Homicide.
20:53How are you doing?
20:55Hey.
20:56So we got a 30 over here.
20:58We're still, like, wrapping up the actual original crime
21:01scene, typing up a warrant very quickly on this house,
21:05and seeing if S.O.D. can assist with executing the warrant.
21:10I'm working just some intel real quick,
21:12seeing if we can just figure out who the perp is.
21:15We might be hitting an empty house, though.
21:17It's possible.
21:19Type in your risk assessment, your search warrant,
21:22and when you get that, send it to me.
21:24All right, sounds good.
21:26Once the witness told us where Dino lived at,
21:30I began researching the address, trying
21:32to see if I could find out, checking our databases,
21:35who lives there.
21:37All right, well, this is interesting.
21:38We got a Devin Green, 36 years old.
21:46All right, so I pulled up the address,
21:49and I got a hit for a Devin Green,
21:53who is 36 years old, light-skinned black male.
21:56He's 5'7", which is exactly the description
21:59we got from the witness.
22:01But at the very least, even if we hit the house
22:03and it comes up blank, we can show a lineup.
22:06Yeah.
22:07Yeah.
22:42So a positive ID on our perp.
22:48Hey, Lou?
22:50Who's that?
22:51Just got a positive ID from .
22:53It is going to be Devin Green.
22:55OK.
22:57It's minutes before the briefing.
22:59I just got the call that my witness actually
23:02picked out Devin Green in the lineup,
23:04confirming that Dino is Devin Green.
23:09This is my suspect.
23:13I get a search warrant for Devin's house.
23:16All right, what's going on, guys?
23:18Good evening.
23:18Thank you all for coming.
23:19I know y'all were activated at kind of last minute.
23:22So earlier today, around 2 PM, two victims were shot,
23:26one fatal, one non-fatal.
23:28We were able to identify the perpetrator as Devin Green.
23:31We actually knew where the perp lived.
23:34We don't know if he's inside.
23:36Appreciate y'all being here and if there's anything else.
23:40We want to get into this house as soon as possible,
23:43because the last thing that we want
23:45is for my possible suspect to go back to the house
23:48and start cleaning things up, getting rid of evidence,
23:52getting rid of any guns.
23:53The more time that goes on, the more evidence
23:56that we are at risk of losing.
24:02All right.
24:03I guess we'll follow the train out of here.
24:14Clock is ticking.
24:16Is Devin Green going to be inside or not?
24:18This is just the moments where I start to get, like, nervous,
24:21like, catch him off guard or is he already in hiding?
24:25Find out pretty soon.
24:31All right, fellas, let's go.
24:32Check your time.
24:38Three, one, two, four.
24:46Police, there's one.
24:48Open the door all the way.
24:50All the way.
24:54Who we got?
24:55Who we got coming out?
24:56We got to help you see me out the front door.
24:59Uh...
25:06Someone else just came out.
25:09I don't think that's the target, huh?
25:11I don't think so.
25:12No, they just let him walk like that.
25:14No.
25:20So right now, he might be inside because they're still
25:24calling his name.
25:25Yeah.
25:26Which they would do if...
25:27It's the lock.
25:29Just take this off section so no one drives up on us.
25:32Oh, .
25:33Shots.
25:34Back up.
25:36Take cover!
25:37Cover!
25:37Cover!
25:39Cover!
25:50We have Devin Green's house surrounded,
25:54and somebody just started shooting from inside.
25:57I don't know if any of our guys are hit.
26:00We're calling for as many units as possible
26:02to respond to the area,
26:03get a perimeter around the location.
26:06Right now, it's a standoff.
26:09This is a tense moment,
26:11waiting to see what's going to happen next.
26:14But our SWAT guys are going to do everything they can
26:16to make sure that we come to a peaceful resolution.
26:29Good morning, everyone.
26:31This is an update involving an officer-involved shooting
26:34that occurred on October the 5th,
26:36around 7 o'clock at night.
26:38This incident took place during the service
26:41of a high-risk warrant related to a homicide
26:45that had occurred earlier in the day.
26:48That homicide suspect was a 36-year-old man
26:52by the name of Devin Green.
26:55Mr. Green fired at the officers
26:58from inside the residence.
27:01And this resulted in our officers' returning fire.
27:05After a nine-hour standoff,
27:10Mr. Green finally surrendered
27:12and was taken into custody.
27:14In the exchange of fire,
27:17no one was struck,
27:20and therefore, there were no injuries.
27:31The smoke is practically still settling.
27:34It's surreal.
27:36I can't believe the number of rounds
27:39that were being fired that nobody got hurt.
27:42I'm grateful.
27:44Nobody wants to see anybody get hurt.
27:46We want the criminal justice system
27:48to hold people accountable.
27:49I can finally breathe some relief
27:52now that Devin is in custody
27:54and our guys are okay.
27:57We did the search warrant inside the house,
28:00and there was two guns,
28:03a rifle,
28:04and a pistol.
28:05The pistol matches
28:07the caliber of casings that we had
28:09on the scene of the homicide.
28:13Now, I want to see
28:14if I can get a statement from Devin.
28:16I still need to be able to prove
28:18that Devin's the one
28:19who killed Stanley Williams.
28:22Did he die?
28:24Yeah, so he's at the hospital.
28:28So we'll see what he says.
29:00How's your case going?
29:01What's up, bro?
29:02Yeah, it's good.
29:03So I'm getting ready to look at some video
29:04from a restaurant,
29:06which is right across the street
29:07from Ugly Dog.
29:09I have a good idea
29:10of who the perpetrator is.
29:12A gentleman named Alfred Pennington.
29:14So hopefully this catches him.
29:17I mean,
29:17I've got a good reference point
29:19with the shirt.
29:19He's had like an emblem.
29:20Wow, why can I never get video
29:22like that?
29:25Look how clear it is.
29:28Now, I don't know who's panning this,
29:30but...
29:30It's got to be motion.
29:31Yeah.
29:31It picks up on alt motion
29:32that's going.
29:34I have video from the Ugly Dog
29:35that shows him walking this way
29:37from here across the street.
29:40And you can tell he's got
29:41some distinct logo on his shirt.
29:44So there were sheriff's deputies
29:45working or something?
29:46Yeah, right across the street
29:47from where the shooting happened.
29:49The shooting happened right here.
29:51Wow.
29:52That's breezing.
29:53Yeah.
29:56Hopefully that is,
29:57that is turned that way
29:58when it happens.
30:02There he is.
30:03Is that the suspect?
30:06That is him.
30:09You see the logo?
30:12Oh, my God.
30:14That's Alfred.
30:15How do you know him?
30:17I have a picture of him.
30:19Perfect.
30:20All right.
30:21Now he's on scene.
30:23Damn.
30:25I'm able to pretty much identify
30:27the shooter from the Ugly Dog
30:29saloon video as Alfred Pennington.
30:32Using those identifying features
30:34from the t-shirt as a reference.
30:38It's clearly the same logo.
30:41Now watch.
30:42You're going to see victim
30:42right behind him.
30:43Look.
30:44Here's the victim.
30:47Oh, bro.
30:48He's skipping.
30:52No, I pan.
30:56Look.
30:57There's the victim.
30:58Yeah, I see him.
31:00So 1.23.
31:02What time did it happen?
31:03It happened at 1.24.
31:054.
31:07Camera ain't going to catch it.
31:10No.
31:11But what this does,
31:13it gives me his face.
31:14Yeah.
31:17It is a very aha moment for me.
31:20This places Alfred Pennington
31:22at the crime scene
31:23at the time the offense took place.
31:25So at this point,
31:27I do have enough probable cause
31:28for an arrest warrant.
31:29And I'm confident
31:30that a judge will sign it.
31:32But I still have a lot
31:33of unanswered questions.
31:34What occurred in front of that
31:36GMC Yukon?
31:38Why did Alfred Pennington
31:40allegedly shoot DeMond?
31:43Hopefully, I am able to find
31:45Alfred Pennington
31:46and get answers
31:47to all these questions
31:48that we have.
32:11And get answers
32:17to all these questions.
32:18I just talked to Dino,
32:19a.k.a.
32:20Devin Green.
32:21After Devin surrendered,
32:23he started saying,
32:25I had an old groin injury
32:27and it's aggravated right now.
32:29So I want to get checked
32:30out of the hospital.
32:31And so it was there
32:33that I interviewed him.
32:35Devin ends up telling me
32:37that Devin owed Stanley money
32:40and Stanley had told Devin
32:42he was going to get back at him
32:43for this money owed.
32:45And Stanley was sharing a video
32:48that depicted Devin
32:50in a light that Devin
32:52didn't want other people
32:53to see him in.
32:55And so Devin felt his manhood
32:57had been disrespected.
32:59And Devin said,
33:00that's why he did it.
33:02He even went as far
33:03to say that the second person
33:05who was in the driver's seat
33:07was nothing more
33:08than collateral damage.
33:12So right now,
33:13we're pulling back up
33:15in the area
33:16where the homicide happened.
33:19I still want to get
33:20as much evidence as possible.
33:23Got to walk up the block
33:25and just see if there's
33:26any other cameras,
33:27ring doorbells,
33:27or anything that might give us
33:29an actual look at what happened.
33:54I secured an arrest warrant
33:55for Alfred Pennington
33:57for the murder of Devin Foley.
33:59I received a phone call
34:00from Alfred Pennington's attorney
34:02who expressed that
34:04Alfred wanted him to turn himself in.
34:05He was aware that he did have
34:07an arrest warrant out for him.
34:08And he came in with two attorneys.
34:12Now, I have a lot of questions.
34:15The obvious question of
34:17what occurred in front of that
34:18of GMC Yukon
34:19of GMC Yukon
34:20that he needed
34:21to possibly shoot Devin Foley.
34:24Okay, you do have a warrant
34:25for your arrest.
34:27The warrant is for a second of your murder.
34:30It's an incident that happened
34:31July 8th in the evening.
34:34Why don't you tell me what happened?
34:37I came down on Friday
34:41to go to the Exeter Festival.
34:44I don't live here.
34:46I live in Houston.
34:48I just was out trying to have a good time.
34:52So I went in the club
34:55and I walked in.
34:57Somebody pulled my shirt.
34:58I turned around
34:59and I saw who it was.
35:01And it's just God
35:03that I
35:04no longer
35:05even associated with.
35:07It's just like,
35:08what's up?
35:09And I'm like,
35:10I'm chilling, man.
35:11I live in Texas now.
35:13You know, I'm not into
35:14none of that footage just no more.
35:16And as I walked off,
35:18he pushed me and said,
35:21you're a bitch.
35:22You're going to die tonight.
35:23And I
35:25immediately tried to exit.
35:27In Alfred's statement,
35:28he tells us that
35:30he felt threatened by Daman
35:32and Daman told him
35:33that he was going to die tonight
35:35and decided to leave the club,
35:37which is consistent with
35:39what we
35:40see so far in the video
35:41that Alfred leaves
35:43and then Daman follows behind him
35:46towards his vehicle.
35:50When I sat down in my car
35:53as I took a breath
35:58he was grabbing at my door
36:01and grabbing at my door.
36:03Yeah, let me in this bitch.
36:06Let me in this bitch.
36:07Yeah,
36:07he started clicking around.
36:10And he just was like,
36:11yeah,
36:12told him you're going to die tonight, bitch.
36:15I'm about to die.
36:16I'm about to kill you.
36:17I'm about to take this bitch.
36:20I got out when he was ramming up,
36:23when he was ramming on the door,
36:25like instinctively,
36:26because I'm just thinking about
36:27to start shooting in the door.
36:29I don't know what he's about to do.
36:30I don't know.
36:31I'm just scared.
36:33I'm just scared.
36:39And he just came and got up on me.
36:44And he was reaching for the guy.
36:47I just heard him off for a second.
36:49But I didn't even get to grab him.
36:52It just was so quick.
36:53And I just,
36:54and I just shot.
37:03I just started shooting.
37:05And when I started shooting,
37:07he was running.
37:08And he was like,
37:09I was just scared, man.
37:12I was just scared.
37:14In his statement,
37:16Alfred Pennington admitted
37:17that he did shoot Damond fully.
37:19He said Damond pulled a gun
37:22and Alfred felt threatened.
37:25Eventually, Damond started running away
37:27and he continued to fire his handgun at him.
37:31I was just scared
37:32and I just got back in my car.
37:36And I just dug down
37:37and just put the gas on like,
37:40but I got a few blocks out
37:43and I just,
37:44I just drove, like,
37:46I just drove, like.
37:50That's what happened.
37:51So, um,
37:54he's obviously emotional, right?
37:56About everything.
37:57Um,
37:59I don't want him answering
38:00a lot of questions
38:02with him and his face.
38:03But I want,
38:04we know the Warren's army out there
38:05and we want you to know the truth
38:07because obviously,
38:08the investigation keeps going.
38:10Um,
38:10I want you to hear his side of the story.
38:12That's the best of the way that we've been.
38:15You know he's on arrest, man, right?
38:16Of course.
38:18I was hoping to clear this up.
38:20I have questions for you
38:21and I can't ask them
38:22because your attorney doesn't want me
38:23to ask them for you.
38:24So,
38:24the only way for me to clear it up
38:25is to ask my question.
38:27That's it.
38:27There's a lot of holes that
38:28I need to build for my investigation.
38:30So,
38:31um,
38:31without that,
38:32you will go to jail.
38:34Okay.
38:35I have one question for you.
38:37Sure.
38:40Do you turn the gun into you?
38:42I don't have to go.
38:43I don't have to go, no.
38:45Okay.
38:47I don't have a gun.
38:49I'll be right back.
38:53The fact that I'm able to make an arrest
38:56for Alfred Pennington related to the homicide of DeMond Foley
38:59is great.
39:01DeMond,
39:02his family are victims as well
39:05because they're the ones that are left
39:07suffering from the loss of their loved one.
39:11So,
39:11it gives me satisfaction that I'm giving closure to
39:15DeMond Foley's family.
39:21DeMond Danke.
39:44DeMond Foley
39:51I want to call the mom of the decedent, Stanley,
39:56now that the chaos has kind of settled down.
40:01Hello.
40:02Hi, is this Miss Desiree?
40:05Yes, it is.

40:29No, I'm not familiar with him.
40:32Again, I am so sorry for y'all's loss.
40:35If you do have any questions about the investigation,
40:39or, you know, even if you just need a few minutes to talk,
40:42this is my cell phone number, okay?
40:44You call me anytime you need, okay?
40:47Okay.
40:48Bye-bye.
40:49All right, bye.
40:52Kids are not supposed to pass before their parents,
40:56and unfortunately, that's what happened here.
40:59Okay.
41:25Bye-bye.
41:28Audrey is the one of those things we do.
41:39Yeah.
41:40Yeah.
41:41Yeah.
41:41Yeah, he was.
41:43I remember he was a happy person.
41:45Happy.
41:46Humble.
41:47Outgoing.
41:48Respectful.
41:49Close to his family.
41:52And just always being there for whoever needed him.
41:55Right.
41:56Since he's been gone, everybody, like, did it.
41:59He really missed him because he was doing a lot of stuff for a lot of people.
42:04He will start with you doing to give you a hand.
42:07He'll take you anywhere you want to go.
42:10But he wasn't for free.
42:11Better have some gas.
42:13Better have some gas.
42:14If he wasn't family.
42:17I'ma miss him.
42:17I'ma miss him.
42:18Yeah.
42:20Doody loved his family.
42:22Doody loved New Orleans.
42:23He loved our culture.
42:25He loved the food.
42:27And he was a mama's boy.
42:29Yeah.
42:30He definitely was a mama's boy.
42:32Yeah.
42:32He was a mama's boy.
42:34Yeah.
42:35Since he's been gone, I keep hearing him, ma.
42:39Yeah.
42:39Uh-huh.
42:40Hey, ma.
42:41You know, I just keep hearing him calling me.
42:45Doody deserved justice.
42:48He deserved it.
42:50Yeah.
42:51The justice will be served.
42:53It will.
42:56Of you.
42:58Rather, death, death.
42:59It will.
42:59It will.
43:01Hell's
43:02Oh
