03:07And so, my thinking is the first thing to do is call the mechanic since they told me that all
03:11the work that was just done was under warranty.
03:13He's a super good mechanic.
03:14He knows the truck better than they do.
03:16It's all taken care of.
03:18Her mom was patting me on the back the whole time telling me everything's good.

04:21with this James during the day before I go and meet for the truck, and then I show up
04:25and there's her standing in the driveway with her whole family outside, and that man that's
04:30in the pictures for the ad is nowhere to be found.
04:32And then I show up, and it's actually her that's selling the truck using a different
04:35Facebook for whatever reason.
04:37Let's take a look at 09, please.

04:43So on the right, it says James Bogo on the bottom.

04:47So that is my father.
04:49As we know, I was 17.

06:25But Aubrey and Alyssa say it was an as-is sale and they never misrepresented anything.

06:49She drove us around a couple neighborhoods for like five, ten minutes and asked if I wanted
06:52to drive it once she got back.
06:53I said, sure.
06:53So I have no idea where I am.

06:56This is an hour and a half away from my house.
06:58Everything seems fine on the test drive.
07:00Nothing seems weird because she's taking me through all these little neighborhoods and
07:02stuff.
07:03She doesn't take me on a highway or anything like that.

07:05Um, I offered to go on the highway.
07:08He did not want to.

07:11He's paying $15,000 for a vehicle and he would want to see how it is when it gets up

08:21And what was it that he was recommending?
08:23It's called bulletproofing.
08:25Pretty much you put studs in the head to make sure nothing ever goes wrong.

08:32So nothing was wrong with the head gaskets that you were aware of?
08:35No, it just wasn't studded and it was getting high in miles and he was like, you guys can
08:39do it if you want, but it was not something that was necessary.

08:43So you buy it and then you're on the drive home.

08:46Tell us what happened.
08:47So when I initially went on the test drive and she was driving at first, I noticed the
08:51check engine light was on.
08:52So I asked her when she was giving the test drive, there's a check engine light.
08:55Do you know what's going on with that?
08:56And she said, honestly, I don't know.
08:57And then her stepdad in the backseat's like, I have a code reader we could plug in real
09:01quick and check it out if you want before you buy it.
09:02I was like, that'd be super helpful.
09:03I'd love that.
09:04So we plug in the code reader.
09:05The code reader says it's like a sensor for like an exhaust or something like that.
09:10And I'm thinking, okay, that's probably not a huge issue.
09:14We could still go through with it.
09:15And then I go home and I'm driving home.
09:17The truck is what's called surging.
09:19So the RPMs are just up and down, up and down, super loud.
09:22It sounds like the turbo is just kicking on and off, on and off the whole drive home,
09:25hour and a half.
09:26I'm extremely worried the motor is going to blow the whole way home.
09:30First thing I did in the morning was call the mechanic.
09:32He basically told me the truth about the truck.
09:34Okay.
09:34So I want to hear this, but I also want to make it clear.
09:37What someone else told you who was not in court to testify is typically considered hearsay.
09:42I am accepting your testimony, not for the truth of what the man said,
09:46but simply for your state of mind as to what you did afterwards.

09:51So what did the mechanic tell you?
09:52So he told me that it needs new head gaskets.
09:55He just did a bunch of work on it.
09:57And Aubrey and her mom couldn't afford the work that needed to be done to it.
10:01So they bargained on price.
10:02They had the truck towed over there.
10:04They had a box full of used parts, NAPA parts, all kinds of parts that aren't even supposed to go
10:08in that truck.
10:09And he was very specific with them and they just basically had him patch up the truck
10:14so they could get it onto the next guy and sell it.
10:16And it was running.
10:17Don't get me wrong, but is it running like it's supposed to or safely?
10:20No, not at all.
10:21So what you claim the mechanic said was that when the defendant and her mom brought the vehicle in
10:27or one of them or both of them brought it in, it was toting because it was not running.

10:32And it needed a lot of work.

10:37You said the mechanic provided them with a list of items that needed to be fixed,
10:41including new head gaskets, not one of those bulletproofing stuff, new head gaskets.

12:09Aubrey says Justin came, saw, and bought the truck as is, so they owe nothing.

17:57It might run top-notch for a truck with, what, 150,000 miles that's had a bunch of modifications

18:08You know, it's, like, suggesting you could say, like, this is, like, the best gavel ever.

18:55Yes, so Mr. Robinson pointed out that the truck has no power, but in Mr. Robinson's,

19:17So, who is being dishonest here?
19:21Because you're making representations to the public that it's got great power.
19:25And that's not necessarily true because in the pictures of that ad, I don't know if
19:28they posted the pictures of all those, I had receipts from the mechanic that they gave
19:32me and I have receipts from my mechanic once I took it to my mechanic as well.
19:36And I also have messages from all kinds of different people that I provided you guys
19:39for evidence that shows me being very honest with people trying to buy the vehicle.
19:43I am going to end where I started, which is when you buy a used vehicle, it is incumbent
19:49on the buyer to do the due diligence and do the inspections and ensure that the car
19:53is working properly.
19:55I'm going to further add that if you show up and the seller is crying and in tears, maybe
20:01you should take a beat.
