00:00You took your motorcycle to him to fix.
00:02He still has the bike.
00:03Yes. It's ready to go.
00:05You were playing him for almost a year.
00:08I was always out of town a lot.
00:09Didn't he at one point tell you his home had been raided by the police?
00:13Yes.
00:13He thought the bike was dead and gone.
00:15And you?
00:16Do you know the best way to cover up a stolen motorcycle?
00:20Uh, no.
00:22You never put the bike in your name.
00:23Now on Tribunal Justice.
00:48Today's case was filed in Fresno, California.
00:51Your Honor, this is case number 3109 in the matter of Sattler v. Aguilar.
00:56Both parties have been sworn in.
00:58Thank you, Cassandra.
00:59You're welcome.
00:59You may be seated.
01:00Okay, Mr. Sadler.
01:02You ride motorcycles through a motorcycle club.
01:05Your motorcycle needed some repairs.
01:07And you knew that the defendant repaired motorcycles.
01:09He had repaired one of yours in the past.
01:11So you took your motorcycle to him to fix.
01:14Yes.
01:14You would provide him with the parts.
01:16And he would provide the labor.
01:18And he never gave you back the bike fixed.
01:21Is that right?
01:22Correct.
01:22And therefore, you're suing him for the value of the motorcycle, which is $10,000.
01:26Yes, sir.
01:27All right.
01:27Now, Mr. Aguilar, according to your answer, you say you don't know what he's suing you for.
01:32Correct.
01:32You fixed it.
01:33But then he just never showed up.
01:35He just ghosted you until you got this lawsuit.
01:37Yes.
01:38And that's available for him to pick up whenever he wants.
01:40Well, the problem is here is that it took months for him to get the parts to me to get
01:46fixed all the way.
01:47So it's still not fixed?
01:48I just need, like, maybe two more things to put on it, and it's ready to go.
01:51Two things, but you still got the bike?
01:53Yes.
01:53Because there was a period of time, Mr. Sadler, that you thought that he had gotten rid of the bike.
01:57Yes.
01:58Let's put up 01.
01:59Is that the bike that you gave off to the defendant to fix?
02:02Yes, sir.
02:02Tell me about this bike.
02:03It's a 2000 Honda CBR 929.
02:06They only made so many of them.
02:08It's been aftermarket.
02:10Everything is chromed out on it.
02:12Okay.
02:12And when did you buy it?
02:152023.
02:17Okay.
02:17According to your complaint, you told us it was February 2023.
02:20Yes, sir.
02:21And did you buy it from a private seller, or did you buy it from a dealer?
02:24Offer up.
02:25What is that?
02:26It's an online sell and trade.
02:29So it was a private buyer?
02:30Yes.
02:31Now, you're suing the defendant for $10,000 for the value of the bike, but what did you pay for
02:36the bike?
02:37I paid $5,000 for the bike.
02:39You paid $5,000 for the bike?
02:40Yes, sir.
02:41Okay.
02:41Right off the bat, Mr. Sadler, here's the problem.
02:43In your complaint, you told us you paid $5,500, but on the listing, can we have the listing up?
02:52$0,500?
02:54The asking price was $4,500.
02:57So is it $4,500, $5,000, or $5,500?
03:00$4,500.
03:01$4,500.
03:02So let's change your sworn statement to $4,500.
03:07You don't by chance have proof of payment of that $4,500, do you?
03:10No, I don't.
03:10Okay.
03:11I paid it cash.
03:12And according to your complaint, you wrote it for quite a while.
03:14Yes.
03:15About how many months?
03:16I wrote it for about three months.
03:18All right.
03:18Would it help if I told you and reminded you in your complaint, you said you wrote it for about
03:21six months?
03:22Yeah, about three to six months.
03:23Three to six months.
03:24We'll say three to six months.
03:25You say that the thing started overheating.
03:27Right.
03:28And that it needed a new thermostat.
03:30Right.
03:30So what'd you do?
03:31Got in touch with my friend, and he ended up connecting me with Westside, and then...
03:37And when you say Westside, that's how you met the defendant?
03:39Yeah.
03:39Okay.
03:40And he said he can fix it, it'd be no problem, $500 for the labor, and just supply the parts.
03:47Just basically, he told me what he needed, and I went and bought it.
03:50You left everything with the defendant, and you said he gained $500 cash?
03:54Yes.
03:54All right.
03:55Would it help to refresh your recollection if I told you in your sworn complaint...
03:58$600.
03:59$800.
04:00$800 was total.
04:00$800, $600, $500, $4,500.
04:02$800 was total because of the cylinder head.
04:06Okay.
04:06And I owed him $100.
04:07So September is when you dropped off the bike regarding the thermostat.
04:11That's when you first met the defendant.
04:13Is that why you were raising your hand?
04:14Yeah.
04:14No.
04:14The first time we brought it, it was for the spark plug kept popping out of the engine,
04:19out of the motor.
04:20Okay.
04:20But I told him the first time, it's going to go out again.
04:23I don't know, I can't tell you when, but it will go out, and sure enough, it went out.
04:27This is a Band-Aid fix.
04:28If it keeps happening, we're going to have to do a bigger fix.
04:30Right.
04:30And I just got to mention, so you're riding this bike for six months after you buy it
04:34in February of 2023, right?
04:36Right.
04:37Now I'm a stickler, you know, for details, and I'm a law and order guy.
04:40Did you have a motorcycle license, or did you just have a Class C?
04:43I got a license, I got a license, a permit.
04:46It's a Class C, it's not even a Class M?
04:48Yes.
04:48Okay, but notwithstanding, you still ride the bike.
04:51Doesn't make you a terrible person, just might mean that you should probably go get your bike license, right?
04:55Right.
04:55I got it, okay.
04:56So now June 24, what's wrong with it the second time?
04:59It was various problems.
05:01It was oil leak, water pump, brakes, gasket change.
05:06I told him that I needed the head, and the head gasket, it was a must.
05:10It took him maybe like four months just to get the heads alone.
05:13And I specifically told him that I didn't have that much time to, I could only have weekends
05:18and maybe every other weekend, because I was always out of town a lot.
05:22When he told you the list of items that he needed, did you give him everything that he needed?
05:26I gave him everything that he needed, but it didn't take no four months to get it to him.
05:30It took him the rest of the month.
05:31The longest was him ordering the cylinder head himself, which I gave him the money as soon
05:36as he asked for it.
05:37You say you gave him everything you needed.
05:39You say that it wasn't everything.
05:40That's okay.
05:41So when did he stop responding after June of 2024?
05:46I want to say around September.
05:48Okay.
05:49And was something going on in September?
05:51Yes, I had lost my phone on a bike run.
05:55Matter of fact, it happened to me twice like that, where I lost my phone, where I had to
05:58replace the phone.
05:59I didn't ignore his calls, you know, I just didn't see the calls when he, the time that
06:04he was calling, I guess.
06:05Some of the texts that you had sent him around September, October, November, December was,
06:09hey, where's my bike?
06:11Send me a photograph of my bike.
06:12I just want to see that you still have it, right?
06:15Yes, sir.
06:15Those are the texts that I saw.
06:16Are you saying you never got those texts?
06:18I can't recall if I got them.
06:20I might have got one or two that I do remember that I did see.
06:24Yeah, because then you responded to him and said that, unfortunately, you had a terrible
06:27accident with the family, but from his perspective, you're not getting back to him.
06:31Right, right.
06:31But I told him from the beginning that my time, it was real, real limited, real limited.
06:35I mean, it was, it was, it could go out.
06:37I still got bikes now that I, um...
06:39You should call those people back, by the way.
06:41No, well, they go to the house.
06:43You know, he's been to my house before.
06:44I got it, I got it.
06:46Coming up on Tribunal Justice.
06:48When did you get your phone back?
06:50I just got it back last week.
06:51I lost it again, and I go through phones, maybe two phones a month or a phone a month.
06:57I'm not kidding.
07:03Keon Sadler claims he paid Jesse Aguilar to fix his motorcycle, but Jesse never gave the
07:09bike back.
07:10Keon is suing for $10,000, the value of his bike.
07:13But Jesse says any delays are Keon's fault.
07:16He knows where the bike is, so he can come and get it.
07:20So now, Mr. Sadler, did you provide us with any expert proof showing that the value of that
07:25bike, for whatever reason, is $10,000?
07:27Uh, no.
07:29Okay.
07:29What I want to go into, though, with you is title jumping.
07:33Do you know what title jumping is?
07:35No, sir.
07:36Okay, title jumping is when you purchase a vehicle from somebody, and you never register the vehicle.
07:42You never put the bike in your name.
07:44You never insured it.
07:45And what that would allow you to do would be to sell it, and then there would be a gap
07:49in the registration, which is unlawful.
07:52It's called title jumping, because the government wants to know what motor vehicles are on the
07:56road.
07:56And most importantly, the government wants to be able to tax you.
08:00Okay.
08:00And as a result of never registering it at DMV, you can't insure a bike that's not registered.
08:04You've got to have first a bike that's registered.
08:06So you just got lucky all these times you were driving without hurting yourself or somebody
08:10else.
08:11With that in mind, I'm going to pass that to Judge Acker.
08:12Thank you, Judge Levy.
08:14Mr. Aguilar, it would be really helpful if you could point me to the communication from
08:19you to him, where you say that the bike is ready, or just come pick it up.
08:24Did I miss something?
08:24I've told him before.
08:25I mean, that's sort of word of mouth before, even when he comes out, when he came to the
08:28house, you know, like...
08:29But in response...
08:30Well, my time is limited.
08:31If I'm taking too long, you're more than welcome to come and pick the bike up.
08:35So, September 18th, he asks you, can I get a pick of my bike?
08:40I'm ready to just pick it up and have someone else do it.
08:43No response.
08:44That must have been until I lost my phone.
08:46Bro, bro, just give me my bike and my $600 of the $700 I gave you.
08:52No response.
08:53So, you went for how long without a phone?
08:55Oh, months.
08:56I mean, one time about a month.
08:58And then the second time, maybe just two weeks.
09:02When did you get your phone back?
09:03I just got it back.
09:04I just got it back.
09:05Today, right?
09:06You just got it back today.
09:07I got another phone just back last week.
09:09I lost it again.
09:10And I'll tell you, I lose my phone quite a bit when I put it in my pocket.
09:13I go through phones, maybe two phones a month or a phone a month.
09:18I'm not kidding.
09:19You may lose a phone twice a day, but that does not obviate your obligations to people
09:26who are entrusting you with their property and when you've taken money to repair that
09:31property.
09:32So, I'm going to go back to you, Mr. Sadler.
09:35Around how many times would you say you visited the defendant's location just to check on the
09:40status of your bike?
09:41I want to say over 30, 40 times.
09:4330 to 40 times?
09:45How far?
09:46I'm not even lying to you.
09:48Yes.
09:48You went to his house.
09:50I literally lived.
09:50You lived next door.
09:51I literally lived like five to ten blocks away from him.
09:55Literally lived there.
09:55So, you were basically going to his house almost all the time.
09:59Almost all the time.
10:00Just to see the bike.
10:02Just to try to check it.
10:02Because you wanted to make sure the bike was still alive and kicking.
10:04How far is it going?
10:06What does it look like?
10:07And his brother would answer the door, say that he wasn't in town.
10:12So, you know, I would wait another two or three weeks and come back and check.
10:16Did his brother ever say, you want to see yours, here it is?
10:19Nothing.
10:20Never said anything?
10:21Nothing.
10:21November 20th, you say to him, good morning, bro.
10:24I'm at the doctor's right now, but it's going.
10:26So, you were making some progress, yeah?
10:28Yeah.
10:29But then he writes you on the 20th, can I get a picture?
10:32What was your response?
10:33Or did you lose your phone again?
10:34No, I was out of town at that time, so I couldn't take the picture at that moment.
10:38So, I forgot about it when I came back home to take the picture.
10:41Okay, so, how long were you out of town?
10:44Sometimes just weekends, because I do bike runs, so.
10:47By the way, he's being remarkably patient.
10:50Like, none of these messages are, what the heck have you done?
10:54Not everything, like the way he's saying it, it's true, because it took him months to give me the parts
10:59that he needed.
11:00Then, I would expect to see a message from you that says, I can finish it up as soon as
11:05you send me the parts.
11:06Everything was verbal.
11:07Because now I have a phone.
11:08I'm only going to have a phone for two minutes, because I'm about to lose it.
11:11Everything was verbal.
11:12Not really, though, because he doesn't seem that verbal.
11:15He's writing a lot of messages.
11:17November 28th, good morning.
11:19Happy Thanksgiving.
11:21Can I get a pic of my motorcycle?
11:23One of you sent a picture of some snowman.
11:25Did you send him the snowman?
11:27That was like, happy holidays?
11:29Who said the happy holidays?
11:31I was trying to be funny, man.
11:32That's about it.
11:32So then he's just trying to be kind.
11:35And no, wait.
11:35Now, we should just say, happy new year, because now it's January 4th.
11:40How long, bro?
11:42And when he writes you on February 2nd and says, I've tried to get a hold of you to see
11:47my bike to pick it up.
11:49If I don't get it by Friday, I'm going to file a lawsuit.
11:52And that's when I told him to do what you have to do.
11:54So there were some other things that happened.
11:57Didn't he at one point tell you that he'd been raided?
11:59His home had been raided by the police?
12:01Yeah.
12:01And that's why you couldn't see the bike?
12:03Yes.
12:03He told me his house was raided.
12:05They took all the cars out of his backyard and all the bikes out the front yard.
12:10He had lost a whole bunch of property.
12:12So, you know, everything had to be set on hold until he-
12:17Did you ever tell him that?
12:17Yes.
12:18It was not a raid.
12:20It was the city that got on me.
12:22So I had to remove vehicles out of the property.
12:25Because you weren't permitted to have a bunch of cars.
12:28Yes.
12:29So it was not a raid.
12:30It was a city.
12:30You just said, I had to get rid of all the stuff.
12:32Oh, I did.
12:32What did you do with it?
12:33I got rid of it.
12:34That's why he thinks his bike isn't there.
12:36He thought the bike was dead and gone.
12:39I told him.
12:39I mean, he just-
12:40I mean, I told him before.
12:41You told him what you told him-
12:42On a text that he got-
12:43I mean, he got-
12:44What you told him was, I'm working on it, bro.
12:47I got it.
12:48I'm at the doctor.
12:49My house has been raided.
12:51Or the police have taken my things.
12:52So let's move on.
12:54We have a special witness who I would like to call to court now, please.
12:58Could I have our expert take the stand?
13:01Coming up on Tribunal Justice.
13:04Do you know the best way to cover up a stolen motorcycle?
13:09Title jumping.
13:15Keon Sadler is suing Jesse Aguilar for $10,000, the value of a motorcycle he paid Jesse to fix,
13:22but never got back.
13:24Jesse claims the bike is almost ready, and he's told Keon to get it anytime he wants.
13:30You swear to tell the truth in these matters?
13:32Yes, sir.
13:32State your name for the record, please.
13:34Parker Pittman.
13:35Sir, tell us what you do, please.
13:37I'm a professional motorcycle racer, amateur AMA national champion.
13:41I've been in the industry for about 20 years, and I am an expert probably in most bikes.
13:45Would you consider the vehicle that the plaintiff had sort of a special type of racing bike?
13:50Am I right about that?
13:51I wouldn't say it's super special.
13:53The fact that we're getting, you know, talking about a 25-year-old machine, you know, things like head gaskets
13:57going and overheating issues.
13:59How hard is it to get the parts?
14:01It's not hard.
14:02I did a quick search, you know, for parts on these types of bikes, and they're available on eBay.
14:07There's still OEM parts available, as well as, you know, you could find donor bikes for sure.
14:12Do you have any opinion as to the value of this bike after any aftermarket parts were added to it?
14:18Yeah, the aftermarket parts, they can add value to the right buyer, so if you had some part that somebody,
14:23like a plaintiff, obviously wanted.
14:25But in terms of valuing the bike outright, I'd say they're somewhere between $4,000 and $6,000, and the
14:31$6,000 would be a pristine, low-model, unmodified version.
14:35So not an uncommon bike and not hard to find the parts.
14:39Yeah.
14:39Thank you, sir.
14:40I don't have anything further, but my colleagues may, and I actually have nothing further for the moment at all.
14:44Judge Domingo?
14:45We actually do have a video which we can show and might help you in some way make a judgment
14:50as to the value of this bike.
14:52Is it clean?
14:53Is it...
14:54The frame's polished well.
14:56It looks good.
14:57It's missing, obviously, all the fairings.
14:59Can that bike be driven, ridden, started?
15:01Not in this state.
15:02It's got the tank off.
15:04It's got everything off.
15:05All right.
15:05So you can have a seat now.
15:07You see, you were playing him.
15:10You were playing him for almost a year.
15:13And for you to stand here and tell us that because you didn't have your phone is an outrage.
15:19And you, your name should be gullible.
15:21A million messages, the most absurd excuses that a person can come up with.
15:26I mean, some of them are true, maybe.
15:27I mean, I don't know about his brother for real, but his brother's in the hospital.
15:31He's visiting his brother.
15:32The city's after him.
15:33He's going to pick up a tool.
15:35I'll get back to you.
15:36You don't hear from him.
15:37Again, how was everything going with the bike?
15:39This is another week later.
15:41What are you going to be doing?
15:43I mean, on and on.
15:45Every page here is you saying, wow, when it rains, it pours, you tell him.
15:50Because now he tells you the city's coming after things.
15:53No.
15:54When it rains excuses, it's pouring lies.
15:56And then the next one we have, it's three weeks since that.
16:00I need the bike or I'm going to lose my house.
16:02I need it.
16:03He goes, just ready to ride.
16:05It's been a year.
16:06But I don't understand.
16:07You're going to be ready.
16:08I mean, found all the paperwork.
16:10A year's gone by.
16:12My all-time favorite is, I'm just putting some oil in it and I'm going to start it up.
16:19That motorcycle could never be started.
16:21How do you know that?
16:22You didn't know that?
16:23He just said it.
16:24He's the expert.
16:25There's no parts on it.
16:27Come on.
16:28What do you see that you can't ride on that thing?
16:29Well, just besides the cover on it.
16:33Sir, you're telling him that he can't start the bike up.
16:37And then two days go by and you didn't start it.
16:40And he's once again, when are you going to start it?
16:42Can I see a picture of it?
16:43I'm feeling like you're dodging me.
16:45What do you mean you're feeling like he's dodging you?
16:47He was dodging you.
16:49And by the way, do you know the best way to cover up a stolen motorcycle?
16:55Title jumping.
16:56So when you buy it, the last notation on the Carfax, and what we have under here by the little
17:03Carfax guy,
17:05is says, hmm, we haven't received any information on this since May 2014.
17:11Before you buy, ask the seller for recent service or repair records.
17:15You got nothing.
17:16How do you know that you didn't buy a stolen motorcycle?
17:20Since 2014, this motorcycle has been off the charts.
17:24Could you step up, please?
17:25What would be a way to cover up a stolen motorcycle?
17:28I mean, what would be the odds that somebody would do this title jumping and sell a vehicle that was
17:32not registered for 11 years?
17:34To be honest, I'm not an expert in stealing bikes, but it does seem a little shady.
17:39But it's not uncommon, especially for a bike that old.
17:42He mentioned that it's been down.
17:43So if a bike gets crashed and gets put in somebody's garage for a long time,
17:47I've bought bikes with titles that have been messed with since 2014 to 2015.
17:52And you still have the bike today, you say?
17:54You could take it.
17:55So let me ask you, because you've asked for the money or the bike.
17:58I mean, it's pretty clear your bike's not worth $10,000.
18:00So would you prefer the bike over the money?
18:03Well, since the times have gone by, I could use the money to do something else now.
18:09But, yeah, I really wanted my bike.
18:11Okay, thank you.
18:12At this point, we're going to retire to deliberate.
18:14Court is now.
18:15Recess parties will be called.
18:25Listen, I don't blame the plaintiff for coming in and filing a lawsuit against the defendant.
18:29The defendant gave him absolutely no reason to believe that he had the bike,
18:33that he was ghosting him for all those times, all those text messages,
18:36all those nonsense excuses was just that.
18:39It was nonsense.
18:40Having said that, the plaintiff was a little shady on his numbers.
18:45He's suing for $10,000, but what he really paid the owner was only $4,500.
18:50He was playing fast and loose with the numbers.
18:52And we've been known to dismiss claims outright for that reason.
18:55I'm not suggesting we do that here.
18:57This was a bailment.
18:59The defendant still has his property.
19:01And I believe that the just verdict in this case would be to direct the defendant to return the motorcycle
19:06within 10 days.
19:08Period.
19:09I lost my phone.
19:10I can't hear you.
19:12Yes.
19:13I am not sure I believe that the defendant really still has the bike.
19:17Because he testified that at some point the city ordered him to remove all of these vehicles.
19:21Where did they go?
19:22With respect to your concern, Tanya, I get it because of the issue with the raid.
19:26The motorcycle was in the garage, at least according to the defendant.
19:29It was in his garage.
19:30It wasn't on the lawn.
19:31And we can put in the order that he has 10 days to arrange for the return of the vehicle.
19:37And if the defendant does not return the vehicle, then the plaintiff has his options of refiling with our court.
19:44And then we can address that at that time.
19:46I like your framing.
19:47I would support that.
19:48Right.
19:48He's going to put the bike back together as the defendant told the plaintiff it was in when all he
19:52had to do was put oil in it.
19:53Oil and start it.
19:54And start it.
19:55And that's it.
19:56And if the plaintiff doesn't receive the bike in that condition, then he can refile.
20:01So let's make it two weeks.
20:03Two weeks.
20:04Because you know how he goes away on the weekends.
20:06And you might lose his phone.
20:08Sound good?
20:09Yeah.
20:14The court is back in session.
20:15Both parties are reminded that you are still under oath.
20:18Thank you, Cassandra.
20:19We have deliberated and we have reached a unanimous verdict.
20:23Okay, Mr. Sadler, as far as we're concerned, the cost of the bike was $4,500, not the 10 that
20:28you were looking for,
20:29the 55 that you put into your complaint, or the 5 that you told me.
20:32We accept your word that you dropped it off at the defendant's.
20:35The defendant said he was going to fix it.
20:37And he still has the bike.
20:38So it is the judgment of this court that within two weeks from today, we're going to get an order
20:44signed today by me.
20:46That order is going to direct you, sir, to provide the plaintiff with the bike in the condition that it
20:52was in,
20:53that is all together with all the new parts, bike ready to drive, within two weeks of today.
21:00Is that fair?
21:01Just fair.
21:02No problem with that?
21:04No, I don't have a problem with that.
21:05It did not seem like it was going to be necessary for you to find a police officer to go
21:09with you.
21:09You respect him.
21:11He respects you.
21:12That there was a miscommunication.
21:13We had lots of lost phones.
21:15Get Velcro.
21:16Stick your phone to yourself.
21:17If for whatever reason something goes wrong after that two weeks, you will be permitted to refile with this court.
21:24And we will be seeing him again.
21:26Fair?
21:27Yes, sir.
21:28Fair?
21:28Fair enough.
21:29That is the judgment of the court.
21:30Thank you both.
21:33This case has concluded.
21:34All parties are excused.
21:39I'm good with it.
21:41He really wasn't nowhere even trying to put it together.
21:45Yeah, just get it out of the way.
21:46Hopefully he gets it fixed and gets it running good so that way I can get back on the road.
21:51I'll be able to get it going.
21:52I'll be able to get it going.
21:53I'm just ready to ride.
