00:14Being a homicide detective in the city of New Orleans, a stressful day at work, could
00:20mean having seen things that 99% of the population has never seen and will never see.
00:329-1-1, what's going on from the emergency?
00:35There's a man shot by Chapatula.
00:38And like, I think that's Andrew.

00:43Yeah.
00:44He's laying on the ground.

00:48They're going to send somebody.
00:50We have units on our way.

00:54All right, we're going to cut this traffic off and send it down that way.

00:58So, when I get EMS to the intersection of Chapatula's and Andrew, we have one victim
01:03down.
01:04Person, gunshot.
01:06Couple to the body, one to the head.
01:09Hey, guys.
01:10There's lots of y'all stepping, all right?
01:11They got cases everywhere.
01:13They got enough men right here.
01:15You know, it's probably homicide.
01:28The only information I have is a black male who was shot, about six caissons on the scene.
01:35And, um, SUV apparently fled from the scene.
01:39A dark gray GMC Yukon just got information that the same SUV may have crashed somewhere in New Orleans East.
01:49This is the, uh, warehouse district.
01:51It's kind of mixed residential apartments and businesses.
01:55It's right outside of the French Quarter of, uh, New Orleans.
02:04As I'm walking into the crime scene, I notice immediately that there's just a large number of people in the
02:10area.
02:11It was the last night of Essence Festival.
02:13A three-day festival every year that we have around 4th of July brings in a lot of visitors to
02:19the city.
02:21In this case, the first responding officers were working in detail, literally within probably a hundred yards of where the
02:27homicide occurred.
02:30What do we have?
02:33We got one body?
02:34Yeah, one body.
02:35Okay.
02:38We had a deceased male on the scene.
02:42There's a lot of people there, but nobody wanted to come forward with what they possibly saw related to the
02:49actual homicide.
02:51So I knew that I was going to be relying on video surveillance evidence in the area.
02:56Ugly Dog has cameras.
02:58See, they have a camera right there on the side.
03:01All of the cases are over there by that Nissan, by the Ugly Dog.
03:06So I think he probably got shot over there and ran over this way.
03:09Yeah, okay.
03:14It looks like the cameras were pointed in the direction where the murder took place.
03:18Unfortunately, the Ugly Dog is closed at this time, so I have to come back tomorrow.
03:23Any idea who the victim is yet?
03:26This is a guy named DeMond.

03:33DeMond Foley is 36 years old.
03:35He's self-employed.
03:37He was out enjoying Essence Fest, but instead he was shot and killed.

04:03They all appear to be the same caliber.

04:18There was a handgun that was in very close proximity to the victim.
04:23At this point, I'm not sure if that belonged to the victim or the perpetrator.

04:49The magazine in that gun was at full capacity, and there is a live round in the chamber.
04:57The gun is a .40 caliber, but the spin cases that are on the crime scene, they're non-millimeter.
05:04It's likely at this point that I'm looking for another gun.
05:07The deputy that was blocking the street right there, he said he heard a sick shot.
05:13He waited a few minutes.
05:15There was nobody around, but he saw the door color and SUV, the Yukon, come from this way and took
05:21the shot straight right there to Washington.

05:24Did he see the shots coming from the Yukon?
05:26No.
05:27No, he just heard the shot?
05:28He said there was nobody out here.

05:31The GMC Yukon Denali was seen fleeing the crime scene by sheriff's deputies.
05:36The tires were screeching.
05:38That's a little suspicious, so we want to know more about that vehicle.

05:44I contacted the RTCC and they gave me video for the Denali.
05:50And the vehicle was in this area at the time of the homicide.

05:58So, um, they have people over there.
06:00They want to know if the victim is somebody named Penny.

06:05And I was asking them to describe Penny.
06:07And they showed me a picture of him.
06:09I said, what kind of car are you driving?
06:11They said, well, you drive a Denali.
06:13Mm.
06:15Detective Smith was approached by someone at the crime scene who is concerned with whether or not Penny is the
06:24deceased victim.
06:26I go over to speak to the gentleman.
06:29How you doing, man?

06:30I'm Detective Ball.

06:33You?
06:34Okay.
06:35What brought you out here?
06:36I was asleep.
06:37I just got a phone card and they said that they saw him on Instagram.
06:41He was at the drug.
06:41Is he here?
06:42And they said that they thought that this was him.
06:45Okay.
06:45What does he look like?
06:47Was that a recent picture?
06:49Yeah.

06:50About three weeks.
06:53The gentleman shows me a photograph of Penny.
06:57It's not the deceased individual that's on the ground.
07:00But I can't tell him that because I still want to get as much information as I can.
07:06I then asked what Penny's real name is.
07:09Um, and he tells me it's Alfred Pennington.
07:13Alfred Pennington?
07:14Yeah.
07:15What kind of color does it drive?
07:17Um, Yukon Denali.
07:19What color is it?
07:20Um, you know, I got like really dark blue.
07:24Hang tight.
07:25I'm gonna come talk to you in a minute.

07:27He tells me someone named Alfred Pennington drives a dark color GMC Yukon.
07:33That matched the description of the vehicle scene fleeing the homicide scene.
07:39So, um, the RTCC gave me a plate on the vehicle.
07:42It is, um, a Texas plate.
07:45Oh, that's who it's registered to?
07:47Yeah, they call him.
07:47They call him to Pennington.
07:49They call him Penny.
07:50So this is who the car registered to.
07:52Detective Smith confirmed with us that the registered owner of the GMC Yukon was in fact Alfred Pennington.
08:00So he became a person of interest.
08:03I wanted to ease.
08:05All right.
08:11We got information that dark colored SUV, a Yukon, fled the scene at a high rate of speed heading towards
08:19the interstate.
08:21And in New Orleans East, right after this shooting, there is a dark colored SUV with the same plate on
08:28it that crashed.
08:30So we're gonna be heading out there right now.
08:42What did they get?
08:43I mean, it looks like the tire just blew out, but I mean, they probably hit something at some point.
08:47The outside of it's all chewed up.

08:54I pulled up on it.
08:55This is exactly what I saw.
09:00That license plate matched the license plate on the vehicle that was fleeing the scene.
09:05It belongs to Alfred Pennington.
09:08So at this point, I do have enough probable cause for a search warrant for that vehicle.

09:38In processing the vehicle, my goal was to find any evidence that's related to the crime scene, like a gun
09:46and any identifying evidence on who was inside the vehicle.
10:01if you could take the phone for sure and let's do dna exterior and interior door handles dna
10:12what i need at this point is a gun that i can link to the shell casings found at the
10:17crime scene
10:25no gun
10:30so far i've got really no evidence that alfred was actually in here

10:39at this point i still need to determine who was in that vehicle at the time the homicide occurred
10:44whether they were the driver or passenger okie dokie thank you much i appreciate it
10:51i need to find the murder weapon and i need to find video that captures the murder without
10:56any of that i'm at a dead end
11:27at this point i still need to determine who was in that vehicle at the time the offense occurred
11:33so we're heading to the ugly dog saloon which is a business that's located just outside of where the
11:40homicide occurred they supposedly have video of the entire offense so i'm anxious to see that video
11:52i am born and raised in the city of new orleans back in 1985 my grandfather was unfortunately murdered
12:01it was an armed robbery and since i was a child i've grown up wanting to be a policeman specifically
12:09homicide i was motivated by his case and i have had as long as i can remember a sense of
12:17wanting to
12:17just do my part in solving crime

12:31you have the video from the camera that's right there have you seen it yet uh-huh okay so i'm
12:37looking for a gray yukon denali that fled supposedly
12:44oh god this is a good video that's the denali huh yeah that's that's the yukon yeah
13:07the video recording from ugly dog it is from a little bit of a distance
13:13in terms of being able to identify the shooter
13:18but i can hear the gunshot and the victim is seen running away and the shooter is
13:24seen chasing after the victim continuing to shoot as the victim eventually collapsed across the street
13:30i don't know at this point that the shooter is alfred pennington for sure
13:36but i do see the shooter get into the driver's side of the dark gray gmc yukon and flee
13:44having this video is great for the first time i'm able to see exactly what occurred what i need
13:49at this point is to be able to identify who that shooter is and who it was that was operating
13:54that gmc yukon
13:56that's the one angle okay and then i had the other one from behind looking down annunciation sweet
14:06so there's the suv right there that's the shooter come across the street then get in his suv okay
14:18here's the victim coming huh yeah right walking right there
14:23it goes around the front it goes around the front that is great video

14:38and then they're in between the two cars
14:50it looks like he had a distinct logo or emblem or something on his shirt front and back
14:57you see his shirt you're right he did hear something yeah
15:02so what i'm thinking i'm gonna go back here and try to pull video him walking
15:05and see if i can get him his face but yeah that's great
15:15the video is pretty cut and dry it definitely put everything into perspective
15:21there's still many unanswered questions at this point what occurred in front of the yukon was there
15:27a physical altercation was there a threat we collected a gun at the crime scene did the deceased
15:34victim pull the handgun out and pointed at him all i know about the gun is that it was stolen
15:39about
15:39a year ago that doesn't really tell us much the shooter he's got a pretty distinct shirt it's got
15:46some kind of logo on the front and back of it so i have a reference point on what to
15:51look for
15:52and hopefully we get a good image of his face
16:14there's a man that just got shot and he is on the ground he's on the street on the side

16:20the way is this car it looks like he can't die oh my god

17:53i get a call from fifth district
17:56they're saying that they're working a shooting the two victims have been transported to the hospital
18:02one of them was shot in the hip but he's expected to survive his injuries the other was shot in
18:08the
18:09chest area and he passed away due to his injuries his name is stanley williams but to friends and family
18:17he's known he's known as duty he was in his 40s he's from new orleans he grew up in this
18:23area
18:31once i walk through the tape i'm able to see that there's our crime scene units
18:36they're starting to cone certain things in the street some casings that are on the sidewalk
18:43i noticed that most of the scene seems to be around a jeep that's parked in the middle of the
18:47block
18:47it clearly has some kind of bullet damage to it on the driver's side and its windows are
18:53shattered out on the passenger side there was a witness who was on scene detective
18:59walt vedman is going to talk to the witness and see what we can find out about who did this
19:06so what do we have on scene we got this is like the surviving victims clothes we got six 40
19:14caliber
19:14shell casings all over here oh walt said the witness says the shooter is a guy named dino
19:21and he came over here and started arguing about some video the victim took of him
19:27on the victim's phone or something like that and then dino started shooting on them
19:33our witness was able to tell us that my decedent stanley was sitting on the passenger side in the
19:39jeep there was some kind of argument happening between stanley and shooter standing on the passenger
19:46side of the car about some kind of video the witness started hearing gunshots he saw stanley was shot
19:54and the driver was also shot and he said dino did it
20:01he didn't know dino's real name but he knew dino lives in the area so this is dino's address is
20:09supposedly this and that came from walt this came from walt who got it from the witness
20:17so i'm raising sod okay get the house surrounded and if we can get a warrant for the house okay
20:22boom
20:25dino supposedly lives right around the corner a couple houses down from where we're all standing
20:31now that we know where dino lives we need to get a search warrant and now we're calling the swat
20:36team
20:50so hey lou uh it's donnie williard over homicide how you doing hey um so listen so we got a

20:57here we're still like wrapping up the actual original crime scene typing up a warrant very
21:04quickly on this house and seeing if sod can assist with executing the the warrant i'm working just
21:11some intel real quick seeing if we can just figure out who the perp is we might be hitting an
21:16empty
21:17house though is possible um type in your risk assessment your search warrant and when you get
21:23that send it to me all right sounds good once the witness told us where you know lived at i
21:30began
21:30researching the address trying to see if i could find out checking our databases who lives there all
21:37right well this is interesting we got a devon green 36 years old all right so i pulled up the
21:48address
21:49and i got a hit for a devon green who is 36 years old life-skinned black male he's five
21:56foot seven
21:57which is exactly the description we got from the witness but at the very least even if we hit the
22:03house and it comes up blank we can show a lineup yeah
22:42so positive id on our perp hey lou uh just got a positive id from it is gonna be devon
22:55green
22:57it's minutes before the briefing i just got the call that my witness actually picked out
23:03devon green in the lineup confirming that dino is devon green this is my suspect
23:12i get a search warrant for devon's house all right what's going on guys good evening
23:18thank you all for coming i know y'all uh were activated kind of last minute uh so earlier today
23:23around 2 p.m two victims were shot one fatal one non-fatal we were able to identify the perpetrator
23:30as devon green actually knew where the perp lived we don't know if he's inside appreciate y'all being
23:37here and if there's anything else we want to get into this house as soon as possible because the last
23:44thing that we want is for my possible suspect to go back to the house and start cleaning things up
23:50getting rid of evidence getting rid of any guns the more time that goes on the more evidence that we
23:57are at risk of losing all right i guess we'll follow the train out of here

25:20so right now he might he might be inside because they're still calling his name yeah which they
25:26would do if it's been locked just take this half seconds and no one drives up on us
25:50we have devon green's house surrounded and somebody just started shooting from inside
25:57i don't know if any of our guys are hit we're calling for as many units as possible to respond
26:02to the area get a perimeter around the location right now it's a standoff this is a tense moment
26:10waiting to see what's going to happen next but our swat guys are going to do everything they can
26:16to make sure that we come to a peaceful resolution
26:29good morning everyone this is a update involving an officer-involved shooting that occurred on october
26:36around seven o'clock at night this incident took place during the service of a high-risk
26:43warrant related to a homicide that had occurred earlier in the day that homicide suspect was a 36
26:51year old man by the name of devon green mr green fired at the officer from inside the residence and
27:01this resulted in our officers returning fire after a nine hour standoff mr green finally surrendered
27:12and was taken into custody and the exchange of fire no one was struck and therefore there were no injuries
27:31the smoke is practically still settling it's surreal
27:36i can't believe the number of rounds that were being fired that nobody got hurt i'm grateful nobody
27:44wants to see anybody get hurt we want the criminal justice system to hold people accountable
27:49i can finally breathe some relief now that devon is in custody and our guys are okay
27:57we did the search warrant inside the house and there was two guns a rifle and a pistol the pistol

28:07the caliber of casings that we had on the scene of the homicide
28:13now i want to see if i can get a statement from devon i still need to be able to
28:18prove that devon's the
28:19one who killed stanley williams yeah so he's at the hospital so we'll see what he says

31:07camera ain't gonna catch it no but what this does it gives me his face yeah
31:17it is a very aha moment for me this place is alfred pennington at the crime scene at the time
31:24the
31:24offense took place so at this point i do have enough probable cause for an arrest warrant and i'm confident
31:30that a judge will sign it but i still have a lot of unanswered questions what occurred in front of
31:36that gmc yukon why did alfred pennington allegedly shoot demond hopefully i am able to find alfred
31:46pennington and get answers to all these questions that we have
32:17i just talked to dino aka devin green after devin surrendered he started saying i had an old groin
32:26injury and and it's aggravated right now so i want to get checked out of the hospital
32:31and so it was there that i interviewed him
32:35devin ends up telling me that devin owed stanley money
32:40and stanley had told devin he was going to get back at him for this money owed and stanley was
32:46sharing a video
32:48that depicted devin in a a light that devin didn't want other people to see him in
32:55and so devin felt his manhood had been disrespected and devin said that's why he did it he even went
33:03as far to say that the second person who was in the driver's seat was nothing more than collateral damage
33:12so right now we're uh pulling back up in the area where the homicide happened
33:19i still want to get as much evidence as possible
33:23gonna walk up the block and just see if there's any other cameras ring doorbells or anything that might
33:28give us an actual look at what happened
33:54i secured an arrest warrant for alfred pennington for the murder of demond foley i received a phone call
34:00from alfred pennington's attorney who expressed that alfred wanted to turn himself in he was aware
34:06that he did have an arrest warrant out for him and he came in with two attorneys
34:12now i have a lot of questions the obvious question of what occurred in front of that gmc yukon
34:20that he needed to possibly shoot demond foley
34:24okay you do have a warrant for your arrest um the warrant is for a second of your murder
34:30it's an incident that happened july 8 in the evening why don't you tell me what happened
34:37i came down friday
34:41to go to the festival i don't live here i live in houston
34:48i just was out trying to have a good time so i went in the club and i walked in
34:56somebody pulled
34:57my shirt i turned around and i saw who it was and it's just god that i don't know what
35:05i even associate
35:06with it's just like what's up and i'm like i'm chilling man i live in texas now you know i'm
35:13not into
35:14none of that footage just no more and as i walked off he pushed me and said you're a
35:21you're gonna die tonight and i immediately tried to exit in alfred's statement he tells us that
35:30he felt threatened by demond and demond told him that he was gonna die tonight and decided to leave
35:36the club which is consistent with what we see so far in the video that alfred leaves
35:44and then demond follows behind him towards his vehicle
35:50when i sat down in my car as i took a breath
35:57he was grabbing at my door like grabbing at my door like yeah let me in this bitch let me
36:07in this
36:07bitch yeah he saw he couldn't get around and he just like yeah told you gonna die
36:14bitch i'm about to i'm about to kill you i'm about to take this bitch and i got out when
36:22he was ramming
36:23up when you're ramming on the door like instinctively because i'm just thinking about to start shooting
36:28in the door i don't know what you're about to do but i don't know i'm just scared i'm just
36:34scared
36:39and he just came and got up on me
36:44and he was reaching for the guy i'm just having it off one second but even i didn't even get
36:51to grab it
36:52and it just was so quick and i just i just shot
37:02i just started shooting and when i started shooting
37:14in his statement alfred pennington admitted that he did shoot demond fully
37:19he said demond pulled a gun and alfred felt threatened eventually the mom started running
37:27away and he continued to fire his handgun at him
37:31i was just scared and i just got back in my car
37:36and i just knocked down and just put the gas on like uh but i got a few blocks out
37:43and i just
37:44i just drove like i just drove like that's what happened
37:54he's obviously emotional right about everything um i don't want him answering a lot of questions
38:02with him and his face but i want we know the ones are we out there and we want you
38:06to know the truth
38:07because obviously the investigation keeps going um i want you to get inside the story that's effectively
38:13everything you know he's under arrest then right of course i was hoping to clear this up
38:20i have questions for you and i can't ask them because your attorney doesn't want me to ask them
38:23for you so the only way for me to clear it up is to ask my questions that's it there's
38:27a lot
38:27of holes that i need to build for my investigation so um without that you will go to jail

38:40do you turn the gun into you it's evidence i don't have to go no okay i don't have another

38:53the fact that i'm able to make an arrest for alfred pennington related to the homicide
38:58damon foley is great damon his family are victims as well because they're the ones that are left
39:07suffering from the loss of their loved one so it gives me satisfaction that i'm giving closure to
