02:39This crime scene is in an area of town that's very diverse.
02:43It's rich in Hispanic and Vietnamese culture.
02:47They have their own businesses.
02:49It's on the edges of New Orleans, really.
02:52Everything past this area is, like, swampland.
02:54It's a very tight-knit community where they all seem to know each other
02:58and try to help each other out.
03:02When I arrive on the crime scene, there are certain things I'm looking for right away.
03:08Shell casings, blood on the scene, video surveillance cameras.
03:14Because in this particular case, there's businesses that have video surveillance cameras
03:19pointing towards the parking lot where all this happened.
03:23So this video, these cameras is what caught it, I'm assuming?
03:27Um, that video right there.

03:35So, from what I'm told, from witnesses, they speak Spanish.

03:42They were out here selling food.

03:45And two guys start circling them.
03:47They think that they're possibly going to rob them for their food based on their behavior

03:55The victim is allegedly part of the people who are here selling the food

04:56Detective Maurice Stewart tells me that after speaking with the officers on scene and some witnesses,
05:01the deceased victim was in some kind of shootout with these teenagers who evidently shot back at him and struck
05:10him, which led to his death.
05:13My victim, his name is David Cano, and he's 46 years old.
05:19He's a citizen from Honduras, and he's here just trying to make money for his family to send it back
05:25home to help support the people he loves.
05:29So, I picked up four shell cases from in between those two vehicles right here.
05:35So, it looked like they were possibly standing over there.
05:38The decedent was standing over here.
05:40That a polyp loading that we picked up, and that's it, no casing.

05:44There's a revolver that's unaccounted for.

09:10They told everybody around them, including the guy who was killed, like, are they trying
09:16to rob us or something?
09:17The guy who got shot told them, like, hey, y'all, leave them alone.
09:21So two African-American males came to the side over here.

09:36So I have two very different versions of events.
09:40One witness said the victim, David Cano, fired that first warning shot.
09:45And the other witness said these two teenagers fired first.
09:50I really need to find out who these teenagers are and get their side of the story.
09:54But I'm also trying to figure out, is this a murder case or is this a case of self-defense?
10:00No one is saying these teenagers are robbing us.
10:03It was more of they felt like they might get robbed.

12:14And hopefully he gives us a detailed account of what he saw.

12:41And I saw a teenage.
12:43They came up to her.
12:44And I asked her what she was selling.
12:46And I actually noticed.
12:48The one in the room, I was holding something.

12:55The other guy, the one with the yellow hoodie, he said, no, I'm not here, so he just left.
13:01And that's how they came back.
13:03So, the guy that got shot, he's always there, most of the time drinking.
13:09He was carrying a weapon.
13:10I had a feeling it took over.
13:13So, for the time he shot it, it was up in the sky, trying to scare them off.
13:17Because the guy was still not letting go of the tracks.

13:21The two teenagers ran.
13:22But the other guy is still shooting at him.
13:24I don't know if he's still shot up in the sky or shot him straight.
13:27I was looking at the teenage.
13:29That's why he's definitely hurting.

13:32And when they got behind the red car that's all damaged, that's when they started shooting.

13:37Do you think you were trying to rob y'all or something?

13:41The witness let us know that basically the teenagers were loitering in the area and kind of making
13:47everyone feel uncomfortable.
13:48He could see the firearm in their waistband.
13:51And they thought that there was a possibility that the teenagers were trying to rob them.
13:56David Cano shot a round into the air to scare the teenagers away.
14:00And the teenagers started to run away.
14:03And then David Cano fired another round.
14:06Then the teenagers who were running away started to return fire.
14:10So why do you believe the guy shot in the air?
14:14He's always the threat.
14:16We have experiences like this before.
14:18Like four more times that we have brought.
14:21Have you seen them before?
14:22Those two kids?

14:24Do you see where they went?

14:32David Cano might have been the aggressor in this situation or maybe escalated a little too far.
14:38It just shifts my focus a little bit about what actually happened.
14:43So if they went back the way you said they went, there's cameras over there.

15:50We see the two teenagers, one in the red hoodie, one in the tan hoodie.
15:55And you see the victim, David, gets out of the driver's seat.
16:04And then a few minutes later, you can hear that first shot.
16:11And then you see the two guys running away basically, being scared off.
16:17And then you see the decedent follow them.
16:23And it looks like the decedent shoots in their direction and actually hits this car window.
16:30You saw that.
16:37And then the guy in the red shoots back.
16:43And then the guy in the red shoots back.
16:54Next to the white truck.
16:57The two teenagers who are being shot at run this way.
17:03So, we're trying to get a better angle to just see what kind of, like, maybe where they went.

17:09I mean, there's an RTCC camera down there.
17:12So, we might go there and just see what video we can get.
17:15Obviously, we need to find them to get their statements.

17:29Looking at the video, I mean, it's pretty clear the decedent did more than just shoot in the air.
17:35Like, you can clearly see he shoots at them and you see the glass break.

17:42And the guy that shot back at them almost got hit.

17:46Well, you have a unique case because in Louisiana, it's a stay in your ground state.
17:52So, when you're being fired upon, you can shoot back in self-defense.

17:58In Louisiana, we have a stay in your ground law, which is basically you don't have the duty to retreat
18:05in a lethal force situation.
18:08I'm going to investigate this incident the same regardless if it's a self-defense case or if it's a homicide.
18:15Someone lost their life.
18:16So, I'm going to get to the bottom of it.

20:16be on the lookout flyer to the department to say, hey, has anyone recognized these kids?

20:23But before that, I arrive at the real-time crime center to check the cameras there.
20:30I get the video surveillance from the camera on the street that my witness said the teenagers ran back to
20:39after the homicide occurred.
20:43I see the two teenagers still wearing the same clothing right after the shooting and see them running away and
20:51turn the corner towards Peltier Drive.
20:55This is great.
20:56Now we know the direction where they went after the homicide.

21:10So, after the shooting, the two suspects take a right on Peltier and they keep going.
21:16Which is the first street after the bridge.

21:18And if you keep going down that road, you hit a large apartment complex back there.

21:23So, the cameras for that apartment complex, they're really good.
21:26I've used them in the past.
21:28They, like, move and they follow motion.
21:30So, you might be able to find out, if they do go back there, what actual apartment that they will
21:36stay at.

24:55any kind of statement to us.

25:04Justifiable homicides, they do happen, but they're not super common.
25:08Like, out of 40 cases, maybe two or three have been justifiable.
25:13There's a fine line in self-defense.
25:15And if anyone needs to be held responsible for David's death, we're gonna find out the truth.

25:42This is a camera located on a building closest to Alcy Foucher, the street where the shooting
25:48happened down there to the left.
25:51This is before the shooting.
25:54Basically, this camera turns, like, every 10, 15 seconds, and it tracks motion as well.

26:08You can't see their faces.
26:12Looking at the footage, we know it's them based on their clothing.
26:16From the store and from witness statements, they're wearing the exact same clothing.
26:23Okay, so they go into this driveway, see them get off the bike, put it right in this driveway
26:29by this fourplex.
26:31This is before they go to the store, so now they're walking on foot, and the shooting
26:35and the stores and all that are over there to the left.
26:38So, one of them probably lives in that fourplex.
26:42So, I think the approach today is to go find that location.
26:46Knock on all four doors and see what we can find.
26:49Hopefully get lucky and it's our suspects.
27:06So, this article came out.
27:09A woman asked for help after two shootings in three days in her neighborhood.
27:14Oh, wow.
27:16I'm an organizer.

27:20And her name is Christiana, and she held a vigil for David Cano on Friday night.
27:29At this point, we haven't been able to find David's family members to inform them of what happened.
27:35But Miles found out that someone had held a vigil for him, who acts kind of as a community liaison

27:47It says she's working to raise money for Cano's family to send his body back to his mother in Honduras
27:54for a proper burial.

31:25And from talking to witnesses, it seems like David chose to put the law in his own hands.
31:33Ultimately, we don't like citizens doing that because now situations like this happen.

36:23his friend had told him that he had shot back
36:27at the individual.
36:28I asked him why he never contacted the police.
36:31He said he was scared and he didn't believe he did anything wrong
36:35because he just ran away.
36:37What did your friend say?
36:40Mm, I heard the news.
36:42That was my first time hanging.
36:45And after that, I've never seen him again.

38:43I ultimately get an arrest warrant for the 15-year-old.
38:46I charge him with obstruction of justice
38:48and juvenile in possession of a handgun.
38:50I know he had a firearm.
38:53And after he shot David,
38:55he left the crime scene
38:56with the pistol that he used to shoot him,
38:58which is obstruction of justice
39:00for removing evidence from a crime scene.
39:26The juvenile suspect is found outside of our parish.
39:30I attempt to speak with him with his family member present,
39:36but he and his mother refused to give me a statement.
39:40He was then booked
39:42and eventually brought into juvenile custody.
39:47Ultimately, even though this appears to be
39:50a case of self-defense,
39:52it was a juvenile in possession of an illegal firearm.
39:54So he's arrested in connection with David's death.

40:32Christina, the person who organized the vigil for David Cano,
40:39she acts as a community liaison for the Hispanic community
40:43out in this area of town.
40:45I talked to his mother.
40:47I think she's being very strong.

40:50Because it's the only son she had here in the U.S.,
40:52so it's the only hope that she had for any, like, support
40:55or anything that she had back there was him.
40:59I think for a lot of her prayers, the miracle happened
41:00that we were able to raise so quickly the money
41:02to be able to send him back home, you know.

41:09He was a very good guy.
41:11He was very, very humble.
41:14He doesn't have family here.
41:15He doesn't have a wife.
41:16He was a baker.
41:17Like, he worked in a Dong Phong Baker for over 10 years.
41:21At the Vietnamese store, he'll be the one
41:23taking out their trash from him.
41:24He really loved the people that sold food all there.
41:27Like, that was his spot.
41:28You know, and it was just, like, pretty much,
41:30I really think he just felt like he was the protector.
41:34There's a lot of community members right now
41:36that feel unsafe.
41:38And they're getting guns that are not registered
41:41and things like that.
41:42What I explained to them is that
41:44that gun will not always be what saves your lives.
41:47Yeah.
41:47Because even if you shoot one of them,
41:50they could come back and retaliate.
41:51Yeah.
41:52They might do more harm than good.
41:54I'm going to be always to protect my community.
41:57And the best way that I can is to make sure
41:59that y'all have every information that y'all need.

42:07with video surveillance evidence and other things.
42:10We are at the mercy, a lot of times,
42:13of the community and the people involved
42:15to tell us what it is that they know
