00:43when a man ran up and said he'd just found a body in the woods.

01:03He's down in this little camp, man.
01:06And discover a man lying in a tent within a small patch of woods.
01:11There's a lot of blood.
01:14Shot dead.
01:23Got a call about a suspicious death over in the area of 11th Garnet.
01:27Detective Vernon McNeil will lead the case.
01:31It's a mix of hotels and businesses,
01:33but you have a large transient population out there.
01:36A lot of them live in camps in the woods surrounding the intersection.
01:41A lot of times what they'll do is get room at one of the hotels,
01:44and that gives them a place to shower and clean up.
01:48The victim was found deceased in a tent.
01:51So that's where we're going to head to.
02:09He's next to a tent.

02:19David Drywater.
02:2442-year-old David Drywater was born in Claremore, Oklahoma, and raised in Tulsa.
02:32The oldest of eight children, David was a member of the Cherokee Nation and worked as a day laborer.
02:39He leaves behind his mother, three daughters, and three sons.
02:48He's got facial trauma.
02:51It's hard to see for sure.
02:54It looks like a gunshot wound inside the mouth of me.

04:01The other witness is the man who discovered David's body.
04:13The man told officers that he saw someone in the camp point a gun at Daniel yesterday.

05:46He says he's friends with the other witness, Daniel, who lives in the camp where David was found.

05:56And that earlier that night, he spoke to Daniel outside a nearby business.
06:01I said, you know, I'm going to go down to camp for about 10 minutes of his school.

06:06And as soon as I got down there, I see that guy in that tent.

06:22I started saying someone needs to call an ambulance.
06:25He says he ran back and got Daniel.
06:28He went down there to the camp and he came right back out.

06:33There was a car wash going on in that parking lot of our bodies in the taco truck.
06:37And when I asked the guy in the taco truck, I said, will you call number one?
06:41He says the owner of the taco truck called 9-1-1.
06:45And he went and looked at the body.

11:01The witness says Todd's last name is Hibner.
11:06But at the same time, I don't know that Todd frequents that play.

12:21Todd Hibner was detained, referencing a flare gun incident last year.
12:26This is some of the body cam footage of that incident.
12:29And this is Todd Hibner.
12:3155-year-old Todd Hibner was born in Wichita, Kansas, and moved to Broken Arrow, Oklahoma as a child.
12:39He's an independent fence contractor, and he has two adult sons and a daughter.
12:46Todd is known to have a gun in that area.
12:48But as of right now, we don't know if this is a murder or if it's a suicide.
12:52Hopefully, by tomorrow, the ME will have done the examination.
12:55If the ME says it's a murder, then that's going to be a person of interest we need to speak
12:58with.
13:06The next day.
13:08When the victim was found and our crime scene people went out there and looked at him,
13:13they couldn't tell if he had an intraoral gunshot wound to his mouth or not.
13:17And so we had to wait for the ME to rule.
13:20This morning, the ME did an examination of the victim
13:23and concluded that the victim had been shot once right above his left eye.
13:28So he ruled it a homicide.
13:31We're going to head back kind of to the area of the scene.
13:33As McNeil and Warren head out to talk to the taco truck owner who called 911.
13:40This morning, it's definitely a homicide.
13:43The rest of the team heads back to the crime scene to search for the second witness, Daniel.
13:49We really do need to re-interview the guy with this new information.
13:53It's not ideal, but we haven't really lost that much time.

14:14Looking inside, it's cleared out. There's nothing in there at the moment.
14:19Mark and I may run back behind these hotels, kind of in the northeast of the Quick Trip.
14:24Kennedy and Brown will search other campsites in the area for Daniel.

14:41Mark and I tracked down these urban campers and they told us that they actually saw David in his camp.
14:48They also told us that David had a girlfriend that was staying at his camp.
14:54They even went as far as to say that they heard gunshots and then heard this girl scream.
15:01They didn't know whether the girl was screaming due to David getting shot or maybe she had something to do
15:08with it.

15:16McNeil calls in with an update.
15:19The taco truck owners said Hibner came and bought a Coke and then walked over to the camp.
15:24And then a few minutes later walked westbound towards 169.
15:28And that would have been about 445 to like 515 or 530.

15:38John and Mark went over to another encampment and said they heard the gunshot.
15:43Around the 5 o'clock time period.

36:07If she picks him out, then we'll go snatch him from his hotel if he's still there.

37:22over here and take a look the team checks the hotel where todd hibner was staying
37:33so basically the management walked him out that same sense according to the manager
37:38hibner left the hotel shortly after kennedy and brown brought him back
37:44we'll see what these folks got to say the team fans out in search of hibner

38:51in the first 48 tulsa homicide responded to the killing of 42 year old david drywater
38:57found shot in an urban encampment spoke to two witnesses who said todd hibner spends time around
39:04the camp and owns a gun interviewed hibner who denied any involvement in david's murder
39:11tracked down david's girlfriend who said she witnessed hibner shoot david
39:16and searched for hibner but had been unable to find him
39:24the next day
39:32he had warned people we'll be able to locate todd at another hotel a few miles away from
39:36uh where the murder happened and so we are now going to see if he's willing to talk to us
39:41and then
39:42if he is we'll go from there

39:56i've talked to this guy's family and the question they keep asking me is the why

40:44dave is dead and the most important thing that people want to know is the why
40:48why todd killed the victim unfortunately mr hibner decided to ask for an attorney and
40:54wouldn't say anything to us david's girlfriend told us what happened and so you know that's kind
41:01of what we have to go this is what the girlfriend said i think david probably said something to todd
41:06that set todd off and then todd just had a split reaction out of anger it's clear that todd was
41:14a threat
41:14to a lot of people in that community it's good to have him off the street
41:27two months after david was killed
41:30my son dave he could do anything except get sober david's family gathers to remember him
41:42miss him a lot because i was 17 when i had him and we grew up together i would tell
41:49him just get sober
41:50i'll help you get sober but he wasn't ready and his addiction got him
41:58never judge like a book bites cover because you never know what someone's going through
42:02deep down my dad was a good person no matter how much you make what kind of house you have
42:07everyone's still a person at the end of the day
42:12everybody out there living on the streets they all have a story and you know they're people
