00:01This program documents actual homicide investigations.

00:27Yes, hi.
00:28So I'm the chief, I can get to the Canada Outlet.
00:32We have two buses that are here, this group of young, like 13-year-old girls,
00:36and they need to afford this bus.
00:39We have somebody, I don't know if they're alive,
00:42they like right next to the bus sitting on the wood line,
00:46which is terrifying.
00:48My partners are defending the closest to all the units.
00:58These are the buses right there.
01:01There's a deceased female.
01:04Blunt for its trauma to the head.
01:08So around 7.53 this morning,
01:11patrol responded to a call for an unidentified body in the bushes.
01:17Initially, we thought it was potentially a hit and run.
01:20He's in almost full rigor.
01:23Looking at it, you can tell if she wasn't hit by a car, she would be beaten up.
01:27It looks like it's going to be a homicide.
01:29Your baby will be around.
01:38For homicide detectives, their chance of solving a murder is cut in half
01:43if they don't get a lead within the first 48 hours.
01:54North Charleston, South Carolina.
01:57I love North Charleston because it is a unique city.
02:03I mean, people flock here.
02:05100,000 people to like 200 and some thousand people during the day.
02:09North Charleston is a truly diverse city.
02:13The city of North Charleston,
02:15the police department and the community itself is just a big family.
02:18And, you know, our crime rate is steady dropping.
02:21You know, we're getting the bad guys off the street.
02:24We deal with a lot of high-end situations that perhaps a confident smaller town
02:28wouldn't get that kind of experience.
02:30I do like that about North Charleston that you never know what's going to happen.
02:34I feel that the community interacts very well with police.
02:38We've spent a long time building that trust.
02:42Well, I would say at least 50% of the people that we get in contact with,
02:46I either know a family member or went to school with a family member
02:49or we actually grew up in the same neighborhood.
02:51And then be able to help these moms and dads and families members,
02:54I feel great about that.
02:57You have to have a servant's heart somewhere down inside of you.
03:00You have to come in here to say that I'm going to serve people
03:02and that I'm going to be the one that's going to fight for those
03:05who can't fight for themselves.
03:07The team has a 73% solve rate,
03:1020% higher than the national average.
03:13First thing that pops in my head when I think of the unit is unity,
03:17you know, friendship, family.
03:19We all work together, always have each other's back.
03:22We're always there to help each other to accomplish the same goal.
03:27We all come from different backgrounds of life.
03:30We all have different years of experience in law enforcement.
03:34Sergeant Bailey just told me this morning,
03:36he's got a pair of socks that are older than I am.
03:40Unlike some departments,
03:41North Charleston doesn't immediately assign a lead detective,
03:44approaching each case as a team.
03:47When we have a homicide occur,
03:49it could be a day or two later that we'll assign a case agent to it.
03:52And a lot of things come into factor with that.
03:55The connections that could be made on scene,
03:57you'll see that one detective has a stronger connection
04:00with the family than another detective.
04:04If it's going to be solved relatively quick,
04:06you're going to want to assign that to somebody
04:07that's going to be able to get everything together in a timely fashion.
04:11We're here trying to do the right thing,
04:13get justice for people.
04:22So right now we're heading over to the Tanger outlet area.
04:25We've got a female that's deceased in the bushes over near one of the hotels in between.
04:31We have homeless population in the area.
04:34So, you know, vulnerable people in bad situations.
04:50The cause of death is blunt force trauma.
04:55I'm not seeing a club or a bar.
04:58Might have just beat her with his hands, honestly.
05:02But she looks pretty fraggled.
05:05I'm trying to identify her.
05:08Detectives find no identification on the victim.
05:11The coroner will get all that information.
05:14Hopefully, if she's been in Charleston County,
05:16we'll get her identified by fingerprints.
05:22On this side, a lot of the bushes, you can tell they're broken,
05:26where possibly she was pulled in from this side.

05:49I really got to wait to find out who she is before we really get further from there.

05:58Now it's the job of figuring out where we got to get the witnesses.
06:21So we got multiple witnesses.
06:23The team identifies two hotel residents who might have information about the victim.
06:29One of the gentlemen that's been saying that a girl named Kelly,
06:34he saw her wearing like a blue sweatshirt and like some blue sweatpants.
06:37And that clothing kind of matches what our victims wear.
06:41So the lady I spoke to, she's not from here.
06:44She said her friend left and never returned last night.
06:48The two witnesses are taken to homicide for questioning.
06:52We have a name.
06:54We'll start going through the tenant list.
06:58Fire extinguisher over there.

07:02CSI finds a fire extinguisher left near the hotel's front office.
07:06Maybe we're just going to be related.
07:08Take photos and fingerprint where it's supposed to be.
07:11I'm trying to find her on camera, seeing who she was with.
07:16Corporal Tim Holly and Detective Cameron Miller break off to look for nearby businesses with
07:21surveillance cameras.

07:5048-year-old Kelly Wallace Wingate was born and raised in Charleston, South Carolina.
07:56She had three daughters, ages 29, 28, and 13, and a 16-year-old son who thought of her
08:04as the cool mom who loved to paint.
08:0713 years ago, she opened a carpentry store, but struggled with drug addiction and ended up
08:14living on the street.
08:16It looks like the victim's daughter is local.
08:20The coroner will be making that notification.
08:26At least 30-plus arrests for drugs and shoplifting.

09:01Tell me all about Kelly.
09:04Kelly is a homeless lady from here.
09:07Kelly does drugs.
09:09She has heroin.
09:12She told me she was in the parking lot.
09:15But Kelly told me she got trespassed from there, so I don't know where she stays.

09:30He says he saw the victim with the other resident, who was brought to headquarters near a picnic table at
09:35the back of the hotel.
09:37How do you know her?
09:39I don't remember her last night.
09:43So back at 10 p.m. last night, what happened?
09:46I went back inside and go to sleep.
09:50I woke up like 6.30.
09:52Right before she didn't ride out.
09:54Mm-hmm.
09:54And I went out and smoked a cigarette.
09:58And was the only one at the picnic table now.
10:02I said, we're the same way you know me.
10:04She said, I don't know if she left.
10:07And she said, you want some white kids or something?
10:09She never came back.
10:10I was like, okay, well.
10:14She said that she was worried about her.
10:17Because some white dude was harassing her.
10:20And I said, one thing about Kelly, you know, she's down here.
10:23She knows how to handle herself, you know.
10:25She's like, well, this cat is really, he was scaring me.
10:29So.
10:30And that's all of that was this.
10:33So we'll fix that.
10:34She said that there was a black male.

11:35The team turns to the woman who said her friend went missing last night.

11:46And how did you meet Kelly?
11:48I met her yesterday.
11:50I went to go sit down with her camp because I just got done walking.
11:56Where's her camp?
11:57It's kind of like where the site is, but a little bit further down.
12:01She says Kelly was staying in a tent near the hotel parking lot where she was found.
12:06What time yesterday did you meet her?
12:07It was probably about one.
12:10In the afternoon?

12:13We started walking around.
12:14We're talking about our kids because we have kids around the same age.
12:17Um, and she just seemed like, you know, a sweet person.
12:22Like, she had a good heart.
12:25And she's like, I'm gonna take in.

12:28You know, this girl's gonna stick together because there's a bunch of words I heard.
12:32So, we went to Circle K.
12:34What time do you go to Circle K?
12:35I'm not sure.
12:37It was night time.
12:38And she's like, that guy over there started talking with me.
12:42She says she pointed to a man standing outside the convenience store.
12:46You know, like, last week, he pulled me by my hair.
12:48It hit me.
12:50Is there any alteration in Circle K?
12:52No.
12:55What does this guy look like?
12:57He's black, big eyes, bald.
13:01He had dark black jacket on.
13:03I don't know if it was blue jeans or black jeans.
13:04He had two shoes on.
13:06And he had it like he was like some tough guy.
13:09Like, he just ran his mouth to people.
13:12And then we walked back to the hotel.
13:14We're sitting outside chit-chatting.
13:16Where are you chit-chatting now?
13:17We're sitting at the picnic table at the hotel.
13:20And we're talking about our older kids and how we'd meet.
13:23Like, we got all the situation that we're in.
13:25That our kids would meet.
13:28She's like, I'm gonna get some blankets.
13:30Do you have anything to do with time this is?
13:31It's around 11, 11.30.
13:34It's just the studio?
13:35Yeah.
13:37And she's like, I'll be back in about two minutes.
13:3910 minutes went by.
13:40Nothing.
13:41I'm starting to worry.
13:43And he just happened to come by and he's safe.
13:48Yeah.

13:51And he said something to me and it didn't make sense.
13:54And he just kind of running at me.
13:57So I got up.
13:59And I'm scared of .
14:00And I keep remembering.
14:01Well, Kelly keeps telling me that he's a hitter.
14:03What's he gonna do to me?
14:05Mm-hmm.
14:06And I was running full speed because at that time, my adrenaline was rushing.
14:10I went across the street where there's lightning.
14:12And I knew those people in case something happened.
14:15See, just the way his demeanor was, it just scared me.
14:19And then I heard him yelling.
14:20He was yelling at her.
14:21She says when she was across the street, she heard the man yelling at someone near the hotel.
14:27He was yelling, I'm gonna kill you, I'm gonna kill you.
14:30Where does he go?
14:32I don't know.
14:33I didn't see where he went off to.
14:35This bald-headed blackmail.
14:36Have you seen him at all today?
14:37No.
14:39I felt like something bad happened.
14:41I tell you, she's not been back.
14:42She's not been back all night.
14:44And I told him, I said, I wish I would've been to go sit for her.

14:48Because if I would've looked for her, maybe she would be around.

15:23three hours in they responded to an incident where a crazy guy did a fire extinguisher
15:30corporal rob van tyne finds a police report about a recent disturbance at the hotel
15:34near the crime scene so there's a call at some point last night involving somebody out there
15:40spraying people with a fire extinguisher
15:44turn 315 robert gardner a hotel resident identified 42 year old robert antonio gardner
15:53as the alleged offender with the fire extinguisher but he wasn't caught
15:58match the description of our suspect gardner was born and raised in charleston he has previous
16:05misdemeanor convictions for drug possession and shoplifting then detectives get another
16:13lead female let us know that hey i have information about what happened last night
16:17while canvassing for surveillance video another resident of the hotel approached corporal tim
16:23holly with possible information about the murder there's somebody who interview her hopefully she
16:30can tell us who did it
16:37okay i appreciate you coming in on the side of holly did you see kelly yesterday
16:44oh i never saw her at all
16:46when's the last time you've seen her a week before
16:51okay kind of just run me through yesterday's events
16:59she says she was at the convenience store last night
17:12okay he got in trouble at the store
17:16so that's why you wanted to get a ride to get out
17:45she says robert brought up the name of another woman

19:17so the witnesses talked about rob being upset with another female
19:21but i believe he was referring to kelly as being the individual that he got
19:26he said i got that bitch
19:28a lot of times with a lot of these young ladies
19:31they'll give us a little bit of information but they won't always give us everything
19:35um just because they don't want to be labeled as a rat
19:37or they don't want to get beat up or anything like that
19:40so we can't push them too hard
19:42then they'll just shut down and then they'll walk out
19:44so sometimes we have to kind of be careful
19:49we want him in a lineup for robert gardner
19:52we'll get a person who doesn't know anything about the case to create a
19:55lineup for us
19:56you know she identifies him as being the one who said

20:32when those interviews definitely did help but none of the witnesses we have so far saw the murder

22:05i think we just got it over to get arrest warrants
22:08the witness placed the suspect in the same area where the body in the victim's camp is out
22:13with him yelling out i'm going to kill you
22:16another witness identified him as being the guy who said i just got that bitch so
22:20her statement combined with that statement combined with the video that we got we can piece it all together
22:24say that the person who said i just got that bitch is the same person who ran into the wood
22:28line saying i'm going to kill you
22:31who's case is this cam's with all signs pointing to robert gardner as their suspect
22:36the case is assigned to rookie detective cam miller as lead
22:40i feel really good about solving cam's case for
22:43i think we have enough right now just trying to put all the pieces together because we have
22:49so many hands in it so we're trying to put everything that we have together
22:53right now i'm going to try to type in warrants and then hopefully we're going to try to get out
22:58and locate this dude

23:15the team searches the area around the crime scene for robert gardner
23:20we'll probably try to get this dude by the end of the night uh just because of how brutal it
23:27was
23:28and he seems to be targeting multiple women so the longer this dude's out the higher of the
23:35chance he does it to somebody else we don't need that

28:35okay who else did you see there i was talking to somebody over the fence
28:41she got smart i asked her if she had extra pipe mine's broke okay what she said to you she

28:48get the hell out of something and then that's when i kept walking through the parking lot
28:52okay so when you walked through the parking lot where did you go to
28:56when y'all picked me up and i slept over there last night but you never seen this female before

31:01himself there it can be frustrating he didn't confess to what he did the blood from rob shoes will
31:09be sent to sled for further testing our witnesses we don't know how reliable they'll be yeah they
31:16came in and talked today but a lot of times can be very hard to try and get them in
31:20a court of law
31:21to testify the chances that i'm going to say with this case are pretty slim i think with the dna
31:28evidence that's crucial but there are several avenues we can take to help sure up this case for
31:33trial it's not closed until it goes to court and we have a conviction so we'll continue to do our
31:42investigation hello hello is this miss devin craig hey this detective hollywood north austin police
31:54department hey hey um so i just i'm just calling you to let you know that uh we just made

32:01in your uh mom's murder i'm sorry you're having to go through all this detective miller is going
32:19to be the case agent on this but i will have him reach out at some point and make contact

32:56devin and her boyfriend come into homicide to speak with detectives
33:02um do you have any other siblings or anything you do i have a full sibling she's ten and a
33:09half
33:09much younger than me i have two half siblings from my mom's second marriage and they're 16 and 13.
33:18this younger two have lived with me since august of last year can you remember the last time you talked
33:26to your mom Thursday about seven days ago the last time you talked to her everything she normal yeah
33:37she wanted me to come and see her um she said that she missed me she said you promise you'll
33:43come and
33:44see me and i said yes i promise i'll come and see you and i wasn't able to go see
33:50her
33:53she ever mentioned any trouble with anyone she told me that she gets raped and beaten out there all the
34:01time and that i don't know what it's like to live out on the streets and she wanted to live
34:07with me
34:08and i told her that i had her kids and i couldn't i couldn't let her live with me because
34:15she's lived
34:16with me before and she stole from me
34:21how was your relationship like i loved her and she loved me and she loved all of her kids
34:37she was just crippled by her addiction she started doing drugs when i was like 10. i know she didn't
34:48want to do drugs and that's not the life she wanted
34:52more questions did you have for me why was she murdered
35:01that i don't know there was an arrest that was made
35:06well found him so quick and some people don't ever get justice and i'm just grateful for that
35:18i know our vacant advocate can assist you would you like to speak to her yeah
35:32our job is to try to help you get through each phase of the process
35:45we're going to continue to aggressively work the case looking for video and other possible witnesses
35:53i think a lot of people can relate to her mom's story a lot of people will just look at
35:57like she's
35:58just a homeless person that's around here she's a dirty person and she's not she had this whole life and
36:05got addicted to stupid that she just couldn't get off of i've been on the the side of that the
36:12family
36:13members that have the addictions and stuff like that and you want to be angry with them and tell
36:17them to get their together and sometimes they just can't the victim's daughter she's gonna think about
36:24like had she just sucked it up and had her mom living with her and stealing from her then maybe
36:29she
36:29would still be here she doesn't have to take care of everybody else right now she needs to make sure
36:33she
36:33takes care of herself and let other people take care of her when she needs it
36:45still lacking any direct evidence that robert gardner killed kelly this is video of the wood line
36:52where the victim was found the team gets video from another hotel facing the crime scene this view
36:59is right here now towards where the body is right on the other side of the bus
37:07so that's the victim right there it looks like she has a blanket over her shoulder
37:15where's that at the picnic 2-1 hotel she decided i'm gonna get the blankets she walks pretty fast
37:25a few sections lately that's gonna be the suspect behind her
37:42we know just based off clothing descriptions he was wearing a puffer jacket
37:48our victim is being followed by the suspect it's her
37:55that's him 138 they disappear in this area where the bus is
38:04143 he pops out from the wood line
38:09she's killed at 138 139. he does go back to the hotel for killing him
38:15i believe the video is great evidence for court
38:20it's just frustrating not knowing exactly why this happened but right now i don't have a motive for why
38:26rob did this to kelly she probably was in the wrong place at the wrong time i don't think we'll
38:32ever
38:32know the exact reason of why someone would do something like this um to someone who's
38:39appears to be completely innocent and just be brutally beaten for no reason
38:44with all the evidence and the witness statements that we have it feel like we bring justice for kelly
38:49uh

39:24One time for science class, she made slime, and she said,
39:30When she came into the classroom dressed like a mad scientist, she had wire hangers in her hair, braided it
39:38up into crazy little things, and then different colored socks, and a mad scientist trench coat, and was like, hey
39:47kids, we're going to make slime today.
39:49And everybody's like, man, your mom's so cool.
39:55When I was one years old, this was my birthday party, and my mom was helping me open all my
40:00birthday presents.
40:03And that's me. This was hers. She was a witch one year, and I put it on.
40:10I always wore her shoes and hats and sunglasses, and she would catch me in her high heels sometimes, and
40:17she'd be like, better get those high heels up.
40:22I miss the way she laughed. Funniest woman on you.
40:27I miss her before she got back into drugs. I miss her being happy. I miss the moments before that
40:36when she was trying to be a mom.
40:38She was very loving and caring. It does suck that she wasn't in our lives as much. I really do
40:49miss my mom and the woman that she could have been.
40:54I was hoping that she would get better eventually, and that we would get to see her and stuff, and
41:00that she would be more of a mother figure for us.
41:05I don't have a lot of early memories of her before she started doing drugs and stuff.
41:11When she was in jail, she used to draw us pictures and put them in letters and then mail them

41:46And she kept pictures of us to try and remind herself to do right.
41:52Mom seemed so happy with all of us kids around her. That's when she was the happiest.
42:00Whatever had a hold of her, she wasn't strong enough to fight it, but, you know, I never got that
42:09opportunity to see if my mom would actually stop with the things that she was doing.
42:16And because he took her life, I'll never know. But I like to hope she would've.
