00:01:27We woke up this morning, and we thought we'd have kind of a quiet show, and then a bombshell
00:01:34entered all our email boxes this morning.
00:01:37And since this show is going to play several hours after we are recording it on Tuesday
00:01:45late afternoon, you already will know all about the fact that basically Churchill Downs
00:01:50acquired the intellectual property rights to the Preakness from the Stornick Group for
00:01:56$85 million.
00:01:57Churchill will license the rights to the Preakness back to the Maryland Jockey Club for an annual
00:02:03fee.
00:02:03I have a lot of questions.
00:02:05There's a lot of things I don't quite understand about this, but what I do understand is that
00:02:10this looks like a massive power play on Churchill Downs' behalf, and they now essentially, it's
00:02:17kind of complicated because Maryland figures into this still.
00:02:20It's not like they've taken the race away and moved it to Churchill Downs or something
00:02:24like that, but essentially, if they have the intellectual rights to it, they own two-thirds
00:02:29of the Triple Crown.
00:02:30And it really is that basic and that simple.
00:02:36And what does that mean for the Triple Crown going forward?
00:02:39They're in the driver's seat right now, and that could mean a lot of things.
00:02:43It could mean TV rights that they decide.
00:02:45It could mean the spacing of the Triple Crown.
00:02:47It could mean a lot of things.
00:02:49I wonder how much this was a power play against them.
00:02:52And Naira, like I said, some things I understand.
00:02:54I have some answers to some things.
00:02:56Some things I don't quite understand.
00:02:58Zoe, what did you read into this?
00:03:01I think it's a good thing.
00:03:03Honestly, it would be nice to see Churchill Downs care for two days of racing a year.
00:03:07So they'll have the Derby.
00:03:08They'll have the Preakness.
00:03:09It'll be awesome.
00:03:10It'll be great for NBC because I would assume, obviously, you hate to assume anything, that
00:03:17as NBC owns the rights to the Derby, hopefully they can re-up and get the rights to the Preakness
00:03:26as well.
00:03:27As far as moving the dates, I don't know, because I would imagine that New York could be steadfast in
00:03:32their opinion,
00:03:33that they want to keep it where it is if it doesn't help them with the TV rights for the
00:03:38Preakness.
00:03:39So that might be a roadblock there.
00:03:41I'm not sure if it would be or it wouldn't be.
00:03:43But my biggest question would be how much of a fee?
00:03:48Churchill doesn't do anything for free.
00:03:50You know, if you're a shareholder in Churchill Downs, you're obviously smelling the roses and you're making plenty of money
00:03:56because they are in the business of making money.
00:03:58I would love to know what the annual fee would be to lease it back to Maryland,
00:04:04because that's got to be quite substantial, I would imagine.
00:04:08Yeah.
00:04:09As an employee of NBC Sports, I can't obviously get into the TV component of this
00:04:15because there would be clearly some bias involved in it, not bias, and certainly the appearance of bias.
00:04:21But I think anybody looking at this from 35,000 feet can see the basics of this.
00:04:28Either Naira was going to control two-thirds of the Triple Crown
00:04:32or Churchill Downs was going to control two-thirds of the Triple Crown.
00:04:36And we've already seen that Naira is not only willing but desirous to put its own best interests
00:04:45in front of the overall health of the Triple Crown.
00:04:49In that Sports Business Daily article that just came out a week or two ago,
00:04:55which looks, smells, and tastes an awful lot like it was engineered by the New York Racing Association, by the
00:05:01way.
00:05:02Now, Naira pretty much put it out there that they were willing to move the Preakness from two weeks after
00:05:10the Kentucky Derby to three weeks.
00:05:13That provides less disruption to the New York Racing Association's stake schedule,
00:05:18which right now benefits from the current three races in five weeks setup.
00:05:23But as Churchill Downs knows, and anybody who really follows horse racing knows,
00:05:29moving the Preakness from two weeks after the Derby to three is not really moving the needle at all.
00:05:36Trainers don't want to run back in three weeks either.
00:05:39And yet, Churchill Downs recognizes this.
00:05:42And if Churchill Downs takes control of the Preakness, it also takes control of the undercard races.
00:05:49More spacing between the Derby and Preakness, Churchill Downs can work with Pimlico to strengthen the undercard races.
00:05:57And certainly, they have the wherewithal to do that with their current experience with their stake schedule
00:06:03and what they've done on the Derby undercard.
00:06:05And I think Churchill believes that they can really transform the Preakness undercard into something special.
00:06:12Hook it up with some of the Derby races and bonuses and maybe create a triple crown for three-year
00:06:17-old fillies and some other categories.
00:06:19And I think they think they can benefit from simulcast betting on these undercard races.
00:06:25They would certainly be stimulated because right now, the way it stands right now,
00:06:29not only does the Preakness suffer from the two-week gap and not getting the quality of horses that it
00:06:35could,
00:06:36the undercard races basically get the scraps and don't get all the top horses that run on the Derby undercard
00:06:43and on the Belmont undercard.
00:06:44And I think Churchill believes it can change that.
00:06:46It would be good for horse racing, I think, in my opinion.
00:06:49And I think Churchill Downs could certainly benefit from it.
00:06:52I think it would be a good thing.
00:06:53Well, one thing I just learned, Wall Street didn't react well to this.
00:06:57Churchill stock went down 2.2% today, which is a little bit of a surprise.
00:07:01But, Randy, I would agree with virtually everything you said here.
00:07:05And I think that this gives Churchill Downs the power.
00:07:10And I also think it's almost now a no-brainer that the Preakness, which we were all talking about even
00:07:17last week being up for grabs,
00:07:18and I wrote a column for the Thoroughbred Daily News that now belongs into the trash can
00:07:23because I anticipated that Fox was going to get the Preakness and all the ramifications that would mean for the
00:07:30industry.
00:07:31So don't read that.
00:07:32Never mind.
00:07:33Let me stress something, since you mentioned it.
00:07:37No matter what network has the Preakness,
00:07:39I think this could be beneficial for Churchill Downs to be operating the Preakness stakes.
00:07:46Would you rather have the government of the state of Maryland that has no experience at all in big horse
00:07:53race operations running the Preakness stakes,
00:07:56or would you rather have the people that run the Kentucky Derby running the Preakness?
00:08:00Oh, you totally agree.
00:08:01And the other thing, too, and people aren't going to like me saying this because there's a lot of people
00:08:06that don't like Churchill Downs for closing down Arlington,
00:08:08some of the other things.
00:08:10These are very smart people, and they've run a fabulously successful business.
00:08:14I think they're probably the smartest horse racing organization in the sport,
00:08:19and they wouldn't have put forward this $85 million if they absolutely didn't know what they were doing.
00:08:26And I do hope this means that they now feel that we've got the muscle, we're in charge,
00:08:32and that they will see to it that the gaps between the races are extended.
00:08:38They don't want a lousy Preakness if they're going to step in and pay all this money for it,
00:08:44and we're getting a lousy Preakness year after year, and it's only going to get worse as long as they
00:08:48only have two weeks in between the races.
00:08:51Randy, I will agree with you again, though.
00:08:52If their only ambition is to change it from two to three, it's not going to change a thing.
00:08:56It needs to be at least four.
00:08:59I'll solicit opinions from both of you on a couple of things that were unmentioned.
00:09:05Do we know, what about the revenue?
00:09:08Does Maryland Jockey Club still get all the money from the handle, from the seating charges, from the admissions?
00:09:15Does that go to Churchill?
00:09:16That's one thing that I didn't understand.
00:09:20And, again, there's so much things that come up.
00:09:23And here's another thing that I don't understand.
00:09:26And I think if I'm a Maryland taxpayer, I'm a little bit upset about this.
00:09:30The state of Maryland put up $400 million in bonds to rebuild Pemico and paid $48 million to buy Laurel
00:09:37off the Stronach Group.
00:09:39And now they're going to give away the single biggest asset by a mile that is part of Maryland racing.
00:09:46I don't think the state of Maryland played this very well.
00:09:50Well, I don't think they're going to be giving away anything, honestly.
00:09:53I mean, there's going to be money involved.
00:09:55Absolutely.
00:09:55I mean, the state of Maryland is going to be compensated.
00:09:59You know they're going to be compensated.
00:10:00But I don't know how much.
00:10:02I don't know the details of that either.
00:10:04Nobody knows the details.
00:10:05And I'm pretty sure we probably never will, to be honest.
00:10:11Well, interesting story.
00:10:12We'll see how this affects the Triple Crown going forward.
00:10:16Easy to predict, and I know Randy doesn't want to weigh in on this, but I think NBC is going
00:10:20to soon announce that they have the rights to the Preakness going forward.
00:10:24And certainly not a bad thing, Randy.
00:10:26I'm not just saying this because you're on the podcast.
00:10:28You guys do a great job.
00:10:29I'd love to see you guys retain the Preakness stakes.
00:10:33But a lot of questions that have yet to be answered, and we'll see what happens going forward.
00:10:38Well, questions were answered on the racetrack at Oakland Park on Saturday.
00:10:44White of Barrio, what a performance.
00:10:47I was on the Sovereignty bandwagon.
00:10:49And the people that weren't, I think, on the commentators on America's Best Racing on Fox, all four of them
00:10:56picked journalism to beat Sovereignty.
00:10:58I didn't think I was kind of surprised by that.
00:11:01But two things about White of Barrio.
00:11:04I think I underestimated him.
00:11:06I didn't think even on his best day he was able to beat Sovereignty or journalism.
00:11:12And this was his best day.
00:11:14And he put it together and beat them and beat them fairly handily.
00:11:19It's time to give this horse some credit, Randy Moss.
00:11:22He's awful damn good.
00:11:23Oh, yeah.
00:11:24He's, you know, when he's on his game, when he runs one of his A-level races.
00:11:29I mean, we saw in the Reader's Cup Classic when Rick Dutrow was training him, how well he ran then.
00:11:35And you can make the case, well, Zoe talked about this more than me.
00:11:38But, you know, I mean, we talked about last week, both of us did, about how weird the race was
00:11:46going to be
00:11:46because of the complete lack of early speed.
00:11:49And if you didn't believe us last week, when Sovereignty is setting the pace in the race, I mean, that
00:11:56is weird beyond comprehension.
00:11:58But he was fresh coming off a long layoff.
00:12:00There was no other speed in the race.
00:12:02I read Ortiz rode a masterful race on White of Barrio to go to the lead, a short lead going
00:12:07into the first turn.
00:12:08And then when he saw the other two ranging up outside of him, he eased back and track instead of
00:12:13being the hunted.
00:12:15And it paid off.
00:12:16Now, whether you think that Sovereignty didn't run his best race because of the change of running style,
00:12:23I guess you could make a case out of that.
00:12:27But it was nice, Zoe, to see all three horses fire in a race that had so much hype.
00:12:35We've seen it so often when it doesn't quite pan out.
00:12:38And that turned out to be just an exceptional horse race.
00:12:41It was a terrific race, an absolutely brilliant race and a Hall of Fame ride by Erad Ortiz.
00:12:48He initially thought that he probably was going to the lead.
00:12:52He was in the prime position to go to the lead.
00:12:55And when he floated everyone wide going into that first turn, that was just genius.
00:13:00Because they had the opportunity, if they wanted to, to tuck by and get behind him.
00:13:05But he's like, I'm just going to float you wide.
00:13:07And then if you want to go past me, you're going to have to go even wider.
00:13:11So he floated those two wide around the turn and then just eased over and dropped him behind them.
00:13:18They went 23.13, 47, 111, which was a fairly decent time, but not overly quick for really good horses.
00:13:28And Sovereignty did inherit the lead.
00:13:30And that's not how he wants to run.
00:13:32At the end of the day, he's kind of still a big baby.
00:13:34He's better stalking horses.
00:13:36And his worst races have been his debut.
00:13:40And then off the layoff, he won by, what, a neck or half a length last year down at Goldstream
00:13:46off of a layoff.
00:13:47If Bill Mott doesn't crank his horses first out, they kind of do it on their own.
00:13:51So not fully cranked, not the pace set up.
00:13:55Maybe Wider Barrier is going to beat them both anyway, because he won convincingly.
00:13:59It's not like he won by half a length.
00:14:01He won going away by two, barely, Arad barely even picked his whip up on him.
00:14:07It was a super confident ride by Arad, a good horse who's good or if not better than anyone on
00:14:14his best day.
00:14:14He's obviously had issues.
00:14:17The ownership groups has issues.
00:14:19They're suing everyone now.
00:14:21There's a whole cluster of all the things that have gone on with Wider Barrier through his whole career.
00:14:26If you look back to Wider Barrier, think of all the things he's had to overcome.
00:14:31Goes to Safi, has to get moved from Safi.
00:14:33Safi gets, you know, months suspension for something he didn't do.
00:14:39He goes to Rick Dutcher, he gets sore feet, he gets scratched from here, he gets scratched from there, he
00:14:44wins the Breeders' Cup.
00:14:45He's scratched again.
00:14:47This horse has gone through everything.
00:14:49He's just amazing.
00:14:50And he's by race day.
00:14:52Race day.
00:14:53What did he cost?
00:14:53Like 40 grand as a two-year-old at OBS.
00:14:56I think they sold him as a weanling for seven.
00:14:58By race day, out of an intermischief mare, which is key here.
00:15:02Intermischief, squarely the best stallion in the world.
00:15:04Because if he's got just a little bit of that bloodline in there, it's going to work.
00:15:08But race day, who the funk it?
00:15:10He's amazing.
00:15:11And one thing to say about Wider Barrier runs a 111 buyer speed figure again, which is huge.
00:15:17But one thing to say about sovereignty, he did not let journalism go by.
00:15:22And he was not going to let journalism go by.
00:15:25And he counts out in front of everybody.
00:15:28Yeah.
00:15:29Hey, Zoe, I want to ask you this question before we wrap up this segment.
00:15:34And you mentioned he's by race day.
00:15:37And that factors into the fact that he's still on the racetrack.
00:15:42If he were by Gunrunner or Intermischief or Quality Road or whatever, he would have been retired a long time
00:15:49ago.
00:15:49But nonetheless, you have a horse that's won the Breeders' Cup Classic, the Pegasus, the Florida Derby, the Whitney, the
00:15:54Oaklawn Handicap, the Holy Bull, and earned $8.4 million.
00:15:59Why can't he get a stud deal?
00:16:03And surely, before this year is over, they will come up with one.
00:16:08But what can these owners fairly expect from the breeding industry for this horse that they've obviously, the people in
00:16:18the know in Lexington, Kentucky, at the big farms, have obviously not shown much interest in this horse.
00:16:23Well, that's just it.
00:16:25I'm sure people have shown interest in him, maybe regional breeding programs around the country.
00:16:30I don't know what kind of money they want for him.
00:16:33So, you know, if you're trying to stand a horse by race day and you want $20 million or $10
00:16:40million or $5 million for your horse, people aren't going to give it to you.
00:16:44It depends on the number they want.
00:16:46I'm sure there are people that would stand him, maybe in a regional market, maybe in Kentucky.
00:16:52But it's up to the ownership group and the stud farm to agree on a price.
00:16:57And I'm not sure any price has ever been agreed.
00:17:00Well, we shall find out.

00:19:15He had previously run a career best of $110,000 and had also run a $109,000 buyer.
00:19:22So, more evidence that when Wyatt Abario is at his very, very best, he puts in some strong performances by
00:19:29the numbers.
00:19:30Our horse of the week, fastest horse of the week, Wyatt Abario.
00:19:38Welcome in the Gainesway Guest of the Week.
00:19:40A man that absolutely needs no introduction to people who follow horse racing.
00:19:45It's Mike Rapoli.
00:19:46And, Mike, last week we had Everett Dobson from the Jockey Club, the chairman on the podcast.
00:19:52And, predictably, you reached out to a couple of us and expressed a desire to come on to talk about
00:19:59what Mr. Dobson had to say and to get your side of the story out.
00:20:04Predictably, you had some things to say on Twitter that were not necessarily very kind to the Jockey Club.
00:20:11Matter of fact, I'll read one of them.
00:20:13Pheasant hunting stewards, hiding, deflecting, telling us everything is great.
00:20:20All right.
00:20:21So, you, in a text to me, said, go ahead and ask tough questions.
00:20:25And, I don't know how tough a question this is, but I think it's a place to start.
00:20:29What was it about Everett Dobson's appearance on our podcast and what he said that so disappointed you?
00:20:39Can I say hello to Zoe and Randy, or I'm not allowed to do that?
00:20:44You know, I am pretty polite.
00:20:46So, Randy, how are you doing?
00:20:47Zoe, how are you doing?
00:20:48Goodbye.
00:20:49Bill, that was a great question, and I want you to be as brutally tough on me as you can
00:20:54because I believe in transparency, and I believe in honesty, and it's not always what people want to hear, but
00:21:03it's, you know, there's no reason to continue to try to fool people.
00:21:08But I think the first thing, Bill, with your question was 95% of what me and him talk about
00:21:19we agree on, and me and the jockey club agree on.
00:21:23If that's true, then we have a major problem with execution and a major problem with getting shit done.
00:21:32If that's false, then you're just full of BS and stop lying to us.
00:21:39So, you know, anytime I've agreed with someone 95%, you have to find a solution, and I think I am
00:21:48willing to find a solution on how to move this game forward, and I don't really believe that they're attempting
00:21:53for any solution.
00:21:56So, as we mentioned to Dobson last week, and as you've made clear, you asked for a sit-down with
00:22:04a group of people on your side, with the jockey club board or stewards or executives, whatever, and you were
00:22:13rebuffed on your request.
00:22:15If you were to get a sit-down, and if the jockey club were to listen, and if the jockey
00:22:22club were to seriously consider what you bring to the table, you're a businessman.
00:22:28You know you're not going to get everything you want.
00:22:30What would be the things that would satisfy you, your requests, if the jockey club were to grant them?
00:22:39So, Randy, I want to, I mean, the message went through lawyers, but it was not threatening at all.
00:22:45It's like, what if we got the entire board of stewards, and then I brought in some expertise, like Pat
00:22:51Cummings, Aaron Wellman, two or three breeding farms, you know, that have big influence in the game, some of the
00:22:57biggest track owners or operators, some people from political, some people from aftercare, some people that know gambling and horse
00:23:06players.
00:23:06It's like, all I wanted to do was get a bunch of industry experts.
00:23:10You have 12 stewards, I'll have 12, and let's just lock each other in a room for 24 hours, maybe
00:23:16two days, and just talk about what's working, what's not working, and what can we do to make it better?
00:23:21In the most non-threatening way.
00:23:24And I was, it was rebuffed to, you know what, Mr. Rapoli, Mr. Dobson would meet with Mr. Rapoli if
00:23:33he had the exact agenda, this is how it would be, and maybe there'd be somebody, a third party to
00:23:39listen in, but not the rest of the stewards and no other people.
00:23:43So, to me, that's not showing that you're looking to move the game forward.
00:23:49Randy, Zoe, and Bill, you know, I don't want to be pessimistic or negative on the game, but you have
00:23:58to be honest.
00:23:58I don't really see anything that is really working in this game, from full crop, to racing, to HISA, to
00:24:08aftercare, to the sales, to the SAFE Act, to CAWs, to the horse players, to the tracks.
00:24:20Like, horse racing is a sport that people are so passionate about and people love so much.
00:24:27Like this, Mike, like Rapoli, when I was a 13-year-old kid and fell in love with this game,
00:24:32that I'm willing to make excuses for it and I'm willing to look away to a certain amount.
00:24:38In 20 years as an owner, I haven't recruited anybody, hey, get into horse racing, spend $5 million, it's great.
00:24:46I don't.
00:24:47I bring 75 people to the track and I won't even let them pay because I want to make sure
00:24:52they have a great experience, right?
00:24:55And I don't believe in the product or the systems and process that are going on in racing, but if
00:25:01I want to spend $25 million a year, it's my money.
00:25:04And I think that there's a lot of people like that.
00:25:07But then there are people that, A, when they put money in, they actually need it or they want to
00:25:12bring people in.
00:25:13And then there are people that make a livelihood here, that have wife, kids, husbands, grandkids, that need horse racing
00:25:24to feed their families.
00:25:25And it's their livelihoods.
00:25:27And we have killed so many dreams of small breeders, small owners.
00:25:32We've scared people away from the game.
00:25:35And it's just so nasty, mean, and cruel.
00:25:41Every track that closes, fall crops that go from $30,000 to $15,000.
00:25:47It's come about, and you guys know this, 95% of the people are not happy with this game.
00:25:54And, you know, when I talk to Todd Pletcher or I talk to the six people that work for me,
00:25:59it's not fun anymore.
00:26:01I got the favorite in the Derby and the favorite in the Oaks.
00:26:05And it's just Wednesday today.
00:26:07You know, there's no, you know, the question is, are the vets going to scratch me again?
00:26:13That's the fucking thought process.
00:26:14Like, it's sad.
00:26:16You know, my family's kind of excited.
00:26:18They got the hat, the dresses, 75 people.
00:26:20My assistant's making reservations.
00:26:22And I'm like, yeah, you know what?

00:30:10for four straight years.
00:30:12We're up 32% in the first eight months.
00:30:15What the hell do I know about being an owner of a football league?
00:30:18Never mind.
00:30:19But you know what?
00:30:20I made a field goal, four points over 60 yards.

00:31:00Nobody can name a player or knew the team.
00:31:03You know what the Breeders' Cup Classic had?
00:31:05Last year, one million viewers.
00:31:08That should have 10 million viewers with fierceness, mind frame, forever young, Sierra Leone.
00:31:13But you know what?
00:31:14We have it on Saturday while people are watching Alabama and LSU and Ohio State-Michigan.
00:31:20Where's the innovation?
00:31:21Where's the thought process?
00:31:23We get nothing from the Breeders' Cup.
00:31:24We get nothing from the Jockey Club.
00:31:27And Heiser is accelerating the death of the sport.
00:31:29And that's the truth.
00:31:31Mike, we do want to get on to Renegade.
00:31:34But before we move on to Renegade and Zaney, one last question.
00:31:38And obviously, the SAFE Act is something that you already brought up.
00:31:44And Pat Cummings, as we know from his tweets and from something that I wrote, rolled up his sleeves, went
00:31:52to Washington the last couple weeks, and did the dirty work, did the work that needed to be done.
00:31:57And he came away from there very enthusiastic about the SAFE Act becoming a law.
00:32:03So, two-part question.
00:32:05First of all, the SAFE Act just bears repeating.
00:32:09That would be an act that would, among other things, prohibit the transportation of horses to Canada and Mexico for
00:32:16slaughter.
00:32:16And if it passes, that's the end of horse slaughter.
00:32:19It's just there's no avenue to take these horses anywhere.
00:32:22So, my question, well, first of all, I want to commend you for doing this work.
00:32:30It was important.
00:32:31But two-part question.
00:32:33How much more confident or how confident are you now that the SAFE Act is going to be passed?
00:32:40And you're not a guy who's shy about saying when others failed, did other parts and important parts of this
00:32:48industry fail to do the right work to get this done?
00:32:52And what did you think about the three organizations that put out, oh, we're in favor of the SAFE Act,
00:32:58at the same time, your guys in Washington, D.C., doing what maybe these organizations or other people in racing
00:33:07have failed to do over the years?
00:33:10Great question, Bill.
00:33:11I mean, some people just know me now through Twitter, which is pretty funny, by the way.
00:33:17Um, um, there's no one that uses the X.
00:33:21It's X, by the way.
00:33:22It's not even Twitter.
00:33:22So, no one uses X more strategically than me.
00:33:25I mean, so there's things that I put out there that I want people to know.
00:33:29And then there's things behind the scenes.
00:33:31You know, whether it's a major track operator, an aftercare alliance that we have, or CAW conversations that we have
00:33:40that we don't put out there.
00:33:42This is something we've been working on since the beginning of January, when we heard all the noise and thought
00:33:51that people were actually trying to move this right in the right direction.
00:33:59Once I found out that there was no moving in the right direction, I actually didn't want to publicize it.
00:34:05I didn't want to say anything.
00:34:07So, Pat and I, we hired Chris Hyde, who I think has been on your show.
00:34:12I fund everything 100%, by the way.
00:34:15I send Pat down there, like, you know, with, you know, sunglasses so no one recognizes him.
00:34:20We have all these meetings and meet with this congressman, meet that, and everything.
00:34:25He's been down there multiple times.
00:34:27I think it's, is it, is it, is it, is it Andy Barr?
00:34:31I'm trying to, I don't want to make sure.

00:34:35Pat has had numerous meetings with him, and he's been incredible.

00:34:49To me, they got word that Rapoli and Pat Cummings are working on this behind the scenes, and they're making
00:34:54progress.

00:35:00All three of them, like, one, Wednesday, Tuesday.
00:35:03Like, you're a joke, you're a joke, you're a joke.
00:35:05I haven't said anything in 20 years.

00:35:07So, they have to act like they're in.
00:35:09Just so you know, we've spoken to a bunch of people.
00:35:13So, no one's ever really come down there and spoke to them about them.
00:35:16No one's been down to D.C.
00:35:17No one from the Jockey Club is involved here.
00:35:20Nobody from the Breeders' Cup has done shit about this.
00:35:22Absolutely none.
00:35:23They just tell you that they're doing it, and they're on top of it, and it's all optics.
00:35:27The whole thing is a house of cards of optics.
00:35:30That's all it is.
00:35:32So, privately and secretly, we wanted to move this.
00:35:35We didn't need.
00:35:36We're out here to help horses.
00:35:38We're out here to help the industry.
00:35:40So, I really believe it can be done.
00:35:45And like I said, Heist is focused on fatalities at the racetrack.
00:35:49That we decided to decide if horse racing safety and integrity was just based on fatalities versus all the other
00:35:59good things you can do in the backstretch with the horses, with the people that work for the aftercare system.
00:36:07There are a lot more horses that are dying in this country, maybe 30 times more, through horse slaughter than
00:36:14on the racetrack.
00:36:15And you know what?
00:36:18But they're only worried about optics.
00:36:20They're only worried about the 100 horses that get injured at the racetrack.
00:36:24And they want to highlight that.
00:36:28They want to scare you into this is the right thing.
00:36:32Heist has not made an ounce of difference.
00:36:36I mean, maybe you get more vet scratches.
00:36:38Maybe you get more horses to new locations and aftercare.
00:36:43It's so subjective where one vet.
00:36:46You know, five vets can look at the horse and one guy can say, no go.
00:36:51And you got trainers like Bill Mott, Todd Pletcher, Chad Brown, Bob Baffert that are with these horses like, hey,
00:36:57not everybody has the same type of walk.
00:37:00Not everybody.
00:37:00What do you call it?
00:37:01I mean, I mean, in sports, there's you.
00:37:05You have bumps and bruises.
00:37:07So for a horse to be actually pretty funny.
00:37:09Look who's calling me.
00:37:10My friend.
00:37:14My nephew.
00:37:14I always call my nephew.
00:37:15So like it's it's it's it's like the wider burial situation.
00:37:21You know, he looked pretty healthy when he ran by ran by just ran by sovereignty and journalism the other

00:37:30I mean, that's going to be, you know, that's going to be a big case.
00:37:33And I don't know.
00:37:35It looks pretty good pretty, you know, right now.

00:37:43But you've got the freaking favorite for the Kentucky Derby and Renegade.
00:37:46And I'm going to guess that one reason why you may not be as gung ho and excited right now
00:37:52is because you've been through Uncle Mo.
00:37:54You've been through Forte.
00:37:56It's like Charlie Brown with the football being pulled out away from him at the last minute.
00:38:00So how are you feeling right now with Renegade?
00:38:04You got to be excited.
00:38:05You can't tell us you're not.
00:38:06You know what?
00:38:08I am excited.
00:38:09And I'm not as excited about the sport.
00:38:13But how can I not be excited about this horse?
00:38:16I have to be.
00:38:18And, yes, I've been – Lucy has fooled me a bunch of times.
00:38:24And me being Charlie Brown, I've gone for it every time.
00:38:28And, you know, I think my best chances of ever – I'm 0 for 8 with three scratches.
00:38:35So that means I got a 33% chance of even running the race.
00:38:39But honestly, I think my three best chances ever were Uncle Mo, raw talent.
00:38:47Was Forte undefeated.
00:38:51And then if you guys remember, I don't know if you remember who won the derby that year.
00:38:55It was Meij and Forte beat him twice.
00:38:56So that one hurt a little bit.
00:38:58And then he came back on a 10-week rest because he won the Florida Derby and ran second in
00:39:04the Belmont.
00:39:04And if that Archangelo doesn't get inside – gets through on the rail, we'd probably win the race, by the
00:39:12way.
00:39:13And then Fierceness, who had no excuse.
00:39:16But those were our best chances.
00:39:18I think Renegade is right up there.
00:39:20This is a horse that's intermissive with a curling mare.
00:39:25So you got the speed of being in the game early, the curling stamina.
00:39:31He looks wonderful.
00:39:32He's training incredible.
00:39:34Now I'm going to get more anxiety talking about this.
00:39:36I'm trying to look the other way.
00:39:38And he's only going to get better with more distance.
00:39:40And when he comes home, you know, at his 16th and under 6 seconds or comes home at the last
00:39:468th and under 12, that big Churchill stretch is going to look awfully good if Irad can just get him
00:39:56outside in 5th or 6th or 7th place and good luck, you know, down that last quarter of a mile.
00:40:01So, yeah, you get excited by that.
00:40:03So was there ever any doubt that your nephew, Irad or Tees, would pick, further ado, over Renegade?
00:40:11I mean, I would have taken him out of the will.
00:40:14I mean, come on.
00:40:16You know, I mean, 40 years from now, it would have cost him and his kids and his grandkids a
00:40:21lot of money.
00:40:22So, you know what?
00:40:23And Zoe, it's a great question.
00:40:25Listen, these agents and the jockeys.
00:40:28I love Irad.
00:40:29I love Johnny.
00:40:30I love a lot of jockeys.
00:40:32But even Todd Pletcher and I, I want Todd Pletcher and Irad Ortiz to win the Kentucky Derby or Johnny

00:40:57the best jockey on their horses before mine.
00:41:00And with Irad, I would never be upset if he went on a horse that he thought could win more.

00:44:12She looked like she was huge and Zany too.
00:44:15So we paid three 50 for an American pharaoh.

00:51:24Her first win since last year at the fairgrounds.
00:51:27And her first graded stakes ever.

00:52:00Mike, all is interesting.
00:52:01In our first segment, we were talking about White Iberio's win in the Oakland Handicap,
00:52:06and he was in the news for more than just that during the week.
00:52:09The owners of White Iberio came out and sued the California Horse Racing Board,
00:52:14the Breeders' Cup, and Del Mar over the fact that they scratched the horse
00:52:19prior to the 2025 Breeders' Cup dirt mile, and obviously didn't let him run.
00:52:25And not only scratched him, scratched him with just a few minutes to post.
00:52:29It's very interesting reading.
00:52:31I've read all 14 pages of the lawsuit, and I've got a lot to say about this and a lot
00:52:37of thoughts.
00:52:38First of all, they made some very good points in there.
00:52:43Namely, that this horse was cleared time and time and time again throughout his career
00:52:49and even during the week of the race, and that they admit that he has what they call
00:52:55a choppy gait, but said that veterinarians had always realized that's just the way the
00:53:01horse goes and that he is sound, and they have let him race.
00:53:04Matter of fact, Dr. Brent Cassidy, who was the one who scratched him out of the 2025 dirt
00:53:10mile, is the same veterinarian who passed him when he won the 2023 Breeders' Cup Classic.
00:53:18So they make a very good case that this just doesn't make any sense.
00:53:23How can you pass the horse time and time and time again, including during the week of the
00:53:28race, then, oh, by the way, three minutes to post, we're going to scratch him.
00:53:32So I think the veterinarian, in hindsight, obviously made a mistake.
00:53:38Look what the horse has done since then.
00:53:40I also understand that these regulatory veterinarians are in a very difficult position, but I also
00:53:45will say this.
00:53:46I don't think they can win this lawsuit, Randy, and I'll let you go to that because it's a
00:53:53judgment call, and they have to prove to me.
00:53:56I'm not a lawyer, and I hate that so many things we talk about get involved in this legalese
00:54:02and lawsuits and whatnot, but unless they can prove some sort of malice or prejudice against
00:54:09this horse, this was someone who's just doing their job, making a judgment call.
00:54:13Again, I think he made a bad call.
00:54:15I think all the evidence that they put in the lawsuit suggests that he made a bad call,
00:54:20but people are human.
00:54:21They made bad calls.
00:54:22These regulatory vets are in very difficult positions, and they deserve to be mad.
00:54:28They deserve to be furious.
00:54:29I think they got shafted, but no, I don't think they're going to win this lawsuit.
00:54:34Yeah, I mean, I have no idea about the merits of the lawsuit and the chances that they have
00:54:39of winning.
00:54:42I will make a couple of points.
00:54:44Number one, in defense of the regulatory veterinarians, we have seen time and time and time again
00:54:54in major races like the Triple Crown races and like the Breeders' Cup races where horses
00:55:01are scratched by the regulatory veterinarians, not necessarily on the track, but the weak
00:55:07of, and you hear loud cries of complaints from the owners and the trainers, and then lo and
00:55:15behold, the next thing you read is that the horse has undergone surgery or the horse has
00:55:20been out for eight months or 10 months or a year before he comes back to the races again.
00:55:25And oh, by the way, obviously the regulatory veterinarians were correct in their judgment
00:55:30to scratch the horse.
00:55:31And some of this you have to realize, and people that are involved in horse racing realize
00:55:38this, when a trainer complains about his horse being scratched, it's not rare for a trainer
00:55:48not necessarily to approve of running a horse in a Breeders' Cup race, but being forced to
00:55:56run by an owner who very much wants his horse to run.
00:56:00And a lot of times the trainer, he can't call his owner out if the horse, if the veterinarian
00:56:05scratches the horse, he can't say, well, my owner made me enter him, I didn't really want
00:56:09to run.
00:56:09He's not going to throw his owner under the bus.
00:56:12So the trainer therefore has to sort of kind of, you know, take offense to it and, you know,
00:56:19publicly question it.
00:56:19Um, I think it all comes down to, uh, we, we all want horse safety.
00:56:26Uh, are you comfortable with this scenario?
00:56:31Veterinarians see a horse daily.
00:56:33They test a horse, they do pet scans, whatever on the horse, the horse is just fine, passes
00:56:41all the tests.
00:56:41They get to the races, the horse is warming up on the track and one veterinarian out of,
00:56:48let's say six who are watching the horses decides that he or she doesn't like the way
00:56:55that horse is moving and recommends a scratch.
00:56:58Is that okay?
00:57:00Is it okay for the horse to pass batteries of tests all week long and only one out of,
00:57:05let's say six veterinarians thinks the horse should be scratched and therefore the horse is
00:57:10scratched.
00:57:11If you think that's acceptable to try to prevent what we all don't want to happen on the racetrack
00:57:19is, is a horse injury, then that's just, you know, you're just going to have to swallow
00:57:24that, uh, that sometimes these things will happen and sometimes horses that shouldn't be
00:57:29scratched will be scratched.
00:57:30If you think that that's maybe a little over the top, then something needs to be changed.
00:57:37It's a tough call.
00:57:38It really is.
00:57:39I'm pretty sure there is no veterinarian in the country that would like to scratch a horse
00:57:46in the post parade of a Breeders' Cup race.
00:57:50You could ask every single one of them and that would be their worst nightmare to scratch
00:57:55one in the post parade of a Breeders' Cup race.
00:57:58Now, many different things can happen.
00:57:59Yes, he could have, any horse can jump through all the hoops prior to the race and I'm not
00:58:04on one side or the other, but I've ridden many horses in the afternoon.
00:58:09I've even scratched a couple that I've been on in the morning that were absolutely fine.
00:58:14Horses are fickle creatures.
00:58:16If there's a way to hurt themselves, God damn it, they will.
00:58:19They could be standing in the stall and kick it a fly and kick the wall.
00:58:23You wouldn't even know.
00:58:24You lead the horse over.
00:58:26Horse is absolutely fine.
00:58:28Jock takes it out on the racetrack.
00:58:30Oh, it's lame.
00:58:30What the hell happened?
00:58:32You weren't in the stall 24-7 with it.
00:58:34You don't know if that horse kicked the wall.
00:58:36You don't know if the pony kicked him.
00:58:38You don't know if the pony stood on his foot.
00:58:41There are an infinite number of things that can happen between the time that horse passes
00:58:47the vet in the morning and to get to the starting gate in the afternoon.
00:58:53A number of things.
00:58:54Now, I don't know if that happened to him.
00:58:55I've got no idea.
00:58:57I'm just playing devil's advocate that your horse can be sound in the morning and lame in
00:59:01the afternoon.
00:59:03I've seen it.
00:59:04I'm not saying he was or he wasn't.
00:59:06It's just going to be a very hard thing to prove in a lawsuit.
00:59:10I just like to add one more thing to this and that another thing, I think if they win
00:59:15the lawsuit, it sets a precedent that maybe the horse racing industry does not want.
00:59:21Think of the vets in the future thinking, oh, my God, if I scratch this horse and it turns
00:59:27out that people are going to question it, maybe I'll get sued.
00:59:31This is going to put extra pressure on these vets, I think, and that, you know, maybe they'll
00:59:36be afraid to make the tough decisions if they think that a lawsuit is hovering over their
00:59:42heads.
00:59:42So I'm on board with pretty much everything both you and Randy, Zoe, both you and Randy
00:59:47said.
00:59:47But it is a difficult case.
00:59:49I don't think they're going to win.
00:59:51But I also don't think it was handled.
00:59:53I think it was handled very poorly from the start to finish, including the fact that there
00:59:57was no transparency whatsoever, that they never told the betting public what was going
01:00:02on.
01:00:02They apparently never really even said anything to the owners until well after the race.
01:00:06So hopefully from that respect, horse racing can learn some lessons from this.
01:00:11But this will be an interesting case.
01:00:13We'll see where it goes.
01:00:14And again, I don't blame these guys for being mad, but as happens with so many times, I think
01:00:24the ultimate winners here are going to be the lawyers, and that's the case.
01:00:28All right.
01:00:28So before we go to the break, I want to just let people know that there's a new horse rescue
01:00:35operation out there that goes by the name of HERF.
01:00:38And what it is, is the Haiza Equine Recovery Foundation.
01:00:42And now this is something that is doing some very important work in horse racing that hasn't
01:00:48been done largely outside of the Stronach Group tracks.
01:00:51And what the Stronach Group started was that they were taking horses that were injured, but
01:00:57were not injured.
01:00:59They were injured to the point where they could not race anymore, but not injured to the point
01:01:03where they were a definite candidate for euthanasia.
01:01:07Now, owners in that situation are faced with a difficult decision.
01:01:12Knowing the horse is never going to race again and may not even be able to be repaired to
01:01:16the point where they could be an equestrian horse or riding horse, et cetera.
01:01:20Do they pay the money to have the surgery performed?
01:01:24We can understand why some people say no.
01:01:27They may not be able to afford it.
01:01:28They may not see the practicality of it.
01:01:30So what the Stronach Group did and what this organization called HERF now is going to pick
01:01:36up in the Midwest and Northeast is to let the veterinarians know that if there's a horse
01:01:42that is in this situation, they are going to fix the horse up at no cost.
01:01:48Root and Riddle is going to perform the surgeries for free.
01:01:51It's an absolutely great initiative.
01:01:54And even though it is called, I know there's people say, oh, it's Haiza.
01:01:58So automatically 50% of the people are probably going to think it's a bad thing.
01:02:03Haiza only kickstarted this.
01:02:04They're not controlling this.
01:02:05They're not behind it.
01:02:07They just got it started.
01:02:08And every single Haiza employee there was, every single one donated out of their own pockets
01:02:15to get this charity going.

01:05:19The first day, usually, they get to know around, but after he fasts, he's like, you can tell
01:05:25it's more relaxed and more smooth.
01:05:27I mean, he does everything nice.
01:05:29Switch legs, everything really, really nice.
01:05:31Is this the most expensive horse you've ever ridden?
01:05:34Probably, yeah.
01:05:35Yeah.
01:05:36Cool dude.
01:05:37He needs a good nickname.

01:06:34And, you know, we see the million-dollar sales, the $2 million.
01:06:37And at this point, we don't even blink when people pay that kind of money.
01:06:41And lo and behold, here comes Amherz Zydan buying a son of Flightline for $10.5 million,
01:06:50which probably from a business standpoint doesn't make a whole lot of sense.
01:06:54But it's his money.
01:06:56He dreams of winning the Kentucky Derby.
01:06:58And if the horse doesn't, goes on to be a great stallion, he's going to make a lot of money.
01:07:03If the horse doesn't live up to those expectations, he's going to lose a lot of money.
01:07:08But, Zoe, you were front and center.
01:07:10What was it about this guy that made him the $10.5 million horse?
01:07:16He was a wow individual.
01:07:17I actually saw him the day before he breezed.
01:07:20I was at the Hartley-Dorenzo consignment and I had a look at their Jackie's Warrior brazen persuasion,
01:07:26who, by the way, set the record on day two of the sale, selling for $2.3 million.
01:07:32So they already started off a good sale.
01:07:35Anyway, I looked at her.
01:07:36She was lovely.
01:07:37And then Dean said, hey, come here, Zoe.
01:07:40Look at this guy in this stall.
01:07:41And there was no plaque up that told you the breeding.
01:07:43So I go in the stall and I'm like, whoa, there's this huge, big, burly horse.
01:07:49Looks like a three-year-old standing there.
01:07:51And I'm like, what's that, an intermischief?
01:07:53He's like, no, it's a flight line out of an intermischief mare.
01:07:57So the next day, he breezed.
01:08:00I can't even remember what set he was in.
01:08:02But he was just amazing.
01:08:05Nine and three down the lane and just kept galloping out.
01:08:08It's not often that horses will gallop out like sub-22 and then sub-34.
01:08:14He just kept going.
01:08:16And watching him at the barn, he just looks like a man against boys.
01:08:21We'll just leave it at that.
01:08:23He's absolutely gorgeous.
01:08:24We had over under a $5 million on him.
01:08:27I was fortunate enough to be up on the rostrum
01:08:31and had the best seat in the house when the bidding started.
01:08:35And just phenomenal.
01:08:36The buzz in the place.
01:08:37I've never seen anything like it.
01:08:39Ryan Mahan, the lead auctioneer there and at Keeneland,
01:08:42I was sitting next to him and he's like,
01:08:44I've never seen anything like this in 30 years.
01:08:46There were people stacked five deep in the back walking ring to see him.
01:08:51I literally had to yell down the microphone.
01:08:53I'm still getting used to that.
01:08:55I might have messed up a few times, but trying to read off the pedigree page.
01:08:59But the whole of the indoor auditorium was packed full of people.
01:09:03Round of applause.
01:09:04And then the auctioneer, Justin, was like, just hold your applause till he leaves.
01:09:09And then he's like, oh, what the hell?
01:09:10No, applause.
01:09:11Nothing bothers him.
01:09:12He stood up there for five minutes like he was tied to the feed bowl.
01:09:15What a classy individual wishing Bob and Amma the best of luck with him.
01:09:20Already went to the track at Santa Anita.
01:09:23Just looks like a superstar.
01:09:24But again, you never know until they run.
01:09:27You just don't know.
01:09:29Was Zidane there?
01:09:30No, he wasn't.
01:09:31And Bob wasn't even there.
01:09:33Nope.
01:09:33He was on the phone.
01:09:34Bob had already left.
01:09:37So Donato likes to bid in the press box.
01:09:40So I can see Donato there.
01:09:42And the other two bidders were out the back.
01:09:45It was the Japanese.
01:09:46I believe it was Northern Farm.
01:09:47And then you've got West Point on the back with Jane Lyon, who flew up, especially that morning.
01:09:53It was like a cash call called Jane Lyon.
01:09:56They were out back and they were underneath.
01:09:58And I believe Donato was on the phone telling Amma, I'm going to hang up in a minute.
01:10:03I'm hanging up.
01:10:04And Amma was like, don't you hang up on me.
01:10:06I'm buying that horse.
01:10:08I told Donato afterwards, I don't think I've ever seen you sweat before.
01:10:12Oh, man.
01:10:13And the Yoshidas were involved, too.
01:10:15That's cool.
01:10:16Wow.
01:10:16So it was a very cool experience.
01:10:19In fact, the wholesale was very cool.
01:10:21I'll read off some of the stats here.
01:10:22$113 million gross, which has surpassed any gross ever.
01:10:28Last year, it was $88.4 million gross.
01:10:31So that's already up.
01:10:33The median was way up, $80,000 for the median.
01:10:38I think the buyback rate was $17.8, just up a tick from $16.6 last year.
01:10:44But all across the board, terrific gains.
01:10:48It was a fabulous sale.
01:10:49They do have their OBS second chance digital sale, which is for unsold, horses that were
01:10:55unsold going through the sale or were breezed and scratched.
01:10:59And there were a lot of those kind of middle market horses that were taken out.
01:11:03They do have the last chance digital sale.
01:11:06They'll have the same numbers.
01:11:07And that sale starts on the 24th through the 28th of April, starting at noon on the OBS
01:11:13website.
01:11:13And the horses have their same hit numbers, so it makes it easy.
01:11:17So you can go on there if you didn't get a chance to buy anything and take a look at
01:11:21the horses that went through the April sale.
01:11:23But through and through, that was exciting.
01:11:25So we like to end the show each week by reading off some of the comments that people are posting

01:12:54is running in a million-dollar grade one race, who would you want to ride that horse?

01:13:03I would look at the top, I don't know, 10 jockeys in America, right?
01:13:09Mm-hmm.
01:13:12Doesn't matter.

01:13:21if you start off with, let's say, Tyler Gafleone, and he wins, I mean, I guess you want to try
01:13:27to keep Tyler Gafleone, but I've had riders tell me that sometimes the very first time they
01:13:32ever sit on a horse's back with no preconceived notions are the best times that they've, you
01:13:37know, so to me, top jockeys, they're so good, the difference between them is minuscule.
01:13:44They can all win with the best horse.
