00:00You claim she assaulted you.
00:02She hit me first, Your Honor.
00:04She kicked me, and I almost got hit by a car, Your Honor.
00:07She approached me to my vehicle.
00:08She was calling me names, and she wanted to fight me.
00:11And then you got out of the car.
00:13I didn't do anything wrong.
00:15When I walked up to her, I defended myself.
00:18This is Judy Justice.
00:37Karen Casas is suing car buyer Destiny Jones for impound fees, parking tickets, and an assault.
00:45Court come to order.
00:46All rise.
00:49Have a seat, please.
00:52Judge, case 4018, Casas v. Jones.
00:56You're welcome.
00:58Ms. Casas, you sold the defendant an old car.
01:01Yes.
01:02And you claim that as a result of her not following through with your agreement,
01:07which was to register the car immediately, she accumulated tickets.
01:12The car became impounded.
01:13You had to go and get the car out of impound.
01:16You had to do that twice.
01:18Ultimately, you repossessed it.
01:19She took it back.
01:20All of this resulted in expenses for you that far and exceed the value of the car.
01:25Yes.
01:25The defendant, Ms. Jones, says she purchased the car from you.
01:29She paid you $1,600 for the car.
01:32It was a 2007?
01:357.
01:36Hyundai Tucson.
01:37Now, when you sold her the car, on what date?
01:41I sold you the car on February 1st, 2024.
01:44What date?
01:45The 25th of February.
01:46No.
01:47It's not true.
01:47I have evidence.
01:48I have it right here.
01:49Excuse me, Your Honor.
01:50I have it.
01:51Shhh.
01:51Show me what you have to demonstrate that the car was sold on February 1st.
01:58And you can show me what you have that established the car was sold on February 25th.
02:13What's this $200 finder's fee?
02:15My cousin charged us both $100 each for connecting us together and her selling the car to me.
02:21So I paid her that, the date of purchasing the vehicle.
02:25Well, I don't know whether you did or whether you didn't.
02:27And then the transaction fee, sorry, on the other page.
02:32Well, I have your release of liability, but that's in May.
02:36But it says on the date over there, on the date that I sold her the car.
02:40Well, you put the date.
02:41Yes.
02:42You put the date in.
02:43Yeah. Why would I do that if I was lying, though, you know?
02:45I remember.
02:45Because you didn't remember.
02:47But you put the date in.
02:48This doesn't have anything that suggests that it was the beginning of February as opposed to February 25th.
02:54You got a release of liability of the car on May 1st.
02:58Yes. Well, may I, Your Honor?
03:00No, not yet.
03:02Had the car been registered at the time that you sold it?
03:06Yes, it was registered to me, Your Honor.
03:09I have the registration if you'd like to see it.
03:11I just want to know, when you sell a car, you live in California.
03:14Yes.
03:15When you sell a car in California, you have to have, along with the title,
03:18you have to give a smart test that's valid within the last 90 days.
03:22Did you have that?
03:23Yes, I do.
03:23I'd like to see it.
03:24Yes.
03:35This car was smogged 11-24-2023.
03:41Why couldn't you register the car?
03:43When I went to register the car, the car needed to be smogged.
03:48I have my title saying that it's a temporary registration.
03:52She didn't provide me the smog certificate when I purchased the car off of her.
03:56She never asked me for it, Your Honor, but I would have gave it to her if she would have
03:59asked me.
04:00Well, that's a problem.
04:02I understand, Your Honor.
04:03Because you have to provide this.
04:05This is my first time with selling a car or having experience, but I held on to it, and I
04:10do know
04:11that now, Your Honor, so I do understand why I was wrong.
04:13So she couldn't register the car without a smog test unless you had it retested.
04:19But when you purchased the car from her sometime in mid-February, when you purchased the car from her,
04:26she did, in fact, give you the title.
04:28Um, she gave me the title two days after because we were supposed to meet at the DMV,
04:32which she never did because...
04:33Shh, just a second.
04:34She gave you the title?
04:36Yes.
04:37On what date?
04:38She gave me the title on the 27th.
04:40Okay, so now you have the title.
04:44Mm-hmm.
04:44And now it's up to you to get the car smogged.
04:48Do you work?
04:49Um, at the moment, no.
04:50No, not at the moment.
04:51No.
04:51Then?
04:52Then, no.
04:54What did you need a car for?
04:55To see my daughter.
04:56She lives in Whittier, and I live in South Central.
04:58Between February 27th and May 1st, did you see your daughter?
05:04Mm-hmm.
05:05Uh-huh.
05:05Is not an answer.
05:06Yes, I did.
05:07And you drove there.
05:08Yes, I did.
05:09And you drove there in her car.
05:12That would be a yes.
05:13No, I drove there in my car.
05:14Well, you drove there in a car that you had purchased from her,
05:17but didn't complete your contract with her.
05:20You drove a car where she had given you the title to the car
05:25so that you had the ability to register it.
05:28You just had to do a little more work.
05:30So it's not that you didn't have use of a car.
05:34You had use of a car, but she had all the liability
05:37because it was still in her name.
05:39You're smart enough to understand that, right?
05:43You're smart enough to understand that if the car is still in her name,
05:47then she will be responsible for parking tickets
05:51or moving tickets that you get for the car.
05:55Because her name is still the registered owner of that car, right?
06:01Yes.
06:02Great.
06:06I approached her, and she was already coming out all crazy at me,
06:10and she pushed me in the street, and I almost got hit by a car, Your Honor.
06:13I didn't do anything wrong.
06:14If she would have provided me the smog certificate,
06:17then none of this would even be happening.
06:29Karen Kosas claims car buyer Destiny Jones purchased her car
06:34and never transferred the title, causing Karen to receive parking tickets in her name.
06:40Now I'd like you to show me tickets that accumulated on the car
06:45between, let's say, the third week in February
06:50and May 1st, when you finally removed yourself from libel for the car.
06:55Your Honor.
06:57I don't need to speak to you yet.
07:02Okay, so here's one parking ticket that's on the 26th of February.
07:07So 26th, according to you, you had the car.
07:10Mm-hmm.
07:11So this is your ticket.
07:12Okay, that's fine, yes.
07:13Did you pay it?
07:15No.
07:15You got it.
07:16Listen to me.
07:17I didn't...
07:18No, no, no, no, no.
07:20That's baloney.
07:21You got it because it wasn't a moving ticket.
07:24You parked on the street where there was no parking, street cleaning.
07:28So when you got back to the car, there was a ticket which you took and discarded.
07:35Okay, and here you were double parking in March.
07:39Uh, who is at the street?
07:43I live on...
07:45Well, then what were you double parking for?
07:48I live in South Central and the apartment complex I moved into doesn't have a parking lot for their
07:54tenants.
07:54And the parking is really, really bad there.
07:56I have pictures of the streets, like, in the middle of the day.
07:59Who cares? What does that have to do with her?
08:00You get a parking ticket because you double parked your car.
08:03Then you pay it.
08:04Your Honor, if she would have provided me the smog certificate when she sold me the vehicle,
08:08then nothing would have been in her name.
08:10Listen to me.
08:11Shoulda, woulda, coulda.
08:12What did that have to do with you double parking the car?
08:14You were driving it.
08:16Duh!
08:17You were driving the car.
08:19You were violating the rules by not parking it in the right place.
08:24What does that have to do with smog?
08:26Explain it to me.
08:28Maybe I'm stupid.
08:29What does the fact that you didn't get a smog receipt have to do with you violating the law,
08:35getting tickets, and not paying them in a car that you were using?
08:40Can you explain that to me?
08:41No, you can't.
08:42Okay, good.
08:44Not as dumb as I thought.
08:48Okay, so you were getting these.
08:50There were two parking tickets.
08:51Is that right?
08:52Yes.
08:52Okay, and you sort of got fed up with the two parking tickets,
08:56and you tried to contact her.
08:57That didn't work out.
08:58So I reported the car stolen because I...
09:01I understand.
09:01That's where I'm getting to.
09:02Okay.
09:03But the car was not stolen.
09:04So you know that that's not the right thing to do.
09:06It wasn't stolen.
09:07She had paid you for the car.
09:09Your Honor.
09:10You returned over the title to the car.
09:11The car wasn't stolen, madam.
09:13May I, Your Honor?
09:14Sure.
09:15Okay, so upon selling her the car, when I gave her,
09:18when she gave me the money, I told her we had a verbal agreement.
09:20And I said, if you don't take me to the DMV tomorrow,
09:23because I did not want to be liable for anything,
09:26that I could give you the money back.
09:28This goes, all bets are out the door.
09:29Okay?
09:29We had a verbal agreement.
09:30She knew that, and she never came.
09:33So...
09:33What does that have to do with you reporting to the police?
09:37She wasn't answering her phone, Your Honor.
09:39I had started getting tickets in the mail already,
09:41and so when I was trying to contact her,
09:42she wasn't answering my phone calls.
09:44So I figured if I got her attention by reporting the car stolen,
09:48that she would then see, maybe I should transfer the title to the police.
09:51I just want to tell you something.
09:52It's expedient, but when you falsely report an incident,
09:57which is what you did, you falsely reported a crime.
10:01Yes, Your Honor.
10:02Not a breach of some civil contract, but you falsely reported a crime.
10:07That is a crime.
10:09I understand, Your Honor.
10:10Okay.
10:10I just want you to understand that.
10:12That people can't do that and sort of resort to, because it's expedient.
10:19Well, I'll report it stolen, and that way the police will get involved,
10:22and that way it'll get her attention.
10:23That's not what the police are there for.
10:25The police are there to take care of crimes.
10:27This is not one.
10:28Just letting you know.
10:29Okay.
10:30Okay. Now, then the car was impounded.
10:33Yes, Your Honor.
10:34Why was the car impounded?
10:36Because she reported it stolen.
10:37And is that when you had to retrieve the car?
10:40Yes, so I...
10:41Just a second.
10:41Then you had to retrieve the car.
10:43Yes, ma'am.
10:44Because you reported it stolen, and they picked it up.
10:46And how much was that?
10:47It was $900 the first time.
10:50Okay. So that you don't get back,
10:52because you don't get rewarded for committing a crime.
10:55I understand, Your Honor.
10:56Okay?
10:56Okay.
10:57Now, the car was impounded a second time,
10:59because you took the car back.
11:02Did you get the car back?
11:03Yeah, the date...
11:04Shh!
11:04Did you get the car back?
11:06Yes.
11:07On what date?
11:08On April 2nd.
11:10How did you get the car back?
11:12Karen told me where it was at.
11:13It was at her father's house.
11:14That's not true.
11:15You got the car back on April 2nd?
11:17Mm-hmm.
11:18Uh-huh.
11:19It's not an answer.
11:20Yes is an answer.
11:21Was the car impounded again?
11:23Yes.
11:23On what date?
11:25May 20th.
11:26For what?
11:27For allegedly blocking a driveway.
11:29Blocking a driveway where?
11:31On the street I live on.
11:34Okay.
11:35Where's the car now?
11:36I have it.
11:37It's outside.
11:38Is it now registered in your name?
11:39The car...
11:40I registered the car...
11:41That's either yes or no.
11:43Yes.
11:43On what date?
11:44April 2nd.
11:46I have the evidence.
11:48May I see the registration for the car, please?
11:58Okay, so as of the beginning of April, the car is registered in her name.
12:03Now, the car was towed a second time on what date?
12:08They retrieved it on 5-20-2024, and it was also in the impound for 19 days.
12:14Well, 5-20, what did you take it out of impound for?
12:16Um, 19 days later, well, because they sent me a letter,
12:18because I was still the registered owner at that time.
12:20No, not on May 20th.
12:22But that's what the tow yard people here, this is from the tow yard.
12:25They're mistaken.
12:26According to this, she registered the car in April.
12:30Well, Your Honor, the tow yard had informed me,
12:33and they sent me a letter saying that I was still the legal registered owner,
12:36and that she was just an interested party.
12:38What I'm telling you is...
12:39I believe you, Your Honor.
12:40I just...
12:41Your problem is, if the tow company was wrong, which clearly, based upon this,
12:47which was stamped April 2nd, and if they towed the car because she was double parked on May 20th,
12:55then the tow company got it wrong.
12:57Yeah.
12:58Then you can't sue her, you sue the tow company.
13:00But she still wasn't able to get it out.
13:02Who cares?
13:03It was in there for 19 days.
13:04Who cares?
13:0419 days.
13:05It had nothing to do with you anymore.
13:07At that time, I wasn't aware of that.
13:08I didn't know that, you know?
13:09You were aware of it because you...
13:10I...
13:10Shh!
13:11You were aware of it because in the beginning of May,
13:14you signed a release of liability at motor vehicles.
13:17Yes, I did.
13:18So you were aware of the fact that a month before, because it was released to you in June,
13:24you were aware of the fact that you would sign this release of liability because you were concerned about her.
13:30Okay, I would take this up with the tow company.
13:33If I were you, I'd be more than delighted to hear it.
13:36Okay.
13:36If everything is, as you indicate, that the tow company got it wrong.
13:41All they had to do was upgrade their information about this car,
13:45and they would have found out that the defendant was the registered owner.
13:48And if she wanted to get it out, she'd have to stop blocking other people's driveways.
13:53Okay.
13:56I didn't exchange any names with her.
13:58She exchanged names with me.
13:59So what did you do?
14:00I approached her, and then she hit me with the dog leash.
14:03She did?
14:04Yes.
14:04No, I didn't.
14:04Well, what were you, just a second.
14:06What were you going to do when you approached her?
14:10Stop.
14:11Stop and think.
14:21Karen Kossis is accusing car buyer Destiny Jones of purchasing her car and never transferring the title.
14:30Karen also claims Destiny assaulted her, but Destiny says it was self-defense.
14:37So who paid these parking tickets?
14:39My friend Bob, he lent me the money, and he was holding onto the car for me until I was
14:44able to pay him back,
14:45which I did pay him back.
14:45I just wanted you to show me receipts that the parking tickets were paid.
14:50Um, my friend Bob's not around right now.
14:53He's sick, you know.
14:53Well, and then I actually can't help you.
14:56They wouldn't have allowed her to register the car if there were outstanding parking tickets on it.
15:02So I don't know who paid for the parking tickets, but you have no proof that you paid for the
15:06parking tickets.
15:08Okay, now after the car was impounded for the second time, you claim she assaulted you.
15:14Yes.
15:14Tell me when and where that happened.
15:16Okay, um, it was two days after the car had gotten out and, um, she...
15:20Gotten out of when?
15:21At the tow, the tow yard, the second time.
15:23The second time, so that was in June.
15:24Yes, June, yes. June 7th.
15:27Now, the car was in impound for 19 days. Why?
15:30I was waiting for my, um, program to assist me with pulling it out of the impound.
15:34I live in a, uh, with the homeless program.
15:37They helped me in payment rent and stuff,
15:39so they were gonna assist me with getting the car out of the impound.
15:41But you didn't.
15:42No, I didn't.
15:43She, her and, um, her friend pulled it out of the impound.
15:46And I also have a police report.
15:48I filed a police report when I needed to retrieve the vehicle back from him.
15:51Okay, so you found out where the car was and you got it back from her friend.
15:55Mm-hmm.
15:56Uh-huh, is not an answer.
15:57Yes, sorry, Your Honor.
15:57Yes, it's an answer.
15:58Yes.
15:58Okay, and after that, you had a confrontation with her.
16:01Tell me about that.
16:02I was in my vehicle that I bought from her.
16:04She approached me to my vehicle, walking towards me, and she was calling me names.
16:09That's not true.
16:09And she wanted to fight me.
16:10So I walked up to her.
16:12When I walked up to her, she hit me with her dog leash.
16:14And then I defended myself.
16:16Let me ask you this question.
16:17We're gonna go back slowly.
16:19According to you, you were sitting in your car in the driver's seat.
16:22I was in the passenger seat.
16:23In the passenger seat.
16:24Who was driving?
16:25My friend, who doesn't have a license.
16:26Friend, shh.
16:28So your friend's driving.
16:30Yes.
16:30And you were in the passenger seat.
16:32Mm-hmm.
16:32And she approached you while you were sitting in the passenger seat.
16:35I got out of the vehicle.
16:36Oh, that's a different story.
16:38I believe that.
16:38So she's calling, just a second.
16:40So she's calling you names.
16:41And instead of staying in the car, you got out of the car.
16:44And then what happened when you got out of the car?
16:46When I walked up to her, she...
16:48So you walked up to her.
16:50She was already walking to me.
16:52Show me somewhere in the room where she was when you got out of the car.
16:56For instance, I was in the vehicle over here and she was over here at this black wall.
17:01And she was walking with me.
17:02So from there, just a second.
17:03So from there, she's walking and shouting at you.
17:06So she didn't come up to the car window and start screaming at you.
17:09No.
17:10She was far away when she allegedly started to call you names.
17:13Yes.
17:14And then you got out of the car.
17:15Yes.
17:15And you were exchanging bad names back and forth.
17:18I didn't exchange any names with her.
17:20She exchanged names with me.
17:21So what did you do?
17:22I approached her and...
17:24And then she hit me with the dog leash.
17:25She did?
17:26Yes.
17:27No, I didn't.
17:27Well, what were you...
17:27Just a second.
17:28What were you going to do when you approached her?
17:33Stop.
17:33Stop and think.
17:35You approached her.
17:36And she was clearly close enough so that, according to you, she could hit you with the dog's leash.
17:43And according to you, you weren't saying anything to her.
17:46What did you approach her for?
17:52Why did she even do all of this to begin with?
17:55I didn't do anything wrong.
17:56She failed to provide me the smog certificate when I purchased the vehicle.
17:59If she would have provided me the smog certificate, then none of this would even be happening.
18:08That's what I have to deal with, Your Honor.
18:10Yeah, you're right.
18:11All right.
18:11Tell me your version of what happened after the car was released a second time.
18:15So, by the shelter that I live at in Whittier, it was off of Greenleaf, a 7-Eleven right there
18:21on
18:21the corner.
18:22There was video surveillance of it.
18:24And so, okay, so I approached her and she was already coming out all crazy at me.
18:30And she hit me first, Your Honor.
18:32And I told her, let me put my dog down.
18:34Let me tie my dog up.
18:35Because I was ready to fight back and defend myself, okay?
18:38And that's the truth, okay?
18:40She wouldn't let me tie my dog up.
18:41So, she continued to assault me and start hitting me.
18:44So, I was just trying to, you know, protect myself.
18:47And I did hit her with a dog leash, because that's all I had.
18:49My dog ended up getting stepped on.
18:51And so, when I went to go grab my dog, because my attention then went to my dog.
18:55So, I picked him up and she pushed me in the street.
18:58Like, she kicked me.
18:59And I almost got hit by a car, Your Honor.
19:01Okay.
19:02There is video surveillance of it.
19:03And the 7-Eleven.
19:04Well, I'd like to see it.
19:05Well, the 7-Eleven, they told me I had to get a subpoena.
19:07Don't tell me what they told you.
19:08If I don't have it, it doesn't exist.
19:10Do you have a police report?
19:12You're right.
19:12Um, I couldn't retrieve it in time, Your Honor.
19:14So, you don't have a police report.
19:15I don't, Your Honor.
19:15Do you have any medical proof that you saw any facility, urgent care, emergency room?
19:22The answer is yes or no.
19:24No, Your Honor.
19:24Do you have any photographs of your injuries?
19:26No, Your Honor.
19:27All righty.
19:28So, we have, A, no proof that you paid the parking tickets.
19:33We have, B, a first impound of the car that happened as a result of you committing a crime
19:39and reporting a stolen vehicle.
19:41Right?
19:41Yes, Your Honor.
19:42We have a second impound of the car because the towing company failed to adequately research
19:48who owned the car.
19:50So, she's not responsible for that.
19:52That's the towing company.
19:53And you have no proof of the assault of any injuries as a result of this confrontation
19:58between the two of you.
20:00No police reports.
20:01No video surveillance that you say exists.
20:04And no medical reports because you didn't seek medical attention.
20:07Am I correct?
20:08Yes, Your Honor.
20:08On all of those things.
20:10Perfect.
20:11Case is dismissed.
20:12We're done.
20:12Thank you very much.
20:13This court is adjourned.
20:20Well, it was about the car when it got impounded the second time.
20:23You know, I had to pay almost $1,400 to get it out.
20:26And that was like almost as much as I sold her the car for, which was $1,600.
20:30So, I don't even know what the big situation about all of this is really to begin with
20:34because I bought the car from her.
20:35And I don't know what her problem is with me.
20:38I don't know why she even approached me the way she approached me.
20:41She would have transferred the title like she was supposed to the first day.
20:44After I sold her the car, then none of this would be happening, you know?
20:47She sold me the vehicle and she didn't provide me the smog certificate.
20:51And it worked out how I expected it to.
20:55I actually would look forward to trying the second part of that case against the towing
21:01company because the most legitimate argument she had is against the towing company on the
21:07second tow, which really failed to do a proper investigation of who owned the car.
21:11I agree that she should sue the towing company for getting it wrong, but
21:15I don't know if I would have done anything different in her shoes just because when
21:18you receive something like that in the mail, it's kind of startling.
21:20It doesn't belong.
21:21The car doesn't belong to me.
21:22I signed a release of liability.
21:25Yeah.
21:25It's not mine.
21:26I think she's got a good case against the towing company.
21:28Yeah, I agree.
