00:00to be before a grand jury, this was really perhaps a foregone conclusion that this might happen.
00:04Let me ask you, because as I understand it, intent is key here.
00:08Proving intent is key to getting beyond the indictment, getting conviction on these charges.
00:13Explain why and how one would go about proving intent here.
00:16Well, in order to be forthcoming with you about what they want,
00:19because they know they've got this sort of Damocles.
00:21So you've got this great reporting. You've got this idea of the recording.
00:24You've got the notion of what he...
00:26Typically, we are the lawful custodians of documents.
00:28We need to have them returned. There was a subpoena as well. You haven't given them.
00:32Is the taped conversation that CNN and Paula and team have a transcript, a partial transcript of,
00:40is that a smoking gun to this point of intent?
00:44Well, first of all, the dramatic reading of it, Paula, unbelievable, because it gave the gravitas.
00:49I didn't do my Trump voice.
00:49I'm telling you did not, but you didn't have to with the gravitas assigned to what we said.
00:53If you just heard about it, can get that in. Is that part of it or is there something more?
00:57And by the way, that move is one of the pieces of news.
01:00Many pieces of news in recent days is that move from a case that we thought,
01:03we imagine, might be prosecuted here in Washington, D.C.
01:06I do want to ask you, Evan, on the Espionage Act specifically,
01:09because that is among the most serious of the charges here in retaining documents.
01:15The Justice Department considered, but ultimately did not charge on the Espionage Act.
01:20Hard thing, right? Hard thing to prove and quite a serious charge.
01:23Explain that to folks at home.
01:25Listen, a president being charged with any federal crime is a big deal.
01:28Espionage Act stands out.
01:30Right, it does.
01:31And what the prosecutors are going to have to do in front of this jury is to show that this
01:37was something very serious.
01:40And, you know, as you said, it's not charged often in some of these cases, but it is.
01:45To this May 11th subpoena, and Trump Attorney 1, Evan Corcoran, and Trump Attorney 2 tell Trump
01:51that they need to search for documents that would be responsive to the subpoena.
01:56They need to provide a certification that there had been compliance with the subpoena.
02:02Trump, in sum and substance, made the following statements, among others,
02:05as memorialized by Trump Attorney 1, Evan Corcoran.
02:08A, I don't want anybody looking.
02:11I don't want anybody looking through my boxes.
02:13I really don't.
02:14I don't want you looking through my boxes.
02:18B, well, what if we, what happens if we just don't respond at all or don't play ball with them?
02:25C, wouldn't it be better if we just told them we don't have anything here?
02:29You know what he said?
02:30He said that it, that it was him.
02:32That he was the one who deleted all her emails, the 30,000 emails,
02:36because they basically dealt with her scheduling and her going to the gym
02:39and her having beauty appointments, and he was great.
02:42And he, so she didn't get in any trouble because he said that he was the one who deleted them.
02:48So much there to go through.
02:50Lock her up is the chant that we heard.
02:53Absolutely.
02:53Hillary Clinton's lawyers protected her.
02:56Laura Coates, lawyer present here.
02:58Speaking about Corcoran, based on what you see in this document,
03:03is Corcoran testifying against the president?
03:05Yeah, he did already in a grand jury.
03:06It's about Trump wanting to see photographs of the boxes.
03:10There is actual documentation that he was aware about the breadth of it.
03:14The statements that were actually made.
03:15You cannot say that I don't get to tell you anything because I'm a lawyer and you're my client
03:19if what you're asking me to do is in furtherance of a crime or a fraud.
03:22And just to bring the point home, just look through on page 8.
