00:00Your dog was off leash and running up to him.
00:03My dog was very friendly and very nice.
00:05The dog lunged up towards my face.
00:07He's a very nice, very good boy.
00:10I don't care.
00:12When an 80-pound animal is running up to you,
00:16you don't know what to expect.
00:18Don't you get that?
00:19This is Judy Justice.
00:38Jason Durfee is suing dog owner Terry Sachs
00:42for legal fees and damages from a false arrest.
00:46Court come to order.
00:47All rise.
00:51Have a seat, please.
00:53Judge, case 4008, Durfee v. Sachs.
00:56You're welcome.
00:57Mr. Durfee, you are suing the defendant
01:00because you allege that because of his actions,
01:03you were falsely arrested.
01:05Yes, Your Honor.
01:05Spent a day in jail.
01:07Yes.
01:08And the defendant has a counterclaim for emotional distress
01:12based upon what he claims were your actions
01:16that occurred over a year ago and involved dogs.
01:20Yes.
01:20This dog, he looks very unhappy on there.
01:24Would he be happier on the floor?
01:25No, but I can try.
01:27I think so, he's shaking, he was-
01:28He's cold, actually.
01:29Oh, I can imagine.
01:32Should have a sweater.
01:33I'm cold too, or a sweater and a robe.
01:35I'm still freezing here.
01:36Yes.
01:37Okay, you were walking your dog at approximately what time?
01:40About 8 p.m., Your Honor.
01:42Where were you walking your dog?
01:43Just around my neighborhood.
01:44There's a park in the neighborhood
01:45called Facio Farms Park.
01:47When you were walking your dog,
01:49was your dog on leash or off?
01:51It was on leash.
01:51And you were in the same park?
01:53That's right, Your Honor.
01:54And you were with your dog?
01:56That's right.
01:56What kind of dog do you have?
01:58He's a German Shepherd Husky mix.
02:00It's a big dog.
02:01He's a big boy, yeah.
02:01On leash or off?
02:03At the time, he was off leash, Your Honor.
02:04Oh.
02:04By the way, where you were in this park, you were not, I assume, in a dog park park area
02:12with the dog.
02:13That's correct, Your Honor.
02:13So the dog should have been on leash?
02:15Yes, Your Honor.
02:16Okay.
02:16Now, I'm going to let you tell me, from your perspective, you tell me what happened.
02:22I approached the park.
02:23I saw down, there's a playground that sits approximately 15 feet below to the area of the
02:28park that I entered.
02:29I saw a dog off leash.
02:31Did you see Mr. Sachs?
02:33I did.
02:34You did?
02:34Yes.
02:35Okay, was he the only one, as a matter of fact, that may make it easier for me?
02:38I think it will.
02:39It also has the distance from where the dog approached to my location.
02:46Okay.
02:50So, where did you enter?
02:51This is my view from where I was standing.
02:54At the bottom left-hand corner is where I was standing.
02:57Here?
02:57The dog was down in the playground area.
02:59In the sand area?
03:01Yes.
03:02And what were you doing there, sir?
03:03I was using my drone to help get my neighbor's rocket out of a tree.
03:08So, you were in the playground area?
03:10Yes, Your Honor.
03:12And would it be fair to say that when the plaintiff was here, your dog went up to the
03:18plaintiff, went on the grass area?
03:20He did walk up to him, yes, Your Honor.
03:22Okay.
03:22Now, let's go.
03:23As I approached the park, I saw the dog off leash.
03:26I hollered out to the owner.
03:27I said, is your dog on leash?
03:28As soon as I said that, I grabbed the attention of the dog, and the dog started running towards
03:32me, barking towards my dog.
03:35So, I reached down on the ground, picked up my dog into my arm, loaded a CO2 pistol gun
03:40that I carry with me for protection, and started to kick the dog backwards.
03:45And?
03:46As the dog went back, the first time I kicked with my foot forward, the dog lunged up towards
03:52my face.
03:53And about that time is when Terry was able to regain control of his dog.
03:57Okay.
03:58Your version?
03:58I was in the playground.
04:01Got it.
04:01Using the drone.
04:02I hear a voice just say, is your dog on a leash?
04:05I thought it was Jerry speaking.
04:06I don't care what you thought.
04:07I heard a voice say, is your dog on a leash?
04:10I turned around.
04:11I see Rico walking up to Mr. Durfee.
04:14Your dog wasn't walking.
04:15Let me explain something to you.
04:16I'm a dog owner, and I have a five pound schnurdicker.
04:20And when she wants to get to another dog, she doesn't walk over.
04:24She runs over.
04:25She scoots over when she sees another dog she wants to play with.
04:28So, when a German Shepherd sees another dog, it may not be aggressive, but they don't walk.
04:35So, let's keep the verbs real, shall we?
04:37Yes, Your Honor.
04:38Your dog ran over to where the plaintiff was with his dog.
04:42Okay, Your Honor.
04:43Now, the reason that you might see me be animated is because judges bring with them to their job,
04:50just like everyone else brings their experience to their job.
04:55We're not really blank slates.
04:57We're supposed to be, but we're not.
04:59And I'm a relatively diminutive person, short.
05:05And only once did it happen to me that a big dog, that didn't mean to be hurtful or aggressive,
05:12but just wanted to sort of play and was playful, was off leash, ran up to me, knocked me down,
05:19and almost broke my back.
05:21Didn't mean to hurt me.
05:23But there's a fear that one has when a large dog that is unattended approaches them quickly,
05:30because they don't know whether it's a good dog or not.
05:34They certainly know that the owner of that dog was violating the rules by allowing the dog to be off
05:41leash.
05:42And not only was your dog off leash, but you weren't even paying attention to the dog.
05:47You were helping your friend.
05:50So, you were busy with your drone, and you weren't even in eye control of your dog.
05:55Not only you weren't in physical control of your dog, not even eye control of your dog.
05:59Mr. Sachs, you look like a very nice man.
06:01That's very frightening.
06:02The first thing I said to Mr. Durf, Your Honor, is he's a very nice, very good boy.
06:06But that was after you got control of him.
06:09Do you understand?
06:10Your Honor, I said that after Mr. Durf says, is your dog on a leash?
06:13I noticed that he was holding his dog.
06:15He's standing up by the pavilion.
06:16OK.
06:16You think he was holding his dog because he thought that that's the way the dog was going to use
06:21the bathroom,
06:22where he was holding his dog?
06:23He was holding his dog because your dog was off leash and running up to him.
06:28I can see that, Your Honor.
06:29I'm glad you can see it.
06:30I can see it.
06:34You allowed an 80-pound animal that you may know is friendly and wouldn't hurt a fly be put in
06:41a
06:41situation where it almost got shot. You did that. You're the parent. And then you blame him?
06:48Is he awake? What did you bring him for?
06:53And later today.
06:54Did you ask her to do something that was not legal?
06:59No.
06:59Weed is legal in Ohio and in Michigan.
07:03So why would you need her help?
07:04Because I don't drive.
07:05What do you mean you don't drive? She just sent you a car payment.
07:17Jason Durfee claims dog owner Terry Sachs owes for legal fees after having him falsely arrested.
07:25Terry is countersuing for emotional distress.
07:29Now, what happened was you had this air pistol, whatever it was, and you took it out.
07:34Yes.
07:35And didn't use it.
07:36I didn't use it.
07:37And you called 911 and he was arrested.
07:40That's a brief summary of what happened, Your Honor.
07:42Of course.
07:43He did not pull the gun out until I approached, Your Honor.
07:46Mr. Durfee pulled the gun out in response to my approach, not my dog's.
07:50Oh, I don't know that, sir. How do you know that? This is all happening instantaneously.
07:55This isn't happening in slow motion, sir. Be fair.
07:58He says to you, is your dog on leash? Your dog takes off.
08:01You have a dog that weighs probably 80 to 110 pounds?
08:0673 pounds, Your Honor.
08:07Well, close. So that's a big dog and combination Husky and
08:11Shepherd probably a beautiful dog, but they're ominous looking if they're running at you and
08:16you don't know whether to expect something that's going to hurt you, going to lunge onto your dog,
08:22or as you say, my dog is very friendly. You don't have to worry about him.
08:27Now, do you need to be licensed to carry that weapon?
08:31No, it's a less than lethal weapon.
08:33So what were you arrested for?
08:35Aggravated assault.
08:37Aggravated assault?
08:38With a deadly weapon, yes.
08:39I'd like to see the complaint. You were arrested, spent 24 hours in jail.
08:43Were you given a summons, Mr. Sachs, for having your dog off leash?
08:47No, Your Honor.
08:48I spoke to...
08:50That's hysterical.
08:52That's actually hysterical.
08:54The person who precipitated this whole incident wasn't even admonished by giving him a ticket for
09:01having his dog off leash.
09:03Your Honor, I spoke to the officer that arrested Mr. Durfee, and I explained to him that prior to my
09:09knowledge, there was no signage in the park saying that dogs must be on leash. The officer explained to
09:14me that it's a West Valley City ordinance that dogs do not...
09:16Oh, yes, listen to me.
09:18I don't give a rat's behind what the officer said to you. It was the law. You disregarded it.
09:25Yes, Your Honor.
09:27Okay. Can I see the dismissal of the case, please, that happened a year later?
09:34You paid a lawyer $5,000 to represent you, sir?
09:37Yes, ma'am.
09:38You have the bill?
09:39I do.
09:39I'd like to see it.
09:45I also have the police report, Your Honor, that says Mr. Durfee was unable to explain to the police
09:49how my dog was being aggressive. I just told you how. I just told you how. And what I told
09:56you was an
09:56accurate description of what happened that day. Listen, I'm 81 years old, been there a dozen times.
10:04Schlemels who let their big dogs off leash should be punished if they threaten somebody else. Now,
10:11threatening is in the mind of that person, not your dog. When an 80-pound animal is running up to
10:19you,
10:19you don't know what to expect. Don't you get that?
10:23I understand, Your Honor.
10:24Well, I'm glad you understand it, so don't make any excuses for it.
10:28Your Honor, I don't have that receipt. It was not in my package.
10:30It's right here.
10:31Okay.
10:32$49.80.
10:33Oh, it was there.
10:33So you're going to pay his counsel fees. And what Mr. Durfee is suing for is $10,000.
10:39If I could award you more for spending 24 hours in jail, is that what you spent in jail?
10:46Yes, ma'am.
10:46Yes, Your Honor.
10:4624 hours?
10:47Yes, Your Honor.
10:47Believe me, I would award you more.
10:51Now, you have a counterclaim. Your claim is that this whole incident caused you serious emotional
10:58distress.
10:59Yes, Your Honor.
11:00I don't care.
11:02I don't care. Nobody cares. You caused your own emotional distress. You allowed an 80-pound animal that you may
11:10know is friendly and wouldn't hurt a fly be put in a situation where it almost got shot. You did
11:18that. You're the parent. And then you blame him? Is he awake? What did you bring him for?
11:24I'm awake.
11:28Judgment for the plaintiff for the amount of $10,000. You count the claims dismissed. We're finished here.
11:33Thank you, Your Honor.
11:33This court is adjourned.
11:41He told me he would shoot my dog and he started to raise it toward me.
11:45I think an over-exaggeration by the defendant.
11:47Because there was someone with a gun in the park threatening to shoot my dog and starting to raise it
11:52toward me.
11:52I was immediately arrested, put in handcuffs, drawn 10 different officers with guns drawn on me.
11:58Of course, I'll keep my dog on a leash.
11:59Please watch your dogs. Protect your dogs.
12:04What I said to him was true. Judges bring to their job their life's experience.
12:10And you know that I was pushed over by a very friendly dog. Just jumped on me to say hello,
12:17but off leash and was injured. And that moment is so frightening when a big animal is running towards you.
12:28I know I don't like to walk past on the street an unleashed dog. They're animals at the end of
12:32the day.
12:33It doesn't matter how well trained they are. And I think that pet owners have to remember that,
12:37that it doesn't matter how much you believe that your dog is safe and friendly and wouldn't harm a fly.
12:42But if someone else is petrified, you're going to be liable for that.
12:46You're responsible. And you're also responsible for the dog.
12:49Yeah.
12:50Case 4001, Wilhelm versus White. All parties, please come forward.
12:55Grandi Wilhelm is suing her ex-girlfriend, Kamri White, for two unpaid personal loans.
13:03Ms. Wilhelm, you and the defendant met on a dating app.
13:07Yes.
13:07You lived in two different states.
13:09At the time, in 2020, we were both in Michigan.
13:12When you met?
13:13Yes.
13:14Who moved?
13:15She was moving with her job.
13:17To where?
13:18She went from Ypsilanti to Columbus, Ohio.
13:21And according to your complaint, the two of you discussed you moving with her?
13:25Yes.
13:26And she was supposed to go out there and get a place, and you would join her.
13:30You have a child?
13:31Yes, ma'am.
13:32A one-year-old?
13:33Mm-hmm.
13:34Okay. Now, it is your claim that Ms. White owes you $3,000 for two separate loans.
13:41Both of those loans, according to you, I believe, were extended after she moved.
13:47Yes.
13:48Okay. Now you can tell me about the first loan.
13:51The first loan was for her car payment. It was late, and she told me that she...
13:58By phone, text, how?
13:59Text and phone.
14:00May I see the text?
14:02Yes, ma'am.
14:10I'm absolutely done here.
14:12Smoke a little less weed. It'll keep your head clear.
14:16Clear, so that you...
14:17...especially when you come to court, so that you're not all fuzzy-wuzzy.
14:29Brandi Wilhelm claims her ex-girlfriend, Kamri White, refuses to pay back two personal loans.
14:37Kamri is countersuing for filing a false police report and harassment.
14:42You say to her, please, I need to pay my car.
14:46Mm-hmm.
14:46You can send me money.
14:48You can use my cards. What does that mean?
14:51Yeah, her account got locked down, so I told her she could use me.
14:54And how did that happen?
14:55I guess she couldn't, like, confirm herself. I'm not... I don't really... I don't even have that app,
14:59so you would have to ask her.
15:00She requested $1,000, and then she said, I can't use it, so then she sent it back to me.
15:06Oh, I sent it... Okay, that's what happened. I think she PayPal-ed it to me at first, but I
15:11couldn't figure...
15:12PayPal-ed what to you?
15:14The money.
15:15Your car payment?
15:15Yes.
15:16How much was your car payment?
15:18Uh, it was late, so it was probably around, like, $800.
15:23How much was the car payment?
15:26$860.48.
15:28Okay. Did you pay her back?
15:30Mm-mm.
15:31Uh-uh. It's not an answer.
15:32No, ma'am.
15:33Why not?
15:34I told her she had to wait till I had the money.
15:36I wasn't working. I just got back with my traveling job. I didn't have...
15:40What does that have to do with her?
15:41No, that's what I told her, though.
15:43So you said to her, I'll pay you back when I have the money.
15:46When I have the money.
15:47Okay, so it was a loan.
15:50Perfect. $860 car payment. What was the next loan? There were two.
15:53The B&B, because she's...
15:55Okay, explain it.
15:56It was early June.
15:57Um, she told me that I could stay with her for three months in a B&B.
16:01And she requested my half.
16:03Um, the B&B was only $2,600 something.
16:07So I told her, oh, $1,300?
16:09And she said, no, I can't afford the whole thing.
16:11You would have to pay $2,000.
16:14Well, that doesn't sound like a loan to me.
16:16However, you sent her how much money?
16:19$2,000.
16:20And you received $2,000.
16:22Shh.
16:22You received $2,000 from her.
16:24Is that correct?
16:25Yes, ma'am.
16:25Okay.
16:26And that money was to go for a place for the two of you to live together?
16:31Yes, for while I work.
16:32Yes.
16:33And did you live together?
16:35No, she never came.
16:37She wouldn't let me.
16:38Just a second.
16:38It was not that one, Larry.
16:40Okay.
16:41Just a second.
16:42That money was for a place for you to live together.
16:46Mm-hmm.
16:47Uh-huh.
16:47There's not an answer.
16:48Yes, ma'am.
16:49Good.
16:50And where's the $2,000?
16:52It went towards that Airbnb.
16:53I paid for it.
16:54She told me that B&B.
16:56She gets mad and she'll block me, talk a little crap, do whatever.
17:01I have messages of her saying she didn't even want to come anymore.
17:04I asked her, look, weed is legal where I'm from.
17:07I asked her to go get me weed from Michigan because I'm in Ohio.
17:11She got mad because I asked her to get me weed.
17:13She said I wanted to lock her up even though it's legal.
17:16So she said she wasn't going to come anymore.
17:18Mm-hmm.
17:18I did not say that.
17:19It's right here in my messages.
17:21You want to see them?
17:23Did you ask her to do something in her jurisdiction that was not legal?
17:30No.
17:31Weed is legal in Ohio and in Michigan.
17:34So why would you need her help?
17:35Because I don't drive.
17:37So I asked her to do it for me.
17:38What do you mean you don't drive?
17:40She just sent you a car payment.
17:41Yeah, I have a car, but I don't drive it.
17:43Other people drive me in it and she knows that.
17:45Why don't you drive your car?
17:46Because I don't have a license.
17:48Who drives your car?
17:49The people I work with.
17:51I've been with them for five years.
17:52Do you charge them for using your car?
17:54No.
17:55I don't charge them, but we ride together.
17:57Things sound very sketchy.
17:58Anyway, the $2,000 was sent so that you could live together and you didn't live together.
18:03That's $2,860 and 28 cents.
18:07Now we have a counterclaim.
18:09And the counterclaim is sort of funny.
18:12Counterclaim is for $5,000 for filing a false police report and harassment.
18:17Now, tell me about the police report that she filed against you that was false.
18:22I had a number call me from Michigan stating...
18:25You can't tell me when anybody called you and said.
18:27No.
18:28I need a report.
18:29I don't have it.
18:30Document.
18:30I see it.
18:31Yes, ma'am.
18:33I couldn't get it.
18:40Okay.
18:41Ms. White threatened to beat her up.
18:43This is you telling this to the police.
18:45It all stems from the defendant owing the plaintiff $3,000 and the plaintiff letting
18:52the defendant's dad know about it.
18:54She told your father about you owing her money.
18:57This is your counterclaim.
18:59Pay attention.
19:00I am paying attention.
19:01You know you filed a counterclaim.
19:03Yes.
19:03It was for filing a false police report.
19:06Yeah, and harassment.
19:07Well, I want to hear about it.
19:09What was the false police report?
19:10She said that I threatened to beat her up.
19:12And we don't even live in the same state.
19:14We weren't even nowhere near each other.
19:17We're three hours apart.
19:18That's a different state.
19:19Shh, don't talk to each other.
19:21So what I gather, she told your father about you owing her money.
19:25Yes, ma'am.
19:26And your father had been paying the insurance on your car.
19:29Yes, he told me he would pay my insurance.
19:31And then he said he wasn't going to pay your insurance.
19:34Yeah, he cut it off.
19:36He cut it off because she told him that you took money from her.
19:38Because he was aggravated.
19:40Well, that was true.
19:40She's allowed to tell him that.
19:42And he's allowed to cut you off.
19:43How old are you?
19:44Twenty-four.
19:45Twenty-four.
19:45Pay your own car insurance.
19:46It's not paying.
19:47You don't even drive a car.
19:48You don't have a license.
19:48I can pay for it.
19:49I have to have him do it because I don't have a license,
19:52so I can't have insurance.
19:53Well, what does that have to do with her?
19:55What do you mean?
19:56She texted my father for no reason.
19:57She didn't have to do that.
19:58She's allowed to text your father and say to your father,
20:01She don't even know my family.
20:01Your daughter, who's 24 years old, took $3,000 from me?
20:05She's allowed to do that.
20:06It wasn't took.
20:06A car payment.
20:07Yeah, that.
20:08But that $2,000 for that Airbnb, that was not a loan.
20:12She offered to pay half of it so she could come stay with me.
20:15And that never happened.
20:17So because she didn't come and stuff happened,
20:20I should pay her that back?
20:22If you stayed in it, then you paid for it,
20:25and you lived in it alone.
20:26Yeah, I'm trying to get what you're getting at.
20:28I'm absolutely done here.
20:31Smoke a little less weed.
20:33It'll keep your head clear, clear, so that you,
20:36especially when you come to court, so that you're not all fuzzy wuzzy.
20:39I get what you're saying.
20:40Judgment for the plaintiff in the amount of $2,860.28,
20:45your counterclaim is dismissed.
20:47She's allowed to call and tell your father whatever she wants to.
20:50She told your father you owed her $3,000.
20:53And with the exception of a couple of bucks, you absolutely did.
20:56We're done here.
20:57This court is adjourned.
21:04I believe she gave me justice in this situation
21:06because Kamri is a liar.
21:08Like, she's literally psycho.
21:10She's crazy.
21:11I would tell her I would come over,
21:13and she would tell me no, and she would just hang up on me.
21:16She gave me that money to get it, yes, but she never came.
21:19I will never talk to her again.
21:20For nothing, I ain't gonna talk to her no more.
21:24So my takeaway from that case is just a general, worldly bit of advice.
21:31When you come to court, you're supposed to be clear-headed,
21:36clear-eyed, clear-thinking.
21:39Especially when you have a counterclaim and you're supposed to be the plaintiff,
21:42the burden of proof.
21:45So if you're going to court, do it in the early morning.
21:49Don't make yourself look like a fool.
21:51Yeah, right.
21:54Are you a victim of a scam?
