00:06in January 2026. But here's the truth. There is no nationwide rent law that has suddenly
00:13come into force in 2026. What people are actually referring to is the Model Tenancy Act of 2021
00:23that was introduced by the central government in 2021, that is five years ago. But, and this is
00:30the most important point, housing and property transactions fall under state jurisdictions in
00:35India. That means that the central government can only suggest a framework. Each state has to pass
00:42its own tenancy and rent laws to make these rules enforceable. And so far, only a handful have done
00:49that. So what does the Model Tenancy Act actually propose? Its goal is simple. Rebalance the
00:55relationship between landlords and tenants and make it more streamlined. First, mandatory written
01:02tenancy agreements. All rental agreements, whether residential or commercial, have to be in writing
01:08and registered with a rent authority, who is a deputy collector level officer, who's also authorized to
01:15help resolve any disputes that may occur. Second, limits on security deposits. For residential properties,
01:22landlords under the Model Act cannot take more than two months rent as security deposit. Third,
01:28restrictions on landlord entry. Landlords must give at least 24 hours written notice before entering a
01:34rented property and only for reasonable purposes like repairs or inspection. These rules were meant to
01:40give tenants greater privacy and protection. But here's a catch. These provisions apply only if the state
01:48adopts the Model Law. And according to the Ministry of Housing and Urban Affairs, only a handful have broadly
01:54updated their tenancy laws after the 2015 Model Act, which is Assam, Uttar Pradesh, Tamil Nadu and
02:02Andhra Pradesh. And even among them, the rules are not identical. For example, while Assam has adopted the
02:08entire 2021 Model Law, in Uttar Pradesh, rental agreements are registered, but short-term agreements
02:15under 12 months do not need to be registered. That's why in UP, the more common 11-month rent agreement
02:22is still widely used. Tamil Nadu changed its rule in 2017 and made them stricter. So the takeaway is simple.
02:29There is no new rent law across India in 2026. So if you are renting a home or giving one
02:36on rent,
02:37the most important step is simple. Read the rental agreement carefully before you sign. Consult a
02:44lawyer if you can. Because in India, your rights as a tenant and as a landlord still largely depend on
02:51which state you live in.
