00:00So, I just heard the breaking news about Kristi Noem.
00:04I called in hearing this week that she should either step down,
00:07she should be informed, or she should be impeached by Congress.
00:10So she is gone.
00:11She should be held to account for the corruption that she has shown
00:14with the contracting and the way they do business.
00:16She should be held to account for the violation of court orders.
00:19She should be held to account, frankly,
00:21for the violating constitutional rights of Americans.
00:23But this changes nothing.
00:24We are in a shutdown right now because we have a rogue and reckless organization
00:29that is breaking into Americans' homes, jumping out of unmarked cars,
00:33masked, literally slamming Americans to the pavement,
00:37or worse, as we've seen in two cases, murdering people.
00:41We are seeing in Republican-run towns and Democratic-run towns
00:44that they don't want them there, that they're making us all less safe,
00:48that they said they were going to go after the worst of the worst,
00:50but they're detaining American citizens, over 20 American children.
00:54They're ripping parents away from their American kids.
00:58This is not who we are. This agency is out of control.
01:01I am so happy that one of the worst administrative leaders I've ever seen is gone.
01:06But the agency itself is still reckless and out of control,
01:09and we should not be funding it until these issues are addressed.
01:12On that note, do you want to confirm?
01:13Will you vote to confirm?
01:14Look, I've known Mark Wayne now for a good amount of time.
01:19It is not about the head of this agency.
01:22It is about what the agency is doing in our communities.
01:25And obviously, there will be hearings, and I think a lot of this should be brought out.
01:29But we have an agency that is out of control.
01:31And what they're doing in our communities, what they are doing to the Constitution,
01:35their reckless, continuous violation of court orders,
01:38even Republican-appointed judges, they are routinely violating those court orders.
01:42That makes this whole agency, to me, morally bankrupt.
01:45Do you see Senator Mullen as an upgrade over Kristi Noem?
01:48Honestly, the way she has led that agency, she has demonstrated a complete incompetence.
01:55It's hard for me to imagine somebody being as bad as she was.
01:57You said it would do nothing on the funding debate.
02:00But what could help unlock that issue, especially now that you have someone like Mullen setting up?
02:04Well, this is the problem right now, is that even the issues that are being negotiated,
02:08Republicans have said, no, they're not going to insist upon warrants before they barge into American homes.
02:13They said, no, we are not going to make sure that agents are clearly identified.
02:19They have put out of the realm of even negotiation the common sense things we ask from law enforcement agencies
02:25all over our country.
02:27So even the realm of negotiation right now makes me believe that anything that we come up with
02:32is not going to rein in this agency that's out of control.
02:35Are you going to want a commitment from Mullen on that piece before voting to confirm him?
02:38I want the nightmares in our communities to stop.
02:41I want him to commit to end the warrantless entrances of Americans' homes,
02:46to end the violation of Americans' free speech rights,
02:49to end coming into American communities and instilling so much fear
02:53that people are afraid to even walk their children to school.
02:56I want them to end having ICE rushing into churches and our public schools
03:00and rushing into courthouse proceedings.
03:03I want this to be an agency that is not upending our communities,
03:07terrorizing our communities, violating our laws.
03:10I want it to be an agency that's focusing on what Donald Trump said,
03:12the narrow mission of making sure that violent people are not in our communities.
03:16Senator, you said that Secretary Noem should face responsibility, be held accountable.
03:20It seems like something that probably won't happen in a Republican Congress.
03:24Is that something that falls to a Democratic?
03:25No one should be above the law.
03:29And what Donald Trump seems to be saying,
03:30with his pardon of January 6th violent rioters who beat police right where we're standing,
03:36with people who've created incredible corruption,
03:39literally dealt with transnational funding of terrorism in our country,
03:44he seems to be pardoning people who have done horrible, horrible things.
03:49Nobody is above the law.
03:50And if she violated the law, we know she violated,
03:53her agency violated court orders.
03:55You know that she knew that the court had ordered them not to deport people,
04:00and yet they still did.
04:01I think that she is not above the law.
04:03She should be held account for any violations of our law or constitution
04:06that she didn't want to is in her position.
