01:14Tee and David Swims are supporting their beloved Ole Miss University at a marching band competition
01:21in atlanta georgia she is extremely bubbly energetic she just makes you want to just have
01:29fun look like she's just enjoying herself and singing something she loved to do and dancing
01:38something she couldn't do the same shimmy dance she do with her shoulders
01:45there's david he's trying to look mean and tough and now she finally got david into it
01:55t knew david almost our whole life really
01:59he could be extremely charming they look like very very happy couple she loved him i could tell
02:15auntietta archie lovingly known as t is born on november 18 1985 to anatoly and elissa archie
02:25in carroll county mississippi he was very energetic she was smart she would always have a smile
02:37and she just loved life
02:41when she was young t was very helpful with her baby sister shalanda
02:50they were six years apart and t felt that she was more of big sister slash mom
02:59he was she was the glue she was the natural nurturer for the entire family
03:07t's fierce loyalty is strengthened by a traumatic family split
03:12my divorce was hard on them but i would always make sure they had what they needed
03:20as a teacher miss archie instills the importance of education in her daughters
03:26t was a phenomenal student she was very determined to have straight age
03:32t ended up graduating high school and going to the university of mississippi well old miss
03:40t thrives in the college town of oxford and her time there is filled with happiness
03:45t graduated from the university of mississippi in 2008
03:49and she told me she said mama i'm gonna catch the first train coming
03:55so she took the first job that she was offered and it was in yazoo city
04:02as a teacher third grade
04:05i was very proud
04:08not long after moving to yazoo city
04:1322 year old t reconnects with an old acquaintance
04:1727 year old david swims
04:19i taught david in sixth grade math
04:24he was a good student but he was a student that thought he knew it all
04:30but he he didn't david had quite a reputation within our hometown
04:38he was labeled as a bad boy
04:41he and david start dating she learns he has two children with two different partners
04:47and is in the midst of a divorce as an adult i heard david was a jealous person i know that he
04:58and his first wife and his first wife have major issues
05:03hearing things around town about what he was doing made me very uncomfortable
05:07on the day that he brought david to my house she came in and he was behind her she said
05:18mama david and i are dating now i said oh really he walked in with pride
05:24you know like chest out you know like chest out he knew what a gym he was getting
05:29david was offering her a lifestyle that she was not used to the streets the clubs the partying
05:42this was all new to her this was like a lifestyle that mama tried to keep me away from
05:50this is not a relationship that i want her to be in but she was an adult now
05:57i think the bad side is what she was attracted to the most and in her mind she would be able to
06:04love this person and allow them to find the good side within themselves
06:09david claims he wants to marry t
06:14but in march 2009 one year into the relationship his life takes an unexpected turn
06:22he called me and she said mama david has been in an accident he was hit by a truck
06:36my mom she said that david may not live
06:43she told me to come on we're gonna get in the car and then we got there my sister was
06:49right by his bedside he was gonna be in a wheelchair for the rest of his life
06:57i wanted him to go for care from his mom or or other family members but t told me david is
07:07gonna go home with me she said mama i love him i could tell instantly that she was determined
07:15to make that relationship work but that was the kind of person t was she just couldn't walk away
07:22from something that she started
07:24t moves david into her yazoo city home and they start on the long road to recovery
07:33i think after david's accident it was a blow to his ego because he had to ask for help
07:42and that's really what he did not like asking for help
07:49they were struggling sometimes he would be emotional i definitely will say he took his
07:57frustrations out on her i mean she would literally just carry him throughout the house
08:05she was going to be that loyal person for him because it's in her mind that was her soulmate
08:13with t's unwavering care david slowly regains his confidence
08:18this is david when he wanted to try to regain strength and help him be able to walk again
08:28he seemed to put aside his disability and began making it an ability
08:36once david's divorce is finalized he and t set a wedding date for the winter of 2010
08:46my heart dropped i did not want her to stay in that relationship
08:53not because of the paralysis but because he was who he was
08:59he said that i'm going to love her and i refuse to ever leave
09:03in the months before the wedding t and david regularly visit miss archie
09:11t had come to the house she and david with the little baby and i'm like t whose baby is this
09:22so she pointed at david and i said t you all were together when this baby was conceived
09:33we realized that he had had a daughter while they were dating
09:40t was very hurt that he chose someone else over her
09:46so i'm shocked i'm thinking what had she done to him that would make him do that to her
09:57it was like he was saying okay it's my baby so what
10:03you know that he stepped out before and he just won't stop
10:09my heart was telling me to tell her you know get out of this take it and run
10:15you don't have any obligations to him yet i feel that she thought she was getting a husband
10:25in actuality he was not what he appeared to be
10:45he marries david swims on november 20th 2010
10:50she wanted him to just be a better person she said honestly i don't feel like it's a problem it's
10:57still our decision i said okay after t and david were married t seemed happy i felt like okay
11:06everything is going along maybe i just need to stop feeling how i was feeling and accept what had
11:14happened the couple still faced challenges david was not working but t took care of pretty much
11:23everything
11:24the stress behind keeping the bills was definitely major for t but she felt like i have to go ahead
11:34and just be the person to stand up and do it
11:36everything was done online then she pushed david to go back to school
11:53he started going to this i.t tech building he enjoyed like fixing computers or fixing phones
12:02and things like that t pushed for him to be able to get that degree that way he could actually apply
12:10in his skill set to any job he graduated and did very well i was so happy for them
12:19but three years into their marriage t hit shalanda with another bombshell
12:24he called me and she just said he was still being unfaithful there was one incident where she said
12:32that there was someone at her at her house while she was at work she was honestly very upset with that
12:40because he promised her that once they're married it will never happen and she's at work and she's
12:46still trying to make sure he's taken care of
12:47i think she had gotten to a point to where she's like well if he's going to choose to entertain then
12:56i'm going to do the same thing and she said they discussed to have just an open relationship
13:03i said are you sure are you doing it to fix the situation of him not changing or are you doing this
13:11for you and she said honestly i feel like both of them but i'm going to make sure i stay to make sure
13:19i take care of them t had dreams about going back to old miss university to work on her phd
13:31so she told me she said mama i still want to move back to oxford
13:35in august 2014 t lands a position teaching third grade in batesville 25 miles from oxford
13:47and david finds a job in a phone and computer repair shop
13:53having two steady incomes helped a lot and it took a lot of the burden off of t i could see a little bit
14:00of relief the couple move into a home adapted for david's wheelchair on the outskirts of oxford
14:11their lakeside street is known locally as the cove my husband and my family we moved to the cove
14:18in 2016 some of the couples that had been living in the cove for a while did block party and that was
14:27the first time i got to meet t and david they seemed like a very sweet couple david was in the wheelchair
14:35he seemed like it didn't slow him down even from a distance you could tell t was just warm and there
14:43was just something so special and beautiful about her just seemed like it was going to be great to have
14:50a friend who's a neighbor instead of a neighbor who's a friend
14:57as the months pass more new families moved to the cove the ladies who were new in town we started
15:05exchanging phone numbers and started a group text t actually named the group the cove queens
15:13we started going out for each other's birthdays kind of became a monthly thing after that
15:23this was one of our cove queen nights t learned a tick tock dance and she was showing it all
15:32she was so proud of herself for learning how to do that dance
15:35she was the party t was absolutely the party if she was there you already knew it was going to be a
15:44good night but beneath the smiles there are growing cracks in t's relationship basically it is the 13
15:53stars around but my dims my dims my dims my dims i'm listening to baby i'm listening to what you're
16:03saying i know i hear you baby i hear you seems like t is is working on a paper and she's probably trying
16:12to get some uh serious business taken care of and he's being silly my dims put it out being a comedian
16:21t looks genuinely upset my dims i feel like he expected her to do certain things but he didn't
16:30have the respect that i would feel a man should have for his wife my dims put it off yo
16:41t confides in her sister that david is not respecting their personal agreement either having the open
16:48relationship did not work he was just extremely jealous he said he could do pretty much anything
16:57but he wanted to make sure he kept the control over whatever she did she had no privacy he would call
17:07from her phone people that he would assume would be a male even if it's a co-worker saying things like
17:14oh that's my wife i don't want you calling her it was definitely a wave that he could manipulate and
17:20maneuver to have his infidelities and just take really he's very good at not showing that dark side
17:31that she would see the cruelty with his words we were talking every day she just like burst out to
17:40cry and i didn't know what to do i think she realized that she wanted better and she didn't want to be
17:52her words she didn't want to feel like she was in prison anymore
18:05six years into their marriage david and t's relationship problems persist
18:11unaware miss archie continues to visit her daughter on weekends
18:15i would go and stay with them so that particular friday i made it up there and i noticed all the
18:23david's clothes was in the back bedroom that's the room i always stayed in she didn't let on that they
18:30were having marital problems but i started paying attention a little bit more
18:38it definitely became more apparent that they were having issues whereas normally she was there
18:44for every cove queen's dinner there was a few where she would miss
18:50that was definitely something noticed because she was the party i know there were things that
18:56she held back she was just always part of the support system but very rarely was she
19:05one that would come out and say i have a problem with something that's going on in my life
19:11despite david's controlling behavior he never stopped striving and in april of 2021 she completes a
19:21lifetime goal she did send us a group text to let us know that she was just waiting to hear if she got
19:28her phd or not we just started calling her dr t just to kind of boost her confidence because we knew she
19:37had it i knew she had been undergoing a lot of stress with everything and i said hey we're going out we're
19:46gonna relax and enjoy it and so the next day we went to go get our nails done happy and laughing and kind of
19:57calm and relaxed and then she got a text from david and she just immediately started tensing up
20:07and from that point on he was constantly texting her who are you with what are you doing why are you
20:14there that was the moment where i saw exactly how jealous and and kind of possessive he could be
20:21i would say it it was almost like the higher she climbed the actions got a lot more controlling
20:33it was so much tension you could cut it
20:38t would come and spend more time at my house by herself come on a friday and go back home on a sunday
20:45she was always saying everything fine everything fine but it wasn't fine
20:52with t spending more time away david often takes sole charge of his children spending time at a local
21:00gun range but his mood deteriorates the fact that david's kids were there and t was not um is very telling
21:19she said that it had gotten to a point to where things were unbearable and he would say things that
21:29you shouldn't just say to someone that you love she had enough and she was tired of being watched 24 hours
21:39like a day so she made the decision to get a divorce
21:46she decided he would have one half of the house and she would have the other portions
21:54he returns to her mother's house on the weekend of june 4th 2021. we sat in the kitchen and we talked
22:02she said mom it's over between david and i she said i'm tired of david's arrogance and i'm tired of him
22:11telling me what i can and cannot do it she finally admitted that maybe she should have listened to mom
22:18i was very relieved she deserved so much more
22:22and then that sunday before we left the house david drove up and the look in her eyes was fear
22:33was pure fear i went to the door walked on out to his truck i said hey david what going on is t here
22:43i said yeah he was telling her t i just want to talk to you she said david i'm done i am done with
22:50you and i am done with this situation david drove on off the first thing that came to my mind was
22:57maybe he ain't coming back i'm like wow that was good to me we went to fishing and shalonda came on up
23:07there she and t was sitting out on the bank i said hey y'all look at me and i snapped their picture
23:13t felt relieved she dedicated pretty much everything and she put everything on hold
23:21it was almost like i could just see the light coming back into her eyes
23:27and she felt safe
23:33at the end of the weekend t returns to oxford with plans to put the house up for sale
23:38she got in the truck and left that sunday the realtor was supposed to be there that thursday
23:49at two o'clock
23:56that tuesday night she called me back she said hey mama what you doing i said nothing
24:01and so i said you got a glass let me go get a glass so i went and got a glass and i poured some wine in
24:07there i said where david and she said he up in there somewhere that was her exact word to me he up in there
24:15somewhere
24:19we were sitting there just talking and then when we get ready to get off we tapped the screen
24:25she tapped hers and i tapped mine good night i said i love you she said i love you too
24:31that wednesday morning she was supposed to call me i didn't get that call so that wednesday afternoon
24:44about 1 30 i called her phone went straight to voicemail i said oh that's not like t and then i didn't get a call
24:52back definitely not like her so i waited and waited then i got a text message on my phone
25:04just said hey mom i'll talk to you later all of the words was jammed up together no punctuation
25:13when t was sent a message you better know it was going to be correct
25:18it didn't make sense i called her phone that thursday before she left school i got a message
25:26saying hey mom in a meeting i'll call you later no punctuation mom was lowercase i just felt something
25:35was wrong so that friday morning i left to go to oxford
25:41i'm going to call her phone and i'm going to call her phone and i'm going to call her phone
25:47there's an insurance department oh yes we need to make a report in regards to a very
25:52serious matter one of our co-workers called and basically said that he was involved in a murder
25:58a few days ago and it's like apparently everything's still like it was at the house like he hasn't come in to work
26:18dispatch had a male subject on the line saying that he had shot his wife he was currently still
26:31inside the house as i got closer to the neighborhood dispatch did relay information that
26:38the suspect was possibly in a wheelchair
26:42most important thing when we arrive on a scene to a call of this nature is safety try to find out
26:52where the suspect's at and secure the residence as quickly and as safely as possible
27:02i remember the garage door kind of opening and i could see an ale coming outside in a wheelchair
27:09my greatest worry or fear is that he was still armed with a weapon appearances can be deceiving
27:24dude let's clear after we secured the suspect we start making our way through the residence room
27:30by room we're constantly on high alert there could be a threat to pop out behind the corner
27:39because i was making my way through the kitchen i do remember seeing a couple firearms on the bar in
27:44the kitchen at this point we just bypass them because this is mississippi nothing unusual to see a gun
27:51laying on a counter
27:51once i got to the bedroom i could see a comforter laid on the floor
28:05yeah she's cold it appeared that she had been there for a period of time so at this point i've
28:11asked the deputies to exit the residence with me because this has now become an active crime scene
28:16you really never know what you're going to get when it comes to a murder suspect
28:29i would say that the the suspect's demeanor was was very calm he didn't really say much he was very
28:44nonchalant suspect was placed in a patrol vehicle i followed that vehicle back to my office at the
28:54lafayette county criminal investigations building still on the road miss archie remains unaware
29:01of what has happened to her daughter i called david's phone he didn't answer the number cannot be reached
29:08so i called dave's mom's phone she didn't answer i said somebody need to call me what is going on
29:16she called my phone she called my phone and said aunt tiotta is dead and hung up and i just lost it
29:29when i made it to the home yellow tape all the way around the house
29:34and that policeman walked up to the car and he said i said what's going on he said well ma'am
29:40there was a deceased female in the house all i could think about was i know this ain't true i know this
29:51is not true but it was true it's like a gut wrenching it's just a hurt that just won't stop
30:10david swims was placed in our interview room the only thing i was aware of is the 911 call that he
30:18had made claiming that he had shot his wife so i went into the interview trying to figure out exactly
30:25what happened but once he was read as miranda writes he invoked his rights so unfortunately we
30:32had to end the interview at that point officers obtain a search warrant for the property
30:41a knife was recovered on the scene towards the back of the bathroom where t was found
30:48t had three entrance and exit wounds indicating that she had been shot three times
30:53there were three bullet holes in the wall behind where she would have been those bullet holes weren't
31:00in a tight group they actually moved the way that i perceived it from left to right
31:05the bathroom where t was found clearly had been cleaned it should have had more blood in it
31:14something that struck me very odd written in the very center of the kitchen counter by the firearms
31:19with a black sharpie were the words pain lies and deceit we also noticed the picture frames on the
31:28bookshelf they were turned face down and then i started looking around the residence and i noticed
31:36that all the other photographs were turned over i picked one up i saw that it was david swims and what
31:44appeared to be the deceased female it was like the suspect couldn't look at the victim after what he had done
32:05david swims is charged with first degree murder and a secondary count of felonious possession of a firearm
32:12bail was set at one hundred thousand dollars david was able to hire a bail bondsman
32:23generally speaking that bail bondsman only requires ten percent of that payment to sign on to that bond
32:33the next day david posts ten thousand dollars bail and is free to leave
32:37ten thousand dollars for my daughter's life i go out in the yard and dig up ten thousand dollars
32:46i still don't understand that but he was released extremely quickly
32:52i really had to pray so that i wouldn't do anything that would take me away from my kids
32:57those were the hardest days because everybody it's like everybody was frozen like wondering if like
33:09are we really gonna get justice
33:13they were clearly very emotional however i needed them to be strong my goal is to get a conviction first
33:22and foremost second of all send mr swims to prison for as long as possible david did come back to the
33:30cove he moved right back into the house that was a very very hard time there was all the anger i had
33:39towards him for what he did there was a certain amount of fear somewhat in a way uh became a recluse
33:49because anytime i stepped outside that was the chance i was going to see him
33:53he went back to work he was an arrogant person he was going on living his life
34:05but he took my daughter's life
34:11somebody sent me the video of him out at a club two weeks after he murdered my daughter
34:17it just turns my stomach
34:26on monday september 19th 2023 the trial finally begins when david testifies it's the first time
34:35he gives his full version of events david swim's defense was that he came into the bedroom where t was
34:45that they had a confrontation with one another that t picked up a knife david testified that t lunged at
34:54him sideways with the knife he picked up the gun that t had in the bedroom and that's where he shot her
35:05he describes himself as firing blindly at somebody who was attacking him
35:10covering his eyes when he shoots her i argued in this particular case to the jury that it was not
35:19self-defense
35:22it was clear speaking to witnesses and looking at the forensic data that was recovered from both cell
35:28phones that the relationship was dissolving in a case like this the motive often becomes very clear
35:37the defendant did not want her to go and would do anything to prevent her from going
35:44the argument that i made to the jury was that mr swims entered that room where t was
35:51that he brought the firearm with him with the deliberate design to kill t
36:03t had three entrance and exit wounds indicating that she had been shot three times
36:08there were three bullet holes in the wall behind where she would have been those bullet holes weren't
36:15in a tight group indicated not that t was coming at david but that t was trying to get away from david
36:23and that he knew exactly how to aim if t was coming at him with the knife the knife would have dropped
36:33somewhere in the center of the room where he shot her as opposed to in the back of the bathroom where it
36:39was ultimately recovered that indicated that the knife clearly appeared to have been placed
36:46in the case miss archie brought the information to law enforcement indicating that the text messages
36:55that she received from t's cell phone clearly was not from her that david swims being the only other
37:02person who had access to that cell phone sent those text messages indicated that he was trying to cover
37:08up for his crime the length of time between when t was murdered and when david swims called law enforcement
37:21gave mr david swims two days roughly to clean up to come up with a story he was very intelligent and
37:30physically fit from the waist up but i believe he was unable to completely clean up
37:38the crime scene and he had no choice but to say that he had shot her in self-defense
37:48when we finally made it to court i learned the gruesome details of how my daughter died
37:58when i got up on stand to give my victim impact statement i looked dead in his eyes
38:04i said david swims do you hear me this will hurt me until the day god calls me home
38:17and he just sat there he never responded he never acknowledged he showed no remorse
38:27the trial lasts three days on thursday september 21st the jury returned with their verdict when the
38:36judge asked for the verdict to be read the foreman stood up he said guilty
38:50despite the prosecution working for a first-degree murder conviction the jury remain unconvinced the crime
38:56was premeditated the jury accepted that his actions instead of being deliberate in nature were depraved
39:03in nature which is second-degree murder i'm satisfied with that verdict the jury also find david guilty of
39:11felonious possession of a firearm mr schwims received a sentence of 40 years to serve two of those years
39:18suspended 38 years in the custody of the mississippi department of corrections
39:23i don't know if i'd say i'm satisfied with that but i'm happy with that because that's just like a
39:32lifetime for him when they heard the truth they knew what a monster he was
39:40and he was one of a person that could not be changed it was his way or no way he had a big hand
39:49in assisting him helping him and nursing him back from that accident she sacrificed she gave everything
40:00for his life and then he took hers
40:03i remember my sister as the peaceful dove the helper the nurturer the leader
40:18that was my one person that knew everything about me and i knew everything about her
40:25i like to remember my daughter as the vibrant young woman that she was
40:32and she would always tell me mama just do it if it's something you want to do just do it smile like
40:42you're happy happy i know it my daughter was loved she was very much loved
40:55but i'll never be the same
40:56vicky's love for ryan was pretty intense
41:13but her fear was awesome there's no other word to describe him than as a monster
