00:00I think I'm going to run.
00:23Yeah, there's a shot fired over all of Becky.
00:26We have Riverside behind the gas station.
00:30I'm on my bike.
00:31How many?
00:32How many?
00:33I don't know, three of them.
00:34Three of them.
00:35Becky and Riverside is behind the pantry.
00:39Pretty sorry, somebody might be here.
00:43I was just trying to go to the gas station,
00:45and some guy told me, no, some guy told me to come around.
00:49And he told me to go.
00:52Best to get away from over there.
00:55Uh-huh.
00:56Yeah.
00:57Power, power, power.
00:59The call came out that shots had been fired.
01:06I was a new boot.
01:07I was definitely a rookie.
01:08And for a rookie, you're kind of walking into the unknown.
01:11My body camera was already rolling.
01:13You know they're intel, right?
01:14It's smaller than the, it's about two subjects.
01:16The gas station from the gas, they also kind of shot south of the gas station.
01:20My adrenaline was definitely rushing.
01:22I was driving that night.
01:23We call him a field training officer.
01:24He was sitting in the middle of the middle of the middle.
01:26I was driving that night.
01:27You know their intel, right?
01:28It's smaller than the .
01:30So next to the gas station from the gas,
01:32they also kind of shot south of the gas station.
01:37My adrenaline was definitely rushing.
01:39I was driving that night.
01:41We called him a field training officer.
01:42He was sitting on the passenger side
01:44and basically was like, all right, it's your show.
01:46Let's go.
01:52We turned down the residential street,
01:54and we get out of the car.
01:56It was dead silent.
01:58I could hear the car that was revving.
01:59It was pretty eerie.
02:05Turn the car off.
02:06Yeah.
02:10The car was still on.
02:11I could see a black male sitting in the driver's seat,
02:14and I could see him convulsing.
02:16Every time the male was convulsing, their engine would rev.
02:20.
02:24Have AMR step it up.
02:26Climbed in the passenger side seat.
02:28He looked anywhere from 17 to 24, maybe.
02:33I mean, he was young.
02:34Looks like he's been shot right there.
02:36Yeah.
02:36I could see that he had a bullet hole to his head.
02:42There was brain fragmentation coming out, blood coming out.
02:44And at that time, I was basically face-to-face with him
02:49and kind of saw his last breath.
02:52And I kind of stepped back from there and just kind of was like, oh, shit.
03:02A field training officer tried to feel for a pulse, and there wasn't one.
03:06Uh, this was clearly a, uh, a murder.
03:12Andy.
03:13Hey, it's Hoover.
03:15I don't know if you're the guy in charge since everybody's out of town,
03:19and Brad's on, uh, the funeral leave, but we had a murder.
03:23Murder.
03:24One third, just wanted to pass on.
03:26Yeah, we just got the call.
03:27The guy's dead in the car.
03:29He got shot.
03:30We're, uh, we're still actively working at blackmail in the car,
03:33and we're in Kentucky Plates, down on Prissy, Prissy and Bakke.
03:37We're 10, 12, 15 minutes from Kentucky.
03:41It wasn't odd that a Kentucky car was parked here.
03:44We run a plate in our car.
03:47We were able to pull up his driver's license,
03:50and on his driver's license, it had his face.
03:52So, identified the driver of the vehicle as a 25-year-old Delvin Mitchell.
04:03Delvin was my best friend.
04:07Technically, his name is Delvin,
04:10but he didn't really like it that much,
04:12so he would tell us to call him Delvin.
04:14People loved him.
04:15As soon as you walk in the room, like,
04:17like, you're just gonna get that joy, that, that, that,
04:19like, it's like this wind that comes over you.
04:25Delvin did a lot of music.
04:27He never was really a rapper,
04:30but he was doing, like, the, the, like, the production of it.
04:34He used to hang out at the house with my son, Blake.
04:39My house used to be, like, a place where all the boys would come to chill out.
04:44So, one day, Blake had come and sat down in my room
04:46and asked me if he could, if Delvin could stay with us,
04:49because he didn't have nowhere to live.
04:51First, I was kind of hesitant, because I always had people there.
04:54And then I told her, yeah, then, yeah, go ahead, we can.
04:58And then, from there, me and Delvin, you know,
05:00got us a relationship as mom and son,
05:03and he used to call me mom.
05:05Oh, he ended up becoming, like, my actual brother.
05:08He went from a friend to a best friend, close friend, to a brother.
05:11That's a whole different relationship dynamic, okay?
05:20That night, he got killed.
05:24And I was asleep.
05:27They woke me up.
05:28Blake called me.
05:30And told me that Delvin was dead.
05:32I think I just shut down altogether.
05:35I just got numb.
05:37I got a text message.
05:39It was, like, um, there's, like, a Facebook status
05:42talking about there was gunshots last night.
05:44Y'all be careful, y'all.
05:45So, like, I don't know, my heart's, like, beating real, real fast.
05:48And, like, my whole, I, like, fell to my knees
05:52because I had a feeling that it was him.
05:57And then, by the time I got to the crib,
05:59they told me that it was Delvin.
06:03I don't really remember too much of the conversation
06:05because I was, like, I was, all I seen was red.
06:08Like, who would hurt my brother?
06:10Like, I don't know.
06:11I lost it.
06:12For a long period of time, for real, I was, you know what I mean?
06:15I was lost.
06:19Just close out that noise complaint.
06:21It's X-Patrol.
06:22We're going to be here a while.
06:23On scene, it was, you know,
06:25kind of that tunnel vision to what we had in the car.
06:30We crime scene off the entire area.
06:32That's when the brigade of detectives, detective sergeants,
06:44the crime scene guys started to pile in.
06:52When I arrived on scene
06:53and kind of processed that scene myself,
06:58just looking at things,
07:00seeing where, you know,
07:03there's a round laying there on the street.
07:07There's one in the floorboard.
07:09The victim, Delvin, has been shot in the head.
07:12You're kind of wondering, is this a setup?
07:15We don't know.
07:16There's all different kinds of scenarios
07:18as a detective that you run through your head
07:20to try to get it figured out as soon as you possibly can.
07:28The driver's side window also had what was consistent
07:30to be a projectile round through that.
07:34The door was open,
07:35so it could lead to a couple different things,
07:37but it looked like who shot him
07:39was in the vehicle
07:40or in close proximity to the vehicle
07:42when the shots were fired.
07:45The violence behind it was intentional,
07:47and you could tell that
07:48just from the amount of rounds
07:49that were sent through the car.
07:51It wasn't just to scare him.
07:52It was to kill him.
07:55There's two shell casings
07:56that we've seen.
07:57One in the car
07:58and one right outside the passenger side.
08:02Yeah.
08:04Because it out looks that way.
08:11Do a...
08:13Your boys start a crime scene log.
08:15Okay.
08:17We don't have all the pieces to the puzzle yet.
08:19It was one of those eye-opening experiences of,
08:22hey, you know,
08:23we've got somebody we know that shot,
08:24but where's the shooter?
08:25As you're standing there,
08:27you're just...
08:27You see this,
08:30you're asking yourself why,
08:33and, you know,
08:33it's just a mystery.
08:36Now...
08:37You can't go southbound on sweet, sir, right?
08:50Here in my ear,
08:52the dispatch had notified us
08:54that a car was fleeing the area,
08:56and other units were trying to get behind it,
08:59and as it was fleeing,
09:01they could see that the car had false plates on it,
09:04possibly involved with the scene.
09:06So hearing that in my ear,
09:08I'm thinking,
09:09hopefully we can get this car stopped,
09:11figure out who's in the car,
09:12maybe they're involved with what happened here.
09:14Officers are initiating their lights and sirens,
09:21trying to get this guy to stop.
09:22Won't stop.
09:23So now, in the back of everybody's mind,
09:26they're thinking,
09:27maybe he's our suspect.
09:29You know, he's definitely not going to stop.
09:33It's just a straight adrenaline dump,
09:36and it's just a rush.
09:38Like, we have to get this car stopped at all costs,
09:42and knowing that there's a possible gunman in this car,
09:47the level of threat just goes through the roof.
09:59There was a vehicle pursuit.
10:01We were trying to get the vehicle stopped,
10:03and it wasn't stopping.
10:04So we thought,
10:05possibly could it be involved,
10:06because it's in the area.
10:08It's fleeing the area.
10:09It could be a piece of the puzzle.
10:11This sergeant or lieutenant at the time
10:13radioed and said,
10:14other counties and state police
10:16are starting to pick up on this pursuit,
10:18so now they're pursuing the guy.
10:21But they ended up stopping him
10:22and placed him in handcuffs.
10:28Where's the problem?
10:31We got an Indiana ID card.
10:33I don't know if that's going on.
10:36We got Jack Williams' phone number.
10:38Uh, baby.
10:40I want to keep calling the phone.
10:41We're going to want to take this guy back to Vanderburg, so...
10:44Are we going to tell her, or are they going to tell her?
10:46We're thinking this might be our guy.
10:49He had the false plates on his vehicle,
10:53and they looked suspicious.
10:57I was planning...
10:58I mean, we got felony charges in our county,
11:00so there's no extradition there
11:04that we should be able to bring him back to Vanderburg.
11:06And you guys can try to talk soon.
11:08Um, just the...
11:10Him leaving the area,
11:12but that is awful coincidental.
11:13And...
11:15Talk with Peter and the prosecutor.
11:17I mean, if they just want us to impound this
11:19and talk back to Tri-State to Evansville,
11:21and we'll get a search warrant for it.
11:22Okay, thanks.
11:26I identified the guy as a subject named Simone.
11:29And Simone was placed in one of our patrol vehicles,
11:32and that patrol officer brought him to headquarters for an interview.
11:41Hey, what's going on, man?
11:44I'm Detective Lowe.
11:45What?
11:47This is my Sergeant Detective, huh?
11:49What's up, man?
11:50How you doing?
11:51I'm doing good.
11:53I need to ask you some questions, okay?
11:55Sure.
11:56So, I'm going to read you Miranda.
11:58You've probably heard that before, right?
12:00I still have to read it to you, all right?
12:02You can tell a lot by...
12:04when interviewing subjects,
12:06by their disposition.
12:08How they act, how they talk.
12:10Are they looking you in the eye?
12:12Are they looking away?
12:14Simone had some of those,
12:15but you're thinking,
12:16well, this guy was right there,
12:18and this guy fled the scene from there.
12:21All right.
12:23Do you know why you're in here right now?
12:28Run me down what happened tonight.
12:30I don't even know, man.
12:32All I know is the police jumped at me,
12:36and I was just thinking back into my mama, man.
12:40Because, you know what I'm saying?
12:42You know what I'm saying?
12:43I'm on probation and stuff,
12:44and then, like, the PO, you know what I'm saying?
12:49He said he was going to...
12:51I got a warrant or whatever, so...
12:57I don't know, man.
12:58I'm stupid.
13:00Simone basically told me that he had warrants.
13:04He was scared.
13:06He didn't want to go to jail.
13:08You think, well, maybe they did flee
13:10because they have warrants.
13:12Maybe...
13:14Maybe they have something else going on.
13:16Well, can you at least run me down?
13:19I'm trying to figure out something that happened tonight,
13:23and I'm trying to take you out of the equation,
13:25but I need you to tell me, like I asked you all ago,
13:28the last couple hours before cops got behind you
13:32and you took off, what all did you do?
13:35The liquor locker right there on cover,
13:38but I ain't been nowhere else.
13:40I ain't even do nothing wrong, man.
13:42I thought I had a warrant.
13:45After we talked to him,
13:47we got a signed search warrant for his vehicle.
13:52We couldn't find anything that would tie him to it,
13:56so we released him from that crime.
14:00It is a little frustrating because you're thinking,
14:07well, this guy was right there
14:09and doesn't have anything to do with this murder.
14:13Now you're back to square one.
14:17You got to take a broad picture and just,
14:19you don't want to get hooked on one thing
14:20and this is the way this happened.
14:22You know, that's a good thing of a good investigation
14:24as you look, you know, broadly and see
14:26who all could be involved in this
14:28and what all possibly happened here.
14:30The suspect that's still out there didn't like this guy.
14:32I mean, who killed Delvin?
14:37Still don't know.
14:38Don't have anybody else to look at right now.
14:48So when you're going through these investigations,
14:51you want to know the victim's life.
14:54You want to build the victim, his own profile.
14:58The more information you gather,
15:00you're starting to build some sort of a lead
15:04to try to help solve this case.
15:07One thing we're going to do is look at his background.
15:10There's a couple different ways we can do it,
15:13on Facebook and interviewing witnesses
15:15and talking to people.
15:17So as we're investigating this murder,
15:20we start looking at Delvin's history.
15:24We don't have much to go off of.
15:26He has a report taken under his name for something criminal,
15:30which wasn't like something huge.
15:33There wasn't anything of interest that we would need
15:37or think that we would need to follow up with.
15:41A short time later, another detective in the office
15:48had answered a phone call,
15:50and it was a male subject,
15:52and it was named Justin Brewer,
15:53saying he'd like to talk to Detective Lowe.
15:57Pretty much almost every homicide,
15:59we do always kind of get some type of tip
16:01or, hey, you might want to know this information.
16:03That's kind of typical of every case you have.
16:05My name is Justin Brewer.
16:07She said I could talk to you.
16:09Yes.
16:10Hi, how are you doing today, sir?
16:12Not doing too bad.
16:13Just in here trying to figure out an investigation I've got going on,
16:18trying to figure out what happened.
16:20Yes, sir.
16:21That's the reason why I called.
16:23I wanted to present myself to you properly
16:25and help as much as possible.
16:28But I didn't want to talk to you, sir.
16:30Okay.
16:31First, I wanted to tell you that, you know, Delvin,
16:37that's who you talking about, right?
16:39Because that's the only one that I'm, you know.
16:42First of all, he wasn't a bad guy.
16:44You know, he wasn't an angel.
16:46Don't get it wrong, but, you know,
16:48he wasn't a bad guy, sir.
16:50He said that Delvin was a good guy.
16:53He was a great guy.
16:54He's known Delvin and his, and Delvin's family
16:57pretty much his entire life.
16:59I don't want to tell you what I think,
17:01because I've heard so many different stories.
17:03I've heard so many different allegations
17:05coming from so many different situations.
17:07Uh, okay, uh, okay, for example, okay?
17:10He was having sex with a guy's wife
17:14that lived across the street from me and my wife.
17:17He also mentioned a, uh, a subject named Sean.
17:22And, uh, he, he has, uh, either a wife or a girlfriend
17:27that was named Chastity.
17:29And, supposedly, Delvin was messing around
17:33with this Chastity lady.
17:36And maybe we should turn our direction towards that.
17:39Maybe, maybe Sean's mad at Delvin
17:43and decided that he's had enough
17:45and he's going to take care of it.
17:49Okay. All right.
17:51Well, you have my number, Justin.
17:55When Mr. Brewer talked about Sean being involved,
17:58so that's something you have to take in consideration.
18:01Sometimes you have retaliation killings.
18:03We were very concerned of the situation.
18:06When the gentleman that's having an affair
18:08with your significant other does end up murdered,
18:10you're always suspicious when anything like that happens.
18:12Maybe that could be one potential motive
18:14for Mr. Mitchell's demise.
18:16We need to interview him to help us find out,
18:18where is this going to lead us?
18:27Mr. Brewer did contact the police department.
18:30On a recorded phone call,
18:32he brought up the information that Mr. Mitchell
18:35was having a relationship with Chastity
18:37and that her husband, Sean, was not happy about that.
18:41Sean's the one that I raised, also.
18:44Everybody thought Sean done it.
18:46Everybody thought Sean done it.
18:48Everybody was calling me, talking about Sean.
18:50We're going to kill Sean.
18:51Me knowing Sean, growing up with Sean,
18:53like, I knew that he, you know,
18:55he wouldn't do nothing like that.
18:56You know, but, you know,
18:57put nothing past nobody, though.
18:59We don't know.
19:00We just know that he's a person of interest.
19:02Obviously, we're going to look at Sean's criminal history,
19:05and he did have a little criminal history
19:06with disorderly conduct and lying to law enforcement.
19:09Sean said, Mom, I didn't do it.
19:14So, I believe Sean.
19:16So, I went with Sean to the interrogation place.
19:21I want to read you, Miranda, just because your name
19:28is being brought up as a suspect.
19:29Yes, sir.
19:30I understand that.
19:31I had talked to Sean about the murder
19:34and that he's a possible suspect,
19:37that his ex-wife, Chastity, had been seen, Delvin.
19:42Well, you guys were divorced, though, right?
19:43Yes, sir.
19:44Yeah, so it was none of my business.
19:45Yeah.
19:46You know what I mean?
19:47But then, I guess...
19:48But still?
19:49Yes, sir.
19:50Because you and Delvin were friends?
19:51Well, as far as I knew, we was.
19:52And then, I didn't get all the traumatic and sad information
19:55until after that.
19:56He didn't even really like you.
19:57And obviously, you know, by the actions of what was going on,
20:00I wasn't anything to him.
20:01Right.
20:02You know what I mean?
20:03But I didn't know all these hurtful things until after that.
20:06That night, he got killed.
20:07I had to tell Sean that Delvin was with Chastity.
20:09He didn't know.
20:10So, he got mad and sad all at the same time.
20:13He said he was a little upset about that,
20:16but, you know, it wasn't something that he would go
20:19and take revenge out on somebody else.
20:21He said he was a little upset about that,
20:25but, you know, it wasn't something that he would go
20:28and take revenge out on somebody for.
20:30Why do you think your name was brought up about this, though?
20:33I think my name was brought up because everybody needs
20:37a fallback and a scapegoat, and that's who I am.
20:40I'm not blaming anyone, but I even immediately,
20:43when I heard it, was like, oh, my goodness, what do,
20:46what should I do?
20:47What do I need to do?
20:48Is there someone I need to speak with?
20:49Like, because, I mean, look, you know what I mean?
20:51Like, how it looks, you know what I'm saying?
20:53Like, your buddy's messing with your wife, blah, blah, blah.
20:56Yeah, it looked real bad.
20:58You know what I'm saying?
20:59Yeah, I mean, it did for a little, you know, so.
21:01It really did.
21:02Yes, sir.
21:03And, you know, I mean, we've all watched,
21:05you've seen enough, you know, shows to know that.
21:09Sean said he went to sleep that night,
21:11that that incident occurred,
21:15and he didn't know anything about it
21:17until the next morning when he woke up.
21:18You have a past conviction of lying to the police.
21:21You know, why are we going to believe it?
21:23You're going to have to show us, you know,
21:24why you're not involved in this.
21:27Would you mind us looking at your phone?
21:30I don't know.
21:31Okay.
21:32Whatever you need to do.
21:33Can I take it?
21:34I'm going to take it in there and look at it.
21:36Is that all right?
21:37Yeah, that doesn't matter.
21:38He said, I have an app that tracks my sleeping pattern,
21:41and it'll show you on my phone that at that particular time
21:45and day that I was sleeping.
21:47So we looked at his phone, looked at that app.
21:52He was just being very honest and truthful,
21:56which in our minds kind of eliminated him from this murder.
22:02Investigating something like this is hard sometimes
22:05because it's a little overwhelming,
22:07but we keep working our case.
22:11Delvin was my biggest fan,
22:16my biggest supporter.
22:18He was always pushing me to do great.
22:21I remember, like, preparing for the funeral.
22:24His birth mother did not want to show up.
22:27She did not.
22:28His sisters welcomed me in, you know,
22:31because they know that I took care of him.
22:33Then everybody got together and wanted a picture taken
22:37of all the guys together.
22:39That whole time, like, I changed to a whole different person.
22:46Like, I don't even remember who I was at that moment.
22:49And we were still trying to find a killer for Delvin.
22:51So it's just a lot going on at this moment.
22:54You know what I'm saying?
22:55Like, I can't grieve at all right now.
22:56Like, right now, it's just, like, my soul's gone.
23:00You know, I don't even want to live no more myself.
23:03You know what I mean?
23:04So it really hurt, for real.
23:06And I'm still suffering.
23:07His life was taken.
23:10He didn't deserve that.
23:12There's a lot of people out here that deserve it,
23:15but he didn't.
23:16A short time later, the phone rings, and again,
23:30it's Justin Brewer.
23:31Same guy from the earlier communication.
23:33He was having sex with a guy's wife that lived across the street from me and my wife.
23:40I did find that kind of odd that another call came in.
23:43So I answered the phone.
23:45He tries to tell me several different stories about what could possibly happen to Delvin,
23:50which, in my mind, thought was kind of far-fetched.
23:56I said, did you ever meet up with Delvin?
23:59He said he was supposed to meet Delvin on the night that he was murdered.
24:04And at that particular time, I don't know that information.
24:08He didn't want to give a whole lot of information before.
24:11So you're kind of wondering why now.
24:14That night, I called him, and he was supposed to meet up with me.
24:18My wife is a cab driver.
24:19I called my wife to bring me, and he never showed up.
24:23And I didn't charge him, you know, to my heart about that
24:26because it was something so small and petty.
24:28You know, honestly, I just felt like, well, maybe he thought it wasn't worth his time.
24:32So I asked him where they're going to meet at.
24:34It's a little apartment complex,
24:36a block and a half away from where Delvin got shot and killed,
24:39where he could get a bag of weed for his wife.
24:44His wife's name was Amber Brewer.
24:47She worked for a cab company, driving a cab.
24:52And he said, no, no, I met in that area, and I waited all night long.
24:57He never showed.
24:58There was other detectives in the room with me.
25:00We kind of all just looked at each other in awe.
25:06We just could admit of being there that night, close to the area where Delvin was murdered.
25:12In my opinion, you're being nosy because you know something happened,
25:17and you're wanting to know what we know.
25:19And I'm not giving that to you.
25:21You heard the stuff on Facebook, like the police chase and the shooting and all that.
25:25You tried to call him or text him or what did you do?
25:27No, sir. No, sir.
25:29After I left, I tried to call him again and he didn't answer.
25:33After we completed our conversation, like I said, did this guy really just call in here and give this story of his events that in his mind took place?
25:48It didn't make any sense. None of his stories made any sense.
25:54I believe then Justin called back one or two more times just trying to kind of feel the detect about, hey, what do you have on me?
26:01And then trying to throw shade on maybe other, just to send an investigation to another area other than himself.
26:09He kind of admitted that he was supposed to meet Delvin very close to where the incident occurred the night that he was murdered.
26:17So we had enough probable cause to get a warrant for his phone number to get call detail records, text messages.
26:26And found out that on the night of the incident, Justin had called a female, her name's Scarlett.
26:34There were several phone calls and texts back and forth.
26:38So we all were thinking, is she the side chick that got involved?
26:42When you commit a crime such as murder, you know, the wheels are turning.
26:46I'm sure he's looking out the window, did anybody see us?
26:48You know, he called on somebody that he had faith in and maybe that was Scarlett.
26:53We got to talk to that person, find out how she was involved.
26:57We did some further follow-ups and found additional cell phone data.
27:10Cell phone data does not lie.
27:14The phone data showed that Scarlett was in recent contact with Justin the night of the murder.
27:20There were several phone calls and texts back and forth that was suspicious.
27:27We found out that Scarlett was living with her mother.
27:30So we went to the mother's house to try to interview her there, but she wasn't home.
27:36So we interviewed the mother at her house.
27:42Okay, Terry, go ahead and have a seat.
27:45Terry, you remember me. I'm Detective Wheeler.
27:47Yes.
27:48And this is Detective Hands.
27:50She's a very nice lady, and I believe she had some concerns about her daughter's safety since she was involved with Justin Brewer.
27:56She said, Mama, Justin wants to know if he can come to the house and stay for about three or four days.
28:05And I said, well, he's got a home.
28:08Because when he came that night, I was so freaked out.
28:12I knew she wasn't right.
28:14And I stayed in there to myself.
28:17I didn't want to be around him.
28:19No.
28:20She said Justin ended up getting dropped off at Scarlett's mother's house.
28:25The night of the murder, and Justin had come in kind of in a frantic-type mood, very wired, very amped up.
28:34Really, truly, honestly, didn't even want it there.
28:38Mm-hmm.
28:39But that's fine, right?
28:42Yeah.
28:43It's your daughter. I understand.
28:44I know, I know.
28:45It is unsettling.
28:47But what I want to make sure is you're not doing something to your kid now.
28:52No.
28:53If you know something, it's important.
28:56The only time that he talked to me, he came downstairs, Scarlett was gone.
29:00And he just kept walking back and forth, you know, doing this.
29:06I really want to tell you what's going on, Mom.
29:10I think you should know, but I really don't want to tell you.
29:15You know, more or less, he was admitting to me, but he didn't come out and say it.
29:23According to Scarlett's mother, he said something bad had happened that night.
29:29We were starting to get more and more information.
29:33She did admit that Justin was at the house.
29:36She's a potential not eyewitness to the murder, but maybe a circumstantial witness to a murder.
29:43Do you ever get 100% of the information?
29:46The only person that really knows that is the person you're interviewing.
29:49Did he expand on that, what he wanted you to know?
29:52No.
29:53Not at all.
29:55He did not come out and say he murdered that boy.
29:59No, he did not.
30:01And I put my name on the Bible to that.
30:04He did not say that.
30:05But in so many words, I knew that something wasn't right and he done something.
30:12I mean, you could tell she was scared of him.
30:16She would sit there and talk to us and smoke, which I'm not a smoking fan, but it was worth it.
30:22What did Scarlett tell you that he told her?
30:25Scarlett told me that he killed me.
30:29When was this?
30:31This was...
30:32Before he left?
30:33Yeah, before he left.
30:35Justin didn't tell you personally that he did?
30:38No, he did not.
30:39I never heard that come out just now.
30:41In a roundabout way, though.
30:44He said it.
30:45You know, in a roundabout way.
30:51Afterwards, we did some interviews with Scarlett.
30:55She was not willing to give up any information.
30:58We tried to speak with Justin, but he refused to talk to law enforcement when confronted.
31:05Justin didn't want to speak with us.
31:08So we put our attention more towards Amber, Justin's wife.
31:13In the interview, phone calls before with Justin Brewer, he did inform detectives that he had been picked up that night in Amber's cab to meet Mr. Mitchell.
31:25And Mr. Mitchell had never shown up.
31:27We then go to Ucabi.
31:30They did confirm that, yes, Amber was working that night.
31:36And her cab, it had GPS tracker in it, which is always good for us.
31:41And it shows exactly where the cab was going.
31:44It could be that break moment where, like, this is it.
31:50There is almost always information on those devices that will help us along in our case.
31:57So you're hoping that happens.
32:00I went into the office and they had come back from the taxi cab place with the GPS information.
32:07It showed Amber's cab going down to the southeast side and stopping a block or so from the murder.
32:16So it was kind of nice to look at the data and go, okay, so it puts him at the scene of the crime at the time of the murder.
32:23And then, immediately after, it shows her stopping on top of Diamond Avenue over Pigeon Creek.
32:33That was the first thing we all thought, holy , she just threw that gun out in the creek.
32:41The dive team showed up at the bridge.
32:44And they did their process as far as searching for the gun.
32:48Are we going to find something there?
32:51My thoughts are, there's no way.
32:55There's a young man from the local news.
32:57And my first question to that reporter is, hey, when is this going to be on TV?
33:01And he said it would be on an 11 o'clock news.
33:04Evansville is not a huge community.
33:07But you look up and there's news media trucks lined across this bridge.
33:11They were all over the story.
33:12We then got the thumbs up that there was a discovery and the diver did a great job.
33:22He found it in pitch dark water and he pulled that thing up and I'll never forget it.
33:26And the next thing you know, you're looking at a slide from a Smith & Wesson.
33:29So this is more icing on the cake.
33:35We had enough probable cause to get arrest warrants for Justin and Amber.
33:43But we could not locate them here in the city of Evansville.
33:50It might have taken us a week or two, but then we got a, I was on a date night with my wife and got a confirmation from the FBI that Amber and Justin were in custody in Shumlee, Georgia, just outside Atlanta.
34:09She was stopped while texting and driving.
34:15So at that point, things were going good.
34:18With them in custody, you'd love to sit down face to face with them, look them eye to eye and get a full confession.
34:28Justin Brewer refused to speak to investigators, but Amber decided to speak with law enforcement.
34:34Myself and detective Lowe walked in there thinking, okay, what, what are we going to hear?
34:51The best way I think to kind of start this back is just going to go back a little bit from the day before everything happened.
34:57Are we going to hear some story that does not jive with any of the evidence we have?
35:01I'm going to take you back to around January 25th of 2019.
35:05Or is she going to tell us the truth?
35:07Amber Brewer did decide to speak with law enforcement.
35:26Amber Brewer did decide to speak with law enforcement.
35:29I fully intend not to tell a lie at home.
35:34So if it's safe to say on 1-25-2019 that in January 25th of 2019 you were working at UCAVI?
35:41Mm-hmm.
35:42Sometime or another did you have a conversation with Justin and did you go pick him up at the hotel you were staying at?
35:50Yes.
35:51Okay.
35:53I went and picked him up so I could get a bag of weed.
35:55Okay.
35:56Amber basically told us that the night of the murder Justin was wanting to get a little bag of weed.
36:05Who, um, who set up the deal to get the bag of weed?
36:08He did.
36:09Okay.
36:10And we're talking about, and who did he set it up with?
36:13Um, that young man right there.
36:16His name was on that paper.
36:17Devin.
36:18Devin Mitchell.
36:19Okay.
36:20She said she picked Justin up.
36:22They drove to the southeast side of, uh, of Evansville to meet Delvin that night.
36:30We just enter into the parking lot.
36:32Okay.
36:33And what happens there?
36:34We get in, um, the car that he was driving.
36:37Delvin's car?
36:38Okay.
36:39And what happens in there?
36:40Um, he takes off out the parking lot and I can't, I'm, I'm not going to tell you which
36:45direction we went in because at the point we get in the car, I'll leave it up to the,
36:49to them to figure out whatever they're doing cause I, you know, I'm just, I'm with my husband.
36:53I understand.
36:54She gets in the back passenger seat of Delvin's car and Justin gets in the front seat.
37:05They drive around a little while.
37:07So I'm in the back seat, minding my own business.
37:10Susie pulls over, my husband pulls out a gun.
37:13And I'm not used to those type of things.
37:17I understand that.
37:18Yeah.
37:19So I took, I got out the car and took off running.
37:21Okay.
37:22And, um, that's, that's when I heard, um, the gun go off.
37:27Um, I just...
37:28She couldn't remember how many times you heard it go off?
37:30No.
37:32Justin's got a gun pointed at Delvin.
37:35And she says she jumps out of the car and takes off running.
37:39And she gets a short distance and hears some gunshots.
37:45People give false confessions.
37:47We did not find anything deceitful in her interview with us.
37:51Everything was consistent with our investigation.
37:55Okay.
37:56At some point you stopped your cab at the Pigeon Creek Bridge there?
37:59Yes.
38:00Okay.
38:01And do you get out?
38:02Yes.
38:03And what do you do there?
38:04Well, my, my vehicle was smoking.
38:05I didn't make a maintenance report about it.
38:07And, um, I don't, I don't know just if it was smoking.
38:12So, but, um, I drew the slide that he told me I had to get rid of.
38:16So after she tells us this story, you're pretty confident you've had the right guy.
38:23You've been hearing his name, he's made calls to you.
38:28It all matches up.
38:29Mr. Mitchell was a very young man and to be killed over a bag of marijuana, it is tragic.
38:41He's not going to get his life back and the family doesn't have him back.
38:44I don't know if it's a lack of respect for a human person or it's just the disdain for not getting something you think you deserve.
38:53I don't know what causes this.
38:55Amber testifies against her husband.
39:01She was charged with obstruction.
39:07She was released on time served.
39:09Justin was ultimately charged with murder.
39:15They found him guilty.
39:18He was sentenced.
39:20And the judge recommended 85 years in prison.
39:23Scarlett was ultimately convicted of obstruction of justice for lying to law enforcement.
39:32And she was sentenced to two years and 182 days.
39:39We've done phone calls before where people have actually called in and talked to law enforcement knowing they're the suspect.
39:45They want to know what the word on the street is.
39:49But curiosity kills the cat sometimes.
39:52And that's what happened in this case.
39:55In my mind, in my heart, I hope the family knows that we did everything we could and that we did get justice for Dalvin.
40:07Dalvin, he was a star.
40:12I mean, he was just great.
40:15He didn't really get a chance to even live life.
40:26I'm still having trouble with it.
40:30I sit at home all the time.
40:31I really don't deal with anybody.
40:34I don't deal with anybody.
40:40I hope Justin really thinks about what he done.
40:44and how bad he impacted a lot of people.
40:50Dalvin was the joy of a lot of our lives.
40:56And now we don't have that joy no more.
40:59You stole that joy from us.
41:04He took my bestest friend.
41:05So, I'm hurt still to this day.
41:14It was the life of the party.
41:17There ain't no more parties no more.
41:19There ain't no more parties no more.
41:21There ain't no more parties no more.
