00:00The Federal Court was told on Thursday that MOAR MP Syed Sadiq Syed Abdul Rahman was the mastermind behind the Criminal Breach of Trust, CBT, involving Angkatan Bersatu Anak Muda, Armada funds.
00:15Deputy Public Prosecutor DPP Datuk Wan Shaharuddin Wan Ladin argued that Syed Sadiq had allegedly instructed Armada's then Assistant Treasurer, Rafiq Hakim Razali, the 13th prosecution witness, to withdraw one million ringgit belonging to the party's youth wing.
00:33He said this was corroborated by several witnesses, including Muhammad Naqib Abdul Rahim, Muhammad Daniel Kusari, Abdul Hanan Khairi and Ahmad Redzwan Mohamed Shafi.
00:45who testified that they too acted on Syed Sadiq's instructions.
00:49Wan Shaharuddin added that in abetment cases, it is lawful to charge only the abetor even if the person who executed the act is not charged.
00:58He also said the Court of Appeal failed to consider why Syed Sadiq allegedly ordered the withdrawal or why he asked for the one million ringgit to be cleared during an MACC raid at his home in March 2020.
01:12Another DPP, Datuk Ahmad Akram Garib, argued that the appellate court erred in overturning Syed Sadiq's convictions for dishonest misappropriation and money laundering involving RM120,000 ringgit raised during political fundraising events.
01:28He said the funds were entrusted to Syed Sadiq in his capacity as an office bearer and warned that the Court of Appeal's reasoning could open the door for political figures to treat campaign donations as personal funds.
01:41Syed Sadiq's lawyer, Datuk Hisham Teh Potek, said the defense would reply to the prosecution's arguments on Friday when hearing continues before a three-judge federal court panel led by Court of Appeal President Datuk Abu Bakar Jais.
01:54The prosecution just completed your submissions this morning. We will respond tomorrow. We put up a strong and a robust response to the submissions made by the prosecution. And God willing, inshallah, we will have the appeal dismissed.
02:09On June 25, the Court of Appeal acquitted and discharged Syed Sadiq after allowing his appeal to overturn his conviction and sentence of seven years jail, two strokes of the cane, and a RM10 million fine imposed by the High Court on November 9, 2023.
02:27The Attorney General's chambers filed its appeal in the federal court the next day.
02:32Syed Sadiq was charged with abetting Rafiq Hakim, who was entrusted with RM1 million of Armada funds, to commit CBT.
02:40He also faced a charge of misappropriating RM120,000 from an Armada Bumi Bersatu Enterprise account,
02:47and two counts of money laundering involving RM50,000 transfers each from his Maybank Islamic account into his Amanah Sahambhumi Putra account.
