00:00Shep, dozens of times in Elizabeth Holmes' sixth day on the stand, the one-time prodigy
00:05said she couldn't remember statements that she made to investors, only to be confronted
00:11with evidence of what she said.
00:13Holmes' testimony, of course, is that she never intended to deceive anyone, that she
00:17truly believed in Theranos' technology, and she still does to this day.
00:22But in this second day of cross-examination, Assistant U.S. Attorney Robert Leach tried
00:26to show how Holmes allegedly let the hype about her company explode, even when she knew
00:31that the reality was different.
00:33Like her work with the military, Holmes acknowledging today that the Theranos device was never used
00:38on the battlefield, but one big investor testified last month that she had told him the company
00:43had something like $200 million in Pentagon revenue.
00:47There's nowhere close to that.
00:49Or a potential deal with Safeway for in-store testing, which was on the rocks by 2014 and
00:54never did come together, but investors were told that Theranos would be in some 900 stores
01:00in the next year.
01:01Or the glowing Fortune magazine cover story in 2014 that had turned out wildly overstated
01:06some of Theranos' capabilities.
01:08Rather than correcting the record, Holmes admitted that she had that report sent out to investors.
01:14Now, on a redirect examination, this is friendly questioning from her attorney, Kevin Downey.
01:20Holmes said that one of the reasons that she couldn't set the record straight to the extent
01:25that maybe she should have was because of the company's obsessive attention to trade secrets.
01:32It was something that she said that a Theranos attorney drilled into her and other executives.
01:36She will be back in the witness stand for some more friendly questioning from her attorney,
01:40Kevin Downey, tomorrow.
01:41Then the government could have some more questions.
01:43The defense has said that it hopes to wrap up its case, to rest its case this week.
01:48That could come, Shep, as soon as tomorrow.
