Democrats celebrated after a Clinton appointed judge threw out the James Comey indictment and Letitia James mortgage fraud case, ruling the prosecutor lacked lawful authority, a decision that echoes the earlier dismissal of Jack Smith’s case against Trump and leaves both cases open to future re filing. At the same time Senator Mark Kelly is under Pentagon review for appearing in a video urging troops to defy illegal orders from President Trump despite admitting he could not name any, a move Pete Hegseth says used Kelly’s rank in a way that could bring real consequences under military law.

00:13Then Pete Hegseth, he just went nuclear on Senator Mark Kelly after a group of Democrats posted a video—

00:20where they're telling troops to defy illegal orders from President Trump.

01:35All right, let's dive in.
01:36Breaking today.
01:36A Clinton-appointed judge, Cameron Curry, just tossed not one, but two major cases.
01:42The indictment against disgraced former FBI Director James Comey and New York AG Letitia
01:47James' mortgage fraud case.
01:49The judge claims interim U.S. Attorney Lindsey Halligan
01:52wasn't lawfully serving when she secured the indictments.
01:55What the judge here has found, this is Judge Cameron Curry from South Carolina.
01:59She came into the district, heard arguments from both of the lawyers on these cases against
02:04Lindsey Halligan's role.
02:06They argued that she didn't have the power because she wasn't Senate confirmed and thus
02:11these indictments are invalid.
02:13The judge is agreeing with that.
02:15Judge Curry is saying that the Attorney General's attempt to install Ms. Halligan
02:19as interim U.S. Attorney for the Eastern District of Virginia was invalid.
02:23And because Ms. Halligan had no lawful authority to present the indictment,
02:29James Comey's motion is granted.
02:31The indictment is dismissed.
02:33Now, the judge does mention that this is without prejudice.
02:37So in legal speak, that means that it could be
02:40brought back by another prosecutor in the Eastern District of Virginia
02:44if they took it through the grand jury again.
02:46But everything Lindsey Halligan did at the end of September, beginning of October,
02:50and since then, this judge is saying she couldn't have done that.
02:54She didn't have the authority.
02:56She was not confirmed by Congress, by the U.S.
02:59Senate as the Eastern District of Virginia's U.S. Attorney.
03:02And thus, the president went out of his bounds.
03:06And the Attorney General, Pam Bondi, also overstepped her bounds in sending
03:10Lindsey Halligan into this district to get these indictments against both Comey and James.
03:16Now, this is just a district court ruling.
03:18And yes, it will likely be appealed, but we know how long that takes, right?
03:22Appeals take forever.
03:23And that's the point.
03:24This has stall tactic written all over it.
03:26And here's the wild part.
03:28The judge leaned in on the dismissal of Jack Smith's case against Trump as her blueprint.
03:33Watch this.
03:34And she cites the case, U.S. v. Trump.
03:38So that is the nail in the coffin at this point in time for these two cases.
03:43The decision made by Judge Eileen Cannon in Florida last year that the case against Donald
03:49Trump related to his alleged mishandling of classified documents, that that could not go
03:53forward.
03:54The judge is saying in this case that James and Comey, they cannot face these charges because
04:01the prosecutor was invalid.
04:03And she is basing that, according to this order, this 26-page order, largely upon the
04:09Trump case, which Donald Trump won and which freed him from being a criminal defendant as
04:14he was taking office this year.
04:16Now, the case she's talking about, as you probably know, was tossed out.
04:20And then Trump won the presidency, which sent the Justice Department scrambling to slam the brakes
04:24on not just that one, but also the Jack Smith case in D.C.
04:28Both got shoved straight into the political deep freeze.
04:31And now this judge is basically saying, hey, if Congress hands the right person the magic badge,
04:36these cases could rise from the dead.
04:39So the door isn't closed.
04:41It's just waiting for someone with the proper credentials to kick it wide open.
04:45Hopefully the DOJ will take that initiative and make it happen.
04:48Letitia James, she wasted no time taking to X and responding to the judge's ruling, writing, quote,
04:52I am heartened by today's victory and grateful for the prayers and support I have received from
04:57around the country.
04:58I remain fearless in the face of these baseless charges as I continue fighting for New Yorkers
05:03every single day.
05:05Law professor Jonathan Turley says to the AG, she might want to hold off on that champagne toast.
05:09Well, Letitia James might be celebrating a tad too early.
05:13The problems here are not with the charges themselves, but essentially with the cop,
05:19or in this case, the prosecutor.
05:21So the court is not saying that she was innocent of these charges.
05:27The court is simply saying that the person who signed off on the charges didn't have authority
05:31to do that.
05:32Now, the DOJ says they learned about this at the same time we all did this morning.
05:38They're now evaluating their options.
05:39Swift accountability?
05:41Hmm, not going to happen.
05:42Comey and Letitia James aren't walking into a federal courtroom anytime soon.
05:45They are both, I believe, supposed to appear in January.
05:48This is classic two-tier justice, right?
05:50We have big headlines, big investigations, and then nothing.
05:54Justice delayed?
05:55Starting to feel a lot like justice denied.
05:58But you know I'll keep watching for any new developments on this.
06:00Hopefully there will be some.
06:01Meanwhile, the Pentagon is now threatening to court-martial Democrat Senator Mark Kelly
06:06for starring in a video telling troops to break the chain of command and disobey President Trump,
06:11even as some admit they can't name a single illegal order.
06:15We wanted to start a conversation, and we did, about the dangerous rhetoric this president is using
06:22and the threats that he's made to use our military in an unlawful way.
06:26Specifically what?
06:28Well, send troops into Chicago, send troops into polling stations,
06:31kill terrorists' families, arrest and execute members of Congress.
06:36Yeah, so those were comments, not orders he gave.
06:38Do you believe President Trump has issued any illegal orders?
06:43To my knowledge, I am not aware of things that are illegal.
06:47Even Joe Scarborough called that answer a dumpster fire.
06:51I'm sorry, with all due respect, wrong answer.
06:53If the president has already said, I'm going to commit this illegal act,
06:59then I'm kind of surprised they don't have the answer when they go on a Sunday show for that.
07:03Scarborough gets it. No matter how much you disagree with the president,
07:06you do not interfere with the chain of command.
07:08Those who have served, they know better than anyone.
07:11Here's Mark Kelly over the weekend trying to save face, playing like he's the patriotic hero.
07:16We're not giving up. We're not going anywhere.
07:19Donald Trump is not going to intimidate me or make me back down.
07:24What he said this morning on the radio, insignificant.
07:28What we did was patriotic. There is nothing more patriotic than standing up for the rule of law
07:35and the Constitution.
07:36Pete Hegseth over the Department of War, he sees it differently, writing about Kelly,
07:41saying in part, quote,
07:42As was announced, the department is reviewing his statements and actions, which were addressed
07:46directly to all troops while explicitly using his rank and service affiliation, lending the
07:51appearance of authority to his words. Kelly's conduct brings discredit upon the armed forces and will be
07:56addressed appropriately. Now, for those of you that are wondering why the other five Democrats involved
08:02in this video are not being held accountable, Hegseth explained it and he says it's basically
08:06because they do not fall under the Department of War jurisdiction.
08:09One is CIA and four are former military but not quote unquote retired, so they are no longer
08:15subject to uniform code of military justice.
08:18Well, then over the weekend, Senator Alyssa Slocken, who's never so much as held a rifle,
08:22whips out a few good men like it's a field manual on illegal orders.
08:26Because obviously Hollywood is the gold standard for military law now.
08:30If you look at popular culture, there's like you watch, you know, a few good men like we have
08:35plenty of examples since World War II in Vietnam where people were told to follow
08:40illegal orders and they did it and they were prosecuted for it.
08:44So now Hollywood flicks count as evidence because, well, that makes sense, right?
08:47Democrats do love living in fantasy land. And speaking of fantasies, here's Abby
08:52Phillip over CNN, so-called journalist, doubling down that it's totally fine for military members
08:58to just, I don't know, ignore the president. Because apparently chain of command rules are
09:02optional when it suits your political narrative. It's a wink and a nod and it's all meant to
09:07undermine the president of the United States. The military does not have a right to undermine-
09:11Guess what? Hold on a second. In this country, you do get to undermine the president of the United
09:16States. Not if you're in the military. No, no, no. He's the commander in chief.
09:18If you are a member of Congress, you absolutely in this country have a free right to undermine
09:24the president of the United States. Do you know that?
09:27Can you imagine if our military started defying Biden's Afghanistan withdrawal orders that got
09:3213 service members killed? That would have been a real crisis. But did you see Republicans telling
09:37troops to disobey? No. Instead, they fought to hold those responsible accountable. That's called
09:44leadership. That's how you do it. Something the left only reads about in history books.
09:48Now, speaking of left-wing leadership fails, let's turn to New York City, where soon-to-be mayor Zoran
09:53Memdani had a little Oval Office moment with President Trump on Friday. You probably saw it by now.
09:58And wouldn't you know it, suddenly he's singing a very different tune when he's not standing shoulder
10:02to shoulder with the commander in chief. Just a few hours later, fresh off the Oval Office floor,
10:08Memdani was back on live television calling Trump names like a political yo-yo.
10:12You've also said in the past that President Trump has engaged in a, quote, attack on our democracy.
10:18You've called him a despot. Do you still believe President Trump is a threat to the democracy?
10:23Everything that I've said in the past, I continue to believe. And that's the thing that I think is
10:27important in our politics is that we don't shy away from where we have disagreements, but we understand
10:32what it is that brings us to that table. Because I'm not coming into the Oval Office to make a point or
10:37make a stand. I'm coming in there to deliver for New Yorkers. And a few weeks ago, I was asked by
10:41a reporter three words to describe myself. I said, New York City. And that's what animated
10:45that conversation. How do we deliver for the people of New York City?
10:48If you really believe the president is a despot, why on earth are you arguing to work with him?
10:54By the left's logic, Trump even trying to negotiate with Putin was cause for a national panic.
10:59Hypocrisy much here? Meanwhile, classic Trump, he quietly does what he always does,
11:04keeps his friends close and his enemies so close, they end up looking foolish on camera.
11:09Trump posted pictures of him and Memdani from the Oval Office, and suddenly, it all clicked for me.
11:15On defense, he's showing critics he'll talk to anyone and that he genuinely cares about New Yorkers,
11:20right? It humanizes Trump. And it blows up that narrative that he's selfish and it's my way or the
11:24highway with him. Well, on offense, those same photos sabotage Memdani's relationship with his base.
11:30Trump knows his fans see him as the devil, and Memdani cozying up to him just enrages those
11:36supporters. It is brilliant strategy. He's always playing chess, right? Meanwhile, Memdani,
11:41he's running his own little business model. Everything will be free, just send me money first.
11:46He is still begging for cash, like it's Black Friday sale that never ends, ad after ad after ad.
11:53And now, we're up to number three. Here's a quick little highlight reel of his socialist wish list.
11:58Bring your checkbook. Remember how I told you a few months ago to stop sending us money?
12:03You can start again. This transition requires staff, research and an infrastructure that can
12:08meet this moment. I'm still asking for your help because we need to raise $4 million in total.
12:12So January 1st can be the day we start to deliver, not start to prepare. I hope very soon not to have
12:17to ask you for money. But until then, I'm asking. The leaves, they are changing. The air, it is crisp.
12:24But one thing that stays the same is we still need you to donate.
12:27Ah, yeah. Socialism. Always stumbling upon capitalism when it's time to pay the bills.
12:33And speaking of wild contradictions, let's talk about Jasmine Crockett, who manages to
12:37prove once again her level of ignorance. This time, she says Elon Musk is the bigger strain
12:42on the federal government than the people on Snap. Yeah, Elon. The guy literally building spaceships
12:48while she's busy building conspiracy theories. There was this image that people had of who it is
12:54that is on welfare, right? Like the person that is getting EBT and snap benefits. The image was
13:01some lazy, typically black woman, right? That was the image that they wanted to portray. But then
13:07people found out that we have 42 million people that rely on snap benefits in this country. And that's
13:12only $6 a day to eat $2 a meal, which I'm not really sure what all you get for that. But they
13:17wanted to make people believe who weren't on snap benefits, that these people are the real drain on
13:22our system. When you're worried about somebody getting $6 a day to eat. And the real welfare queen
13:28is like Elon Musk, who gets $8 million a day from the federal government. Now let's talk facts,
13:33which I know is unfair to Jasmine, but we're going to do it anyway. Elon, he actually gives back to the
13:38system unlike snap recipients who just received handouts. Elon, he creates real jobs, he pays
13:44massive taxes, he builds cars, robotics, medical tech, and Starlink, which by the way, kept people
13:50connected after Hurricane Helena knocked out communications in North Carolina. Starlink literally
13:55let people call for help and let emergency crews coordinate. And on top of that, he builds rockets so
14:00we don't have to bum a ride from China or Russia. I mean, the man even saved astronauts in space.
14:05Meanwhile, Jasmine's biggest achievement is going viral for saying something unserious on purpose.
14:11And as for the snap program she's defending, Minnesota is running it like Tim Waltz is a
14:16game show host gone rogue. Step right up, spin the wheel. Maybe you qualify, maybe you don't,
14:21who cares? Except the prizes aren't vacations or cash. They're taxpayer dollars being launched
14:26into the abyss. The program distributes nearly 70 million dollars in benefits each month in Minnesota
14:33alone. Well, Five Investigates has uncovered audits that show the state did not perform required
14:39security checks of the computer system that determines who is eligible to receive this money.
14:45It is a discovery that has SNAP recipients like Mateo Halbesleben worried about the safety of his
14:51personal data. You'd think the focus would be making sure the right people actually get the help,
14:55but instead it turned into a government free-for-all. And predictably,
14:58the folks who depend on these benefits the most are the ones who pay the price.
15:02Just another installment in Tim Waltz's ongoing saga of how to mismanage a state in record time,
15:07and him and Gavin Newsom, boy are they going for the gold. The only question here though is,
15:11was Tim Waltz doing this out of incompetence, or is this something that was a bit more deliberate?
