00:05A federal immigration agent allegedly aimed a gun at a U.S. citizen during a Chicago protest,
00:10shouting, you're dead, liberal.
00:13According to a court filing, the threat marks a violation of a temporary restraining order
00:17against the Department of Homeland Security.
00:20Representing the Chicago Headline Club and other plaintiffs,
00:23the court document claims that DHS agents disregarded a temporary restraining order on force at protests.
00:30The plaintiffs alleged that a federal officer pointed a pepper ball gun, and then a real gun,
00:35at a man who was lawfully standing on the side of the road voicing his opposition
00:39as agents were driving by in their vehicles.
00:42The incident, which involved a man who was reportedly unarmed,
00:46occurred during Little Village protests following federal operations earlier in the week.
00:50According to the filing, agents deployed tear gas and pepper munitions in violation of the restraining order
00:55Judge Sarah L. Ellis' issued against DHS,
00:59which allows such crowd control measures only when there is an immediate and serious threat of physical harm.
01:05On X, DHS defended the agents, stating they were reacting to rioters
01:09who shot at agents with commercial artillery shell fireworks.
01:13They claimed the mob of rioters grew more hostile and violent,
01:17advancing toward agents and began throwing rocks and other objects at agents,
01:21including one that struck Chief Greg Bovino in the head.
01:24DHS continued,
01:25riot control measures were deployed, including by Chief Bovino, and arrests were made.
01:30Agents properly used their training.
01:32The use of chemical munitions was conducted in full accordance with CBP policy
01:36and was necessary to ensure the safety of both law enforcement and the public.
01:41The plaintiffs argue that the demonstrators were peaceful
01:44and that authorities failed to issue warnings before tear gas was used.
01:48They added that there is no evidence that commercial fireworks were fired by anyone at the scene.
01:53Aaron Reikland Melnick, senior fellow at the American Immigration Council,
01:58weighed in on the incident, stating,
02:00DHS has to understand that it's playing with fire by refusing accountability for officer misconduct like this.
