00:00One, two, one, two, hey, go Creekside!
00:12Hey, go Creekside!
00:15Tristan was a cheerleader.
00:18She would often post her in her cheerleading outfit.
00:20She looked like your perfect all-American young girl.
00:24Happy and truly glowing.
00:27Tristan was very energetic and she was very inclusive to everyone on the team.
00:32She was just the most caring person I've ever met.
00:35She was a typical teenager.
00:37She was very active on TikTok.
00:40Tristan was obsessed with TikTok.
00:42She wanted everyone, you know, to see the best version of herself.
00:56Is this a place?
00:58Yes, it is.
00:59I need somebody to come to my home right now.
01:02I have a missing child.
01:06Take a big breath for me, okay?
01:09It's an indescribable feeling when your child is missing.
01:14There is nothing you can do.
01:17Pure panic.
01:19Pure panic.
01:2013-year-old Tristan Bailey was reported missing around 10 Sunday morning.
01:25The family last saw her last night at approximately midnight.
01:28There are shocking details coming out about this case.
01:31Horrific, brutal murder.
01:33TikTok's role in Tristan's case really was huge.
01:38So many people wanting to help to get justice.
01:41Everybody was speculating and people were commenting.
01:44The motive, the why, and most importantly, the who.
01:47It's all on you right now.
01:50This is the 14-year-old suspect.
01:52The victim was only 13 years old.
01:53This is hard to find to me.
01:55She was 13 years old.
01:57It felt like the world needed to know her story.
01:59They needed to hear her voice.
02:01People talk about this and they wonder,
02:03how could something like that happen?
02:16My name is Stacey Bailey and I am Tristan Bailey's mom.
02:31Forrest Bailey is my husband and we've been together since college.
02:36We have five children together.
02:38In addition to Tristan, we have Sophia, Alexis, Brittany, and Tegan.
02:44And I always told our kids that the best thing that, you know,
02:49they were ever given as a sibling.
02:51It's just a very, very unique relationship.
02:55The night before Mother's Day, Tristan and Sophia decided that they were going to make breakfast for me.
03:01And I had very strict instructions to not leave my room until breakfast was done.
03:09It must have been like around 9.30 and I was like, I cannot sit in my room anymore.
03:16So I came out and it was just Sophia making breakfast.
03:21Stacey asked Tegan, who was downstairs, to go and get a hold of Tristan so that she could help out, as had been the plan.
03:27So he went upstairs.
03:33He came down a few minutes later.
03:36He said he couldn't find her.
03:40Nothing about it made sense.
03:43Tristan loved Stacey so dearly that knowing it was Mother's Day,
03:48it was an immediate sense of something is really wrong.
03:51She was just a really good girl.
03:56She had good grades.
03:57She had good friends.
03:59So it was very out of character for her to just disappear.
04:04I'm Brittany Bailey Russell and I'm the oldest sibling.
04:08I got a call from Alexis, my sister.
04:10We can't find Tristan.
04:13She's not in her room.
04:14Like, I think she snuck out.
04:15Her phone is not in her room.
04:21And you guys have searched room by room that she's not sleeping in a guest bedroom or using cars.
04:29We've searched room by room.
04:31My husband went around the floor.
04:3413-year-old Tristan Bailey was reported missing around 10 Sunday morning.
04:37The family last saw her last night at approximately midnight.
04:45I am Robert A. Hardwick.
04:48At the time of this investigation, I was the elected sheriff of St. Johns County.
04:53And we put the alerts out to the neighborhood looking for Tristan via social media, media,
04:58any other type of platforms we can put it out.
05:00And it gives a basic overview.
05:02When they were last seen, who, what, when, where.
05:05It was to advise the community that we could use your assistance.
05:08Because possibly she was in someone's house.
05:10We were hoping just watching TV with another child.
05:12Hey guys, all right, so I've got brand new updates for you in the Tristan Bailey case.
05:21My name is Annie Elise, and I am a true crime TikToker who reaches 870,000 users.
05:27When I first heard about Tristan Bailey's case, I knew that I wanted to spread awareness as fast as possible.
05:33A 13-year-old girl was missing.
05:36I knew something wasn't right.
05:37There wasn't usually a lot of crime that happens in that area.
05:40It was a nice neighborhood.
05:43It felt like close to home in a way because we all can identify ourselves in Tristan or somebody we know.
05:50She was so relatable.
05:52Five days to my birthday.
05:53Four days to my birthday.
05:55Three days to my birthday.
05:58Her case took social media by storm.
06:0113-year-old Tristan Bailey.
06:02St. Johns County in Florida.
06:04She was a cheerleader.
06:05Everybody was worried about where she might be, but nobody had any definitive answers in the beginning.
06:10You have to triage every tip that comes in, whether it's a social media platform or whether it's a phone call.
06:17And that's exactly what our team was doing.
06:20Through Tristan's TikToks, you could tell that she was extremely close with her family.
06:25From the get-go, she always wanted to be the front and center.
06:31And actually, Brittany and her have the same kind of personality.
06:34They always fought for who is going to get the most attention.
06:38She would practice and learn a routine that she saw on TikTok and come to me and, you know, say, like, let's do this one together.
06:47It was always fun and full of life.
06:49I remember Tristan wanted to join the All-Star cheer team.
06:57The All-Star gym is very competitive.
06:59Tristan's determination to get on that team was insane.
07:06She had to get her splits or a back walk over something, and she put her mind to it and accomplished it.
07:12I was so proud of her for putting in the effort and her being so excited and so happy.
07:19When you're done over there, bring the canines over to
07:29and to get a scent from over here.
07:33We had police officers that were at the house.
07:36We had police dogs trying to get a sense of Tristan to search for her.
07:41People that had plans to celebrate Mother's Day showed up to begin searching.
07:48We had a tremendous outpouring of support.
07:52We're less than 24 hours into this entire case.
07:54Our investigative team is out there interviewing all kinds of witnesses.
07:58My name is Curt Hannon.
07:59I was assigned as the case agent, which is the primary person that's in charge.
08:03The biggest keys for us in this kind of investigations are who did Tristan last had contact with.
08:08At some point that night, her sister had seen her on FaceTime with someone, and she knew it was a boy.
08:20And we kept getting more information that Tristan was at his house that night.
08:25He was the first suspect in this case.
08:27I knew of Tim.
08:32I think he was kind of involved in the wrong crowd.
08:36I think Tristan liked him.
08:37I didn't really like that she liked him, but it wasn't really my decision to make.
08:44I think Tristan snuck out that night so she could see the teenage boy that she liked.
08:50My name is Jennifer Dutton.
08:54I'm an assistant state attorney here in the Seventh Circuit, and my role in this case was lead prosecutor.
09:00Deputies go to this boy's house and start questioning about whether he had seen Tristan.
09:06What all happened Saturday night?
09:08I currently got suspended from school, so I wasn't able to go anywhere.
09:13He wasn't supposed to have friends over, but he had friends over anyways.
09:16I thought about Tristan because I always invite her if I have people over.
09:21He told law enforcement Tristan came over shortly after midnight.
09:25She was only there for like maybe half an hour, 20, 15 minutes.
09:30They told us they had another friend over.
09:32The other friend's name is Aiden Fucci.
09:35Tristan and Aiden, they have one class together.
09:38I don't really know what they talk about.
09:40I don't really know what else to say.
09:42I don't think Tristan and Aiden Fucci knew each other very well.
09:46They definitely had minor conversation, but not very many.
09:52He told law enforcement that Aiden and Tristan had hung out a little bit at the house outside for a while.
09:58And then they came back in.
10:00I was like, I should go because I'm falling asleep.
10:02I heard the door open and they both left.
10:04He said he woke up the next morning, assuming all was okay.
10:10He saw the missing child alerts for Tristan, reached out to Aiden because he knew that he had left his house with her the night before.
10:18And Aiden said he walked her home and denied knowing anything was wrong.
10:22Because her friend had introduced Aiden Fucci's name, he became another suspect.
10:29Tristan Bailey, just 13 years old.
10:37Her parents reported her missing.
10:40Hours go by.
10:42Everything is just saturated with people looking for this little girl.
10:46And nothing is producing positive results.
10:48Everyone is searching everywhere for 13-year-old Tristan.
10:54Make sure that wherever you go, at least one person knows where you are at all times.
10:58Please be safe and let's pray for Tristan and her family, please.
11:01We're going to go make contact with Aiden at his house.
11:05Aiden came out.
11:06His mom came out.
11:08Hey, are you Aiden?
11:09Yes, ma'am.
11:10Hey, I'm through the sheriff's office.
11:12We're trying to figure out where Tristan's at.
11:15He admitted that he had been at his friend's house the night before, seen Tristan.
11:20Yeah, so we were at your house and then I stayed there until probably like 1.50 a.m.
11:26And then I was really late to be home, so I just had to leave.
11:29The rest of my mom would like seriously just kill me.
11:34Aiden Fucci said, what happened that night?
11:37They were walking back and they parted ways.
11:41Tristan going to her home, he going back to his.
11:45He should have been home between 1.30, 1.45 at the worst.
11:50His mom actually interjected and volunteered that, you know, you got home after 3 in the morning.
11:57She knew she had seen her surveillance cameras.
12:03I'm Vic Micolucci.
12:05I was a local news anchor and investigative reporter for 14 years in this area.
12:11This is a really quiet residential neighborhood, lots of homes.
12:17They're close together.
12:19A typical person would be able to walk this relatively short distance in 20, 25 minutes.
12:25He was gone for about two hours.
12:29And that was really suspicious.
12:34Deputies started questioning him.
12:36Why the delay?
12:37He made some comments about how he was just walking around.
12:41His timeline wasn't making any sense.
12:43And so we asked Aiden where he and Tristan went to try to retrace his steps.
12:46Deputies asked him to point out where he broke off with Tristan and she went home.
12:51And as he's telling that story, he suddenly volunteers, well, she didn't actually turn on her street.
12:59We kept walking.
13:02He indicates that there was an intersection that they stopped near.
13:06Next to where that brick wall starts up there is where she touched my dick.
13:13And I pushed her off me real hard.
13:16He said he pushed her down where she had hit her head.
13:19And he just walked away because he was so mad that she had touched him in that manner.
13:25And then I just kind of walked away out of anger.
13:29Deputies look around at that intersection in the area where he says she fell down, hit her head, and was hurt.
13:35There's no blood.
13:37It just doesn't make any sense.
13:40Things are not adding up.
13:48We were hanging on to both the friend and Aiden because we weren't quite sure what their involvement was yet.
13:54In Florida, we can detain a suspect until law enforcement can quell their suspicions.
14:00So we put them both in the back of a police car.
14:03They still have access to their phones.
14:04They're detained.
14:05They're not free to leave.
14:06But we're not taking anything away from them.
14:10Having fun in a fucking cop car.
14:13Fucking just so right on this bitch.
14:16She's tripping, dude.
14:19Aiden, he decided to make some Snapchat videos.
14:22Making a big joke of it.
14:23This clip started going viral because of Aiden's behavior.
14:29He decides to post in the back of the cop car.
14:31He's sick.
14:32He was more concerned with bragging on social media that he was being questioned by the police.
14:37It makes my blood boil mocking the situation.
14:40There was absolutely a very strange disconnect.
14:43And you could see that this kid was not living in the same universe that we are.
14:48Aiden posts something to Snapchat with the banner of, hey, guys, has anybody seen Tristan lately?
14:59All the kids in school, they all see that.
15:02Begin to suspect that Aiden had something to do with it.
15:05They start presenting that post out to everybody else.
15:08On TikTok, it spread like wildfire.
15:12This just shows how little he cares about the entire situation.
15:16This is a piece of garbage that we're dealing with.
15:19Your sake.
15:20A friend of his who he had just been with the night earlier was missing.
15:24He had no sort of sympathy.
15:26Not at all.
15:28These young kids will do anything to go viral.
15:32They will do anything.
15:33What's up, guys?
15:34Tristan, if you fucking walk out the damn...
15:38He makes the comment along the lines of, hey, Tristan, if you see this, you know, feel free to walk out of the...
15:43And then he stops right there.
15:44He stopped himself short of saying the woods.
15:47It was pretty...
15:48It was...
15:49I'm still in disbelief of it.
15:53Like, how can you be so callous?
15:58That showed us that he's communicating about Tristan and her whereabouts.
16:03And that was really suspicious.
16:08I don't think she's alive.
16:27No, I found the missing girl.
16:29Sir, this is Supervisor.
16:33He's not moving, correct?
16:35No, I don't think she's alive.
16:43Gentleman that live in the area has gone out for a run.
16:46He finished his run and he went to go check behind the woods.
16:50He saw that there was a person that appeared to be dead.
16:53You got cops right around here, can you send them?
16:56Well, they're coming right now, sir.
16:57I just want to keep you on the line until they are in your area.
17:01Yeah, I'm going to walk back out toward the road.
17:03Oh, man.
17:06We sent people over immediately.
17:10Based on the description we had,
17:12our detective team immediately made a tentative ID of Tristan Bailey's body.
17:17It was obvious that she was deceased and it was obvious that there was trauma to her body,
17:24that she had not died naturally.
17:26There were visible stab wounds.
17:28My team made the instantaneous, you know, determination that we were now working a brutal, horrific murder.
17:34I got a text from my sergeant asking me to come to the Bailey's address.
17:46The worst part of my job is doing a death notification to the parents of a child.
17:52A whole bunch of police showed up and they...
17:56They asked me to...
18:06To go inside with them.
18:17And I kept saying no.
18:21Because I knew.
18:22I knew at that moment...
18:26We went into a bedroom and that's when Kurt and Anna told us that they had found her.
18:38They were able to kind of confirm that they had done an identification.
18:45It was Tristan.
18:49She was no longer alive.
18:52Upon learning that Tristan was dead and wasn't coming back, things were just an absolute blur.
19:03Stacey was feeling guilty.
19:06Thinking about how she's the parent and she didn't know Tristan was gone.
19:10My point with Stacey was, hey, do you remember when you were a teenager?
19:14All the things that we do as teenagers that aren't necessarily very smart or very safe, but you don't deserve to die for.
19:27St. John's County Sheriff's Department says the search for a missing Florida teenager has been called off.
19:32We have located a body that is preliminary identified as Tristan Bailey.
19:36Once Tristan's body was discovered, everybody wanted to post about it.
19:40Please pray for her and her family.
19:42It breaks my heart. It really does. Especially for Tristan's family.
19:45You have the loss of a life. There is no way to pay back that family for what has happened to them.
19:52Heart-wrenching new details on the murder of St. John's County teenager Tristan Bailey.
19:57According to the autopsy report, she was stabbed 114 times as she fought for her life.
20:03Let's not think in for a minute, that's 114 times that this poor girl was stabbed.
20:09That number in itself is just astronomical and really hard to comprehend.
20:16How do you tell somebody that their daughter was stabbed 114 times?
20:21Like that, I had no idea how to do that.
20:24The detective, they shared to us how she died, and then how many stab wounds, and I think the whole family couldn't process how somebody could do that to somebody else.
20:47It was a complete loss to the family.
20:52It was very, very difficult to take in.
20:56She had a large number of defensive wounds, meaning that she had fought back and fought back hard.
21:03Tristan fought for the things that were important, and she fought hard for her life.
21:10Once the details came out that Tristan had been brutally murdered, people are panicking.
21:18People are really, really scared.
21:21It's affecting all the children.
21:22It really is.
21:23I did not want to be, sorry, be around my friends or anybody because hearing it come out of someone else's mouth made it real for me.
21:35The pressure was on for law enforcement.
21:37Find what happened and secure that community.
21:41They promised me that day that they would, they would get to the bottom of this.
21:56At this point in the investigation, law enforcement really wants to question both boys, Aiden and his friend, more fully.
22:04We brought them to our station, and we put them in two different interview rooms.
22:08During police interviews, Aiden Fucci chooses not to speak any further.
22:14Aiden's friend continued to cooperate with law enforcement.
22:18And we were able to rule him out as a suspect in this case.
22:21He began to reveal a more disturbing side of Aiden, his personality.
22:28He later told us that Aiden sought out the real video clips of violence online, beheadings, real killings,
22:37not anime, not video games.
22:40I think I asked this question before.
22:41He made comments about stabbing somebody or he said cutting somebody's throat.
22:45He said, like, stabbing somebody's throat.
22:47He said it'd be satisfying to watch the blood drain out.
22:50I was like, that's weird.
22:53Like, that's weird.
22:54Like, that's not normal.
22:55His friend thought it was disturbing, but it's their friend, and they didn't really think he would ever act on it.
23:02Everybody was wondering why nobody said anything to the police at the time.
23:07Oh, my God.
23:08If these kids or anybody would have spoken up or told somebody, like, this little girl could have possibly been saved.
23:18Aiden had a bad reputation.
23:20His friends told us he had anger issues.
23:22I noticed Aiden would get into physical fights with other people, students, or just people we all knew in the area.
23:30And then he would get into verbal fights with teachers because he did not like anybody having authority or power over him.
23:40I think he was the type of teenager that would make parents very concerned.
23:45We identified another friend, and they provided a lot of information.
23:56Aiden kept knives.
23:58He called one picker, and then he called one poker.
24:04They identified that Aiden loved knives, and there were two particular knives that Aiden always carried.
24:11He talked about wanting to kill me.
24:15Sometimes he would take his knife and put it against my throat and pretend to slit my throat.
24:23Aiden and I had a dark sense of humor, and I never took him seriously.
24:29Like, he asked me, like, what I would do if he murdered someone.
24:35He would say that he would just walk at night and find, like, a random person walking to, and just drag them in the woods and stab them.
24:47He said that he thinks it's going to happen soon, within a month.
24:53This is what had happened to Tristan Bailey.
25:01Aiden had talked about wanting to kill somebody.
25:04Saying that he was going to drag someone into the woods.
25:08Kept telling people he wanted to kill a person.
25:11But everyone stated nobody took these things seriously.
25:13To me, the red flags in the Tristan Bailey case came directly from Aiden Fucci himself.
25:20He said that he was going to stab somebody to death.
25:22That he was going to drag them into the woods.
25:24Why didn't these friends say anything?
25:26Why didn't they tell a teacher, a parent, a law enforcement?
25:29Had anybody that heard some of the things he was talking about,
25:34had they felt that there was somebody that they could have reached out to and say,
25:38I think there's something seriously wrong here,
25:41maybe it would have changed the direction.
25:43A lot of us looking at this case were quite upset.
25:48These kids spent their whole lives chatting to each other online.
25:52But when it came to that really crucial information about Aiden Fucci's dark fantasies,
25:57if only they'd spoken out, maybe Tristan would still be alive here today.
26:13What's this place?
26:24It's a whole life.
26:26It's a whole life.
26:30Aiden is now in an interrogation room.
26:33The cameras are on and they are rolling like they always are in Florida.
26:39He asked for his parents.
26:41Information that we overheard later became important in the case.
26:46You know they found this girl, right?
26:50Where?
26:51In our neighborhood.
26:52Down our main street.
26:55Is she good?
26:56No, she's dead.
26:59That's why this is very important.
27:01It's all on you right now.
27:04That's not my problem.
27:05With his comment, you know, how is that my problem?
27:09It's just that lack of remorse, the lack of empathy, the lack of caring,
27:12the lack of any kind of human emotion, it's indescribable.
27:19Did she really grab you and you just really pushed her or was that?
27:22No, she did.
27:23His parents asked what happened that night and he shares the same story that he gave earlier.
27:30Do you know what directions you wanted?
27:33Probably the other way because she wasn't next to me anymore.
27:36As the conversation goes on between Aiden and his parents,
27:39we start noticing a little bit of manipulation by his mom.
27:45You wore khakis or blue jeans?
27:48Blue jeans.
27:50You sure I was not on them?
27:51When we looked on the camera, you were wearing khakis.
28:05It's a bizarre exchange.
28:08The significance of this only emerged later in the investigation.
28:16They're searching our house right now.
28:18Nothing to worry about, right?
28:24Mm-mm.
28:30We begin the execution of the search warrant at the house where he lived.
28:33And we're looking for specific pieces of evidence that might lead us to be able to figure out what happened with this case.
28:39Things we include in the search warrant are things that include blood.
28:41Crime scene technicians locate several things of interest.
28:47In Aiden's bedroom, there was a white shirt that appeared to have bloodstains on it.
28:56We test it on site.
28:58It's a presumptive positive test.
28:59They find these wet jeans.
29:01They run some tests on them, and they determine that that is, in fact, blood on the jeans.
29:08During the course of the search, we find white Nike shoes.
29:13Blood was present on all of these items.
29:16That evidence is sent off here in the state of Florida to the Florida Department of Law Enforcement Biology Lab.
29:22We put a rush on it.
29:23They were able to find Tristan Bailey's DNA profile on Aiden's shoes.
29:31In addition to that, in his bathroom, the sink, the pipes, and the drains are tested, and those were testing positive for blood.
29:40They took those swabs to the sheriff's office.
29:43It's blood that belongs to Tristan.
29:44I went to the vigil with my mom, and all my friends from school were there, and all my friends from CHEER were there.
30:03We had to really, really think about the fact that she's gone.
30:16I was amazed by the amount of people that were there, and the amount of people that, you know, used their time to go.
30:27I still feel so grateful that I have people surrounding me that are like that.
30:38We didn't know the exact story of what happened, so it was really confusing and really hard for us all.
30:51Video surveillance played a huge part of this case.
30:55We are very grateful that, in this neighborhood, almost every door had a ring camera.
31:02We start putting everything together.
31:04We see Aiden's stories weren't consistent.
31:12Aiden and Tristan were at the friend's house.
31:15The friend said, hey, it's time for you guys to leave.
31:18And Aiden and Tristan left at about 1.10 in the morning.
31:21And they started walking.
31:27Surveillance footage from neighbors' cameras show her walking with Aiden Fucci overnight from Saturday into Sunday.
31:36We are able to obtain video footage from the amenities center.
31:43They walked along the main road.
31:47So, walking north.
31:51They passed by the road that leads to his house.
31:52walking north. They passed by the road that leads to his house. They kept on
32:01walking.
32:05And what we found was the two figures clearly Tristan and Aiden walking
32:11towards the area of the woods. Ultimately where Tristan was found, her
32:17final resting place.
32:31Several hours later Aiden Fucci or this male figure running now in the opposite
32:37direction when he appeared to be carrying his shoes in his hand. And so
32:43that's clearly different than his story of just casually wandering around the
32:46neighborhood. It was obvious in this video that there's only one subject and it did
32:50not appear that that Tristan was with him. The time difference between when he was
32:54last observed walking east with Tristan and then running back west away was
32:59about an hour and 45 minutes. So we now know after we've you know located Tristan
33:04and building this case and finding out all the details we could find out during
33:09this time frame is when Aiden murdered Tristan.
33:17We actually have arrested a suspect by the name of Aiden Fucci, 14 year old. He's
33:24currently in custody charged with murder. Hearing of a 14 year old boy committing
33:28such a horrible heinous murder on a 13 year old girl, it was scary. I feel like
33:32every case with a child is horrific. The victim was only 13 years old. This is the
33:3814 year old suspect. I just can't comprehend being 14 wanting to kill someone.
33:43After we learned that the sheriff's office had arrested the person responsible, it allowed
33:52us to realize that that threat was gone, but yet deep down you're trying to understand why.
33:59During the course of search at Aiden's house, we found a Buck brand knife sheath that was empty
34:11and had no knife. So we're still have this murder weapon that we're we're missing. And that's
34:17obviously a key part of the investigation. Here we have video as detectives with the St.
34:23John's County Sheriff's Office found it. They pulled it out in a pond.
34:31One of our divers located a Buck brand folding knife. That knife was tested and it indicated a
34:38presumptive positive for the presence of blood. They take it to their offices and they find that
34:43it matches the sheath that was discovered in Fuji's bedroom. The knife was eventually sent off to
34:51forensics and it was tested for DNA. And we were able to obtain DNA from Tristan on both the handle
34:57and on the blade of the knife. We now have the murder weapon.
35:00Our digital forensic examiners are pouring through the interior and exterior footage from Aiden Fucci's
35:15residence. That morning after deputies first make contact with Aiden and his family, Crystal
35:21goes back inside. Aiden goes back inside. Aiden is off with the deputies. She goes right upstairs.
35:27She is seen taking Aiden's jeans from a laundry basket. She takes them to the sink.
35:40It kind of explained the very damp nature of the jeans. It was clear to us that she was trying to
35:57get rid of whatever evidence she saw on those jeans. It offers that explanation as to why Crystal
36:05Smith is saying to her son and getting him to agree that he was wearing khakis when this happened.
36:12I can only imagine that she wanted to protect her child, but at what cost?
36:19It was at the cost of my child.
36:24Which just begs the question, how far would you be willing to go to help your child?
36:28I would never help my son cover up a heinous crime. This is insane.
36:36She was charged with tampering with evidence. Now son and mother are going to court.
36:42Aiden Fucci, the 14-year-old charged with first-degree murder in the killing of a 13-year-old neighbor
37:00and schoolmate, is now in the juvenile wing of the Duval County Jail.
37:05Debate was raging about what should happen when a child kills a child.
37:10Do you think that he should still not serve life in prison?
37:14There's a petition going to get him tried as an adult, which I will link in the comments.
37:17They have about a week to decide if they're going to charge him as an adult,
37:20so we would find out sometime next week.
37:23The state attorney's office received calls from around the country and from around the world
37:27with social media demanding that we charge Aiden Fucci as an adult.
37:32If Aiden Fucci had been tried as a juvenile here in the state of Florida, what that would have meant was
37:40he being 14 years old, the maximum he would have gotten was seven years, which would have put him at 21.
37:47Anybody can look at this case and know that that is not appropriate.
37:52We looked at the facts, we looked at the law, and I got to tell you, the adult system is where this case belongs.
38:02They did charge 14-year-old Aiden Fucci as an adult and with first-degree premeditated charges.
38:09The only thing that really remains is when it comes to sentencing.
38:14They cannot do the death penalty because of his age, but that still does carry a maximum of life sentence.
38:20That change was very impactful.
38:24We knew that the state attorney's office was really focused on getting justice.
38:33In all cases, we have pretrial hearings to advise the judge of the status of the case.
38:38It was Aiden Fucci's very first pretrial, his very first court appearance.
38:42He was on Zoom.
38:45I don't want to let you, Terrence.
38:47I don't want to let you, Dean, take my soul.
38:49He was acting very bizarrely on camera, kind of acting like he didn't know where he was, saying things about demons.
38:57He was trying to prove a point that maybe he wasn't all there and maybe it was something he could use as a defense.
39:04He was on the Zoom and we heard him saying some pretty interesting statements that have me questioning what's his motive here.
39:11His behavior is so incredibly different from the videos that we saw in the back of the police car.
39:17With that video, in my opinion, I think it's full of crap.
39:20I called the detectives and said, we need to pull his jail calls before court and after court and let's compare them to how he acted in court.
39:30Our attorney's office realized very quickly he had extremely coherent conversations with his mother before and after his appearance.
39:38The calls were ultimately turned over to the psychologist and that was fake and, ironically, it never happened again.
39:46We came to the courthouse ready for jury selection on Monday.
39:58And we found out that morning that he was not going to go to trial.
40:03Entering a guilty plea is charged.
40:06He was going to enter a plea of guilty.
40:08It's a really big deal to enter a plea of guilty.
40:14I think the defense is going to have a very hard time expressing remorse with their client.
40:20It was clear how overwhelming the evidence was and that by accepting guilt, it was the first step in potentially having a reduced sentence.
40:29The victim impact statement allows the Bailey family to tell the court how the crime impacted them.
40:43My daughter fought for her life and we were going to fight alongside her for her justice.
40:49Even 15 made a heinous decision on May 9th, 2021, and took the very life that I brought into this world.
41:02Stacey Bailey's was extremely emotional.
41:04This jar now holds 114 stones, one for each of the 114 stab wounds that my sister had to endure.
41:25My daughter, Alexis, did an amazing job.
41:28The victim impact statements from Tristan's friends and family were so heartfelt.
41:37The only outcome here is for him to pay with his own freedom because he took the freedom of Tristan.
41:43I cannot wait for Tristan to get justice.
41:50This crime, it was committed in a cold, calculated, and premeditated manner.
41:56He just wanted to kill somebody for the sake of killing somebody.
42:06Complete and total disregard for human life.
42:10Mr. Fucci, I adjudicate you guilty of the premeditated first-degree murder of Tristan Bailey.
42:16I sentence you to life in prison.
42:21When that information was released, it went absolutely viral.
42:25He was sentenced to life in prison.
42:28I hate this kid.
42:29Deserves to rot and deserve to be punished.
42:31I am so, so, so happy with Aiden Fucci's sentencing.
42:36You know what you did.
42:37And now you got hell to pay.
42:40Was it enough?
42:42I mean, I...
42:45Nothing brings her back.
42:46So as much as it is great that he's put away and won't be able to do this to anybody else, it doesn't bring our sister back.
42:59Crystal Smith was charged with tampering with evidence.
43:02She pleaded guilty to that charge.
43:04She was sentenced to 30 days in jail and community service.
43:08Tristan is remembered exactly how she left this world.
43:15Bubbly, happy, loving, warm.
43:19On TikTok, many people still talk about it.
43:21And we all know that Tristan's case will never be forgotten.
43:25One of the things we wanted to do was start a foundation and give back.
43:42And that foundation starts with the spirit that Tristan had.
43:46We've been able to work with a phenomenal program that teaches young ladies and women about situational awareness.
44:01So how you avoid even getting into a situation where something negative could happen.
44:07And then also self-defense techniques.
44:12Also, we want to encourage more conversations.
44:15Open up an avenue that should a child ever feel like they're being preyed on or being put in a bad situation.
44:22That they understand they can go to a trusted adult and share.
44:27Here's what's happening.
44:28How can they get some help?
44:35I will never forget how appreciative she was for anything.
44:40The first thing she would always say to me is,
44:44Thank you, Mom, for spending the weekend with me or taking me shopping or just spending time with me.
44:54You wanted to be with her, next to her, like her.
44:59I wish everyone could have met her.
45:01There's not a way to describe the laugh.
45:11There's not a way to describe the smile.
45:14I will cherish those memories forever.
45:22Tristan Strong!
45:24All right.
45:25All right.
45:44All right.
