00:01But then next up today,
00:03Ghislaine Maxwell just got some bad news
00:05from the Supreme Court
00:06because they just officially returned to the bench today
00:07to kick off what is gonna be a very, very consequential term.
00:11And one of the first things that they did
00:12was reject Maxwell's attempt to appeal her criminal conviction
00:15for sex trafficking girls for Jeffrey Epstein.
00:16Because back in April, you had Maxwell filing a petition
00:19asking the Supreme Court to overturn her conviction.
00:21And you had Maxwell arguing
00:22that she should have never been prosecuted
00:23because of the infamous plea deal
00:24that Epstein had reached with Florida prosecutors
00:26back in 2008 to resolve allegations
00:28that he had molested dozens of girls.
00:29And specifically under that deal,
00:30you had Epstein agreeing to plead guilty
00:32to state criminal charges of soliciting prostitution.
00:34And in exchange, prosecutors agreed
00:36to not bring more criminal charges against him
00:38related to the sex trafficking investigation.
00:39But also very notably there,
00:41the prosecutors also agreed
00:42to not charge any of Epstein's co-conspirators.
00:45And so after Maxwell was convicted
00:46for her sex crimes in New York,
00:47she attempted to appeal the decision,
00:49arguing that Epstein's plea deal
00:50protected her from prosecution.
00:51But what you saw was an appeals court rejecting that claim,
00:54ruling that the authorities in New York
00:55were not bound to an agreement
00:56made by prosecutors in Florida.
00:58And so now by declining to hear her case,
01:00the Supreme Court basically put the final nail in the coffin.
01:02Though you also had her lawyer issuing a statement saying
01:04that this fight isn't over and adding,
01:06serious legal and factual issues remain,
01:08and we will continue to pursue every avenue available
01:11to ensure that justice is done.
01:12But with that said, it's also not clear
01:14what exactly they can do right now.
01:15You have experts saying that with the Supreme Court decision,
01:18it seems likely that Maxwell's only hope
01:19for an early release would actually be Trump granting her clemency.
01:22Which on that note, I'll say for his part back in July,
01:25he said, you know, he hadn't considered pardoning Maxwell,
01:27which you can believe him or not at that point,
01:29but he also added, I'm allowed to do it.
01:32But also say, you know, for whatever it's worth,
01:33his administration did urge the Supreme Court
01:35not to take up Maxwell's appeal.
01:37Though I will say, since we're on the topic
01:39of Epstein-related news,
01:40we need to then talk about House Speaker Mike Johnson.
01:42And that because Democrats are accusing him
01:44of refusing to swear in a new representative
01:46and denying hundreds of thousands of people a voice in Congress,
01:48because he wants to continue to block the Epstein files
01:50from being released.
01:51Because as we've talked about many times before,
01:53Representatives Thomas, Massey, and Ro Khanna,
01:55they proposed a bill to release the Epstein files,
01:57but Johnson has refused to even bring it to the floor
01:59for a vote.
02:00And so instead, Massey and Khanna,
02:01they've been circling what's known as a discharge petition,
02:03which would allow them to bypass leadership
02:05and force a floor vote,
02:06as long as they can collect signatures
02:07from a majority of House members.
02:08And for a while now, they've been just one vote away
02:10because several prominent Republicans even joined their charge.
02:13And then it seemed like they got their final vote
02:15that they needed, because Adelita Grijalva,
02:17she won a special election in Arizona and she's a Democrat.
02:19And Grijalva vowed to sign the discharge petition
02:21once she got sworn in.
02:22But apparently that's easier said than done,
02:24because even though she was elected two weeks ago,
02:26Speaker Johnson has repeatedly refused to swear her in.
02:28Where the House was at a session all last week
02:30in an effort to pressure the Senate
02:31to pass the GOP's stopgap spending bill
02:33to keep the government open,
02:34which is an attempt that obviously failed.
02:36But also before the government shut down,
02:38Johnson held what's called a pro forma session,
02:40which basically is a brief meeting
02:42for members of the House to discuss procedural matters
02:44without conducting legislative business.
02:45And so Grijalva, she went to Washington early last week
02:48in hopes of being sworn in during that session.
02:49Hopes, I should say, that are not unreasonable,
02:52because earlier this year,
02:53Johnson swore in two Republican representatives
02:55during another pro forma session,
02:57just one day after they won special elections.
02:59But apparently Johnson's only willing to do that
03:01for members of his own party,
03:02or people I guess who don't wanna release the Epstein files,
03:05because he refused to do the same for Grijalva.
03:07With Johnson arguing that for some reason,
03:08he doesn't want her to take office
03:10until the House resumes its normal legislative business,
03:12with him telling CBS on Thursday,
03:14the House is not on the floor doing business this week,
03:16but we will do it immediately early next week,
03:18as soon as everyone returns to town.
03:19But we have to have everybody here,
03:21and we'll swear her in.
03:22But then the next day,
03:22you had Johnson going back on that promise as well,
03:24but announcing that he won't actually
03:25be holding a session this week,
03:27instead designating a district work period,
03:29which allows Congress members to return
03:30to their home states from October 7th to the 13th.
03:33But then also the day after that,
03:34Johnson signaled that he would be laying Grijalva
03:36swearing in even more,
03:38retelling reporters that the House won't come back
03:39into session until the shutdown ends
03:41and the government reopens.
03:42And of course, right now,
03:43we have no idea when that's actually gonna happen.
03:45And so as a result, you have many,
03:46including many Democrats,
03:47condemning Johnson,
03:48arguing that he could call a pro forma session
03:50whenever he wants to make her election official.
03:52Noting that a shutdown doesn't actually
03:54prevent members from being sworn in.
03:55In fact, the entire House was sworn in
03:57when a new Congress started during the month-long shutdown
03:59that bled into January of 2019,
04:01which is then why you have tons of people accusing Johnson
04:03of intentionally refusing to swear Grijalva in
04:05so he can continue blocking the House
04:07from even voting on releasing the Epstein files.
04:09And that's also something that Grijalva herself
04:11says she believes is the only explanation here.
04:13At first, I was trying not to be a conspiracy theorist.
04:15Yeah, I also have been the same.
04:17Like, maybe there's something I'm missing here.
04:20Right, it doesn't have anything to do with these files,
04:23but that is literally the only thing I can point to.
04:26It's not like me getting sworn in is gonna change,
04:29you know, now the Democrats will be in the majority.
04:31I mean, there are certain things
04:32that are not going to change,
04:34where Democrats will still be in the minority.
04:36That is literally the only thing that is different.
04:38But for now, we'll have to wait to see how this plays out,
04:41because while it's very important to look
04:43at the insane lanes that Johnson is going to
04:45to just make sure this plays out a certain way,
04:47whether it is days or weeks from now,
04:49Grijalva will eventually be sworn in.
04:51When she does, that discharge petition
04:52will have enough signatures,
04:54and the House will be voting on releasing the Epstein files.
