00:00Fox News alert. At any moment, the suspected killer of Charlie Kirk will appear virtually
00:12in court. Tyler Robinson facing seven charges, including aggravated murder, felony discharge
00:19of a firearm and multiple counts of witness tampering and obstruction of justice. According
00:24to prosecutors, Tyler Robinson confessed to his transgender roommate that he killed Charlie
00:30Kirk, texting this, quote, I had enough of his hatred. Some hate can't be negotiated out.
00:37Prosecutors will seek the death penalty. I am filing a notice of intent to seek the death penalty.
00:43DNA consistent with defendant was found on the trigger, other parts of the rifle,
00:51the fired cartridge casing, two of the three unfired cartridges and the towel.
00:58Robinson's mother explained that over the last year or so, Robinson had become more political
01:04and had started to lean more to the left, becoming more pro-gay and trans rights oriented.
01:12But it's not over yet. FBI Director Cash Patel testifying before the Senate,
01:17hinting that others might have participated in the attack.
01:20I see the public reports that the Discord thread had as many as 20 additional users. It sounds like
01:26you're trying to run down all of that to see if that's accurate, who else may have been on that
01:30thread, what they may have known. Is that fair to say? It's a lot more than that. We're running
01:34them all down. It's a lot more than 20? Yes, sir. There are a number of individuals that are currently
01:39being investigated and interrogated and a number yet to be investigated and interrogated specific to
01:43that chat room. So we are very much in our ongoing posture of investigation.
01:50So others could have been involved? Yes, sir.

02:51Mr. Skortis. Good afternoon, Your Honor. You're probably already aware of my presence or why I'm
02:59here, but if not, I am not entering an appearance. I'm not counsel on this case. I'm working with the
03:04county to get counsel assigned, but we need you to allow for the appointment of counsel.
03:13Thank you, Mr. Skortis. It is, well, I want to go through the qualifications for indiancy.
03:21But that is my intent, Mr. Skortis. Very well. And I thank you for being here.
03:26So, Mr. Robinson, you have a right to an attorney. If you cannot afford one, the court can appoint an
03:32attorney to represent you. I have reviewed your declaration of financial status and find that
03:38you are indigent. I'm provisionally appointing a Rule 8 qualified attorney to represent you on your
03:46case, Mr. Robinson. Along with their filing of their appearance of counsel, the assigned attorneys
03:52must file declarations with the court that outline their qualifications under Rule 8 and Rule 8C,
03:59I'm sorry, under Rule 8B and Rule 8C, for counsel appointment in a case where death may be a sentencing
04:06option. I'm ordering that those declarations be filed prior to the next hearing date, which is set for
04:13September 29th at 10 a.m. Mr. Robinson, I also wish to inform you of your rights against self-incrimination.

04:45Yes, Your Honor, Chad Grunander for the state. I'm also joined, and they're listed as attendees,
04:52Ryan McBride, Lauren Hunt, David Sturgill, and Chris Ballard. We are the trial team on this case.
04:57I do have a few points I'd like to bring up with Your Honor. We have filed a pre-trial protective
05:05order on behalf of Erica Kirk. We would ask the court to review that. It should be in your queue,
05:11Your Honor, and sign that. Thank you. I have reviewed the pre-trial protective order and will be grants
05:19issuing this pre-trial protective order in favor of Erica Kirk. Is there any other business that we need
05:27to address today, counsel? Just for the court's information, we did file just recently within
05:32the last few minutes a notice of intent to seek the death penalty. That was filed by Utah County
05:38Attorney Jeff Gray. So that should be in the court's file. Lastly, I would just indicate to the court and
05:47to, at this point, Mr. Robinson, that we are prepared to collect all of the discovery in this
05:53matter and get that turned over to the defense as soon as possible. Rule 16 requires us to provide
06:00what we have relied on in charging the information and bringing these charges within five days once
06:07it's requested. So that'll be prepared to disseminate to the defense as soon as possible.
06:12Thank you, Mr. Grander. Mr. Robinson, what I also want to do is you have the right to have the charges
06:20read that you stand charged of, and I wish to read those two to you at this time.
06:39Mr. Robinson, for count one, aggravated murder, a capital felony in violation of Utah code
06:45annotated 76-5-202, in that on September 10, 2025, in Utah County, the defendant, Tyler James Robinson,
06:57intentionally or knowingly caused the death of Charlie Kirk under the following circumstances.
07:03The defendant knowingly created a great risk of death to another individual other than Charlie Kirk
07:09and the defendant. Notice conviction of this offense may carry the death penalty
07:14for pursuant to Utah code 76-3-207.7, a mandatory term of imprisonment for life without parole
07:24or an indeterminate term of not less than 25 years, and that may be for life.
07:30Victim targeting enhancement in violation of Utah code annotated 76-3-203.14 sub 2, Tyler James
07:42Robinson intentionally selected Charlie Kirk because of Tyler James Robinson's belief or
07:48perception regarding Charlie Kirk's political expression. Notice if the trier of fact finds
07:55beyond a reasonable doubt that the victim targeting enhancement applies. The sentencing judge or the
08:00board of pardons and parole shall consider the defendant's selection of the victim as an
08:06aggravating factor. Violent offense committed in the presence of a child aggravating factor,
08:11the sentencing judge or the board of pardons and parole shall consider as an aggravating factor
08:16in their deliberations that the defendant committed a violent criminal offense in the presence of a
08:22child. Count two, felony discharge of a firearm causing serious bodily injury, a first-degree felony,
08:30in violation of Utah code annotated 76-11-210 sub 2 and 3C, in that on September 10, 2025 in Utah County,
08:42the defendant, Tyler James Robinson, discharged a firearm in the direction of Charlie Kirk,
08:48knowing or having reason to believe that Charlie Kirk may be endangered by the discharge of the firearm,
08:54and that the act caused serious bodily injury to Charlie Kirk. Victim targeting enhancement in violation of Utah code annotated 76-3-203.14 sub 2,
09:08Tyler James Robinson intentionally selected Charlie Kirk because Tyler James Robinson's belief or perception regarding Charlie Kirk's political expression.
09:17Notice if the trier of fact finds beyond a reasonable doubt that the victim targeting enhancement applies,
09:25the sentencing judge or the board of pardons and parole shall consider the defendant's selection of the victim as an aggravating factor.

10:16Conceal or remove the firearm used to shoot Charlie Kirk,
10:19and the conduct that constitutes an offense would be a capital felony or a first-degree felony.
10:26Count four, obstruction of justice, a second-degree felony in violation of Utah code 76-8-306 sub 2,
10:35in that on or about September 11, 2025 in Utah County,
10:39the defendant, Tyler James Robinson, with an intent to hinder, delay, or prevent the investigation, prosecution, conviction,
10:47or punishment of any person regarding conduct that constitutes a criminal offense.
10:54Destroyed, concealed, or removed the clothing he wore during the shooting,
10:58and the conduct that constitutes an offense would be a capital felony or a first-degree felony.
11:05Count five, tampering with a witness, a third-degree felony in violation of Utah code annotated 76-8-508,
11:15in that on or about September 10, 2025 in Utah County,
11:19the defendant, Tyler James Robinson, believed that an official proceeding or investigation
11:25was pending or about to be instituted or intended to prevent an official proceeding or investigation,
11:32and attempted to induce or otherwise cause his roommate to withhold testimony, information,
11:38a document, or an item to wit directing his roommate to delete incriminating text messages.
11:46Count six, tampering with a witness, a third-degree felony in violation of Utah code annotated 76-8-508,
11:54in that on or about September 11, 2025 in Utah County,
12:00the defendant, Tyler James Robinson, believed that an official proceeding or investigation was pending
12:06or about to be instituted or intended to prevent an official proceeding or investigation
12:11and attempted to induce or otherwise cause his roommate to withhold testimony or information,
12:18to wit directing his roommate to stay silent if the police questioned the roommate.
12:24Count seven, violent offense committed in the presence of a child,
12:29a class A misdemeanor in violation of Utah code annotated 76-3-203.10 sub 2,
12:38in 76-3-203.14 sub 3A, double I,
12:45in that on or about September 10, 2025 in Utah County,
12:49the defendant, Tyler James Robinson, committed criminal homicide in the physical presence of a child
12:56younger than 14 years of age with knowledge that a child was present
13:01and that may have been seen or heard the commission of the criminal homicide,
13:07victim targeting enhancement in violation of Utah code annotated 76-3-203.14 sub 2,
13:16Tyler James Robinson, intentionally selected Charlie Kirk because of Tyler James Robinson's belief
13:23or perception regarding Charlie Kirk's political expression.

14:21So that was Mr. Robinson standing there, emotionless, expressionless.
14:26You can see the face of evil as he's hearing these charges read against him.
14:30Aggravated murder, obstruction of justice, witness tampering, and the death penalty is an option.
14:36Greg, you were saying it's so good for the country to see how this proceeds in the courtroom.
14:43Yeah.
14:43And this is going to be a learning experience, not just for the people who saw this coming,
14:48but for the people who have to reconcile their role in this.
14:50You know, he said some hatred can't be negotiated with.
14:55Well, where did that belief actually come from?
14:58It sounds really familiar.
14:59You know, if you designate the other side as Hitlerian or fascist, why would you negotiate with them?
15:06We said that many times.
15:07This rhetoric has been part of the democratic media industry complex for the past decade.
15:15They believe that they didn't have to debate us because we were deplorable or irredeemable.
15:21If you remove debate, the only thing that's left is violence.
15:26It's the most regressive act you can imagine.
15:28This was the product of mass hysteria that then cemented into a belief.
15:35And we need to end it.
15:36We can't let another one of these things happen.
15:39And that means confronting the people that actually still believe this.
15:42I think you do need the death penalty for this because this could be a sanctioned evil.
15:51You see people treating Luigi like a folk hero.
15:54Why does that happen?
15:56It could happen again.
15:57We need mutually assured destruction.
15:59If you take somebody's life, we're going to take yours.
16:02And this is the time for it.
16:04Also, there's an amazing contrast here that gets rid of the both sides argument.
16:09After Floyd, you had sanctioned riots for three months.
16:14You had dozens dead.
16:16After this, you had vigils.
16:17You have mourning, grief, and justice.
16:20You know, we don't label people evil and then sanction their death.
16:26You know, our responses through the courts and by the law, everything flows from that.
16:31Conservatives and Republicans have been called square forever because we're so hokey about law.
16:36Why didn't we riot?
16:39Because we don't like doing that.
16:41We inherently believe in law and order.
16:44And we expect that in others.
16:46So this is the right way to do that.
16:48I just want to end on this.
16:50His rhetoric, which is derived from the Democrats, has done the Democrats irreparable damage by exempting them from debate.
16:58They never had to prove the validity of their ideas.
17:01All they had to do was implement them, watch them fail, and then demonize the critics.
17:07Now they've reached the end point.
17:08This is the end point.
17:09They have demonized to a point where an innocent, brilliant man died.
17:14But now they also have no policies because they never had to debate.
17:18They never had to prove their worth.
17:19They have no ideas.
17:21They have no meaning.
17:22They have no value.
17:23They're a soulless whole.
17:25After relying on this demonizing rhetoric to carry the load of their party, without it, it's just an empty abyss.
17:32It'd be interesting, Kay, to see how the media covers this trial or if they cover it at all.
17:38Friday night, they didn't even air Erica Kirk's address to the country.
17:43Yeah, they're not covering it well already.
17:45It's very difficult to watch and look at this person who is not only an alleged murderer, but who is also a thief.
17:54This is allegedly the person who stole a husband and a father from Erica Kirk, from their children.
18:01And he stole Charlie from his friends and from the country.
18:05And it's very clear watching him and looking at the text messages that he knew exactly what he was doing.
18:13This is not an insanity case.
18:15This is not a case of mental illness based on what he is accused of and the messages we've seen on Discord and the text messages with his roommate,
18:25who was also his trans lover, talking about how he was carving, engraving bullets, which brings up another question.
18:32And I'm sure Paul can talk about this with the obstruction issue and what his roommate and trans lover actually knew about what his plans were.
18:40But in terms of your question about the media, we're already seeing and we've seen this since this happened almost a week ago now.
18:48This victimization of the killer, that he somehow had something in his life that justified this,
18:56that he didn't like what Charlie Kirk stood for because Charlie was too hateful in his debate on college campuses
19:01and therefore maybe he was somehow justified in taking his life.
19:05And you saw today, even ABC calling the text messages between this guy and his roommate trans lover touching
19:13because there was some concern about what might happen to him after he had murdered, allegedly, Charlie Kirk in front of his family and the entire world.
19:22And so you are seeing this idea of the media turning him into a murder.
19:27Utah does have the death penalty.
19:29They also have a firing squad and he's not confessing, which means this could take a long time.
19:35And you may see him get the Luigi treatment where you have thousands of people online and showing up in person,
19:41making this guy the martyr rather than the family man and good American who he stole from the rest of us.
19:48So it's their time to make a decision about whether they want to report this honestly or what they want to turn a monster like this into someone who deserves some kind of praise and sympathy.

20:01Yeah. And to Katie's point, you can see you can just see the people who've already tried to justify this heinous act.
20:09You can just see them getting together to try and raise money for him and try and crowdsource for him to make sure that he's got defense lawyers.
20:19And it's reprehensible because the only answer right now is not people in the media or people on social media or professors or teachers falling all over themselves to justify this assassination.
20:32The only answer is to come out and say that political violence is wrong, full stop and words are not violence.
20:43You know, you talk about debate, Greg, and how the left has an allergy to debate.
20:48And it makes you realize just how powerful the debate was.
20:53And that tactic was that Charlie Kirk employed on college campuses and how incredibly necessary that was to make sure that young people there who were being radicalized,
21:04who were being propagandized at certain colleges in the country, that at least they had access to ideas.
21:11And he was smart about it because he empowered them.
21:15He didn't talk at them.
21:17He gave them a microphone and invited them to challenge him because they wouldn't debate in political form.
21:24So he had to take the debate to them.
21:27And what I truly hope is that college campuses don't act in cowardice and shut down conservative debate and conservative voices and libertarian voices on college campuses.
21:40But they welcome it because talking about things in the way Charlie Kirk illustrated is the only way to truly stop right now this violence, this tenor, this climate and move towards something that looks more like desperately needed rationalization or rationality.
22:00I should say. We've had enough rationalizations. We need rational thought and critical thinking back on college campuses in debate and in society.
22:07We sure do. Paul, you heard a lot of those charges read and we've seen a lot of evidence so far, especially these communications between him and his trans boyfriend.
22:18Yeah. So what the prosecutor did there, not only in New York would be an indictment, federally it would be an indictment.
22:25This is an information. But I bring it up just because this is what would be called a speaking indictment.
22:29Why does that matter? Because it's a situation where you lay out a lot of the facts, facts as you're going to allege them.
22:35So you're not just impugning the accused, but you're putting out facts that are known to you that are going to be the basis of your case.
22:42In this case, they chose to do that, in my opinion, because they wanted to tamp down some of the lunacy that we're all seeing going around online relative to conspiracy theories, who he was.
22:54This guy is actually a right winger, blah, blah, blah.
22:55Very clearly, he was putting out where this guy was coming from.
22:59I think we can put to bed any questions about motive at this point.
23:03A couple of things that jumped out at me, the charging of the potential witness tampering and the destruction of evidence.
23:09That's leverage over the roommate, because if you remember in the initial thing we saw this morning when the prosecutor gave the hearing, the press conference,
23:19talked about the fact that the note was under the dashboard and the police were able to retrieve a photograph of the note.
23:26My understanding is they don't have the note.
23:28Where'd the note go?
23:29Well, who would have destroyed it?
23:30Likely the roommate, right?
23:31So you're starting to see some of the things, some of the contours of what's going on here.
23:35The investigators want that roommate on their side.
23:38They want that person right where that person is right now, which is don't charge me.
23:43I'll tell you whatever you want to know.
23:44And that seems pretty clear from the conversations, the text messages that we've seen.
23:49So a lot of that now is being clarified by that press conference and now, of course, by this whole thing here,
23:56where we've got the official charges which say that it's aggravated murder because he put others in danger other than Charlie.
24:04The basis of that is going to be a long-range shot, could have hit somebody else all.
24:09Or, and forgive me for being graphic here, but the round at that short distance, a high-powered round, likely goes through.
24:17And my understanding is that's exactly what happened.
24:21That's not going to be hard to hold up.
24:22Accrobated murder is going to go.
24:23Let me just close with one other thing that jumped out at me.
24:25Again, trying to tease out some subtleties here.
24:28The judge called him indigent.
24:29All right?
24:30If you caught that right.
24:31All right.
24:31I want to know what this guy, how he was keeping heart and soul together.

24:35He's living with an aspiring gamer who's transitioning.
24:39Right?
24:39Which costs a lot of money, by the way.
24:41That's all kinds of hormone treatments and all this other stuff.
24:43He's going to school.
24:45Let me ask.
24:46Are there student loans?
24:47Would anybody be shocked to find out that they have $200,000 in student loans and that's
24:52how they're managing to live at home, doing nothing more than plugging themselves into
24:56the Internet, into a progressive ecosystem that creates this kind of stuff?
25:02You know, this is not that fringe.
25:04When you consider, they always, the left's going to come back with, oh, Donald Trump, Donald
25:07Trump says outrageous things.
25:09Donald Trump doesn't advocate for killing anybody.
25:11Last I checked, the guy who almost became the vice president, Waltz, literally said
25:15after two attempts on Donald Trump's life, oh, I woke up today, he's still alive, huh?
25:20Something to that effect.
25:21You know, this is far more inside the mainstream of the Democratic Party than anything on the
25:27right.
25:27So the both sides of him doesn't work.
25:29And to me, this guy, he's not even human.
25:32This guy is an excremental byproduct of a progressive ecosystem that has been countenanced
25:38and funded by some of the worst enemies of the American experiment.
25:44In some parts of the country, they call him a dingleberry.

25:53murder and six other counts.
25:55Now, unfortunately, some on the left continue to cheer the killing.

26:08rise of the violent rhetoric.

27:08Most of these people are not public figures.
27:10They were anonymous until a few days ago when this conservative campaign organized online
27:16targeting people that it says are attacking Kirk.
27:20Look, this is a new form of cancel culture.
27:22This does seem to be turning into a very aggressive attempt to purge not just, you know, government
27:28officials, specifically people who work in education, who work in health care, who work in government.
