00:22Caro left intact a lesser murder charge, second-degree murder. That charge still carries the
00:27possibility of life in prison. But it nonetheless was a victory for Mangione. His lawyers were trying
00:33to get the entire state case dismissed. They argued that it was double jeopardy. Judge Caro said
00:38that it's premature at this stage to entertain the notion of double jeopardy because neither the
00:43state case against Mangione or a parallel federal prosecution have gone to trial. Judge Caro did
00:49say that prosecutors in the state case presented insufficient evidence to support the top charges
00:54that alleged that Mangione killed Brian Thompson as an act of terrorism.
01:09Mangione is due back in court in the state case on December 1st. He's due back in court
01:13on the federal case on December 5th. No trial dates have been set in either case.
