00:13Day two of Brazil's Supreme Court ruling against former President Jair Bolsonaro and seven of his cronies for allegedly plotting a military coup has come to a close.
00:24Today was marked by a one-day-long decision issued by Minister Luis Fux, a Dilma Rousseff appointee in 2011 who later turned on her and ruled in favor of her impeachment in 2016.
00:40In contrast to the guilty verdicts issued by Minister Alexandre Gimoraes and Flavio Dino yesterday,
00:50Fux claimed that the Supreme Court has no jurisdiction to rule on this case because the date that the investigation started was after most of the defendants had left political office,
01:02meaning that they don't have political immunity which would necessitate their case from going directly to the Supreme Court.
01:10He argued that the case should be pushed back to the lower courts in direct contrast to nearly 1,000 rulings he's already made
01:18on people who were arrested for participating in the Capitol riots on January 8, 2023.
01:26He cited in favor of guilty verdicts for nearly 1,000 people.
01:30So today he contradicted that and read off a laundry list of complaints made by the U.S. government,
01:37couched in legal language, citing American law professors about freedom of speech and things like that.
01:43And what's the end result?
01:45The Bolsonaro supporters are now going to have hundreds of video clips that they can use in Instagram videos,
01:51TikTok videos to try and pressure the public and pressure Congress for an amnesty bill
01:58to declare everyone innocent and free of charge.
02:01This also opens up space, according to a legal scholar, Pedro Serrano,
02:06for some time in the near future for them to be able to restart the case and try and get an annulment
02:12based on the arguments presented by Fux today.
02:15So tomorrow is the third day.
02:18There's going to be two people voting, Carmen Lucia and Cristiano Zanin.
02:22All they need is one more vote for a guilty verdict for the defendant.
02:26But Fux's behavior today is going to create instability in the near future.
