CEPEP Contractor Eastman Enterprises suffered yet another loss today when Court of Appeal Judge Justice Nolan Bereaux dismissed an application for an urgent hearing of the matter.
00:00A CPAP media release which was issued today states that Justice Barrow found that attorneys representing Eastman Enterprises Limited did not provide enough evidence to support their application for an urgent hearing.
00:13The release said Justice Barrow was critical of the affidavit evidence of Attorney and Opposition MP Karim Marcel, stating that there was nothing in Mr. Marcel's affidavit which demonstrated any curgency or urgency of circumstances which justify that the matter should be deemed fit for urgent hearing.
00:33The court said even if it did take the plight of CPAP workers into account, there were no curgent circumstances that would allow the appeal to be heard over, above and in priority to other matters before the court in which other persons have been waiting patiently in the queue.
00:51He said that very curgent facts and circumstances were needed and there was no proper basis in Eastman's evidence to hear the matter urgently.
01:00Justice Barrow dismissed the application and ordered Eastman Limited to pay CPAP's legal costs.
