00:00Matapot ang desisyon ng Senado na i-archive ang impeachment case ni Vice President Sara Duterte,

00:05pag-usapan natin ang mga posibleng susunod na hakbang ng Kamara.

00:08Kausapin natin ang isa sa mga miyembro ng House Prosecution Panel,

00:12si Batangas 2nd District Representative Gervil Luistro.

00:14Magandang umaga at welcome po sa Balitang Hali.

00:18Good morning and thank you for having me here sa Balitang Hali.

00:23Apo. Sinabi po ni House Speaker Martin Romualdez na pila minadali ng Senado yung pag-archive sa impeachment case.

00:29Ganito rin po ba ang inyong paniwala?

00:32Well, it is our position ever since that we complied strictly with the Constitution.

00:39Wala pong minadali ang Kongreso and kami po'y nabibigla na yung inaasahan namin na pag-uumpisa ng trial

00:50as shown in the proposed dates of SP last February of 2025,

00:57e mukhang nabaligtad.

01:00And as a matter of fact, hindi na nga po nahintay ang desisyon ng Porte Suprema

01:06sa ating motion for consideration at kaagad na itong na-archive.

01:11Giit po ng ilang senador, patay na rao yung impeachment case laban sa vice-presidente sa naging SC decision.

01:17Ano pong komento nyo rito?

01:19I wish to believe otherwise.

01:22Mayroon pong pagkakaiba ang archiving at ang dismissal.

01:28Kapag ka po archiving, ibig sabihin, ay temporarily inactive yung kaso.

01:34At kung gusto natin matake up ulit ito, ang tamang remedy po doon is the motion to revive.

01:40Doon po sa dismissal, totally dinisregard na ang kaso.

01:45At kung gusto ulit na magkaroon ng hearing kaugnay dito,

01:50the impeachment complaint has to be refiled.

01:53Ito po ay may pagkakaiba.

01:56And it is my humble submission as one of the members of the panel of prosecutors

02:02na dahil mayroon pang motion for consideration sa Supreme Court,

02:07may pag-asa pa po na mabuhay ang impeachment complaint.

02:11Paulit-ulit pong naging debate doon sa Senado ay hilaw daw yung impeachment complaint

02:16at napatunayan daw nito nung lumabas yung Supreme Court decision.

02:19Kulang-kulang daw yung isinumiti ng mababang kapulungan ng Kongreso.

02:24Ano pong reaksyon nyo rito?

02:26With all due respect po sa ating mga Senador,

02:29but we firmly stand na hindi po hilaw ang impeachment complaint.

02:34Ito po ay dumaan sa masusing pag-aaral.

02:38At ito po ay kininsulta ang mga signatories ng impeachment complaint

02:44the 215 members of the House of Representatives

02:48na nag-endorse po nitong impeachment complaint na ito.

02:52We followed strictly the provisions of the Constitution

02:56at lahat po ng aming mga pagpapaliwanag ay amin po isinama

03:02dito sa ating motion for reconsideration.

03:05All the differences in facts, the differences in issues,

03:10we completely address them in the motion for reconsideration.

03:14And we are hopeful na maliwanagan po ang Supreme Court

03:18at ma-modify or ma-reverse even yung kanilang naunang desisyon.

03:23Pero nagulat po ba kayo doon sa mga hinihinging bagong impormasyon

03:26mula sa Supreme Court?

03:28Ang sinasabi kasi nung debate sa Senado,

03:31may mga hinihingi na bago.

03:33Nagulat po ba kayo na may ganitong lumabas sa Supreme Court decision?

03:37Nagulat sapagkat ito po ay hindi nakasaad sa ating saligang patas.

03:43Alam mo, Rafi, meron tayong pag-aaral

03:48ang lahat ng mga estudyante ng patas,

03:51ang tawag dito statutory construction, no?

03:55Dalawa ang mahalagang rules dito.

03:57Ang sabi, when the law is clear, you should immediately apply it.

04:02But when the law is not clear, you should interpret it.

04:06But what happened really to the decision of the Supreme Court,

04:10nagkaroon ng mga additional requirements

04:13na wala at hindi mo makikita sa ating saligang patas.

04:17I understand, Rafi, that I am not at liberty

04:20to discuss in detail all these issues

04:23sapagkat ito po ay sakop na ng subjudice rule.

04:27But rest assured na lahat po ng ating mga differences in facts

04:31and even differences in arguments

04:34ay nailatag po natin ang maayos

04:37sa ating motion for reconsideration

04:39na inihain sa Corte Suprema.

04:42At dahil nasagot nyo na po yung mga hinihingi ng Corte Suprema,

04:44sa palagay nyo po may pag-asa yung inyong MR

04:46at ano po yung susunod yung hakbang?

04:48We are hopeful that the Supreme Court will still be enlightened

04:54and they will find reason to modify or even reverse their decision.

05:00Kung ito ay pagbibigyan ng ating Corte Suprema,

05:05then I think we are back to our impeachment hearing.

05:11Okay, abangan po natin yan.
