00:00:00Welcome everyone just want to call to order since it is 7 o'clock the public
00:00:16hearing that was announced over 30 days ago and I will turn it over to John if
00:00:22he wants to yes the highlights sure so this the there was the application to
00:00:32rezone 222 West Carroll Street from it basically it reverted again to a
00:00:39residential zone when it ceased to use for school purposes okay so the request
00:00:46is to have that reason to be one which is the neighborhood business district which
00:00:51is again more in line with its use right now as administrative or office use so
00:00:57there's really no proposed change the neighborhood business district does not
00:01:03allow like service station things of that nature it's more restrictive and use so
00:01:09this is really our second hearing we had the hearing before Planning Commission as
00:01:14you'll see in your packet and the minutes it was unanimously recommended by the
00:01:19Planning Commission for approval so we're now here for the second hearing I know
00:01:25we have a representative of the county who has potentially an interest in the
00:01:30property again working with Brad on the filing of the application so I guess does
00:01:37any we can accept any kind of comments from the public including yourself for
00:01:42anyone for or against the application
00:01:47anyone has any comments one last time it's not an auctioneer but yeah
00:02:00I think we should I was going to have them do I think it would be fine during the public hearing if there are no objections we have a motion in support of the
00:02:18fine well there's only commission yeah we probably just ought to do that council no

00:03:57I pray for these people to lead them through your wise counsel and guidance
00:04:02I pray for them to lay aside selfish desire and petty grievances instead focusing always on
00:04:08the best interests of the people may they lead through humility and with love and unity
00:04:14lord keep our leaders grounded in what is good and true protecting them from the temptations and
00:04:20distractions of power and influence may they know and follow you leading through faith ever working for
00:04:28the good of the people they serve amen
00:04:32I pledge allegiance to the flag of the united states of america and to the republic for which it stands one nation under god
00:04:42indivisible with liberty and justice for all

00:05:16I'm going to go ahead and try to set the stage

00:05:26just a reminder
00:05:28citizens requesting time to speak is a time when
00:05:30individuals
00:05:32whether they be groups
00:05:34representing or individuals representing a group
00:05:36individuals themselves
00:05:38residents
00:05:40non-residents that have work in the city
00:05:42can get on the agenda
00:05:44and be a part of the agenda
00:05:46and
00:05:48we also later in the meeting
00:05:50in the meeting
00:05:52have what we call
00:05:54comments from the public
00:05:56that is where folks
00:05:58do not have to be on the agenda
00:06:00and can speak to the public
00:06:02this is not something I'm going to read at every meeting
00:06:04but I want to read it once
00:06:06and we may make it a part of our agenda
00:06:08in the future
00:06:10citizens requesting time to speak
00:06:12and later in the evening
00:06:14comments from the public are specifically designated
00:06:16for the public to address council
00:06:18and the administration
00:06:20with their concerns
00:06:21compliments
00:06:22and or other questions
00:06:24we welcome and encourage your participation
00:06:26if you wish to speak at a council meeting
00:06:28please keep the following in mind
00:06:30your comments should be factual
00:06:32and respectful
00:06:34of the rights of others
00:06:36before speaking at a council meeting
00:06:38with a specific problem
00:06:40you should have to first address the problem
00:06:42with the appropriate department
00:06:44staff member or the administration
00:06:46or your council member
00:06:48speakers will be limited
00:06:50to a maximum of five minutes
00:06:52noting that council members
00:06:54and the administration
00:06:56may ask for more time
00:06:58if they have questions
00:06:59or desire more details
00:07:00let me let me clarify
00:07:02a little bit there
00:07:04we're not going to have a clock
00:07:05up on the wall
00:07:06that counts down five minutes
00:07:07I am going to pay attention though
00:07:10to that
00:07:12if someone goes along over five minutes
00:07:15I'm going to mention
00:07:16hey you've passed five minutes
00:07:18at the same time
00:07:19we're going to try not to ask speakers questions
00:07:22we're going to give them their five minutes
00:07:24when they're done
00:07:26or at the end of that five minutes

00:07:32are never afraid to say

00:16:10so you had the whole picture
00:16:12you got a copy in your packet of the red line
00:16:17version of John's
00:16:18and how that amendment got to where it is
00:16:21so we're treating that
00:16:22as an amendment

00:16:25the six of you are here

00:16:28that's why

00:17:05I'd also asked him for a projected fee

00:17:12but it was ballpark

00:17:14I asked him in the context of
00:17:16basically holding our hand
00:17:18from beginning to end
00:17:20so
00:17:21in the essence of high dollar end stuff
00:17:26the quote come back about
00:17:28it's going to be between 45 and 55
00:17:3155 being the high end
00:17:33if we have
00:17:35if we use them less
00:17:36obviously it's going to be less
00:17:38but the
00:17:39my approach was
00:17:40to ask them to give me a quote
00:17:43on basically holding our hand
00:17:46from beginning to end

00:18:52it's not council deciding
00:18:54it's council deciding
00:18:55to give public the opportunity

00:19:03there was red lines on it
00:19:04on what they felt
00:19:07kind of bullet proof
00:19:09anything as far as
00:19:10the board of elections
00:19:11or with the state of Ohio
00:19:12that would

00:19:19effective I guess

00:20:29you're all

00:20:31the bounds of
00:20:32what has been done
00:20:33what hasn't
00:20:34court cases
00:20:35things of that nature
00:20:36so there's a lot of
00:20:37knowledge
00:20:38when you go to change
00:20:39in the codified
00:20:40but
00:20:41you know
00:20:42obviously we have
00:20:43two elections
00:20:44before we're at that point
00:20:45right
00:20:46two ballot issues
00:20:47that would both have to pass
00:20:48I feel
00:20:49I feel like the codifies
00:20:50and the ordinance
00:20:51are a part of this piece of
00:20:53piece of the puzzle
00:20:54as far as
00:20:56if we were to implement a charter
00:20:58we've
00:20:59we've had many legislation
00:21:01come our way where
00:21:02the codifies
00:21:03and the ordinances was
00:21:04one was from 1968
00:21:06I mean
00:21:07better than 50 going on 60 years old
00:21:10so
00:21:11it's even an opportunity
00:21:14to update things
00:21:15that should have been updated
00:21:16long before now
00:21:17I mean it's
00:21:18it's the same as with
00:21:20what's going on
00:21:21on Detroit street
00:21:22that's
00:21:23obviously a pain
00:21:24for everybody
00:21:25but it's things that should have been
00:21:26done 20-30 years ago
00:21:28we're talking about the same thing
00:21:29in essence with our government
00:21:31we
00:21:32these are things that we need
00:21:33to be proactive about
00:21:35and forward thinking about
00:21:36as a council
00:21:37and not keep kicking the can down the road
00:21:40and
00:21:41get these things up to date
00:21:43and get
00:21:44within the times
00:21:46it's
00:21:47that's just my opinion on
00:21:49as far as all
00:21:50the codifies and the ordinances
00:21:51I know
00:21:52would be a lot of work for you
00:21:53but
00:21:54it's definitely a piece of the puzzle
00:21:56that needs to be addressed
00:21:58as well as
00:22:00other things
00:22:01I mean
00:22:02there's so many other things
00:22:04within
00:22:05government
00:22:06anybody I've talked to
00:22:08is just amazed about
00:22:11the things they may not know
00:22:12that
00:22:14it takes to run the government
00:22:16so
00:22:17I know I've learned a lot
00:22:18in just my year and a half
00:22:19I'm sure everybody up here has
00:22:21it
00:22:22it's a big undertaking
00:22:23and
00:22:24I don't feel like
00:22:25probably any of us
00:22:26really believe that
00:22:28the government runs as efficient
00:22:29as efficiently as it could
00:22:32so
00:22:33this is an opportunity to give
00:22:35the community a chance
00:22:36to create their government
00:22:37and make it
00:22:38as efficient as they
00:22:39feel like it could be
00:22:40so
00:22:41I have talked to a dozen
00:22:43so people that
00:22:45I won't mention anybody's name
00:22:47because I don't want to
00:22:48commit them to it
00:22:49but I've
00:22:50had a dozen people that
00:22:51are quality individuals
00:22:53in our community
00:22:54that want to be a part of the commission
00:22:56and feel like they can contribute
00:22:59in a
00:23:00way that would
00:23:02benefit all of us
00:23:03so
00:23:04I kind of
00:23:05was saving some of that
00:23:06for my
00:23:07second read part
00:23:08but
00:23:09it is
00:23:10it's all part of the conversation
00:23:11so
00:23:13okay
00:23:14so
00:23:15you have
00:23:16the
00:23:17potential
00:23:19guess at the cost
00:23:21you have
00:23:23a copy of the engagement
00:23:24letter
00:23:25and
00:23:26you have
00:23:27a copy of

00:28:02it to repair it is over seventeen thousand dollars and when we did the original budget
00:28:08everything that we do in this building is split fifty percent upstairs so city hall maintenance
00:28:15and then the police pay twenty-five percent and the municipal court pays twenty-five percent
00:28:21well when it ended up in the budget that was not a fifty twenty-five twenty-five split

00:28:28so we need some additional money so that we can get that backflow preventer repaired

00:31:26so it was supposed to be done this year but we're putting it off till we get this water on every place

00:31:38the study of the water treatment plant that is a zero percent owda loan so it's just prograting the money
00:31:45but we will get um won't pay for it up front it will pay for it as we as we can
00:31:53um repair the wells so we received a four thousand five hundred dollar grant from the epa for well head protection signage and educational outreach
00:32:05um so that is money we just need to appropriate that money and um having some problems with a couple of our wells
00:32:15uh we need we have a quote for twenty thousand dollars but we're short in that line for repair to well number two
00:32:22um so we need ten thousand five hundred dollars for repair to well number two
00:32:27um and then the last one is the water repair to plant um that was quoted at six million one hundred and sixty thousand dollars
00:32:39for the rehab and repair of the water treatment plant
00:32:43of that half will be principal forgiveness
00:32:47and the balance will be at a zero percent loan
00:32:51which is epa certified bringing our plant up to date yes
00:33:05so of that um total in the water i know it looks like a huge number six um
00:33:12six million two hundred sixty seven thousand seven hundred fifty dollars
00:33:17uh three hundred three million one hundred four thousand five hundred is grant or principal forgiveness
00:33:24and three million one hundred fifty two thousand five hundred dollars is a zero percent loan

00:33:39thirty or forty years but we we really need to be careful because we don't want to be paying for a plant that is not out of commission so that's where i was going yes it's a balancing act yes um

00:34:08well the um press at the sewer plant is down and i don't feel comfortable taking any money from that line and transferring it so we were asking for additional appropriations of two hundred and forty thousand dollars for the lining of the morningside sewer
00:34:26the total cost is three hundred sixteen thousand one hundred fourteen dollars and sixty cents so um
00:34:33and i don't think i have have it up in water but also in water and sewer office new equipment we had given money for the folding stuffer machine for angelica well the company no longer offers that so she went to somebody to

00:48:34of that nature.

00:48:37Like I said, I've had conversations with at least a dozen people in the community that

00:48:46They would know the purpose.
00:48:47They would be driven to get to the end result and work at getting there.

00:48:58All I can say is every one of us up here on council can verify this for yourselves.

00:49:06I make Cindy kind of a gold standard in what we've had in 20 years.
00:49:12And I'm not putting anybody down from the past.
00:49:16I'm just saying, since I've been on council, there's so many projects that are going on
00:49:23in this city that are forward thinking, that we are moving forward.
00:49:28There's a lot of things we still got to address.
00:49:30But we need that type of person to be doing that.
00:49:34If she decides to leave tomorrow, there would be another person appointed.
00:49:40John has said, our real only avenue to replace the city service director as council is basically
00:49:55through the purse strings.
00:49:57We don't vet them.
00:49:58This position, every one of us knows the many hats that Cindy wears just in her position.
00:50:04That position needs to be vetted.
00:50:08I believe through the charter, that needs to be what is created in the charter.
00:50:13It's just one of many things.
00:50:15People ask me a lot of times, what all would I, like outline items that I would change type things.
00:50:22It's not for me to say.
00:50:24I'm just kind of stuck on the fact that we have a city service director that is moving us to the future.
00:50:31She's chasing money four and five years down the road.
00:50:34She's planning projects 10 and 15 years down the road.
00:50:38And that can all change on a dime with a different person.
00:50:42And if we don't have the capability to vet that person, we don't have the capability of directing our city the way that we feel it should be done,
00:50:53we're just hurting ourselves.
00:50:55We are letting ourselves down.
00:50:57And every one of us up here is not serving our community if we don't do the best to put the best foot forward
00:51:04and put the best people in positions, whether it's there or anywhere in the city.
00:51:09We need to have more checks and balances, I think, as far as whether we're elected officials or we're appointed officials.
00:51:16We could have people that are appointed that may not be doing the job, but we don't really have those checks and balances.
00:51:23So when I hear when is the right time, to me now is the right time because we have the gold standard in our safety service director.
00:51:32And once she leaves, I would hope the community would vote for a charter and give us the ability to continue that expectation and that standard going forward.
00:51:44No matter who the mayor would be or whatever, that position Cindy holds is the CEO of over 8,000 people in our community.
00:51:54She's the CEO of a multimillion-dollar budget.
00:51:58She has to be an engineer.
00:52:00She has to be a negotiator with unions.
00:52:04She has to deal with EPA.
00:52:06At the moment, there is no criteria for who holds that position.
00:52:12None.
00:52:14Anybody can hold that position and not even know the first person to call if something happened down at the water plant as far as EPA or anything else.
00:52:22So I challenge council to move forward, put this before the voters, give the voters the opportunity to say yay or nay.
00:52:34We've done our part beyond that.
00:52:36If we give the voters the opportunity to say, and we give them, you know, the opportunity and we explain to them, you know, just like this, this is why we feel we need this.
00:52:49If we educate the community, I feel like this would pass 100 times over.
00:52:54I have not had one conversation with the many people that's approached me, not one conversation where somebody's like, this isn't for us.
00:53:04Everybody I've talked to has been really excited for the opportunity to be a part of it or even excited to see the growth of our city in that form.
00:53:16So beyond that, I mean, you could say we've had this government for 100 years, whatever.
00:53:25I know Peg uses the analogy of, you know, you remodel your house, you don't put the same stuff back.
00:53:31I tend to like the analogy of 100 years ago, everything that came off the assembly line at Ford was identical.
00:53:42Not a one of us drive a Model A.
00:53:45We all have, whether we feel comfortable, we want a four-wheel drive, air conditioning.
00:53:50Everything we, every person's car in here is custom to what they want.
00:53:55You went in and you picked out what you wanted from the dealership.
00:53:58But it's the world we live in.
00:54:00We need to be forward-thinking and have a government that is progressive and grows with the times.
00:54:09So with that, I would ask that we waive the three-read rule on that ordinance to vote to pass it tonight.
00:54:20Based on the premise that the commission would have to have their 25 signature petitions submitted to the Board of Elections by August 20th, which is 75 days before the election.
00:54:36We could read it the third time, but I would move we waive the three-read rule and give everybody that would like to have an opportunity to get their signatures
00:54:45and just to allow them the most time that we can.
00:54:49So that would give them a month, basically, to get their signatures to submit to the Board of Elections to be on the ballot for the commission.

00:55:40I know Sid Upperson-Dusky's been around since early 1900, so I don't really have a number as far as what's statutory and what's charter.
