00:01:18Welcome everyone. We'll move right on with the approval of the minutes from the last meeting. Are there any additions or corrections to those minutes?

00:01:32We have no citizens on the agenda tonight requesting time to speak. I know we'll have somebody toward the end.
00:01:40Thought there real quick. I know we've got two representatives from Rumpke here.
00:01:48Do you guys have anything you want to chat about real quick with the rollout?
00:01:51Yeah.
00:01:54Sorry if I told you.
00:01:55Just figured I'd follow up on my visit from a few weeks ago.
00:01:59We talked about a lot of things and there were a lot of, I think we'll do this unless we do that.
00:02:04So I just wanted to come back and kind of give you guys some confirmation on how we'll be running service in your community.
00:02:10Both trash and recycling, we'll be running the same exact routes that Republic is running.
00:02:15So the trash should be picked up on the same days and recycling should be picked up on the same days.
00:02:19We tinkered with the idea of moving all the recycling to one week.
00:02:25But after we kind of sat down and thought about it a little more, there's probably a reason Republic was doing it the way they were.
00:02:30So we're going to run half the community one week, the other half the other week like they've been doing now.
00:02:35For residents that need an extra card or extra item, something like that, we recommend calling the city to set that up and the city can let us know.
00:02:52That's not to say if the resident does call us, we'll get it taken care of, but for billing purposes and with the city sending us a house count of what each house has each month,
00:03:01it's easier if the city has the running list as opposed to us receiving a call and then having to send the city saying,
00:03:07hey, we received this, we received a phone call from this address saying they needed a card or they needed an extra whatever it is they needed that week.
00:03:16So if people ask, we recommend getting in contact with the city.
00:03:21I have a list of contact information I'll get to, I guess, Angelica, Emma, probably need a few other people just for who they can call or who,
00:03:32once they call the city, who, Angelica or Emma, whoever it is, they can forward that information to them and we'll get it taken care of.
00:03:38This is Tim Groff. He's our operations manager. It's his team that will be doing the day-to-day work.
00:03:44I thought I'd bring him so I could introduce him.
00:03:48His team is, I'd put them up against anybody in the state or the country for that matter.
00:03:53They're really good at what they do.
00:03:55If you have any questions or concerns, I think Tim brought a stack of cards so he can help you guys out.
00:04:01Yeah, the information that he has on there would be my personal cell phone number.
00:04:06I'll give him my company card and my email and everything on it.
00:04:11I answer whether I want vacation, in the middle of the night, it doesn't matter, I'll answer no matter what.
00:04:17I'll tell you, my team leads the east area, which would be the whole state of Ohio minus Cincinnati, in misses per 10,000.
00:04:27So, in other words, for every 10,000 customers, we have the least amount of misses in the whole east area for Rumpke.
00:04:34We take a lot of pride in doing excellent service to our communities.
00:04:38We just did a tip-in-city cleanup, no complaints, no problems.
00:04:42And just so you know, what that involves is every resident gets to put five items out to the curb.
00:04:48It's my team's responsibility to collect them on the day of their service.
00:04:52It's a huge, daunting task for us every single year.
00:04:58We don't look forward to it, but we do those times.
00:05:02And we get it done every single time.
00:05:04And if there's anything I would say, I would place bets against anybody on my team.
00:05:09I have faith in that we'll get this done.
00:05:11We might have a few bumps in the beginning, but I will tell you one thing that my team does is they take bumps and they iron out.
00:05:17So, if you bear with us, if you communicate, all I ask is you communicate to us.
00:05:23If there's issues, sit down and talk to us.
00:05:25We will figure it out.
00:05:26We will result in problems with everything we can to give you the best service you've ever had.
00:05:31Yes, sir.
00:05:32I have had a few of our, let's see, special needs customers, elderly, that we currently go and pick up from the door.
00:05:42We have that list, and we intend to continue doing exactly what it is.
00:05:47There are 70 customers that we receive that we consider backdoor service in the garage, behind the house.
00:05:54We've got a list of where they're at and everything.
00:05:56We've already given that to the two gentlemen that we've picked to be our drivers for this area.
00:06:01They're looking at it.
00:06:02They're looking, they're marking them on a map.
00:06:05They're noting where these backdoor services are already.
00:06:08This Saturday, they're going to come down in a company pickup truck and drive around to the company area to get an idea of it.
00:06:13We've made maps.
00:06:14We've given them maps.
00:06:15We're doing everything I possibly can think of.
00:06:18If you have an idea, I'll gladly listen to it, because I will tell you, I don't know everything.
00:06:23I know a lot of things, but not everything.
00:06:25We were sure that you would.
00:06:26We just wanted to make sure that piece connected.
00:06:28We got it.
00:06:30All the carts, or every home should have received their carts last week.
00:06:35If they already had additional trash or recycling carts, those should be getting delivered sometime this week.
00:06:43One thing about the carts, we've been told Republic will be removing their carts starting with service tomorrow.
00:06:50So if you get a call from a resident and they say, well, Republic took my, or the company took my cart and I haven't received my Rumpke carts yet, please let us know.
00:07:01We will put that straight to the top of the priority list.
00:07:04We don't have any residents having an interruption service.
00:07:07But everybody should have received their carts.
00:07:09I think we had three or four homes that, for one reason or another, refused carts or said they didn't need them.
00:07:16Aside from that, I don't think we had any issues.

00:09:38I know some of the concerns were and comments have been and asks of me were about our private haulers in town.
00:09:47Um, so, you know, I talked extensively with Burrell, who works for the city, but he also is the owner of SV&E, which they are the largest in the county private hauler.
00:09:58Um, and I asked him what that would look like, and he's like, there's no way.
00:10:04There's no way, cost-wise, to take that on.
00:10:07The recycling part is kind of really what that, you make no money on that.
00:10:13It's a wash.
00:10:14You'd probably lose money.
00:10:16He would, you'd have to bring in more trucks.
00:10:19You would have to bring in mechanics.
00:10:21Um, your liability, your insurance would go up.
00:10:25Um, so it's a big factor.
00:10:27I've never had, since we've changed over, I've never had a private hauler even once come in and say, hey, we'd like to take a shot at this.
00:10:37So, it's just the way it works, you know, recycling, you'd have to, you're running out of town, or you can dump out here.
00:10:46But you're paying, you're also paying that kind of fee, too.
00:10:49So, you know, it's just come to this time of, this is how you do business anymore with the bigger haulers.
00:10:57But, Burrell really set it into place about what it would be, why private haulers don't take, don't take it on.
00:11:06So, I just wanted to clarify that.
00:11:08And, I'm just going to follow up just briefly.
00:11:13Some of the questions I know I've been getting, I think you probably have, too.
00:11:17I think maybe all of you have.
00:11:18Not just, why not a private hauler, but why not anyone pick whoever they want?
00:11:23But, I mean, simple answer, beyond the North Central Ohio Solid Waste District, the federal government basically said, thou shalt not do that.
00:11:34I mean, when we were looking at the bids clear back when Mayor Manns was playing with us doing it ourselves, having a city, creating a new enterprise, which I applaud Randy for at least looking at it.
00:11:53We had asked that question also, are the requirements still in place that required us to reduce our output as a city?
00:12:07And, the folks from North Central Ohio said basically yes.
00:12:12If we were to, today, call up North Central Ohio Solid Waste District and say, yeah, we're not interested in having that anymore.
00:12:21We're going to, I guarantee you, we would have three to four people here at the next council meeting and probably the next day in the Mayor's office.
00:12:31If you recall, we had three or four people from North Central Ohio Solid Waste District here when we were working on this four years ago.
00:12:40So, I don't know, is that the right way to say it, John?
00:12:43I mean, it's basically a cost to doing business of a, even a village the size of forest, you can't just open it up and say, whoever you want to take the trash, you can take the trash.
00:12:56Because the incentive is supposedly to reduce the amount of tonnage.
00:13:02So, everything that's done incentivizes you to reduce output.
00:13:07And, also, on that note, just that reminder, Blake said, it starts tomorrow, so put out all your Republic totes so they get picked up.
00:13:20So, that will be second ward, Tuesday pickup.
00:13:23Also, if you are close to or you know someone that's close to a vacant house or one that your neighbors are on vacation or make sure you get those out, too, we'll have our summer help go around and start looking at some other houses, too, that might have them stuck behind.
00:13:45But, if you can help out your neighbor, that would be outstanding.

00:15:48They were dragging and leveling that area today, and they're going to be setting that in.
00:15:52It's a really nice swing set.
00:15:54I think it cost them about $17,000.

00:15:57So they're really working on Pioneer Park.
00:16:00They're very passionate about that park and what they're doing down there.

00:16:08I want to thank Emma and Whitney and all the volunteers for coordinating an excellent event on Friday, the longest day of play.

00:16:45If you don't know what we did is like every hour on the hour throughout the day, we would switch events that we did.
00:16:52Some of the hours we switched parks.
00:16:56So I think that fishing and disc golf and probably the Gaga pit and the firefighter agility test were
00:17:07the biggest ones for us, but I just want to give a big shout out to Kenton High School Athletic Director Brett Purcell.
00:17:17He made sure that the track was unlocked for us to do our morning walk and then we used the tennis courts for pickleball.
00:17:24Deb and Don Purcell, they did the pickleball and then they also went out to Boy Scout League and helped with the fishing out there.
00:17:34And then we finished off the night out of the quarry with a walk and a movie.
00:17:38Jason Howe was out helping with fishing and he also brought the fishing poles for the kids to use and bait.
00:17:46And then we had the assistant boys basketball coach and a couple of the players were there to help the kids with that.
00:17:55United Methodist Church, Marsha Watkins and Lori Ortega provided a lunch for the kids.
00:18:01We gave away over 50 lunches.
00:18:03And then Kenton Fire Department, Chief Donnelly, Bob Wilson, Danny Folk, Jax Stiegel, and then KPD's Dylan Carter and Luke Broadman were all out at Wharton Park to do the agility test.
00:18:18Mike Steyer and Jeff and Michelle Bloom were out to help with disc golf.
00:18:22St. John's Evangelical Church did the dinner for everybody at Fellowship Hall.
00:18:28And then we've got Elizabeth and Kenley Howe and Donna Martin and all of the pool staff.
00:18:34You know, as you guys know, that was the first super hot day of the year.
00:18:38They had already been open their regular hours, 1 to 6, and not only did they stay an extra hour so that we could play,
00:18:45but they actually extended their hours until 9 o'clock.
00:18:48So a big thanks goes out to them.
00:18:51Lions Club, Joe Burbacher, Bill Keller, Brad Bailey, Judd Robinson, and Michael Hunt were all at Pioneer Park
00:18:57for the Gaga Ball.
00:18:59Deb Phillips helped several places throughout the day, and then she did the walkout to the quarry.
00:19:06Middlefield Bank donated popcorn for the movie Hempi Water, and then, of course, the Hardin County Community Foundation.
00:19:13Big thanks to Robin Jones, who was also with us all throughout the day.

00:21:18Ordinance number 25-007, an ordinance authorizing the city of Kenton to enter into a highway improvement project with the Ohio Department of Transportation and declaring an emergency.

00:21:37All I know is it's state route 309 and it costs the city.

00:22:03Ordinance number 25-008, an ordinance submitting the question of selecting a commission to frame a character to vote of the qualified electors of the city of Kenton, Ohio, and declaring an emergency.
00:22:16So I guess I'll refer to the city of Kenton or legislation.

00:22:30Well, so I was asked to draw this.
00:22:36You know, of course, you know, of course, we had a meeting there last year with Burke and Graydon on kind of advising council some of the ins and outs of charter.
00:22:48So I've been asked to draw this up.
00:22:50We cannot pass this tonight, even if you so choose, because it's outside of the window that under my read of when this actually can be passed.
00:23:01It would be more than 120 days before the election.
00:23:03But it could be possibly passed at the next meeting.
00:23:08That gets us within the window.
00:23:12You know, I tried to find – I am blind, blind on this.
00:23:16I've never done it.
00:23:16I tried to find ordinances.
00:23:19Couldn't find any.
00:23:20So Sunbury was the only one I could find, and I think some things have changed on that.
00:23:26So I've tried to map that as best I could.
00:23:28If you want to guarantee that this gets on the ballot, I would advise you having Bricker look over the ordinance.
00:23:37But if not, we can go ahead and try.
00:23:39Obviously, we don't want to get into a lot of expense until we know the voters have decided to task a panel to work on a charter.
00:23:49But once that date's set, I will say you need legal counsel that is used to working with these things.
00:23:58Because the problem with chartering, if you go back to the presentation, there is a lot of litigation on what charter cities can and can't do that's sometimes extending beyond the powers permissible.
00:24:11Whereas, you know, the statutory cities, it's all kind of defined in the revised code.
00:24:17So we want to do this in a way that is lawful, but more importantly, that we can live with.
00:24:27Because any time we change the charter materially, you're going back to the voters through the whole process.
00:24:33So it's cumbersome to change some barriers going through that process right now.
00:24:41There's certain aspects that they determined was not workable in their initial charter.
00:24:47So they're going back to the voters here in the fall.
00:24:49And it's just, I have no idea what kind of cost it would be.
00:24:56But, you know, obviously, there would be a significant legal fee in working.
00:25:01And then the time commitment also.
00:25:03You have the 15-panel member.
00:25:05And, of course, once we pass this, petitions will have to be circulated to get people to serve on the charter commission.
00:25:14Okay?
00:25:14And they would also go on the November ballot.
00:25:17Obviously, if the issue passes, then there's no charter.
00:25:20But if the issue passes, it takes the top 15 vote-getters.
00:25:25Any position that's not filled could be filled by city council.
00:25:29Okay?
00:25:31But it would be advisable, you know, to get people we feel that's going to work with the city.
00:25:37And that's, you know, one of the worst things I feel about this is, you know, again, as you guys know,
00:25:44city council cannot sit on this.
00:25:47But it's getting folks familiar with what works and what doesn't work here in town to make sure when we're framing this charter,
00:25:57it works with our community, our community needs.
00:26:00There's several different kind of methods, if you remember, on the presentation, different plans of charter.
00:26:08But those are just generalizations.
00:26:10I mean, it can be tailored extensively where, you know, you really aren't going one of the three methods.
00:26:18It's more of a blend of all of them.
00:26:20So that would be very important working with the administration.
00:26:24But I will say this, that is going to be a very time-consuming task.
00:26:28So whoever is a part of that needs to roll up their sleeves.
00:26:32And we need to have some engagement, whether city council is on those meetings.
00:26:37There's nothing to prohibit a committee or a city council to be at those meetings.
00:26:41You're just not a charter committee member.
00:26:44But, again, if we sit back and just let the commission take over, I don't think we're going to be happy with the results.
00:26:51Even if we do a firm that's a law firm that's very familiar, it's, again, what's going to work for the city of Kenton.
00:27:01And that's, so that costs, I have no idea.
00:27:06We may want to get a ballpark quote on what they typically see.
00:27:12Because, again, the bulk of the work starts, if this is voted in on November, that's when the work starts.
00:27:20And we've got to get it on within a year.
00:27:23Right.
00:27:24Right.
00:27:24Or it goes away if you don't get the second issue within a calendar year.
00:27:31And then the work's not done because our codified ordinances, a lot of our ordinances need to be changed.
00:27:41And that's where we also have to work through the whole administration, employee section.
00:27:47That's thrown out the window.
00:27:48But there's a lot because our codifieds are based upon the general framework of a statutory city.
00:27:56You pull that out, the appointments, everything, a lot of that changes.
00:28:01We may need a lot of job descriptions, at least some job descriptions change.
00:28:06So, again, I have emergency language on this, so it can go into effect upon passage if we get the requisite vote.
00:28:16But we do not want to waive and read this tonight because it's outside of the window.
00:28:21So, where we go with this, that's kind of my take on it.
00:28:29I'm not saying this would be a bad thing.
00:28:32This could be a good thing.
00:28:33But it will be a lot of work, and there will be expense involved.
00:28:37And I just don't know how to quantify that without getting more information, getting quotes on what they think it would look like.
00:28:47I think we need to give a quote.
00:28:50I know in January when they've done their presentation.
00:28:54I know for me, like, they gave a ballpark.
00:28:57I mean, I don't want to speak on that because that was in January.
00:28:59That could change it, you know, with the tide, so to speak.
00:29:04I would like to kind of add one thing.
00:29:07I know, John, when me and you were speaking, like, we would be in the window of the 120 days to be, to declare our, like, November 4th election.
00:29:18But just through our conversation, we kind of come across, as far as the commission and being allowed in people that window,
00:29:27if we read it three times, so to speak, we would be at the end of July.
00:29:35And the commission, the members that would want to file a petition to be considered for the commission,
00:29:43would need to have their petitions submitted to the Board of Elections.
00:29:47Or tighten their window along the way.
00:29:49But technically, I think, like, within that 75-day window, which would put it August 20th.
00:29:57So if we, I guess, we have to kind of consider that, too, if we want to consider getting into that window of declaring for November 4th.
00:30:06But also, like, at the next meeting, I'll just use them as an example.
00:30:09If we was passed in, we would be in that window.
00:30:12And we would allow more time for people that wouldn't want to be petitioned for the commission.

00:40:31Kenton is my hometown for 62 years, and my family has been in the area since before 1847.
00:40:39I live in Ward 2 near Robinson Field in the house inherited from my father.
00:40:48I also own the historic Kenton Vault Company building that I restored in Ward 3.
00:40:56Most important of all, my granddaughter is growing up in Ward 1.
00:41:00I should have three representatives on city council, but Kentonites like me, who believe the primary role of government
00:41:13is to ensure the safety of its citizens by following the rules, seem to have no representation here at all.
00:41:20If I was on city council, the number one priority is the safety of the families, children, and elderly in wards 2 and 3.
00:41:32Being terrorized 24 hours a day, seven days a week, nonstop, for the past half year,
00:41:41by countless thousands of trapped, panicked, and pissed-off truckers,
00:41:46hauling God knows what, hazardous cargo, and our school bus drivers forced to survive this crap twice a day.
00:41:56As a city official and public servant, who actually cares enough to answer emails and public record requests,
00:42:07I'm extremely outraged and angry about the huge number of daily crashes, injuries, and close calls,
00:42:15endangering the lives of my constituents and visitors to Kenton,
00:42:21the mass destruction of millions of dollars' worth of private, commercial, and public property,
00:42:28including countless fire hydrants,
00:42:32and being stabbed in the back by the Ohio Department of Transportation's shameless and brazen dereliction of duty.
00:42:39Has the U.S. 68 truck detour for the streetscape ever been subjected to any competent oversight at all?

00:42:52A long-term, extremely expensive, and very complex truck detour
00:42:57on a busy two-lane Federal Highway commercial truck route,
00:43:02riddled with errors and mistakes featuring incorrect and missing and non-compliant signage,
00:43:09violating a slew of state and federal laws,
00:43:12including Article 4 in the 11th Amendment of the Constitution.
00:43:19How can ODOT justify so many blatant screw-ups
00:43:24any freshman civil engineering student could see?
00:43:28The act of installing the wrong signs for a detour
00:43:32is generally considered an act of negligence rather than an intentional act
00:43:39unless there is evidence suggesting a deliberate intent to cause harm and mislead drivers.

00:44:59and I would urgently request emergency technical assistance
00:45:04to correct the defective U.S. 68 truck detour
00:45:08before there are any more injuries and fatalities.

00:45:18and replace all of the non-compliant,
00:45:22missing, and illegal temporary traffic control signs for you at no charge.

00:46:16ODOT engineer Kylie Skrimsky should be indicted for manslaughter,
00:46:21then sued in civil court for gross negligence
00:46:24and extreme disregard for safety.
00:46:27Her boss, ODOT District 1 Deputy Director Chris Hughes,
00:46:33a fiduciary who tells lies to get a contract signed
00:46:39causes more harm to society than a thousand drunk drivers.

00:46:53of their 19th century solutions for 21st century problems

00:59:31of things.

00:59:33there's been
00:59:34no injury accidents
00:59:34and no fatalities
00:59:35because of detour
00:59:36signage.
00:59:38None whatsoever.
00:59:38We've had two
00:59:39accidents at these
00:59:40intersections down
00:59:41here in Ohio.
00:59:42They were both
00:59:43cited for driver error.
00:59:44In other words,
00:59:45failure to deal.
00:59:47We've had a lot
00:59:47of property damage
00:59:49from semis,
00:59:51for sure.
00:59:54A lot of those
00:59:55semi-drivers
00:59:56have been cited.
00:59:57One was even
00:59:58ripped out of his
00:59:59cabin and put
00:59:59in jail.

01:00:03vast majority
01:00:04of the problem
01:00:05traffic comes
01:00:06from 68 north.
01:00:09And we have
01:00:10put signage
01:00:10as far north
01:00:11as I-75
01:00:13and 15.
01:00:15And I've got

01:00:16the honest,
01:00:17English-speaking
01:00:18truck drivers
01:00:18that I've spoken
01:00:19to have told me
01:00:20flat out,
01:00:21I ignore them.
01:00:23Because,
01:00:24to quote one of them,
01:00:26I do that shit
01:00:26all the time.
01:00:27And I usually
01:00:28find a way around it.
01:00:29But,
01:00:30you got me this time,
01:00:31so,
01:00:32you know,
01:00:33that's what it is.
01:00:34Swift drivers
01:00:35will flat out
01:00:37tell you,
01:00:38if they get off-route,
01:00:39their dispatch
01:00:39will contact them
01:00:41immediately and see
01:00:42that they're off-route
01:00:42and question their
01:00:44reasons for getting
01:00:44off-route.
01:00:45if they're seeing
01:00:46something on the map
01:00:46that the driver
01:00:47isn't seeing,
01:00:49if it takes more
01:00:50time to make
01:00:50their delivery,
01:00:52more miles,
01:00:53whatever,
01:00:53it's a problem
01:00:54for them.
01:00:54So,
01:00:56if they see a detour,
01:00:58a lot of times
01:00:58they think it's going
01:00:59to be a 10 or 20
01:01:00mile detour.
01:01:01And they will do
01:01:01everything they can
01:01:02to get around it
01:01:02and that's just
01:01:03the way it is.
01:01:04So,
01:01:05I realize that
01:01:07it's painful
01:01:07and I sympathize
01:01:08with this gentleman.

01:01:10too,
01:01:10right up the street.

01:01:13myself in the face

01:01:15with my windows
01:01:16and listening to
01:01:17the truck traffic

01:01:25get it in their head
01:01:26that when you do

01:01:30supposed to be
01:01:31painless
01:01:32and not cause
01:01:33some sort of
01:01:34inconvenience.

01:01:37of the commentary

01:01:38about the traffic

01:01:41I have to wonder
