Calcutta High Court Orders Mohammad Shami To Pay Monthly Rs 4 Lakh As Maintenance To Estranged Wife, Daughter

Shami's estranged wife had moved the high court to challenge a lower court order, which had directed Shami to pay Rs 50,000 to his wife.

00:11See, honestly speaking, tomorrow the matter was not fixed for hearing.

00:14Earlier there were several occasions when the matter was heard by the Honorable Justice

00:18Rajay Kumar Mukherjee. And after hearing several times, all the parties,

00:22this matter was reserved for judgment, which is normally we say CAV.

00:27Yesterday was the date fixed for delivery of the judgment.

00:30So once the matter was fixed as item number two under the heading delivery of judgment,

00:36it was a very happy moment for the learned advocates who were assisting me.

00:42And also the best moment for Hashan Jhaan because I felt that since 2018 till 2024,

00:49she has been running from post to pillar. It started from the trial court.

00:53Initially, she was deprived of any interim order from the magistrate.

00:58An appeal was preferred before the assistant district judge.

01:02Slightly modified, 80,000 to the daughter, Ira, and 50,000 to her.

01:08That order itself was under challenge before this Honorable High Court.

01:11And ultimately, yesterday, it was pronounced in the open court that 1.5 lakhs for Hashan Jhaan,

01:182.5 lakhs for the daughter. And there was also addition that throughout, apart from all this,

01:25any time the daughter requires any assistance. So that has to be also provided by Mohammed Shami.

01:32And apart from the best part in the judgment was that the Honorable High Court has directed the trial court

01:38to dispose of the main application of interim maintenance, that within six months.

01:44So once you are getting 4 lakhs here, there will be a high chance when you go back to the trial court

01:49and conclude the hearing of the maintenance, it might be, again, upgraded to 6 lakhs.

01:55Because the claim of Hashan Jhaan in her maintenance application was 7 lakhs and 3 lakhs.

02:02So the gate is open now. So today we are rejoicing.

02:04Maybe she is happy, but it might go a little upper within six months in the trial court.
