Senior Counsel Avory Sinanan describes the action of Chief Justice Ivor Archie toward High Court Judge Marcia Ayers Caesar as oppressive.

On Monday the Privy Council found that Ayers Caesar was unduly pressured into tendering her resignation from the High Court.

00:00Senior Counsel Avery Synanon says the situation has the potential to shatter the public's
00:07confidence in the justice system.
00:09He adds that it is time for judges to speak out.
00:13The individual members of the individual judges must be their confidence, their self-esteem
00:21being impacted upon.
00:24And I think, my own view is, that these judges should get together, issue a statement, discuss
00:32the matter, issue a statement and say whether they have confidence in the Chief Justice
00:38and the PLSC as President or not.
00:43You have to take the bull by the horns.
00:45The Privy Council stated that pressuring a judge to resign by holding out the threat
00:51of disciplinary proceedings, as the Commission did, circumvents the constitutional safeguards
00:57laid down in Section 137 and undermines their purpose.
01:02According to Synanon's Senior Counsel, it was an evisceration of the Constitution.
01:08He also shared the view that the Prime Minister should intervene.
01:12This is a serious incitement of the JLSC and the Chief Justice under his leadership for
01:20having engaged in oppressive action, unlawful action against this judge.
01:28And therefore, the ball is now in the Prime Minister's court to act.
01:35He says confidence must be restored in the judicial system.
01:40And there is only one way to achieve that.
01:43Section 137 will be invoked by the Prime Minister and a representation will be made.
01:49I think, in fairness, the other members of the JLSC should resign.
01:56That is my view.
