00:00MAB Cargo Sundaran Bahad was entitled to sack an officer after he was caught on camera playing
00:07sepak takraw and cutting trees using heavy machinery, the industrial court has ruled.
00:12Court President Zohelmi Hassan said, Cheh Zamri Cheh Ani had abused his prolonged medical leave,
00:18adding that it was not a minor misconduct which could be tolerated by the company.
00:23He said, it is trite law that medical leave is granted to allow for the
00:26convalescence and cure of a sick employee. Cheh Zamri was involved in a motor vehicle
00:32accident on May 22, 2021 and suffered serious injuries which saw him hospitalised and granted
00:38medical leave until September 21 that same year. He had contended that he should be allowed to take
00:44part in neighbourhood activities and cannot be confined to his house while on medical leave.
00:50However, the court ruled that employees are not entitled to decide for themselves what they can
00:55or cannot do while on medical leave. Cheh Zamri had worked with the company for six years from
01:002015 to 2021 and held the position of acceptance officer when he was dismissed. However, Zohelmi
01:08said no length of service could repair the damage to the shattered trust and confidence
