Presiding Officer Chiz Escudero ruled that Articles I, III, and IV of the impeachment complaint against Vice President Sara Duterte, which the prosecution withdrew, will no longer be submitted to the impeachment court for a vote or a verdict of conviction or acquittal.

Escudero clarified that Article III cannot be brought back during the current trial, and that the three articles are no longer up for a decision since there are no charges left for the court to consider. (Video courtesy of Senate of the Philippines)

00:00The Court, therefore, accords to Articles 1 and 4 finality for the respondent's present term as Vice President while limiting
00:07the procedural effect of the withdrawal of Article 3 to this trial alone, provided, however, that Article 3 may not
00:15be revived in this trial until its conclusion.
00:19Number 3. Articles 1, 3, and 4 shall not be submitted for a vote or verdict by this Court anymore.
00:28As there is no longer any charge under Articles 1, 3, and 4 for adjudication in this trial, those articles
00:36shall not be submitted to the members of the Court for a vote or for a verdict of conviction or
00:41acquittal.
00:42This treatment follows the precedent established during the 2012 impeachment trial of Chief Justice Renato Corona.
00:49When the prosecution abandoned five articles, the defense was not required to present evidence upon them, and the withdrawn articles
00:56were not submitted to the senator judges for a vote.
00:59On March 12, 2012, acting upon the defense's motion to dismiss the prosecution's manifestation of withdrawal, the presiding officer stated,
01:10Regarding the motion of the defense to formally dismiss Articles 1, 4, 5, 6, and 8 of the Articles of
01:16Impeachment,
01:17the Impeachment Court in a caucus decided not to entertain an act on the motion to dismiss with a clear
01:24understanding, however,
01:25that no evidence from both prosecution and defense panels will be received by the Impeachment Court on Articles 1, 4,
01:325, 6, and 8.
01:33The presiding officer also then stated the corresponding consequence of that ruling.
01:39Furthermore, the members of the Impeachment Court will not render any vote on those articles,
01:46and no verdict of the Impeachment Court will be rendered on the same.
01:50Accordingly, Articles 1, 3, and 4 shall no longer form part of the Articles of Impeachment to be decided in
01:58this trial
01:58and shall not be submitted to the members of the Court for a vote or for a verdict of conviction
02:06or acquittal.
