Retired Chief Justice Artemio Panganiban reiterated that the Senate impeachment court, not the Supreme Court, should decide the voting threshold in Vice President Sara Duterte’s impeachment trial.

Panganiban said the Constitution gives the Senate the authority to decide matters concerning impeachment, stressing that the Senate impeachment court is an independent and free court. (Video courtesy of the Senate of the Philippines)

00:00Doon po siya mga sinabi niyo kanina, is it correct to say na you're leaving the decision on this court
00:08to decide what is really the threshold?
00:12What does two-third mean?
00:14So are you telling us na kami ang mag-decide, hindi pwede ang Constitution, ang Supreme Court?
00:21Is that what you're driving at po kanina?
00:25Yes, you're an independent, free court.
00:32In fact, I hate, I mean, I am hesitant to call you an impeachment court because there is no such
00:39thing in the Constitution that is according to your rules.
00:44The Constitution merely said, the Senate shall be the sole judge to try and decide impeachment cases.
00:56It did not say the Senate shall become an impeachment court.
01:00That's just an aside.
01:52But what I'm saying is, you are called upon by our people to decide impeachment cases.
02:00Then decide it from where you sit.
02:02You don't become Supreme Court Justices.
02:07Because if the Constitution wanted you to become Supreme Court Justices, then it must have required you to be lawyers.
02:15It must have required you to pass the bar examination.
02:18It must have required you to study four years of law after four years of preparatory law.
