Malaysian banks have agreed in principle to halt loan repayment demands from the families of 54 Malaysians missing after devastating August floods in Nepal, according to advocacy group Malaysia Solidarity: Families in Hope (MASFIH).

Following a constructive meeting with Bank Negara Malaysia (BNM), insurers, and financial institutions, MASFIH spokesperson Dr Manivannan Rethinam, in a press conference after the meeting on Monday (Oct 12), said banks will begin contacting affected families by Oct 16, with arrangements set for review within two weeks.

00:00As of 13 October, it is day 48 since the disaster.
00:05For these 54 families, the uncertainty has continued for almost 7 weeks.
00:10They are not only coping with anguish of having loved ones missing, but also facing financial
00:17commitments, household responsibilities, difficult questions about how to manage their loved
00:23ones' affairs without definite answer, a constructive engagement with immediate and longer term measures.
00:32MASFE welcomes the constructive discussions with BNM and recognises that issues raised span
00:38financial regulation, contractual obligations, insurance coverage, access to confidential
00:44financial information and legal authority.
00:46Some practical measures can be taken forward immediately through engagement with the relevant
00:52financial institutions.
00:53Other matters require more time to examine the applicable rules, determine the limit of existing
00:59authority and establish workable solutions that are fair, lawful and consistent across the
01:04institutions.
01:06MASFE prioritized priorities include humanitarian financial relief, seeking a coordinated moratorium
01:14on repayment and enforcement actions for eligible facilities, including personal financing,
01:21vehicle loans and IF purchase, together with appropriate treatment of the interest or profit, late
01:29charges and penalties, protections of vehicles and other assets, seeking safeguarding against
01:35premature repossession, enforcement or inappropriate disposal of assets while the missing persons,
01:43legal status and the family's lawful authority remain unresolved.
01:47Number two, urgent intervention by the Attorney General's chambers is essential.
01:54Must we stress that engagement with Bank Negara Malaysia, although important, cannot resolve every
02:00legal obstacles confronting the families.
02:04Certain matters require urgent legal interpretation, inter-agency direction and potentially further legal
02:10or regulatory actions.
02:11The Attorney General's chamber AGC should therefore be engaged without delay to advise on the lawful
02:19mechanism available to protect the interest of the 54 missing persons and the families.
02:24One particular urgent matter is access to the Central Credit Reference Information System,
02:30SICRES.
02:31MASFE requires that Bank Negara review whether a special procedure can be lawfully enabled, verified next of kin, or appropriately
02:39authorised representatives to obtain relevant credit information when a person remains missing and
02:46conventional estate administration procedures may not yet be available.
02:52If Bank Negara determines that the requested access cannot be authorised or facilitated under the existing framework,
02:58the matter should be referred urgently to the AGC for legal review and advice.
03:04AGC should advise whether an exceptional administrative or regulatory mechanism is legally available,
03:10whether legislative or regulatory amendments are necessary, or whether another lawful road
03:16can be established.
03:18The same principle applies to other matters where existing procedures do not adequately address
03:23the circumstances of a person who remains missing without a confirmed debt determination.
03:28MASFE calls for a coordinated pathway involving Bank Negara Malaysia, AGC and the relevant
03:34government agencies with a clear responsibility, defined timelines and regular updates to the
03:39families.
03:40Legal uncertainty must not become a reason for prolonged administrative inaction when practical
03:45steps may still be unavailable.
03:48Number three.
03:48An urgent meeting with the Prime Minister remains necessary.
03:52MASFE will continue to pursue his request for urgent meeting with the Prime Minister and appeals
03:57for the government to facilitate that meeting as soon as possible.
04:00The scale and complexity of the situation extends beyond the remit of any single institution.
04:07A coordinated government response is needed to bring together the relevant ministries,
04:12regulatory bodies, legal authorities and other agencies to address outstanding humanitarian
04:17financial, legal and consular concerns.
04:19I also received that in principle, many banks want to help.
04:24Insurance funds want to help.
05:01Hutang-hutang dia semua bergadung.
05:03Selepas tu, kalau kita tengok daripada segi setiap bank, mungkin satu bank tu 2 juta,
05:081 juta, you know, 5 loan.
05:34Tapi, on principle, tadi semua bersetuju.
05:36Buat masa ni tiada apa-apa tindakan.
05:39Sehingga satu persetujuan diambil.
05:41Mereka takkan kejar ataupun memanggil telefon keluarga untuk mendapatkan bayaran.
05:47Satu itu yang memang bagus sekali.
05:49Ada bank juga bersetuju bagi moratorium.
05:52Tapi, saya tak dapat bertulis lagi.
05:55Secara verbal, kami dapat tahu, indication.
05:58Bank bersetuju nak bagi tanpa any commitment.
06:00Maksudnya, tak ada penalti, tak ada interest, tak ada loan.
06:04Yang tu di welcome, ada bank masih berbincang.
06:06Terima kasih.
