00:01A former Felda Director General has been charged with deceiving the agency's Board of Directors
00:07over the transfer of lamb titles in Jalan Semarak.
00:11Datuk Faizul Ahmad pleaded not guilty in the Kuala Lumpur Sessions Court on Wednesday
00:16after the charge was read out before Judge Suzanna Husin.
00:20The 66-year-old is accused of dishonestly concealing that a power of attorney dated
00:26June 3, 2014, gave Synergy Promenade the authority to transfer ownership of 16 Felda land plots
00:34under a development project.
00:36The prosecution alleges this induced the Board to agree to the power of attorney,
00:42leading to the land being transferred to Synergy Promenade KLVC Sendirian Berhad and Synergy Promenade.
00:48The offence allegedly took place at the Menara Felda boardroom on September 2, 2014.
00:55He was charged under Section 420 of the Penal Code, which carries a jail term of 1 to 10 years,
01:02whipping, and a fine upon conviction.
01:05Deputy Public Prosecutor N. Joy Jothi proposed bail of RM100,000 in one surety.
01:12The prosecution also asked for his passport to be impounded
01:16and for monthly reporting to the nearest MACC office.
01:20Defence counsel Datuk Sukri Mohamad asked for lower bail of RM30,000,
01:26saying his client had cooperated throughout police and MACC investigations.
01:32He added that his client's passport was suspended for more than four years
01:36and there is no evidence he tried to abscond.
01:40Sukri also pointed to a former Felda Investment Corporation CEO,
01:44charged a day earlier in a related case and granted RM60,000 on two counts.
01:51He argued that with one count, his client should get half that amount.
01:55The prosecution counted that that case,
01:58and an earlier acquittal in a separate matter,
02:01were not relevant to the present charge.
02:04Sukri said Faizul had already placed a RM100,000 cash guarantee
02:09with the MACC during his remand from September 6th to 11th.
02:14Judge Susanna set bail at RM70,000 in one surety
02:19and allowed the prosecution's application for additional bail conditions.
