A soldier was charged in the Sessions Court in Kota Baru on Thursday (Sept 17) with abusing his five-year-old daughter by kicking her at an eatery in Jalan Kuala Krai last Friday.

Mohamed Nisa Mohamed Nasir, 40, pleaded not guilty after the charge was read out to him before judge Zulkifli Abllah.

00:00A soldier has been charged in the Kota Baru Sessions Court
00:03with abusing his five-year-old daughter
00:05by kicking her at an eatery in Jalan Kuala Krai last Friday.
00:09The incident was caught on CCTV and the footage went viral.
00:13Forty-year-old Mohamed Nisa, Mohamed Nasir,
00:16pleaded not guilty after the charge was read
00:18before Judge Zulkifli Abla on Thursday.
00:22The offence was allegedly committed at Lot 143 on Batu Dua,
00:26Jalan Kuala Krai, at 10.55pm on September 11th.
00:31He was charged under Section 31 Subsection 1A of the Child Act 2001
00:36and faces a fine of up to RM50,000 or imprisonment
00:40for up to 20 years, or both, if convicted.
00:43The prosecution did not offer bail,
00:46citing concerns that the accused could interfere with the victim,
00:49who is also his biological daughter.
00:52However, the defence requested bail,
00:54saying the accused had served in the military for 19 years
00:58and has three children.
01:00The court was also told that his wife is unemployed
01:03and requires haemodialysis treatment
01:05and that she relies on him to accompany her
01:07for regular hospital visits.
01:09The defence also said
01:11the accused has no previous record
01:13of domestic violence offences or complaints
01:15and is not a flight risk
01:17as he is subject to the control of his military unit.
01:20The court granted him bail of RM10,000
01:23with one local surety,
01:25subject to several conditions,
01:27including that he must not interfere
01:29with any prosecution witnesses,
01:31particularly the victim.
01:32He was also ordered to surrender his passport to the court,
01:36if he has one,
01:37and report to the Penkalan Cepa Police Station
01:39or the nearest police station every two weeks
01:42until the case is concluded.
01:43The court set October 22 for mention
01:46for the submission of documents.
