00:00So Melissa Payne, the black woman that shot the white army veteran in the Walmart parking lot in Florida, apparently

00:05she is not going to be charged.

00:06So the Broward County State Attorney's Office said that she is immune from prosecution because of stand your ground laws.

00:11Just in case you forgot what happened, this man was waiting for her after the two had a dispute when

00:16she was coming out of the Walmart parking lot.

00:18In the video, you can literally see her gun in hand looking like she's telling him to back up as

00:23he continues to charge at her and come her way.

00:26OK, now, a lot of people, especially the people that champion these stand your ground laws when it comes to

00:30people that don't look like them.

00:32OK, we're up in arms saying that she used too much force and she should have retreated and she should

00:36have gotten her car and left.

00:37OK, all this admonish a woman who decided not to let a man who was charging at her, a man

00:42that she didn't know from the son of Sam.

00:44OK, get in her personal space and cause her danger in the state of Florida.

00:47There are stand your ground laws. And yes, you do not have a duty to retreat in stand your ground

00:52laws and stand your ground state, specifically Florida.

00:54You have no duty to retreat from imminent danger that's coming at you.

00:58And she felt threatened and she used her Second Amendment right to shoot him.

01:02And it doesn't appear that she's going to be charged.

01:04This is a developing story. Now, do my best to keep you updated as more information becomes available.

01:08He actually left his vehicle, walked up as he was about to go in and go shopping.

01:12And then he came back. I'm still in my vehicle.

01:17I'm still in my vehicle. So he says a few things again.

01:21He gets into his car. He pulls off.

01:25My niece goes into the store. I say, I'm going to stay in the car.

01:28She goes inside the store. So now, like I said, he done made several regrets about doing something to my

01:34vehicle.

01:36So, when I see he come walking up again, he's walking in my direction.

01:41I step out of the vehicle. I have my gun down on the side.

01:44I said, sir, please do not approach my vehicle.

01:47Do not come near us. He's steady going on about scratching or doing little hand gestures or whatever.

01:55I told him, it's not going to go well for you. Please.

01:58The other guy's telling him, sir, sir, it's not working for you.

02:01Just leave her alone. Leave her alone. Walk away. Walk away.

02:05So, you're circling me. What are you going to do?

02:08What are you going to do?

02:09Oh, I've seen, what do you say? I've seen tougher than you.

02:14Shoot. Do it. Do it. Shoot.

02:16So, you're following me. I've circled around the other vehicle.

02:20I've told him several times to back up because you got up on me before I could, like, get back

02:25in the vehicle or anything.

02:27And you walked up on me several times.

02:29And it went from there.

02:30He actually left his vehicle, walked...

02:35So, we got to talk about this situation in Florida that went down a little while back.

02:43And now it has come to a conclusion.

02:46And that conclusion is that this young lady, that young lady that you saw there in that video and that

02:52you heard speaking,

02:54not the first clip, but the second clip lady, who shot the man in the, I believe that was a

03:02Walmart parking lot,

03:05is not going to face any charges whatsoever, which is quite interesting.

03:11But I want to talk about it a little bit because, obviously, this is an interesting story that has garnered

03:18quite a bit of attention.

03:19All right?

03:21So, let's hop into it.

03:22Coming at 6 tonight, a stunning development and a deadly dispute outside of Walmart.

03:26An Army veteran shot and killed over a parking spot earlier this summer.

03:30Tonight, we're learning the woman who opened fire won't face any charges.

03:33Let's get right to Local 10's Erin Maven, live in North Lauderdale, with why prosecutors say her actions were justified.

03:40Erin?

03:41Well, Nicole and Calvin, this is something that we have been closely monitoring and waiting for for several months

03:46after a shooting played out in this parking lot.

03:49And for the first time, we are hearing from the woman at the center of this Stand Your Ground case.

03:55I said, sir, please do not approach my vehicle.

03:59Do not come near us.

04:01Melissa Payne describes what she says happened moments before she shot and killed Barta Guglielmo

04:06in a North Lauderdale Walmart parking lot.

04:09A deputy interviewing Payne shortly after the June 30th shooting following a dispute over a parking spot.

04:15I told him, it's not going to go well for you.

04:18Please.

04:18The other guy is telling him, sir, sir, it's not worth the fees.

04:21Just leave her alone.

04:22Prosecutors say video shows Payne, who was with two relatives in a white Chevy Malibu,

04:26and Deguglielmo, who was alone inside his white Kia SUV, trying to park in the same parking space.

04:32After a stalemate, prosecutors say Deguglielmo left his car in the travel lane,

04:37grabbed a shopping cart, and walked into the store.

04:40Payne parked in the space.

04:42And then he came back.

04:44I'm still in my vehicle.

04:45Payne said Deguglielmo was upset and began to make threats to damage her car.

04:50I see he come walking up again.

04:52You're walking in my direction.

04:54I step out of the vehicle.

04:55I had my gun down on the side.

04:57Video without audio shows a two in an argument.

05:00What are you going to do?

05:01What are you going to do?

05:03The two walk in circles until investigators say Payne fired the fatal shot.

05:08Broward County prosecutors are not charging Payne because they say her actions fell within Florida's

05:13Stand Your Ground self-defense law.

05:15From what we see in the video, he's unarmed.

05:18He doesn't have a weapon on him.

05:19You can see his hands throughout the entirety of the interaction.

05:24Melissa Rodriguez is representing the 62-year-old military veteran's daughter, Amanda.

05:29Obviously, she's very disappointed.

05:31She was holding hope that the state attorney's office would bring forth criminal charges.

05:40In an interview over the summer with Local 10, Amanda Deguglielmo said that her father was a family man

05:46who worked as a trauma ER nurse for 30 years.

05:50Now, in a memo, a 22-page memo, the state attorney's office said that Payne had the right to stand

05:55her ground

05:56if she was in reasonable fear of death or great bodily harm.

06:00And prosecutors can't prove that her fear of harm was not reasonable.

06:04We are live tonight in North Los Angeles.

06:08Yeah, so there you have it.

06:13There's a lot to be learned from, you know, a situation like this.

06:19And, you know, I've seen situations like this one too many times.

06:25And that is situations where somebody is pointing a gun at you.

06:31And you have people who just don't walk away.

06:35Like, there is a deadly weapon pointed at you.

06:41Anybody who's ever purchased a firearm, a lot of us had a few things drilled into our heads.

06:46At least any good place, you know, where you purchase firearms.

06:51And one of the things that's drilled into your head is you never point your gun

06:55at anything that you're not willing to destroy.

07:00Some of you, some of you probably heard, you know, something similar as well

07:03when you purchased your firearms for the first time and whatnot.

07:06But that's one of the things that's kind of drilled into your head.

07:09You don't point it at something unless you're willing to destroy it.

07:13She's pointing it at you.

07:15She's willing to destroy you.

07:16She's willing to kill you.

07:18It's pointed at you.

07:20You walk away.

07:21Why are you still walking towards her?

07:23Why are you even still arguing?

07:25You know what I mean?

07:26And it's not just him.

07:28Like I said, I've seen this type of situation way too many times.

07:32There's way too many videos that have popped up on X or online or on social media

07:38of somebody getting shot and killed because they would not simply walk away.

07:45Walk away.

07:46Like, oh, what are you going to do?

07:48What are you going to do?

07:49Are you going to shoot me?

07:50Okay.

07:50Yeah, they are.

07:53You're concerned about them going to jail.

07:56Sure, they may go to jail.

07:58But guess what?

07:59They're still breathing.

08:01You're going to be six feet in the dirt.

08:04You know what I'm saying?

08:05Like, we got to be smarter, man.

08:12We got to be smarter.

08:14And this is coming from someone who admittedly was not always, how can I put this?

08:24I wasn't always the first person to walk away from a fight.

08:27I'll just put it that way.

08:30You know, mama didn't raise, you know, no P-U-S-S-Y.

08:36I was always ready to rumble.

08:39Okay.

08:40But, you know, as you mature, you realize that, you know, at any given moment, it could all

08:46be over.

08:48It could all be over in an instant.

08:51All it takes, boom.

08:54You know what I mean?

08:56And so, instead of leaving that possibility open, leaving that doorway open to that possibility,

09:04just walk away and you slam that door completely closed.

09:08You know, don't let your pride get you put six feet in the dirt.

09:13And I got into an argument at the barbershop once with some folks about pride and yeah,

09:22they, they didn't listen.

09:23So their pride is unfortunate.

09:25Hopefully not.

09:27It's hopefully it's not going to happen, but we know, we know how that works.

09:31You know, um, some people just can't put their pride to the side and it's a shame.

09:37It's a shame, you know, because what you showed out and you, you, you did all the, you know,

09:44puffing up your chest and all that extra stuff.

09:47So you, you look nice.

09:49You, you didn't look like a pussy in front of everybody, but guess what?

09:52You six feet in the dirt.

09:53People going to put you on a t-shirt.

09:55That t-shirt's going to be faded after about six months and then they're going to throw it

09:59away.

10:00And only a select few people going to release some balloons or remember you on the anniversary

10:05of your death.

10:09Congratulations.

10:09You played yourself.

10:11You know, you played yourself.

10:13Walk away from confrontation.

10:16Walk away, walk away.

10:19You know, it's, it's, it's not worth it at the end of the day.

10:24Um, obviously some of y'all fellows understand what I mean when, Hey, when we were, when we

10:29were a little bit younger, you know, a little tough to walk away from some of them situations.

10:33And some of us didn't, you know what I'm saying?

10:37We stood there and rumbled, you know, but, um, got to walk away, man.

10:44Got to walk, especially in today's age, right?

10:46Where you got these YNs, these, these young folks who don't care whatsoever.

10:51I literally just watched the video was yesterday, maybe yesterday or the day before yesterday,

10:58where a young man killed an older lady, just shot her in front of a crowd of people, a whole

11:06crowd of people standing all around them.

11:09She's arguing with them.

11:11He pulls out a gun and just blast her several times.

11:16These people do not care.

11:18They will kill you dead in front of everybody and not think twice about it.

11:23I watched that video.

11:25That's a real video.

11:26You could probably find it online.

11:28Some of y'all might know what video I'm talking about.

11:32So at the end of the day, can you be frustrated?

11:37Can you be upset?

11:38Absolutely.

11:39That's, that's natural.

11:40It happens, but control it.

11:44Arguing over a parking spot is not worth it.

11:47Really arguing over just about anything ain't worth it at the end of the day.

11:53Especially a parking spot.

11:54Let's go park somewhere else.

11:55Who cares?

11:57Yeah, you're annoyed.

11:58They took your spot, whatever.

12:01Whatever.

12:47I mean, from the moment she pulled out the firearm, you should have exit stage left.

12:55You know, if you still got an issue about it, call the police.

13:07And gone about it that way.

13:10And now, unfortunately, the man is dead.
