00:01The prosecution has raised a preliminary objection to a college student's bid to strike out two murder charges over a
00:09fatal road crash
00:10that claimed the lives of a married couple on Jalan Ampang, near Great Eastern Mall, on May 2.
00:16Deputy Public Prosecutor Mohamed Fadili Mohamed Zamri told the High Court in Kuala Lumpur
00:22that the objection was filed on the grounds that the defence application was procedurally defective
00:28and failed to comply with the Courts of Judicature Act, 1964.
00:33The case was heard before Judge Datuk Aslam Zainuddin, with defence counsel S. Selvam representing the accused,
00:4024-year-old Danish Raman Kama Kumare-san.
00:44The defence had filed a notice of motion seeking to quash the charges,
00:49arguing that the decision to prosecute Danish Raman under Section 302 of the Penal Code
00:55was made in bad faith, was unreasonable and unconstitutional,
01:00and violated Articles 5 and 8 of the Federal Constitution.
01:04The defence further contended that applying the murder provision to a road traffic accident
01:09in the absence of any intention to kill
01:12was contrary to established principles of criminal law,
01:16and that the charges should therefore be set aside.
01:19Judge Aslam fixed August 17th to hear the application.
01:23Denish Raman was charged on May 15th with the murder of A. Dorezingam and his wife, A. Mehnaga,
01:29who were killed after their motorcycle was allegedly struck from behind
01:33by a Toyota Vios along Jalan Ampang on May 2nd.
01:38He was charged under Section 302 of the Penal Code,
01:42which carries the death penalty or imprisonment of between 30 and 40 years,
01:46along with not fewer than 12 strokes of the cane, upon conviction.
